Atlantic Herring Area 1A Trimester 2 Effort Controls Measures Maintained

August 9, 2018 — The following was released by the Atlantic States Marine Fisheries Commission:

The Commission’s Atlantic Herring Section members from Maine, New Hampshire, and Massachusetts reviewed the effort control measures for the 2018 Area 1A Trimester 2 (June 1 – September 30) fishery. The states agreed to maintain the existing Area 1A Trimester 2 Days Out Measures, which are outlined below.

Days Out of the Fishery

  • Vessels with a herring Category A permit that have declared into the Trimester 2 Area 1A fishery may land herring five (5) consecutive days a week. One landing per 24 hour period.Vessels are prohibited from landing or possessing herring caught from Area 1A during a day out of the fishery.
    • Landing days in New Hampshire and Massachusetts begin on Monday of each week at 12:01 a.m.
    • Landings days in Maine begin on Sunday of each week at 6:00 p.m.
  • Small mesh bottom trawl vessels with a herring Category C or D permit that have declared into the Trimester 2 fishery may land herring seven (7) consecutive days a week.

Weekly Landing Limit

  • Vessels with a herring Category A permit may harvest up to 640,000 lbs (16 trucks) per harvester vessel, per week.
  • 160,000 lbs (4 trucks) out of the 640,000 lbs weekly limit can be transferred to a carrier vessel (see below).

At-Sea Transfer and Carrier Restrictions
The following applies to harvester vessels with a herring Category A permit and carrier vessels landing herring caught in Area 1A to a Maine, New Hampshire, or Massachusetts port.

  • A harvester vessel can transfer herring at-sea to another catcher vessel.
  • A harvester vessel is limited to making at-sea transfers to only one carrier vessel per week.
  • Carrier vessels are limited to receiving at-sea transfers from one catcher vessel per week and can land once per 24 hour period. A carrier vessel may land up to 160,000 lbs (4 trucks) per week. The carrier limit of 4 trucks is not in addition to the harvester weekly landing limit. Carrier vessel: a vessel with no gear on board capable of catching or processing fish. Harvester vessel: a vessel that is required to report the catch it has aboard as the harvesting vessel on the Federal Vessel Trip Report.

The Area 1A sub-annual catch limit (ACL) is 32,084 metric tons (mt) after adjusting for a carryover from 2016 and the research set-aside. The Section allocated 72.8% of the sub-ACL to Trimester 2 and 27.2% to Trimester 3. After incorporating the 295 mt fixed gear set-aside and the 8% buffer (Area 1A closes at 92% of the sub-ACL), the seasonal quotas are 21,291 mt for Trimester 2 and 7,955 mt for Trimester 3.

These effort controls are projected to extend the Trimester 2 fishery through the beginning of September. Landings will be monitored closely and the fishery will be adjusted to zero landing days when the trimester’s quota is projected to be reached.

Due to the results of the 2018 Atlantic Herring Stock Assessment, which indicate poor recruitment and spawning stock biomass, the New England Fishery Management Council has recommended that the Regional Administrator allow for an in-season adjustment to the 2018 Atlantic herring sub-ACLs. The intent of this in-season adjustment is to reduce the severity of catch reductions in 2019. Following action from NOAA Fisheries to adjust the 2018 sub-ACLs, the Atlantic Herring Section members from Maine, New Hampshire, and Massachusetts will reconvene via conference call to review fishing effort measures. Forty-eight hour notice will be provided before a Days Out Meeting.

Changes coming to herring fishery as bait crunch looms

July 25, 2018 — New England’s lobster fishing industry is again facing the possibility of a bait shortage, and ocean managers are looking to make some tweaks to the herring fishery.

The lobster and herring fisheries are tied to each other because herring is the preferred bait for lobster traps. But fishermen in Maine, New Hampshire and Massachusetts have sometimes had trouble getting enough bait in recent summers.

An arm of the Atlantic States Marine Fisheries Commission changed some of the rules about herring fishing off of New England starting on Monday. The rules have to do with how many days herring fishermen can operate, and how much fish they can bring to land.

New York seafood companies shut down factory over listeria concerns

July 20, 2018 — Royal Seafood Baza and Euroline Foods have agreed to stop processing a variety of ready-to-eat foods and certain salt-cured and pickled fish at their jointly owned facility in Staten Island, New York, as part of a consent decree entered this week in a federal court.

The decision was reached following a series of inspections and a warning letter dating back to 2015 by the federal Food and Drug Administration (FDA), according to a press release. Royal Seafood Baza had earlier agreed to a voluntary nationwide recall of its ready-to-eat herring products after inspectors found evidence of listeria while collecting environmental samples, but subsequent inspections revealed that the company had not implemented adequate corrective actions, the agency said.

Change in Area 1A Trimester 2 Effort Controls and Meeting Notice

July 19, 2018 — The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic States Marine Fisheries Commission’s (Commission) Atlantic Herring Section members from Maine, New Hampshire, and Massachusetts revised the effort control measures for the 2018 Area 1A Trimester 2 (June 1 – September 30) fishery. 

Days Out of the Fishery

  • Vessels with a herring Category A permit that have declared into the Trimester 2 Area 1A fishery may land herring five (5) consecutive days a week. One landing per 24 hour period. Vessels are prohibited from landing or possessing herring caught from Area 1A during a day out of the fishery.
    • Landing days in New Hampshire and Massachusetts begin on Monday of each week at 12:01 a.m.

Looming bait shortage poses another threat to Maine lobster industry

July 17, 2018 — Feeling pressure from trade tariffs and pending rules to protect right whales, Maine’s lobster industry is facing yet another threat: a severe bait shortage.

Regulators want to cap this year’s herring landings at last year’s levels, or 50,000 metric tons, and slash next year’s quota of the most popular lobster bait from 110,000 to 30,000 metric tons. They want to do this to offset record low numbers of newborn herring that are entering the fishery to replace those that are caught, eaten by other predators or die from natural causes.

The 2019 quota could fall even lower if regulators adopt a separate proposal to leave more herring in the sea to feed the fish, birds and marine mammals that eat them, including Gulf of Maine species such as cunner, cod, seals, whales, puffins and terns. The New England Fishery Management Council could decide the issue as early as September.

“We need to think about the realities of the 2019 lobstering season with eyes wide open,” Patrice McCarron, executive director of the Maine Lobstermen’s Association, said in the group’s July newsletter. “There will be an acute bait shortage and bait prices will be very high. … We must start now to think about how we fish and when we fish. We must think about how we can be more efficient.”

That will mean different things for different lobstermen, McCarron said – some will decide to use less bait in each trap, use a finer mesh bait bag or forgo the practice of dumping old bait and simply add to it with each haul. Some might switch baits, swapping out herring for pogies or redfish, even though a herring shortage will likely cause price spikes and shortages there, too.

Maine lobster industry braces for looming bait shortage

July 2, 2018 — Maine’s lobster industry is on watch as fisheries regulators weigh whether to make significant cuts to herring catch limits, which could drive up bait costs that have already seen a sharp increase over the past decade.

Maine’s lobstermen draw their bait from the Atlantic herring stocks, which are managed by the New England Fishery Management Council and National Marine Fisheries Service.

In recent updates, the council said it planned on setting a significantly lower herring catch quota in 2019 than in 2018. The catch limit for 2018 was 111,000 metric tons, the same as it was in 2017. But the herring fleet landed many fewer fish than that last year, harvesting just 50,000 metric tons.

The council also called for a reduction to the catch cap for the rest of 2018 amid concerns about low densities and slow replenishment in the fish stock.

“The decline of the most important forage stock in New England is a significant blow, not only for the lobster industry that uses it for bait, but also for those species that rely on herring as forage like groundfish, tuna, whales, and seabirds,” Ben Martens, executive director of the Maine Coast Fishermen’s Association, wrote in a recent post. “Without this motion, rumor has it that the herring fishery would need to be capped at 15 metric tons in 2019, far lower than the 100-metric ton fishery that has operated in recent years.”

A herring stock assessment group held meetings in late June to try to determine its next steps and come closer to determining what quota it might propose. The group should release more details about the expected catch limits in the fall.

“Everyone’s worried about the quota and what that’s going to be,” said Kristan Porter, a Cutler lobsterman and president of the Maine Lobstermen’s Association. “There’s bait around right now, but what happens in the fall? We just don’t know.”

Fishermen feeling bait price squeeze

June 28, 2018 — “We made no money this spring,” said Bass Harbor fisherman Justin Sprague.

The cost of operations for lobstering continues to increase while the boat price of lobster has hardly budged. The cost of herring, the preferred bait for most Maine lobsterman, has gone up especially sharply.

“We don’t have any margin at this point,” Sprague said. “It’s frustrating, to say the least.”

Bruce Colbeth manages the C.H. Rich lobster wharf in Bass Harbor.

“By the time these guys pay for fuel, bait and stern men, there ain’t too much left for them,” he said. “I remember six years ago you could sell (herring) bait for $26 a bushel. Now it’s doubled.”

Herring bait is sold in trays. Fisherman Chris Goodwin said he paid almost $80 per tray for herring bait the last time he stocked up.

A ton of bait can be divided into about 13 trays, Cody Gatcomb of C.H. Rich explained. A tray of fish bait is equivalent to 1.5 bushels, Colbeth said. He saw a recent 3-cent per pound increase at his operation.

That adds up fast.

At the moment, not considered prime season, C.H. Rich Co. is selling between 350 and 400 trays of herring bait a week, Colbeth said. Once the season begins in July, they can expect to sell up to 800 trays of bait each week.

Some fishermen have reserved barrels of herring bait for the upcoming season in preparation for a possible shortage, Gatcomb said.

Atlantic Herring June 26th Days Out Conference Call Cancelled

June 21, 2018 — The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic States Marine Fisheries Commission’s Atlantic Herring Section members from Maine, New Hampshire, and Massachusetts set effort control measures for the Area 1A fishery via Days Out meetings/calls.

The previously scheduled Days Out call on June 26, 2018 at 10:00 AM has been cancelled. Given the current weekly landings limit in the Area 1A fishery has not been fully harvested by all vessels and catch rates have not exceeded projections, the states have decided a Days Out call is not warranted at this time. The Section awaits the results of the 2018 Atlantic Herring Benchmark Stock Assessment, which is scheduled for peer review onJune 26-28, as well as the outcome of the recommendation from the New England Fishery Management Council to NOAA Fisheries to reduce the 2018 sub-ACLs.

The Atlantic Herring Section members from Maine, New Hampshire, and Massachusetts are scheduled to reconvene via conference call to review fishing effort on the days listed below. If the states determine a Days Out call is needed ahead of July 17th, a call can be scheduled and the public will be notified via a press release.

Hearing on Cape Cod for rules to limit herring trawlers

June 19, 2018 — For over 15 years, Cape and other small-boat fishermen in the Northeast have lobbied against the large vessels of the herring fleet, saying they are too efficient at catching fish. They claim these vessels remove such large amounts of herring from an area that there is nothing left to attract cod, striped bass, bluefish, tuna and other species that eat herring close enough to shore for local fishermen to catch them.

These concerns resulted in a proposed regulation from the New England Fishery Management Council, known as Amendment 8 to the herring fishery management plan, which bans these vessels from inshore waters. A public hearing on the amendment is scheduled Tuesday in Chatham.

Right now, these vessels of around 120-150 feet in length, frequently towing huge nets between two ships, can come within 3 miles of the Cape coastline. Fishermen and the public will have a number of options to comment on, including herring trawler bans that extend from 6 to 50 miles from shore. A few months ago, local fishermen and environmental groups were unsure how far offshore they wanted to push large herring trawlers, but recent preliminary reports indicating the herring stock may be in trouble have united many in the fishing and environmental community to press for the maximum: a 50-mile buffer zone. They say this measure not only helps them catch fish in their traditional fishing grounds, but also helps the herring stock recover.

“If you had a bigger zone of 50 miles, you would encompass spawning sites that herring use,” said Peter Baker, director of U.S. Oceans, Northeast, for The Pew Charitable Trusts. “The benefit to the herring fishery is a place, a pretty huge one, where they could live without being chased down by industrial fishing trawlers, the most efficient fishing vessel around.”

A second component of the hearing, hosted by the New England Fishery Management Council, would allow for changes in the annual allowed catch dependent on how the stocks are doing.
