Cities take council to task over monitoring recommendation

September 8, 2020 — You may have noticed that we’ve written a bit lately about the monitoring measure — Amendment 23 — being considered by the New England Fishery Management Council to set future monitoring levels for sector-based groundfish vessels.

It’s a hot item. Conservationists are all for it. Local fishermen say it could spell the death knell for the industry. The council is expected to take final action on the measure at its September meeting.

The cities of Gloucester and New Bedford — the state’s historic commercial fishing fiefdoms — weighed in. Not surprisingly, they are fervently against the council’s preferred option, which would put monitors on every trip by every sector-based groundfish vessel — at an average cost of about $700 per day per boat.

“Monitoring in any fishery is an important component to fisheries management,” the city of Gloucester stated in its comments to the council. “But the New England Fishery Management Council’s preferred alternative of 100% at-sea monitoring on the groundfish sector program is excessive and in complete disregard of the socio-economic disruptions and extreme hardships that will be imposed on fishermen, their groundfish sectors and their communities.”

And it goes on from there.

So there you go. The battle lines are drawn.

Massachusetts Fishermen, State Leaders Fighting At-Sea Monitoring Proposal

September 8, 2020 — Massachusetts fishermen are not sitting back quietly as the New England Fisheries Management Council (NEFMC) considers a policy shift that would require 100% at-sea monitoring of commercial groundfish vessels. Fishermen, along with some state leaders, are raising concerns and making their opposition to the measures known.

Amendment23 to the Northeast Multispecies Fishery Management Plan would require groundfishing vessels to implement 100% at-sea monitoring or a combo of at-sea monitoring and electronic monitoring. And while the goal of the proposal is to improve catch accountability in the fishery, fishermen argue that it’s “overly burdensome and unnecessary.” In addition, with no vaccine available for COVID-19, there are also continued concerns about being able to properly social distance while at sea.

New Zealand introduces plan to put camera aboard all its fishing vessels

September 8, 2020 — New Zealand’s government last week announced plans to put cameras on board 345 fishing vessels, a plan that will cost more than NZD 40 million (USD 27 million, EUR 23 million).

In a press statement, New Zealand Fisheries Minister Stuart Nash said the introduction of on-board cameras will be across the nation’s inshore fishing fleet. He said the government will provide at least a portion of the funding required to install and operate the cameras, but “the precise amount will depend on the business case put together by officials for Cabinet sign-off..”

NOAA Fisheries Provides an Update on Notification Requirements and Implementing Industry-Funded Monitoring in the Atlantic Herring Fishery

March 31, 2020 — The following was released by NOAA Fisheries:

On February 12, 2020, we invited monitoring service providers to apply to become NOAA Fisheries-approved providers for industry-funded observer, at-sea monitoring, and portside sampling coverage. We expect to announce the approved industry-funded monitoring providers in April.

Beginning April 1, 2020, herring vessels will notify us via the pre-trip notification system (PTNS) to be considered for monitoring coverage, including coverage to satisfy Standardized Bycatch Reporting Methodology coverage and industry-funded monitoring coverage. The details of new and existing notification, reporting, and monitoring requirements, and how to comply with those requirements, is described in this bulletin.

Originally, we had also planned to begin selecting vessels, specifically vessels issued Category A or B herring permits, for industry-funded at-sea monitoring coverage on April 1. However, we are delaying the start date to begin assigning industry-funded monitoring coverage in the herring fishery. Once monitoring service providers are approved, we want to provide ample time for industry participants to make arrangements with service providers to secure at-sea monitoring coverage, and potentially observer coverage to access Northeast multispecies closed areas, for their vessels. Additionally, our training class for new monitors and observers in the herring fishery has been delayed in response to the Coronavirus Disease 19 (COVID-19) pandemic. For these reasons, we will not be selecting herring vessels for industry-funded monitoring coverage any earlier than June 15, 2020. This means that PTNS will issue waivers for industry-funded monitoring coverage until June, and herring vessels will not be responsible for paying sampling costs associated with industry-funded monitoring until June.

NOAA Suspends Northeast Fishing Monitor Requirement

March 30, 2020 — An arm of the federal government is temporarily waiving the need for some fishing vessels to carry at-sea monitors.

At-sea monitors and fishery observers collect data on board fishing boats that help inform the management of U.S. fisheries. The National Oceanic and Atmospheric Administration’s Greater Atlantic Regional Fisheries Office has waived the requirement for vessels with Northeast fishing permits to carry the monitors through April 4.

NOAA said additional extensions would be evaluated every week. The rule changes is one of the emergency measures NOAA is using to address fishery observer coverage during the coronavirus outbreak, the agency said.

Reminder: Replace McMurdo Omnitracs Vessel Monitoring Systems

March 17, 2020 — The following was released by NOAA Fisheries:

Beginning April 1, 2020 current McMurdo Omnitracs vessel monitoring system (VMS) units will no longer be supported.

Vessels may not operate without a compliant VMS unit. Consequently, if you have not replaced and activated your new VMS unit by April 1, 2020, you will be out of compliance with the VMS regulations and will not be authorized to fish.

To comply with the VMS regulations, you must replace your current unit with one of the following type-approved units:

  • AddValue iFleetONE (***Newly Type-Approved)
  • SkyMate I1500 VMS
  • SkyMate m1600 VMS
  • Woods Hole Group – Triton Advanced

Alternatively, you may request a “power-down” exemption. A power-down exemption allows you to turn off your VMS unit while your vessel is out of the water for 72 consecutive hours or is docked for a minimum period of 30 days, or meets other conditions. Any vessel that holds a permit requiring VMS cannot turn the power to the unit off unless it is granted a power down exemption. If you are interested in pursuing this option, you should call the Northeast VMS Team to initiate a power down exemption request. Once a request is approved, the Regional Administrator will issue a Letter of Exemption (LOE) authorizing the VMS to be turned off while in port. If your vessel has a type-approved VMS unit installed before the LOE expires, the Northeast VMS team will terminate the power down LOE, so that you may begin fishing.

Fleet monitoring: New England groundfish fleet cooperates with little return

March 10, 2020 — Despite years of ever-increasing monitoring, cooperation from the fleet, and catch-shares-induced consolidation, the New England groundfish industry is still on shaky ground.

A Maine Fishermen’s Forum presentation by Melissa Errand of the New England Fishery Management Council illustrated the council-considered options for monitoring the groundfish fleet (Amendment 23). This presentation focused on the effects on the Maine-based fleet, which is Portland-based.

With projected costs of each alternative ranging from about $1 million to more than $5 million across the fleet, the council expects the changes to force groundfish boats with the fewest at-sea days to lease out their quota rather than go fishing.

The council’s preferred alternative is a blended model that allows boat owners to choose between traditional at-sea monitoring and electronic monitoring.

One Portland-based boat is using the experimental full-retention model that incorporates a combination of full-time cameras on the boat, landing all fish that would qualify as discards, and dockside monitoring and sampling of those retained discards.

Second lawsuit filed in at-sea monitoring dispute

March 10, 2020 — A second lawsuit has been filed in a U.S. federal courthouse against a rule, scheduled to take effect Monday, 9 March, that would require Atlantic herring fishermen to pay for independent monitors aboard their vessels.

Seafreeze Fleet LLC and two vessels it owns filed the lawsuit against the U.S. Department of Commerce, the National Oceanic and Atmospheric Administration, and NOAA Fisheries in U.S. District Court in Rhode Island last week. It comes a couple of weeks after New Jersey fishermen filed a similar lawsuit over the rule.

Wideye iFleetONE Vessel Monitoring System Approved for Use

March 6, 2020 — The following was released by NOAA Fisheries:

On February 28, 2020, AddValue Innovation’s “Wideye iFleetONE” vessel monitoring system (VMS) was approved for use by commercial fishing vessels with federal permits requiring the use of VMS in the Greater Atlantic Region.

The Wideye iFleetONE is a broadband VMS unit which meets all NOAA VMS requirements, and supports other data, voice and text services. The unit operates on the Inmarsat satellite network. For more information, refer to the AddValue Innovation brochure.

New Jersey-based herring fleet sues over at-sea monitoring rule

February 25, 2020 — New Jersey herring fishermen are going to court challenging a new rule forcing them to pay for at-sea monitoring, which they say will cost more than $700 a day for observers and cut their revenue from herring trips by more than 20 percent.

A half-dozen vessels associated with Lund’s Fisheries, based near Cape May, N.J. are named in the lawsuit filed last week against the New England Fishery Management Council, NOAA and the Department of Commerce.

Cape Trawlers, H&L Axelsson and Loper Bright Enterprises contend regulators have no statutory authority from Congress to impose industry-paid monitoring in addition to a separate, federally-funded observer program.

“The regulation also has the potential to modify other New England fishery management plans to allow for standardized implementation of additional industry-funded monitoring programs in the future,” Lund’s Fisheries said in a joint announcement with the Cause of Action Institute, a Washington, D.C.-based legal and free-market advocacy group.

A final rule published in the Federal Register Feb. 7, to take effect March 9, would require Atlantic herring trawlers with areas A and B permits to pay toward a 50 percent at-sea monitoring coverage target for the first time.

Originating with the 2018 Industry-Funded Omnibus Amendment approved by the New England council, the potential for levying new monitoring requirements had been in the background since being okayed by the Department of Commerce.
