California Sues DOI Calling Offshore Wind Cancellation “Blatantly Unlawful”

August 31, 2026 — California Attorney General Rob Bonta and the California Energy Commission moved forward with their earlier challenges and filed a lawsuit on August 28 against the Trump administration and Golden State Wind over what it is calling “the unlawful buyout” of the offshore wind energy lease. The state is contending the deal to buy back the offshore wind lease is illegal and would jeopardize its investments to support the project, the state’s energy policy, and the commitments from the developer for workforce training, the supply chain, and investments in the local communities.

The California Energy Commission in May served an administrative investigative subpoena to Golden State Wind seeking documents and information related to the buyout. The California Department of Justice and CEC followed up in June by sending a Notice of Intent to Sue targeting what it terms an “unlawful agreement between the Department of the Interior and Golden State Wind.” It is asserting that the deal is “blatantly unlawful” and is asking the courts to strike it down.

“The Trump administration’s backroom buyout with Golden State Wind to stop offshore wind development in favor of gas and oil drilling is, unfortunately, a classic playbook for them to line the pockets of their Big Oil donors,” said Attorney General Bonta, announcing the filing of the lawsuit.

Oceana loses court appeal challenging Alaska trawling

August 31, 2026 — Environmental NGO Oceana has lost an appeal of its lawsuit against the National Marine Fisheries Service (NMFS) after the U.S. Court of Appeals for the Ninth Circuit vacated and remanded an earlier decision, instructing the court to dismiss for lack of jurisdiction.

Oceana first sued NMFS in Alaska District Court in 2024, alleging the agency failed to adequately protect the North Pacific seabed from trawl fishing. The lawsuit claimed NMFS wasn’t fulfilling its obligations under the Magnuson-Stevens Act (MSA) and the National Environmental Policy Act (NEPA).

Environmental groups take steps to sue to compel new protections for gray whales

August 28, 2026 — Amid a decade of die-offs and a sharp decline in the population of gray whales that swim along the Pacific coast of North America, three environmental groups are preparing to sue the Trump administration over its failure to bring back Endangered Species Act protections for the animals.

The Center for Biological Diversity, the International Marine Mammal Project and Oasis Earth on Tuesday submitted a notice of intent to sue the National Oceanic and Atmospheric Administration over gray whale protections.

Oasis Earth submitted a petition a year ago to NOAA Fisheries for a threatened or endangered listing to be granted to the Eastern North Pacific gray whale population. But the agency neither issued a 90-day finding on the petition’s validity nor a 12-month finding on the population’s status, as required under the law, the groups’ notice said.

Judge grants preliminary approval for a USD 2.25 million settlement over Dungeness crab price-fixing

August 26, 2026 — A U.S. federal court judge has granted preliminary approval on a settlement for a price-fixing lawsuit leveled against buyers of Dungeness crab in California, Washington, and Oregon.

Northern District of California Judge Alex G. Tse approved three settlements in the lawsuit, which was brought by Brand Little and Robin Burns. Tse approved a collective payment of USD 2.25 million (EUR 1.93 million) from three of the smaller crab buyers, who shared 5.27 percent of the Dungeness crab market during the period: Pacific Dream Seafood, Caito Seafood, and Fisherman’s Choice.

Nonprofit sues over U.S. push to auction areas of water around American Samoa for potential mining

August 20, 2026 — A legal environmental group sued the U.S. government on Tuesday to halt the Trump administration’s plans announced last month to auction off sections of water surrounding American Samoa for potential deep-sea mining.

Earthjustice filed the lawsuit against the U.S. National Marine Fisheries Service and U.S. Commerce Secretary Howard Lutnick on behalf of two groups: Fa‘asao Amerika Samoa and Conservation Council for Hawai‘i.

The legal nonprofit is requesting that a judge order the National Marine Fisheries Service to stop moving forward with its plans and to comply with the Endangered Species Act and other federal laws.

“The United States has never opened its waters to deep-sea mining. Until now,” the lawsuit stated.

It noted that the U.S. plans to sell leases with the intention of allowing mining across 33 million acres of seabed off American Samoa that is rich in minerals including nickel, cobalt and manganese that are used to build batteries, electronics and other products.
