Multiple Groups, Politicians Call on NOAA to Continue Waiver of At-Sea Observers

August 18, 2020 — At-sea observers in the Northeast were reinstated by NOAA on August 14— but multiple groups and politicians are urging the government agency to reconsider their decision.

Observer coverage has been waived for months due to health concerns related to the coronavirus pandemic. However, NOAA Fisheries Assistant Administrator Chris Oliver announced late last month that observer coverage in the Northeast would resume on August 14.

Fisheries Survival Fund Questions NOAA Over Decision to Reinstate Observers, But Cancel Surveys

August 17, 2020 — Why are fishery surveys being canceled but at-sea-observers being reinstated? That’s the tough question that the Fisheries Survival Fund (FSF) is asking. FSF submitted a letter to NOAA Fisheries Assistant Administrator Chris Oliver on August 13, just one day before the resumption of observer programs in the Northeast region.

“As you know, FSF represents the significant majority of full-time Limited Access permit holders in the Atlantic scallop fishery,” the letter reads. “Our members are home-ported along the Atlantic Coast from Massachusetts through North Carolina. The scallop industry recognizes the value of observers, as well as the difficulty of decisions NMFS is confronting during the COVID-19 pandemic. However, FSF still does not understand why NMFS cancelled unique fishery-independent surveys critical to resource management yet is reinstating less critical fishery-dependent data collected by observers when other options (VTRs, vessel tracking, and electronic monitoring) are available.”

Groups File Petition for Additional Speed Limits Along Atlantic Coast to Protect Right Whales

August 13, 2020 — Earlier this month a number of conservation groups came together to file a petition seeking additional speed limits along the Atlantic Coast to protect North Atlantic right whales. The letter, submitted to Secretary of Commerce Wilbur Ross and NOAA Fisheries Assistant Administrator Chris Oliver on August 6, begs the National Marine Fisheries Service to take action to prevent and mitigate the continuing threat of vessel strikes.

The call for action comes shortly after the death of a calf this past June. As SeafoodNews reported, the deceased North Atlantic right whale was spotted off the coast of Elberon, New Jersey, on June 25. The whale was ultimately identified as a male calf of whale #3560. A necropsy conducted by NOAA revealed evidence of at least a pair of vessel collisions.

Make ship speed limits mandatory to protect right whales, advocates say

August 11, 2020 — Vessel speed limits must be mandatory offshore when endangered northern right whales are present, because ship strikes are a leading cause of deaths in the whale population now down to only around 400 animals, ocean conservation groups say in an appeal to the U.S. government.

“The unprecedented number of recent deaths and serious injuries warrants the agency acting quickly to ensure that this endangered species receives the protections necessary to reduce the risk of vessel strikes and ensure its continued existence throughout its range,” the groups state in a petition submitted Aug 6 to U.S. Secretary of Commerce Wilbur Ross and Chris Oliver, administrator of the National Marine Fisheries Service.

“The time has come for NMFS to follow through on the promises it made in 2008 to expand the ship speed rule based on the best available scientific data to address the urgent crisis the right whale faces,” according to the groups Whale and Dolphin Conservation, Center for Biological Diversity, Conservation Law Foundation, Defenders of Wildlife, Humane Society of the United States and Humane Society Legislative Fund.

“While the species faces a plethora of threats, collisions with marine vessels remains one of the two primary threats inhibiting the species’ recovery and threatening its continued existence,” according to the groups. “Since 2017, just over half of the known or suspected causes of mortality for the species have been attributed to vessel strikes, closely followed by incidental entanglements in fishing gear.”

SEAN HORGAN: Watching the watchers

August 4, 2020 — Stop us if you’ve heard this one before: NOAA Fisheries, persisting in an increasingly bad optic and potentially dangerous policy, last week said it will begin redeploying at-sea monitors aboard Northeast groundfish vessels on Aug. 14 despite the continuing national surge of the COVID-19 pandemic. It extends the previous waiver period by two weeks.

“NOAA Fisheries has been working with the regional observer and monitor providers to enact safety protocols that match those that are in effect for vessel operators and crew during this continually evolving situation,” NOAA Fisheries Assistant Administrator Chris Oliver said in a statement announcing the extension.

Oliver said the agency has developed national criteria for vessels to be released from monitor and observer coverage on a trip-by-trip basis. Waivers may be granted if observers or at-sea monitors are not available for the trip or the observer providers “cannot meet the safety protocols imposed by a state on commercial fishing crew or by the vessel or vessel company on the crew.”

And now the lawyers weigh in: “Within our limited authority, our efforts are intended to ensure observers and monitors are following the same safety protocols that fishermen are following,” Oliver stated.

NMFS looks to resume Northeast observer coverage in August

July 31, 2020 — At-sea observer coverage in the Northeast will resume Aug. 14, but NMFS officials say they will continue to waive monitor requirements on a trip-by-trip basis if covid-19 safety protocols cannot be met.

“Providing seafood to the country remains an essential function even in these extraordinary times, and adequately monitoring United States fisheries remains an essential part of that process,” NMFS administrator Chris Oliver said in a statement issued Thursday.

Oliver said waivers can still be allowed for specific trips in both full and partial observer-covered fisheries, under two sets of conditions: when observers or at-sea monitors are not available for deployment, or when companies providing observer services “cannot meet the safety protocols imposed by a state on commercial fishing crew or by the vessel or vessel company on its crew.”

“Within our limited authority, our efforts are intended to ensure observers and monitors are following the same safety protocols that fishermen are following,” said Oliver.

NOAA Fisheries Identifies National-Level Observer Waiver Criteria; Will Begin Redeployment in Northeast

July 30, 2020 — The following was released by NOAA:

Providing seafood to the country remains an essential function even in these extraordinary times, and adequately monitoring United States fisheries remains an essential part of that process.

To improve transparency in our approach to observer deployment, we have established national-level criteria for vessels to be waived (released) from observer or at-sea monitor coverage. Going forward, observer or monitor coverage may be waived, for both full and partial-coverage fisheries, on a trip-specific basis if one of the following two criteria are met:

(1) Observers or at-sea monitors are not available for deployment; or

(2) The observer providers cannot meet the safety protocols imposed by a state on commercial fishing crew or by the vessel or vessel company on its crew. Within our limited authority, our efforts are intended to ensure observers and monitors are following the same safety protocols that fishermen are following.

We recognize that there are differences for observer and at-sea monitor deployment across fisheries, and have heard the concerns expressed about how observer coverage varies regionally, and even within regions. Given the diversity in our fisheries, from the composition of the fleets to how the fisheries are prosecuted, regional flexibility will continue in the detailed implementation of the two waiver criteria. We believe this adaptable approach will allow us to be transparent with stakeholders as well as responsive to ever-evolving changes on the ground. We also continue to encourage the use of electronic monitoring, as appropriate, as an additional option.

On August 14, we will resume deployment of observers and at-sea monitors in the Northeast partial-coverage fisheries. We are maintaining existing observer and monitor, both at-sea and shoreside, coverage throughout our other regions. Vessels should continue to seek observer and monitor coverage waivers through their regular regional process.

NOAA Fisheries has been working with the regional observer and monitor providers to enact safety protocols that match those that are in effect for vessel operators and crew, during this continually evolving situation. The contractual relationships between industry, NOAA Fisheries, and observer providers vary by region and sometimes within a region.

Observers and monitors, at-sea and shoreside, are an essential component of commercial fishing operations and provide critical information that is necessary to keep fisheries open and to provide sustainable seafood to our nation during this time. We will continue to monitor all local public health notifications, as well as the Centers for Disease Control and Prevention, for updates. We are committed to the health and safety of fishermen, observers, and others while fulfilling our mission to maintain our nation’s seafood supply and conserving marine life.

NOAA Fisheries Chief Chris Oliver on Observers and Monitors

July 16, 2020 — The following was released by NOAA:

Observers and monitors, at-sea and shoreside, are an essential component of commercial fishing operations and provide critical information that is necessary to keep fisheries open and to provide sustainable seafood to our nation during this time. We recognize the COVID-19 pandemic continues to evolve and as such, it has required us to adapt to changing circumstances. Our adaptation is multi-faceted. Across the Pacific and Western Pacific, the majority of fisheries require full observer coverage; on the East Coast, the majority of fisheries require partial coverage. The differences in the requirements are an important reason that we have used our ability to waive observer coverage in some regions and fisheries, and not in others.

In addition, how fisheries operate varies regionally and even within a region, including factors such as whether crew or observers need to cross state lines. Some of these operational aspects have allowed the agency and observer service providers to more quickly adapt processes and procedures for deployment. In other cases, we’ve needed more time. For example, in the Northeast, because of the number of different jurisdictions, additional time was needed to finalize our observer redeployment protocols. Consequently, we delayed observer coverage for an additional month. Throughout most regions though, individual trips and vessels in partial-coverage fleets continue to be released from coverage on a case-by-case basis. Overall, our approach to observer coverage and monitoring allows us to be as adaptable as possible given all of the variability across our regions and fisheries.

Finally, the contractual relationships between industry and NOAA Fisheries and observer service providers vary by region and sometimes within a region, affecting what ability, if any, the agency has to make changes to protocols and processes.

In general, observers create no more risk than a crew member, although we do have allowances for vessel by vessel waivers in situations where that may not be the case, and observer provider companies are generally able to match precautionary measures that vessels impose on crew members. Ultimately, within our limited authority, our goal is to have observers and monitors following the same safety protocols that fishermen are following.

Providing seafood to the country remains an essential function even in these extraordinary times and adequately monitoring United States fisheries remains an essential part of that process. We will continue to monitor all local public health notifications, as well as the Centers for Disease Control and Prevention (CDC) for updates, and adjust our processes as needed. We are committed to the health and safety of fishermen, observers, and others while fulfilling our mission to maintain our nation’s seafood supply and conserving marine life.

Below is an update as of the situation in each of our regions as it pertains to observer coverage:

Regional Snapshot of Current Observer Waivers

  • Alaska Region – NOAA Fisheries is in the process of positioning observers at select ports throughout Alaska to meet monitoring objectives for vessels in the Partial Coverage Category of the North Pacific groundfish and Pacific Halibut fisheries. NOAA Fisheries has identified ports in Alaska where current travel and lodging conditions allow observers to meet and maintain applicable national, state, and local health mandates for deployment into the commercial fisheries. The region may release trips from observer coverage on a case-by-case basis for vessels in the Partial Coverage Category, as needed, in consideration of national, state, and local travel and safety requirements. No deviation has been made from the 2020 Annual Deployment Plan for vessels using electronic monitoring or to the requirement that vessels continue to log trips in Observer Declare and Deploy System (ODDS). Observer coverage continues for vessels in the Full Coverage Category of regional fisheries.
  • West Coast Region – Beginning at 12:00 am on May 1, 2020, fishery observer and catch monitor coverage was again required per existing regulations for all commercial fishing vessels and first receivers in required West Coast fisheries. Waivers of partial, scientific observer coverage are being issued on a vessel-by-vessel basis, including for the portion of the fleet using electronic monitoring. Waivers of observer coverage will continue on a vessel-by-vessel basis, as needed, in consideration of national, state, and local travel and safety requirements. The region is also ready to provide waivers for large purse seine vessels unable to get an Inter-American Tropical Tuna Commission (IATTC)-approved observer for tuna fisheries in the eastern Pacific Ocean.
  • Pacific Island Region – Observer coverage requirements continue in all required fisheries. Although contracted observers are being placed on most Hawaii pelagic longline trips in Hawaii, waivers of observer coverage on a vessel-by-vessel basis will continue, as needed, in consideration of evolving national, state, territory, and local travel and safety requirements. International observer requirements for tuna purse seine vessels have been waived by the Western and Central Pacific Fisheries Commission until July 31, 2020.
  • Southeast Region – Beginning at 12:00 a.m. on May 5, 2020, observer coverage was again required per existing regulations for the following fisheries: South Atlantic Penaeid Shrimp, South Atlantic Rock Shrimp, South Atlantic Snapper-Grouper, Southeast Gillnet, Gulf of Mexico Commercial Reef Fish, Gulf of Mexico Shrimp, Atlantic Highly Migratory Species (HMS) Pelagic Longline, Shark Bottom Longline (Atlantic HMS), Shark Gillnet (Atlantic HMS). Waivers of observer coverage on a vessel-by-vessel basis will continue, as needed, in consideration of national, state, and local travel and safety requirements. The region continues to work with the regional observer provider to finalize their observer redeployment plans to support the safe and effective redeployment of observers in the region.
  • Greater Atlantic Region – The region has extended the existing observer waiver exempting all vessels issued Greater Atlantic Region permits from the requirements to carry an observer or at-sea monitor. This waiver is in effect through July 31. When deployment resumes, we will include allowances for vessel by vessel waivers in situations for which there are medical or other issues where the observer may pose an additional risk beyond that posed by a normal crew member (i.e., small vessel with isolated crew for example). We will continue to work with the regional observer provider to finalize their observer redeployment plans to support the safe and effective redeployment of observers in the region.

Seafood Harvesters calls on NOAA Fisheries to apply observer waiver consistently for all regions

July 14, 2020 — Seafood Harvesters of America is calling on NOAA Fisheries to develop a more consistent policy in issuing waivers for observers during the COVID-19 pandemic.

Bob Dooley, the organization’s president, and Leigh Habegger, its executive director, signed a letter sent Monday, 13 July, calling for NOAA to rethink the agency’s current policy regarding at-sea observer coverage. The letter – which was sent to Dr. Neil Jacobs, the acting undersecretary for oceans and atmosphere in the U.S. Department of Commerce; Chris Oliver, NOAA Fisheries’ assistant administrator; and two other NOAA Fisheries officials – is calling for the federal agency to amend the “inconsistent and unequal” process of applying waivers by extending them to all regions where observers and at-sea monitors are mandatory.

‘New Normal’ Trumpets a Bigger Role for U.S. Seafood

May 28, 2020 — The following was released by the Western Pacific Regional Fishery Management Council:

Leaders of the nation’s eight Regional Fishery Management Councils convened the first of their biannual meetings in 2020 today by teleconference. The Council Coordination Committee (CCC) meeting provides the Councils and heads of the National Marine Fisheries Service (NMFS) to discuss issues relevant to all of the Councils. Heading today’s agenda was COVID-19 impacts on U.S. fisheries and federal efforts to address them, including President Trump’s Executive Orders on Promoting American Seafood Competitiveness and Economic Growth and on Regulatory Relief to Support Economic Recovery and the CARES Act $300M stimulus package for fisheries and aquaculture.

“The COVID-19 pandemic has made our responsibility more poignant and highlights the often overlooked fact that managing our nation’s fisheries is about ensuring that Americans have food,” stated Taotasi Archie Soliai, chair of the Western Pacific Council, which hosted the meeting. “Yes, management is about making certain fish stocks and protected species remain healthy. Yes, management is about guaranteeing that our fishermen can earn a decent living, pursue the sport of recreational fishing and continue their cultural traditions. But the bottom line is the goal of management of our fisheries is to ensure that our nation can provide nutritious seafood to its people from its waters, which comprise the second largest exclusive economic zone (EEZ) in the world.”

Assistant Administrator for NOAA Fisheries Chris Oliver said the agency “is looking to support a ‘new normal’ where seafood plays an even bigger role in our economy and in our households. … The Presidential Executive Order greatly adds the horsepower we needed, by codifying our role to support you. It calls for regulatory reform to maximize commercial and recreational fishing opportunities and enforcement of common-sense restrictions on seafood imports that do not meet American standards. And it places NOAA firmly in charge of coordinating the federal process for aquaculture permitting. The Executive Order and the CARES Act funding create an exciting new opportunity to address long-term challenges to expanding the domestic seafood sector.”

Offshore wind issues, bycatch and changing stock assessment status were among other items covered today. The meeting continues tomorrow and is open to the public. The agenda and conference call-in instructions are posted at http://www.fisherycouncils.org/ccc-meetings/may-2020.
