Explaining California’s sudden humpback entanglement surge

April 22, 2019 — Every year, humpback whales make their annual trek from tropical calving grounds to feed in the cold, nutrient-rich waters off the coast of California. Historically, they arrived to feast in June just as the Dungeness crab fishery was closing and gear was being pulled in for the season. But in 2012, they arrived a few weeks earlier than normal. In 2014, they were a month early. By 2015, the humpbacks arrived in April, a full two months earlier than the norm.

That shift has been dangerous for the whales. In March, it was the subject of a lawsuit settlement that prompted an early end to the Dungeness crab season. Some of our own research has determined the cause: climate change.

Humpback sightings from the Golden Gate Bridge are a hallmark of summer in San Francisco. The whales come to feed where the narrow straits of the Bay meet the ocean. Marine life abounds here, where nutrient-dense water feeds blooms of phytoplankton. They are then eaten by zooplankton, including krill, tiny reddish shrimp-like crustaceans which are a favored food for whales. Seasonal blooms of these tiny animals support the ecosystem bottom-up, producing a massive marine buffet for fish, birds and other marine mammals. Predators gorge themselves in the summer and fall when this area supports the most amount of food.

Where there are high concentrations of fish, there are people catching them, and the whales’ earlier arrival has driven more interactions with West Coast fisheries. Since 2014, the number of whales entangled in Dungeness crab pots has escalated dramatically, with 129 cases reported between 2015 and 2017, compared to around 10 each year in previous decades.

Maryland officials join opposition to offshore seismic tests

April 22, 2019 — Maryland officials have joined a host of congressmen in opposing the Trump administration’s plan to start underwater seismic testing along the Atlantic coast, operations that could lead to increased domestic production of oil and gas, but also could be harmful to marine animals.

The offshore seismic testing would be part of oil and gas exploration from Florida up the East Coast to Delaware, including the coast of Maryland.

Maryland Attorney General Brian Frosh and eight other attorneys general joined as parties to a lawsuit aimed at stopping the testing, which they said would subject marine creatures such as whales, porpoises, and dolphins to extremely loud sounds.

Voluntary Vessel Speed Restriction Zone East of Boston to Protect Right Whales

April 22, 2019 — The following was released by NOAA Fisheries:

A voluntary vessel speed restriction zone (Dynamic Management Area – DMA) has been established east of Boston to protect an aggregation of 11 right whales sighted in this area on April 19.

This DMA is in effect through May 5, 2019.

Mariners are requested to route around this area or transit through it at 10 knots or less. Whales were spotted in or near shipping lanes so please be especially vigilant when traveling in these areas.

Right Whales Are Migrating

North Atlantic right whales are on the move along the Atlantic coast of the U.S. With an unprecedented 20 right whale deaths documented in 2017 and 2018, NOAA is cautioning boaters to give these endangered whales plenty of room. We are also asking commercial fishermen to be vigilant when maneuvering to avoid accidental collisions with whales, remove unused gear from the ocean to help avoid entanglements, and use vertical lines with required markings, weak links, and breaking strengths.

Right Whales in Trouble

North Atlantic right whales are protected under the U.S. Endangered Species Act and the Marine Mammal Protection Act. Scientists estimate there are slightly more than 400 remaining, making them one of the rarest marine mammals in the world.

In August 2017, NOAA Fisheries declared the increase in right whale mortalities an “Unusual Mortality Event,” which helps the agency direct additional scientific and financial resources to investigating, understanding, and reducing the mortalities in partnership with the Marine Mammal Stranding Network, Canada’s Department of Fisheries and Oceans, and outside experts from the scientific research community.

NOAA: Team to Focus on Right Whale Survival This Week

April 22, 2019 — The following was published by NOAA Fisheries:

On April 23, a group of approximately 60 fishermen, scientists, conservationists, and state and federal officials will come together to discuss ways to further reduce serious injury and mortality of endangered North Atlantic right whales caused by trap/pot fishing gear. The group will meet in Providence, Rhode Island for four days. At the end of the meeting, they hope to agree on a suite of measures that will reduce right whale serious injuries and deaths in fishing gear in U.S. waters from Maine to Florida to less than one whale per year, the level prescribed by the Marine Mammal Protection Act.

“Tackling entanglements is critical to the recovery of the North Atlantic right whale population, and we can’t do it without the assistance and cooperation of those who know best how the fishing industry interacts with large whales,” says Mike Pentony, regional administrator for NOAA Fisheries Greater Atlantic Region. “The continued participation and dedication of our industry, science, NGO, and agency partners is absolutely necessary to future success.”

About Right Whales

These whales, which got their name from being the “right” whales to hunt because they floated when they were killed, have never recovered to pre-whaling numbers. Due in part to conservation measures put in place to protect these whales from incidental entanglements in fishing gear and vessel strikes, we saw steady population growth from about 270 right whales in 1990 to about 480 in 2010. But in 2010, another downward trajectory began. This downward trend, exacerbated by an unprecedented 17 mortalities (particularly in the Gulf of St. Lawrence snow crab fishery) in 2017, brought a new urgency to modify the existing Atlantic Large Whale Take Reduction Plan.

That Plan, developed by the team of stakeholders meeting next week, identifies a number of conservation measures from area closures to gear modifications that U.S. fixed gear fishermen have already implemented. Despite these efforts, today the population is estimated to be fewer than 411 whales. Only twelve births have been observed in the three calving seasons since the winter of 2016/2017, less than one third the previous average annual birth rate for right whales. This accelerates the trend that began around 2010, with deaths outpacing births in this population.

Take Reduction Planning

The Marine Mammal Protection Act requires that if serious injuries and mortalities to a population of marine mammals due to U.S. commercial fisheries is above a level that the stock can sustain, NOAA Fisheries convene Take Reduction Team to develop consensus recommendations on how to reduce this threat.

The immediate goal of a Take Reduction Team is to develop a to reduce incidental mortality and serious injury to a level, known as the “potential biological removal” level, that allows the stock to stabilize or grow, rather than decline. Although it’s been in existence since 1997, the Atlantic Large Whale Take Reduction Plan has not been able to consistently reduce serious injuries and mortalities to below the potential biological removal level.

Cost of Entanglement

Entanglements are currently the leading cause of known right whale mortality. More than 80 percent of right whales carry scars that indicate that they have been entangled in fishing lines, and nearly 60 percent of those are entangled more than once. Not all entanglements drown whales.  Some prevent a whale from feeding, increase the energy a whale needs to swim and feed and cause pain and stress to the animal, which weakens it. Biologists believe that the additional stress of entanglement is one of the reasons that females are calving less often; females used to have calves every 3-5 years, and now are having calves every 6-10 years.

In recent years, most documented fishing gear entanglements of large whales (like right and humpback whales) that result in serious injury and mortality come from trap/pot gear. The traps lie on the ocean floor and are connected to buoys at the surface by long vertical buoy lines.

Many whales that are entangled are discovered after the event, with no gear attached. In some instances, gear is retrieved, analyzed, and stored for future analysis; much of this retrieved rope is consistent with buoy lines. That said, 71 percent of all recovered/observed gear (2009-2018) from right whales cannot be matched to a specific fishery or site.

Strategies for Reducing Risk

In Providence next week, the Team will be developing and discussing potential measures to modify the Take Reduction Plan, including updates to the current gear marking strategy, seasonal area closures, and reducing the risk of vertical lines through the use of weak rope. Many of these measures were proposed by Team members during an October 2018 meeting to discuss possible options to discuss at the April 2019 meeting. In advance of this meeting, the team particularly requested two things: 1. Clarification of a target percent reduction in serious injury and mortality, and 2. An ability to evaluate and compare different risk reduction elements from Team proposals.

A Target Reduction Level

Based on the 2016 population estimate, the Northeast Fisheries Science Center’s North Atlantic right whale stock assessment establishes a potential biological removal level of 0.9 whales per year — i.e. slightly less than one whale suffering human-caused mortality or serious injury from any source in a given year.

Currently, NOAA Fisheries estimates that U.S. fisheries are responsible for 2.5 to 2.6 observed serious injuries and mortalities each year. Scientists estimate that we only observe 60 percent of the serious injuries and mortalities, which would bring the U.S. total to about 4.3. To get to 0.9 will require a reduction of 60-80 percent of serious injuries and mortalities.

A Risk Analysis Decision Tool

Determining how to judge the expected conservation value of any particular measure is a complicated task. To create a model to assess risk reduction, the model needs to first identify the current risk landscape, overlaying information on the density of trap/pot vertical lines, the distribution of whales, and the relative risk of the gear configuration associated with the lines (strengths/diameters of lines, lengths of trawls). Working collaboratively, the model combines Industrial Economics Inc.’s improved trap/pot vertical line model and the Duke Marine Spatial Ecology Lab’s marine mammal density model, as well as risk assessment weights provided by Take Reduction Team members, Agency large whale scientists and managers, and permitted whale disentanglers. With these data sets, scientists at NOAA’s Northeast Fisheries Science Center developed a risk assessment tool that will be used at next week’s meeting.  This tool represents a substantial leap forward and provides the Team with the best available information to determine risk and support their deliberations.

Next Steps

After this meeting, we will use recommendations from the Team to begin rulemaking in May. At various points during rulemaking there will be a continued opportunity for public comment.

“I’m confident we have the right people around the table to tackle this problem,” says Mike Asaro, Acting Protected Resources Assistant Regional Administrator. “This is a complex issue but with the cooperation and active engagement from the people who know this issue best, I have hope that following the meeting, we will have a solid set of conservation measures to proceed to rulemaking that will allow the fishing industry and whales to coexist and thrive.”

California Considers Sport Crab Fishery for Action Relating to Whale Entanglement

April 19, 2019 — The California Fish and Game Commission is proactively working to avoid further whale entanglements — and further lawsuits.

On Wednesday the Commission approved the Marine Resources Committee to take up the issue of recreational crab fishing, and possibly other fixed gear fisheries, and its potential to entangle whales. The commercial fleet early on questioned why other fisheries, particularly sport fisheries, were not subject to the same scrutiny as the commercial sector.

The commercial season closed earlier this week, on April 15, as part of a settlement agreement between the Center for Biological Diversity, the California Department of Fish and Wildlife and the Pacific Coast Federation of Fishermen’s Associations, which intervened on the case.

CDFW Director Charlton “Chuck” Bonham said during the introduction that, despite a lot of the rhetoric, the increase in whale entanglements in 2015 and 2016 were examples of the real-life impacts of climate change. While the commercial crab season was delayed for months due to elevated levels of domoic acid, whales also ventured closer to shore in search of prey species. Both of those events were linked to warmer ocean waters.

Bonham said during the progression of the lawsuit, the department concluded the judge was likely to rule against the state. Had that happened, the court could have become a “special master” of the crab fishery, he said, and that inserting a federal judge in the management of the fishery wouldn’t make it any easier.

Thus, the state proceeded with settlement discussions between all three parties and began working with NOAA to establish a habitat conservation plan for the whales and get an incidental take permit for the fishery. The process could take up to two years. In the meantime, for some areas, particularly south of Mendocino County, the commercial fishery is scheduled to close on April 1.

The state also is accelerating its rulemaking activities relative to gear, furthering its gear retrieval program, restricting buoy and line configurations and furthering support for the Dungeness Crab Fishing Gear Working Group, Bonham said.

However, there’s also an equity issue, he said.

“It’s time to think about a refined approach to how we manage fixed gear in the water,” noting that recreational crab fishing could have similar issues with whale entanglements as the commercial crabbers have had.

PCFFA Executive Director supported the director’s comments.

“You can’t overstate the impact,” Oppenheim said of the effect on commercial fishermen and processors. “[It was] a seismic shock to our industry.”

The confidential nature of the settlement discussions did not allow any of the parties to discuss potential solutions with the broader fleet, leaving many crabbers frustrated when the agreement was finally disclosed. The fleet had less than a month to remove their gear from the water.

Oppenheim described the past few months as the worst period of his professional career, but it pales in comparison to the livelihoods of his members, he said. Many fishermen are losing the spring fishery on which they depend. Others had to delay their fishing seasons due to elevated levels of domoic acid, so the early closure only made things worse.

Now, recreational fishermen and other fixed gear fishermen may face the same quandary. Entanglements in other fisheries could have an impact on the settlement agreement.

Sport fishermen noted there are vast differences between commercial and sport crabbing gear and sport fishermen should not be subject to the same settlement agreement.

It’s manifestly unfair to apply that settlement on parties who had no representation to the discussion, said George Osborne, a lobbyist for the Coastside Fishing Club. Osborn said the club insists that any management measures on recreational crabbers be proportionate to the degree that anglers may be contributing to the whale and turtle entanglements.

Commission President Eric Sklar said the commission and managers recognize the differences between the fisheries.

The Marine Resources Committee will continue the discussion when it meets on July 11.

Giant Bony Fish Being Found Stranded on N.E. Beaches

April 19, 2019 — The ocean sunfish earned its moment in the spotlight in 2015, when a viral video surfaced of a foul-mouthed recreational fisherman who observed a specimen along the Massachusetts coastline and excitedly tried to guess what it was as the fish calmly rested at the surface.

The largest bony fish, the pie-shaped creature is certainly an oddity to those who are unfamiliar with it — they bask on their side on the water’s surface and can grow to nearly 11 feet and weigh up to 5,000 pounds by eating almost exclusively jellyfish.

Like whales, however, they also sometimes become stranded on beaches or in shallow tidal areas, where they are unable to extricate themselves and die. Almost 350 of them have stranded along the New England coast since 2008, according to Michael Rizzo of the New England Coastal Wildlife Alliance, who studies the species.

Report finds ‘alarming unaddressed deficiencies’ in US offshore oil drilling

April 18, 2019 — Even as the Trump administration has taken steps to expand offshore oil drilling, a new report shows that thousands of oil spills are still happening and that workers in the oil and gas industry are still dying on the job.

The report comes from Oceana, a nonpartisan nonprofit dedicated to protecting and restoring the oceans, which has sued the federal government to stop seismic airgun blasting in the Atlantic Ocean. The blasting is the first step needed to allow offshore drilling, when seismic airguns are used to find oil and gas deep under the ocean. Every state along the Atlantic coast has opposed the blasting, worried that spills could hurt tourism and local fisheries. Some scientists say the testing could also hurt marine life, including the highly endangered North Atlantic right whale. The group tied its report, released Thursday, to the ninth anniversary of the BP Deepwater Horizon oil spill to show what has been happening since the government promised to hold the industry accountable to higher safety standards.

Pacific Council Finalizes Generally Improved Salmon Seasons for 2019

April 17, 2019 — Most salmon trollers can expect better ocean salmon seasons this year — while also meeting conservation goals, fishery managers said Monday.

The Pacific Fishery Management Council finalized its recommendations for 2019 salmon seasons at its meeting in Rohnert Park, Calif., for seasons beginning in May.

The seasons must still be approved by the U.S. Secretary of Commerce, but managers said that is expected.

The adopted regulations for Chinook salmon reflect the improved status of Sacramento River fall Chinook, Oregon managers said in a notice to industry. Rogue River fall Chinook and Klamath River fall Chinook populations both are in good and fair condition, respectively, they added.

Also, most of the north migrating stocks of Chinook (Oregon Coastal Chinook stocks from the Nehalem River south to the Elk River as well as a number of Columbia River Chinook stocks) are in moderate to poor condition. These north migrating stocks of Chinook contribute very little to Oregon’s ocean seasons but are very important to Oregon’s inside estuary and river recreational seasons.

The commercial ocean troll salmon seasons north of Cape Falcon will have very limited Chinook salmon quotas again this year. The ocean fishery will be managed by quotas, season length, and vessel landing week (Thursday-Wednesday) limits. The early Chinook salmon-only season will start on May 6. The season will continue until the overall quota of 13,200 Chinook or the Leadbetter Pt., Washington, to Cape Falcon (in northern Oregon) subarea cap of 1,800 Chinook is taken, or June 28, whichever comes first. Fishermen will be limited to 100 Chinook per vessel for the period of May 6-15 and then shift to a 50 Chinook per vessel per landing week (Thursday-Wednesday), beginning May 16.

The summer all-salmon fishery north of Cape Falcon will open on July 1 and continue through the earlier of the overall Chinook quota of 13,050 Chinook or 30,400 fin clipped coho, managers said in the notice to fishermen. Trollers will also be limited to 150 adipose fin-clipped coho during the landing week (Thurs-Wed) per vessel.

This year’s fisheries were designed to take advantage of a higher number of coho salmon forecast to return to Washington’s waters as compared to recent years, Kyle Adicks, salmon policy lead for the Washington Department of Fish and Wildlife, said in a press release. However, projected low returns of key Chinook stocks in Puget Sound prompted fishery managers to restrict fisheries there.

“We’re able to provide more opportunities to fish for coho in some areas, particularly in the ocean and Columbia River, than we have been able to do for several years,” Adicks said. Coho fisheries generally benefit sport fishermen but can constrain commercial fishermen targeting Chinook if coho is taken incidentally. “But continued poor returns of some Chinook stocks forced us to make difficult decisions for fisheries in Puget Sound this year.”

Again in 2019, fishery managers projected another low return of Stillaguamish, Nooksack and mid-Hood Canal Chinook and took steps to protect those stocks.

WDFW Director Kelly Susewind acknowledged the reductions in Puget Sound salmon fisheries are difficult for both fishermen, primarily sport fishermen, and the local communities that depend on those fisheries.

“Reducing fisheries is not a long-term solution to the declining number of Chinook salmon,” Susewind said. “The department will continue working with the co-managers, our constituents, and others to address habitat loss. Without improved habitat, our chinook populations will likely continue to decline.”

Limiting fisheries to meet conservation objectives for wild salmon indirectly benefits southern resident killer whales. The fishery adjustments will aid in minimizing boat presence and noise, and decrease competition for Chinook and other salmon in these areas critical to the declining whales, WDFW said in a press release.

In the rest of Oregon, from Cape Falcon to Humbug Mountain near Port Orford in southern Oregon, the Chinook salmon season will be open April 20-30, May 6-30, June 1-Aug. 29, and Sept. 1 through Oct. 31. Beginning Sept. 1, a 75 Chinook salmon per vessel weekly limit (Thursday through Wednesday) will be in place.

From Humbug Mt. to the Oregon/California border, the commercial troll fishery will be open April 20-30 and May 6-30. Beginning June 1, landing week (Thurs-Wed) limits of 50 Chinook per vessel will go into effect along with monthly quotas of 3,200 Chinook in June; 2,500 in July; and 1,200 in August (8/1-29).

“I really appreciate everybody’s work this week,” Oregon Department of Fish and Wildlife Fish Division Deputy Administrator Chris Kern said on the Council floor. “[It was] a lot of hard work, but I feel pretty good about where we landed.”

Similarly, California trollers should expect more time on the water this year.

Brett Kormos, with the Marine Region of the California Department of Fish and Wildlife, noted the two primary rivers, Sacramento and Klamath River, that contribute fall Chinook to ocean salmon fisheries are still in a rebuilding phase or overfished status. Still, “we are also looking at increased harvest opportunities in both commercial and recreational sectors in 2019 compared to 2018,” Kormos said.

Fishery managers modeled the seasons and limits to allow for a Sacramento River fall Chinook spawning escapement of 160,129 hatchery and natural area adults.

Feds Agree to Expand Habitat Protections for Northwest Orcas

April 16, 2019 — The federal government says that by October it will propose expanded habitat protections off Washington, Oregon and California for Pacific Northwest orcas.

The announcement comes in response to a lawsuit filed by the Arizona-based Center for Biological Diversity, which sued in 2018 to make officials move more quickly to protect the endangered orcas.

The whales spend their summers in the waters between Washington state and Canada, but about two-thirds of the year they migrate and forage for salmon off the West Coast. The conservation group said the National Marine Fisheries Service had been dragging its feet in designating “critical habitat” for the whales in those foraging and migration areas.

Feds declare Gulf whale species endangered

April 15, 2019 — Federal officials today declared a tiny group of Bryde’s whales in the Gulf of Mexico endangered, facing threats including oil and gas exploration and development.

“They’re the only year-round baleen whales that make their home in Gulf of Mexico, and (they) have a unique and very important role in the ecosystem,” said Laura Engleby, a marine mammal biologist with the National Oceanic and Atmospheric Administration fisheries’ service.

A Republican congressman from Florida and a marine mammal scientist in Massachusetts applauded the decision to protect the whales. There probably are about 33 of them in a deepwater area called the DeSoto Canyon, Engleby said. If there are any in the southern Gulf, she said, the total including the known population is probably less than 100.
