Western Pacific Council Makes Recommendations to Keep US Pacific Island Fisheries Viable

October 26, 2018 — SEAFOOD NEWS — The Western Pacific Regional Fishery Management Council concluded its two-day meeting in the Commonwealth of the Northern Mariana Islands (CNMI) this week with recommendations regarding pelagic, international and American Samoa fisheries.

Council discussion centered around keeping healthy, sustainable U.S. Pacific Island fisheries viable amid an accumulation of U.S. regulations and international negotiations.

Billfish Conservation Act and Bigeye Tuna

The Council expressed dismay over the recent amendment to the Billfish Conservation Act of 2012, which bans the interstate commerce of billfish (excluding swordfish) landed by U.S. fishermen in Hawaii and the US Pacific Islands. The billfish stocks caught by Hawaii and U.S. Pacific Island fisheries are healthy, unlike the billfish in the Atlantic, the Western Pacific Council said in a press release.

The bill to amend the Act was introduced and promoted by Congressional delegates and sports fishing organizations from Florida. Recent guidelines from the National Marine Fisheries Service say the billfish landed in the US Territories and Hawaii are also prohibited from being sold in foreign markets. The Council directed staff to develop a list of questions and issues associated with amendment compliance and send them to NMFS for a response.

The Hawaii deep-set longline fishery catches billfish incidentally when targeting bigeye tuna. The amount of bigeye in the Western and Central Pacific Ocean (WCPO) the fishery may retain annually is developed by the Western and Central Pacific Fisheries Commission (WCPFC), an international regional fishery management organization to which the U.S. is a party.

The Council endorsed recent WCPFC’s Permanent Advisory Committee to advise the U.S. commissioners (PAC) majority recommendation to obtain a longline bigeye quota of 6,000 metric tons (mt) at the upcoming WCPFC meeting in December in Honolulu. This amount is slightly less than the amount of bigeye caught in the WCPO in 2016 by Hawaii longline vessels, including those vessels operating under agreements with U.S. Participating Territories. The Council said it will communicate this recommendation to the U.S. Secretary of Commerce Wilbur Ross. The Hawaii longline fleet is the sole fishery that utilizes the U.S. quota, which is currently set at 3,554 mt.

South Pacific Albacore

The Council also endorsed the PAC recommendation that the U.S. position generally be in support of adopting a South Pacific albacore target reference point. The reference point is a catch target that supports economically viable operations and healthy stock biomass. The American Samoa longline fishery, which harvests this stock, has been in decline since 2011. The Council asked NMFS to provide economic evaluations of the fleet’s performance at various target reference points in advance of WCPFC15.

Hawaii Longline Fishery

Among other pelagic and international fishery matters, the Council recommended initial action be taken that would require electronic reporting in the Hawaii longline fishery. The Council will ask NMFS to continue to develop electronic reporting in the Hawaii longline fishery and to work with Hawaii longline participants and Council staff to address several implementation issues and report back to the Council at its March 2019 meeting.

The Council intended to take action regarding the management of loggerhead and leatherback sea turtles in the Hawaii shallow-set longline fishery, which targets swordfish. However, action was postponed as a draft biological opinion due from NMFS on Oct. 1 has not been completed. The Council will reconvene its Scientific and Statistical Committee Working Group when the draft opinion is available. The Council may convene an interim Council meeting, if needed, to review the draft opinion and consider revisions to its June 2018 recommendations, including a possible specification of individual trip limits for leatherback sea turtle interactions.

American Samoa Fisheries

Regarding American Samoa fisheries, the Council recommended an annual catch limit (ACL) of 106,000 pounds for the American Samoa bottomfish species complex for fishing year 2019. The Council noted the next benchmark assessment, which is scheduled for review in February 2019, will provide new information to set the ACLs for fishing years 2020 to 2022. The Council also directed its staff to work with the Council’s American Samoa Advisory Panel to develop a plan for outreach and education, preferably in cooperation with Territory’s Department of Marine and Wildlife Resources, to educate communities on various fisheries and fisheries-related issues.

The Council will reconvene at 11 a.m. on Friday, Oct. 26, at the Hilton at Tumon, Guam.

California Swordfish Fishery Faces Sustainability and Market Pressures Following Driftnet Ban

October 16, 2018 — SEAFOOD NEWS — With the scrawl of Gov. Jerry Brown’s signature and the unanimous backing of both the California State Senate and Assembly, California has officially banned the controversial drift gillnets used to catch swordfish.

Senate Bill 1017, signed into law on Sept. 27, will phase out driftnet fishing over a four-year period that includes both buyouts and incentives for commercial fishermen to revert to gear and practices that result in less bycatch — the dolphins, sea turtles, whales and other species that get entrapped in the nets and sometimes killed while fishing for swordfish and thresher sharks.

Ashley Blacow, Pacific policy and communications manager for Oceana, wrote in a statement, “Ocean waters off California are some of the most productive and ecologically diverse in the world … . Pulling large drift gillnets out of the water for good while transitioning to cleaner gear means countless marine animals will continue to thrive off the California coast and Californians will have access to sustainably, locally caught swordfish.”

There are 20 commercial driftnet boats still operating in the state — a marked decrease from 129 boats in 1994, according to reporting by The Mercury News. The fishing occurs mostly between San Diego and Big Sur. The bill’s buyout program will compensate fishermen $10,000 for their state drift gillnet permit and an additional $100,000 for surrendering their nets.

California is the last state in the nation to allow such drift gillnets.

While the impending ban will probably be looked at as “a defining moment,” according to Geoff Shester, Ph.D., California campaign director and senior scientist at Oceana, “there are still many battles to go.”

Shester pointed to the renewed push from fishermen to make pelagic longline fishing legal again in California. That fishing practice uses hundreds, and sometimes more than 1,000, baited hooks that hang near the water’s surface to catch species like swordfish and tuna. Like driftnets, longline fishing results in significant amounts of bycatch.

“Why take the approach of pick your poison when you don’t have to choose poison?” Shester asked. Instead of indiscriminate fishing practices with high levels of bycatch, Shester hopes fishermen, with the help of government policies and environmental research, will adopt sustainable practices like deep-set buoy gear.

A local scientist, Chugey Sepulveda, Ph.D., director and senior scientist at the Pfleger Institute of Environmental Research (PIER) in Oceanside, came up with the concept for deep-set buoy gear in 2009.

With this method, a fishing line of one to three baited hooks is dropped to the depths where swordfish feed. When there’s a bite on the hook, the buoy on the surface moves, alerting the fishermen. The gear typically consists of up to 10 lines that fishermen monitor in real time.

Sepulveda explained in an email to The Coast News, “The idea was based primarily on our swordfish tagging studies which showed that California swordfish segregate from other bycatch species at depth during the day — they tend to hang out well below the thermocline and feed on deep forage with only occasional surface basking.

“This daily dive pattern seemed like an ideal opportunity for targeting swordfish and avoiding sensitive bycatch like sea turtles and marine mammals, species that predominantly remain within the surface waters.”

Sepulveda worked with PIER research biologist Scott Aalbers to modify typical hook and line methods for a gear design specific to the West Coast that would effectively catch swordfish and greatly reduce bycatch.

According to data from a PIER-led, seven-year study of commercial and experimental deep-set buoy gear trials off California shores, fishing with buoy gear resulted in a catch that was 83 percent swordfish, 12 percent bigeye thresher shark and 98 percent marketable. Non-marketable species, like blue shark and two elephant seals, were released alive.

The swordfish caught was also more profitable, as people will pay a premium for sustainably caught fish that is not mangled and makes it to market faster. Blacow said, “Last year, drift gillnet vessels targeting swordfish made $52,000 per vessel and those vessels targeting swordfish with deep-set buoy gear made $81,000 per vessel.”

Nonetheless, Sepulveda, who is also a fisherman, said deep-set buoy gear “was designed to provide fisherman with an additional opportunity, not to replace one of the few options our local fishermen have.” As such, he explained that commercial fishermen are disappointed by the passage of SB 1017 “as it means that they have one less tool available to harvest local swordfish.”

Sepulveda noted that domestic fisheries are much more regulated than the foreign gillnet and longline operations that the U.S. imports the majority of its swordfish from. Those imports “flood our markets at reduced prices,” Sepulveda wrote, which makes it hard for local fishers to compete.

In response to such concerns, Blacow wrote, “We acknowledge that an array of regulations have been put in place over the years in attempts to clean up the fishery. However, despite gear modifications and special closed areas the fishery continues to have unacceptably high amounts of waste — throwing back more than half of what is caught … . Just because an activity is regulated doesn’t automatically mean that activity should be occurring in the first place.”

Blacow pointed to a 2018 National Marine Fisheries Service study that estimates that “between 2001 and 2016 the California drift gillnet fishery captured 1,602 protected marine species including whales, dolphins, sea lions, sea turtles and seabirds.”

Furthermore, Blacow believes that restricting seafood imports that do not meet U.S. environmental standards would be a step in the right direction in ensuring food sustainability and the livelihoods of U.S. fishermen.

Sepulveda shared similar thoughts, stating, “Our ultimate goal is to enhance domestic sustainable swordfish operations, improve the availability of jobs in the fishing sector while reducing our reliance upon foreign under-regulated and substandard product.”

California bans giant ocean fishing nets blamed for killing sea turtles, whales

September 28, 2018 — Ending years of controversy and debate, Gov. Jerry Brown late Thursday signed a new law phasing out the use of giant ocean fishing nets used to catch swordfish, but blamed for accidentally killing sea turtles, dolphins and other sea creatures.

The bill, SB 1017 by state Sen. Ben Allen, D-Redondo Beach, requires the state to set up a program to buy back nets and fishing permits from commercial fishermen who work in the state’s drift gill net fishery.

The nets — giant nylon curtains that can stretch one mile long and extend 100 feet underwater — are used mostly by fishermen between San Diego and Big Sur. Although they are intended to catch swordfish, thresher shark and opah, studies have shown that they entangle dozens of other marine species, including whales, dolphins, sea lions and sea turtles, fish and sharks. Those animals, known as bycatch, are often thrown back overboard, injured or dead.

“There is no longer room in our oceans for any fishery that throws away more than it keeps,” said Susan Murray, deputy vice president for Oceana, an environmental group with offices in Monterey that pushed for the new law.

MARK HELVEY: Protect California’s Drift Gillnet Fishery

August 24, 2018 — WASHINGTON — California’s drift gillnet (DGN) fishery has come under attack in recent months. One of the most prominent media attacks was a July Los Angeles Times editorial “Dead dolphins, whales and sea turtles aren’t acceptable collateral damage for swordfishing,” which irresponsibly called for the shut down of the fishery. Like many similar critiques, it overlooked the ways DGN fishermen have worked to reduce bycatch and the unintended consequences of shutting down the fishery.

It is first important to note that the DGN fishery operates legally subject to all bycatch minimization requirements in federal law. This includes not just the Magnuson-Stevens Act—the primary federal fishing law—but also the Marine Mammal Protection Act and the Endangered Species Act (ESA). These statutes are precautionary and conservation-minded, and help make U.S. fisheries some of the most environmentally conscious and best managed in the world.

DGN fishermen have collaborated extensively with NOAA’s National Marine Fisheries Service over the years to further reduce bycatch. Since 1990, the fishery has operated an observer program to effectively monitor bycatch. It has deployed devices such as acoustic pingers to ward off marine mammals from fishing gear, has established the Pacific Offshore Cetacean Take Reduction Plan to further reduce marine mammal interactions, and has implemented time/area closures to reduce interactions with endangered sea turtles.

These measures have led to significant progress in reducing bycatch. For example, no ESA-listed marine mammals have been observed caught in the DGN fishery since the 2010-2011 fishing season and no listed sea turtles since the 2012-2013 season.

As mentioned in the Times editorial, there is indeed good news from fisheries deploying new, experimental deep-set buoy gear. But it is just that – experimental, and it is still unclear whether it will become economically viable. And while fishermen hope that it does, the volumes produced won’t make a dent in the over 80 percent of the 20,000 metric tons of swordfish consumed annually in the U.S. that comes from foreign fisheries.

Often missing from the discussion of the drift gillnet fishery is that most foreign fisheries are far less regulated and are much more environmentally harmful than any U.S. fishery. Should the U.S. DGN fishery be shut down, it will only further increase our reliance on this imported seafood. All U.S. fishermen abide by the highest levels of environmental oversight relative to their foreign counterparts, meaning that U.S. caught seafood comes at a fraction of the ecosystem impacts occurring abroad.

Californians need to understand this and help protect U.S. fisheries that are striving to do things the right way. California’s DGN fishermen provide seafood consumers with a local source of sustainably-caught, premium quality swordfish. We should thank them by keeping them on the water.

WPRFMC Managers Recommend Changes to Swordfish Longline Fishery in Light of Turtle Interactions

June 14, 2018 — SEAFOOD NEWS — Federal fishery managers recommended measures to manage sea turtle interactions in the Hawaii shallow-set longline fishery targeting swordfish this week in Hawaii.

The Western Pacific Regional Fishery Management Council recommended amending the Pelagic Fishery Ecosystem Plan (FEP) for the Western Pacific Region to establish a framework that consists of:

a) annual fleet-wide limits on the number of North Pacific loggerhead and leatherback interactions. Once either of these interaction limits is reached, the fishery closes for the remainder of the year; and

b) individual trip interaction limits for loggerhead and leatherback turtles. When a vessel has reached the limit on a trip, the vessel would be required to return to port and may resume shallow-setting upon providing the required 72-hour notice to National Marine Fisheries Service (NMFS) for observer placement.

The North Pacific loggerhead population in Japan has been increasing at about 9 percent annually. Mike Seki, director of NMFS Pacific Islands Fisheries Science Center, characterized the population as “robust.”

NMFS has reinitiated formal consultation under the Endangered Species Act (ESA) for the continued operation of the Hawaii shallow-set fishery. The Council anticipates NMFS will complete consultation and issue a new biological opinion for the fishery by Oct. 31, 2018.

Based upon the current NMFS biological evaluation to support this consultation, the Council anticipates the new opinion will authorize the take of no more than 37 North Pacific loggerheads and 21 leatherbacks. Accordingly, the Council recommended an annual fleet-wide limit of 37 North Pacific loggerheads and 21 leatherbacks, effective Jan. 1, 2019, and an individual trip limit of five North Pacific loggerhead turtles. The Council did not recommend specifying a leatherback turtle trip limit at this time. The effectiveness of the loggerhead turtle trip limit and potential need for leatherback turtle limit would be monitored annually, the Council said in a press release.

At the same time, the Council recommended a sea turtle interaction avoidance pilot program be established utilizing an industry-led fleet communication system. It also requested NMFS conduct further research on the sea turtle issue for this fishery, including research to minimize trailing gear on released loggerhead and leatherback turtles to further reduce post-hooking mortality rates.

Last week, the WPRFMC’s Scientific and Statistical Committee noted the Hawaii shallow-set fleet likely poses less biological risk to turtle populations than other fleets operating in the region, the SSC said in a statement. The industry and managers have recognized this in the past, when lawsuits forced the swordfish fishery to close completely or for part of the year.

The Hawaii Longline Association, NMFS and Turtle Island Restoration Network and other plaintiffs agreed to a settlement agreement in May to close the Hawaii shallow-set longline fishery for the rest of this year.

Hawaii vessels must adhere to numerous regulatory measures, such as the interaction caps, mandatory observers on all trips to monitor protected species interactions, mandatory use of circle hooks and mackerel-type bait to reduce the risk of hooking sea turtles and mandatory equipment for and training in the safe release of live turtles — some other countries do not adhere to such strict regulatory measures.

The SSC also noted that North Pacific loggerhead nesting beach trends in Japan were much higher in the last decade than in previous years.

California State Senate votes to ban driftnets for swordfishing

June 8, 2018 — California has taken a key step in its effort to ban the use of drift gillnets and transition to a swordfish and thresher shark fishery that conservation groups claim would reduce the amount of bycatch.

Last week, the California State Senate voted 32-0 to prohibit the use of the large nets by 2023. The bill, sponsored by state Sen. Ben Allen (D-Santa Monica), also would compensate fishermen for their nets and provide incentives for them to purchase gear that is less likely to ensnare turtles, dolphins, and other marine life.

California is currently the only state in the country that allows driftnets for swordfish and thresher shark fishing off its coast.

“I am pleased the approach taken in SB 1017 to phase out the use of this damaging equipment earned broad bipartisan support in the Senate today,” Allen said. “I look forward to continuing to work with stakeholders on a plan that protects marine life while being fair to everyone involved.”

According to conservation groups, driftnets can kill or injure up to 70 different species. Fishermen deploy the mile-long nets overnight.

“We have been working to reduce the devastating and cruel impact of this driftnet fishery on whales, dolphins, and sea turtles for 20 years, and passage of this legislation will go a long way toward making the Pacific Ocean safer for endangered marine wildlife,” said Todd Steiner, biologist and executive director of Turtle Island Restoration Network.

Smart Software Helps Fishermen Catch the Fish They Want, Not Endangered Species

June 6, 2018 — In the ocean, everything moves. Waves push around vast swaths of saltwater, tides ebb and flow, and over time tectonic rumblings transform the seafloor. With all that movement, marine life travels as well—making the oceans one of the most dynamic ecosystems on Earth. This constant shuffling can make it hard to predict where a particular marine species might be on any given day. But that is exactly what Elliott Hazen, a fisheries scientist from the National Oceanic & Atmospheric Association (NOAA), is trying to do through new modeling software.

Hazen and a team of other fisheries scientists developed EcoCast in an effort to reduce the unintended bycatch of protected marine species while supporting sustainable fisheries; their results were published last week in Science Advances. EcoCast is already being used to allow fishermen exemptions to fish in certain protected areas in California, and NOAA is working on a smartphone app that will give fishermen this dynamic data in real-time.

The team focused on the California Drift Gillnet (DGN) fishery, which targets broadbill swordfish along the U.S. West Coast. The fishery, which has declined in recent years, only brought in 176 metric tons of swordfish in 2017—down from a historical high of 2,198 metric tons in 1985. DGN fishermen use mesh nets that float vertically in the water to catch the swordfish, but the nets often trap additional species—a phenomenon known as bycatch—including the critically endangered Pacific leatherback sea turtle, blue sharks, and California sea lions.

It’s not just an issue of protecting endangered species, explains Gary Burke, a fisherman in California and a member of the Commercial Fishermen of Santa Barbara. “Fishermen don’t want bycatch. It breaks our gear and it’s expensive. So, we like to avoid it.”

EcoCast takes an array of oceanographic variables into account to generate a fluid map that highlights areas where fishermen are likely to find high concentrations of their target species and not the protected species they don’t want to catch.

Hawaii Longline Swordfish Fishery Closed for Rest of Year; Industry Helped Negotiate Closure

May 15, 2018 — SEAFOOD NEWS — In the ups and downs of the Hawaiian swordfish fishery, the recent May 8 closure for the rest of the year was no surprise to the industry. Longliners worked with the National Marine Fisheries Service and plaintiffs of a recent lawsuit to comply with a court order.

The Turtle Island Restoration Network, Center for Biological Diversity and Earthjustice originally sued the Department of Commerce over a 2012 biological opinion that allowed the shallow set longline fishery to take a certain number of loggerhead and leatherback sea turtles every year. The U.S. District Court of Hawaii ruled in NMFS’ favor, so the ENGOs appealed. The U.S. Ninth Circuit Court of Appeals issued a split decision on Dec. 27, 2017, affirming the BiOp regarding leatherback sea turtles, but not for loggerhead turtles. The Hawaii Longline Association, which filed as interveners, were party to the settlement negotiations with the plaintiffs and NMFS, which were outlined in a May 4, 2018 agreement and court order. The result for 2018 was closure for the rest of the year.

While ENGOs are cheering the outcome as a victory for sea turtles, it’s somewhat of a pyrrhic victory and does more to promote an agenda for the plaintiffs rather than have any actual effect this year.

“The National Marine Fisheries Service, which is supposed to be protecting our wildlife, has instead been illegally helping the longliners push sea turtles to the brink of extinction,” Earthjustice attorney Paul Achitoff said in a press release. “We won’t allow it.”

The main swordfish season usually takes place in the winter, with most landings occurring by the end of March. This year was an anomaly, Hawaii Longline Association President Sean Martin said, in that the fishery reached its annual limit of turtle interactions in January, so the fleet was already done with swordfish for the year.

“We’re on the tail end of what would be the prime season anyway,” Martin said.

The fishery will open again on Jan. 1, 2019, no matter what, Martin said. Since the court vacated the 2012 biological opinion, NMFS is working on a new one. The agency could come back with a new incidental take statement for next year’s fishing season. Or, if the BiOp and corresponding take statement are not finished by Jan. 1, the fishery will open under an incidental take allowance approved by an earlier BiOp that allowed roughly half the number of turtle interactions as the 2012 BiOp.

Federal officials note the loggerhead turtles already show signs of recovery due to a history of better management measures, such as circle hooks and using mackerel for bait — squid bait is prohibited –has proven immensely effective worldwide. Most turtles caught in the fishery are released alive.

Those measures and more, implemented in the early 2000s, reduced sea turtle interactions in the fishery by 93 percent, the Council said. Observer coverage is 100 percent; all vessel owners and operators annually attend mandatory protected species workshops; all longline vessels are required to carry specified tools to safely remove hooks and lines from the turtles and to follow safe handling, resuscitation and release procedures; vessels are monitored through a mandatory satellite-based vessel monitoring system; and longline closed areas from 0 to 50 nautical miles of the main and Northwestern Hawaiian Islands have existed since the early 1990s.

“The record of 99 percent live releases, only two mortalities in 24 years and increasing loggerhead abundance over the past two decades underscore the management success of the Hawaii shallow-set longline fishery,” Council Executive Director Kitty M. Simonds said in a press release.

Martin said most of the 30 or so longline vessels will instead turn to the deep-set longline fishery for the remainder of the year, targeting tunas.

Hawaii swordfish industry shut down to protect endangered turtles

May 11, 2018 — A federal court order to protect endangered loggerhead sea turtles has forced the National Marine Fisheries Service to immediately close the shallow-set longline fishery in Hawaii for the rest of the year.

A 2012 lawsuit filed by the Turtle Island Restoration Network and the Center for Biological Diversity, represented by the nonprofit law firm Earthjustice, was rejected in a Hawaii district court but they eventually won a split decision on appeal in December.

The parties reached an agreement Friday to settle the case. It included an immediate shutdown of the shallow-set longline fishery, which targets swordfish. NMFS implemented the closure Thursday.   

“The National Marine Fisheries Service, which is supposed to be protecting our wildlife, has instead been illegally helping the longliners push sea turtles to the brink of extinction,” Earthjustice attorney Paul Achitoff said in a news release.
