US fishing vessels now have permanent waiver from incidental discharge rule

December 10, 2018 — When U.S. President Donald Trump signed the Frank LoBiondo Coast Guard Authorization Act into law last week, it finally – and permanently – relieved the fishing industry from Environmental Protection Agency regulations regarding incidental discharge on their boats.

The regulation required vessel operators to get EPA permits to perform routine actions, such as using pumped ocean water to clean off the deck after harvesting. It stemmed from a 2005 federal court ruling, and the Southern Shrimp Alliance said the system was a hindrance to more than 80,000 commercial fishing boats.

“This permit requirement should never have existed,” said John Williams, SSA’s executive director. “It was lawsuit driven by environmental groups in a California court a long time ago. SSA has been working ever since with Congress and other fishing groups across the nation to put a temporary stop to it. I have to say, after working to prevent this disaster for more than a decade, it feels pretty good to finally put this one to bed, permanently.”

Sustainable Shark Fisheries and Trade Act Receives Broad, Growing Support

May 21, 2018 — A growing coalition of industry groups, conservationists, scientists, and other stakeholders are rallying behind a bill that promotes global shark conservation, while protecting responsible U.S. fishermen. The bill, Sustainable Shark Fisheries and Trade Act, is undergoing a markup before the Senate Commerce committee on Tuesday, May 22. Similar, bipartisan legislation from Rep. Daniel Webster (R-FL) and Rep. Ted Lieu (D-CA) is under consideration in the House.

Introduced by Senators Marco Rubio (R-FL) and Lisa Murkowski (R-AK), the bill would require that all countries exporting shark fins to the U.S. receive certification that their shark fisheries have an effective ban on the practice of shark finning, and adhere to sustainable management practices like those in U.S. fisheries. The new certification program would be similar to the existing U.S. shrimp certification program.

The United States has been praised for having among the strictest and most conservation-minded shark management in the world; all shark species are required to be harvested at sustainable rates, and the practice of shark finninghas long been banned.

The bill’s approach to conservation, which would preserve the jobs of responsible, law-abiding shark fishermen in the U.S. while promoting a high standard of shark conservation abroad, has won support from a broad cross-section of shark fishery stakeholders, including the Sustainable Shark Alliance. It is joined in its support by leading conservation groups, such as the Wildlife Conservation Society; shark experts at the Mote Marine Laboratory; 62 leading shark scientists; recreational fishing organizations such as the American Sportfishing Association, the Center for Sportfishing Policy, and the Coastal Conservation Association; the Florida Fish and Wildlife Conservation Commission; and the Diving Equipment and Marketing Association.

“The Sustainable Shark Fisheries and Trade Act allows the United States to continue its role as a global leader in shark conservation and management,” says Shaun Gehan, a representative for the Sustainable Shark Alliance. “Unlike other bills that would ban the sale of shark fins outright, this bill maintains our own rigorous conservation standards, while allowing U.S. fishermen to maintain their livelihoods by responsibly utilizing every part of the shark.”

Sustainable Shark Alliance Condemn Fin Ban, Push For Sustainable Shark Fisheries and Trade Act

April 18, 2018 — SEAFOOD NEWS — Should shark fin sales be banned in the U.S.? That’ the current debate.

On Tuesday members of the Sustainable Shark Alliance (SSA) testified before the House Natural Resources Subcommittee on Water, Power and Oceans to support legislation that would promote shark conservation and oppose the Shark Fin Sales Elimination Act.

As we previously reported, chefs and restaurant owners from over 30 states have sent a letter to Congress asking that they pass the Shark Fin Trade Elimination Act of 2017, which would ban the trade of shark fins nationwide. Shark finning is often cruel and wasteful, with some fishermen discarding the sharks at sea after cutting off their fins. Those sharks often drown, bleed to death, or get eaten alive by other fish.

The SSA is supporting the Sustainable Shark and Fisheries Trade Act (SSFTA), which would “incentivize” other nations to meet the same high standards of sustainability that U.S. shark fishermen follow.

“The SSFTA creates an incentive for other nations to end shark finning and meet the same high standards for marine conservation which the United States holds its fishermen,” SSA member and fisherman John Polston told the House Natural Resources Committee. “This bill recognizes the sacrifices our fishermen have made, and continue to make, to rebuild domestic shark populations by leveling the playing field with our foreign competitors.”

Dr. Robert Hueter, Director of the Center for Shark Research at Mote Marine Laboratory, added that the SSFTA would stop the importing and consumption of unsustainably fished shark on American soil, but not completely ban the sale of shark fins. The argument is that banning the sale of shark fins hurts U.S. fishermen who sustainably harvest and sell shark fins and other shark products.

“This bill punishes me and others in the shark fishery by taking away an important income source, undoubtedly pushing some small businesses into unprofitability,” said Polston. “It is an insult to American fishermen who have been required to give so much for decades to create a sustainable fishery.”

SSA Member to House Subcommittee: Sustainable Shark Bill Recognizes Sacrifices of U.S. Fishermen, Fin Ban Undermines Them

At a House Natural Resources subcommittee hearing today, John Polston, a fisherman and member of the Sustainable Shark Alliance (SSA), testified in support of legislation that would promote shark conservation by incentivizing other nations to meet the same high standards of sustainability as U.S. shark fishermen.

In testimony before the House Natural Resources Subcommittee on Water, Power and Oceans, Mr. Polston, owner of King’s Seafood in Port Orange, Florida, praised the Sustainable Shark Fisheries and Trade Act (SSFTA) as a “proactive bill that levels the playing field for American fishermen.” The bipartisan legislation, introduced last month by Rep. Daniel Webster (R-FL) and a group of six Democrats and Republicans, would create a formal and transparent certification program for countries importing shark products into the United States. Nations would be required to prove that they have an effective prohibition on shark finning, and management policies comparable to those in the United States.

“The SSFTA creates an incentive for other nations to end shark finning and meet the same high standards for marine conservation to which the United States holds its fishermen,” Mr. Polston said. “This bill recognizes the sacrifices our fishermen have made, and continue to make, to rebuild domestic shark populations by leveling the playing field with our foreign competitors.”

Mr. Polston was joined in his support for the SSFTA by Dr. Robert Hueter, director of the Center for Shark Research at Mote Marine Laboratory in Sarasota, Florida, who served as a scientific reviewer for the legislation.

“The SSFTA will give the American people an effective tool to say, ‘No longer will we allow the import and consumption of unsustainably fished shark and ray products on American soil. Our participation as consumers in this practice ends now,’” Dr. Hueter said. “The bill does this without punishing American fishers who are conducting legal and sustainable shark fishing, providing a model of responsible management and conservation for the rest of the world.”

Mr. Polston and Dr. Hueter also expressed their opposition to another shark bill discussed at the hearing, the Shark Fin Sales Elimination Act, introduced by Rep. Ed Royce (R-CA). This legislation would ban the domestic sale of all shark fins, including responsibly and sustainably caught American shark fins.

“This bill punishes me and others in the shark fishery by taking away an important income source, undoubtedly pushing some small businesses into unprofitability,” Mr. Polston said. “It is an insult to American fishermen who have been required to give so much for decades to create a sustainable fishery.”

Alan Risenhoover, director of NOAA Fisheries’ Office of Sustainable Fisheries, voiced similar criticisms of the Shark Fin Sales Elimination Act.

“This bill does not meet its intent to improve the conservation and management of domestically harvested sharks,” Mr. Risenhoover said. “It prohibits the possession and sale of shark fins. This would hurt U.S. fishermen who currently harvest and sell sharks and shark fins in a sustainable manner under strict federal management.”

Sustainable Shark Alliance, Southeastern Fisheries Association Applaud Florida Law Cracking Down on Illegal Shark Finning

May 25, 2017 — The following was released today by the Sustainable Shark Alliance and the Southeastern Fisheries Association:

The Sustainable Shark Alliance (SSA) and the Southeastern Fisheries Association (SFA) applaud the State of Florida, Governor Rick Scott, and the Florida Legislature for passing a new law strengthening prohibitions against the illegal act of shark finning. The bill was passed unanimously by both chambers of the Florida Legislature and signed into law yesterday by Gov. Scott. It will take effect beginning in October.

The legislation raises existing fines and penalties for shark finning, which has been illegal under federal law for decades, and codifies a Florida Fish and Wildlife Conservation Commission rule prohibiting this practice. Anyone caught removing shark fins before the shark has been landed at the dock will be subject to escalating punitive measures, such as fines and suspended permits, that culminate in a loss of all Florida fishing license privileges for a third offense.

“The SSA is grateful to Florida’s lawmakers for taking an approach that both protects sharks and allows law-abiding fishing families to continue to earn a living,” said Shaun Gehan, an attorney for the SSA. “This is the right way to eliminate shark finning and promote shark conservation. While some have proposed measures that would totally eliminate the sustainable harvest of sharks, Florida is showing why U.S. shark fisheries continue to be the gold standard around the globe.”

As originally introduced, the bill would have completely eliminated the sale and trade of shark fins in Florida. But after industry and the Florida Fish and Wildlife Conservation Commission presented facts about how Florida’s commercial fishermen responsibly land and harvest sharks, the bill was altered to specifically target those engaged in illegal shark finning. It was introduced in the Florida Senate by Sen. Travis Hutson, where it passed 39-0, and in the Florida House by Reps. Joe Gruters and Alex Miller, where it passed 115-0.

“This bill started out bad but ended up good, because lawmakers listened to their constituents and listened to the science,” said SFA Executive Director Bob Jones. “Our commercial fishermen catch the whole shark in a process that is rigorous and transparent. We despise anyone that would take any kind of animal and cut part of it off and just throw the rest away. That’s immoral and that’s wrong.”

Butchered shark fins seized from shrimp boat off Key West

April 4, 2017 — Florida wildlife officers made a grisly discovery aboard a Key West shrimp boat this week: dozens of pairs of dismembered shark fins.

The boat was discovered about 20 miles north of the island Wednesday night, an indication that illegal finning still occurs in Florida waters despite being banned more than 16 years ago. Buying and selling fins also remains legal in most states, fueling a practice that targets some of the world’s biggest and longest-lived sharks that are also among the planet’s oldest species.

“When we import them we have no idea if they came from sustainable shark fisheries or fisheries where they’re still finning,” said Mariah Pfleger, a scientist for Oceana, which is pushing a bill to ban the trade.

The boat was stopped by Florida Fish and Wildlife Conservation Commission officers who alerted the National Oceanic and Atmospheric Administration Fisheries Service. FWC referred questions to NOAA and NOAA declined to release details, saying it was too soon in the investigation.

However, Oceana reported that officers found between 30 and 40 pairs of fins. NOAA Fisheries is continuing to investigate and no charges have been filed, spokeswoman Kim Amendola said in an email.

The Sustainable Shark Alliance (SSA), a coalition of shark fishermen and dealers along the Gulf and Atlantic coasts, applauds Florida Fish and Wildlife Conservation Commission efforts to combat unlawful shark finning in a reported enforcement action involving a Key West shrimp boat. Such alleged unlawful activities, where a shark’s fins are removed and its carcass is discarded, harm the legal and federally permitted shark trade by U.S. fishermen laboring under conservative catch quotas and strict anti-finning laws.

Shark finning has long been illegal, and shark finning in the United States is extremely rare. Given the frequency of at-sea and dockside enforcement inspections, this violation is clearly an outlier.

The SSA strongly urges state and federal law enforcement agencies to remain vigilant in their efforts to eliminate illegal activities, including identifying the would-be buyers and ultimate customers for the fins. The legal shark fishery is closely monitored: harvesters must report catches of individual sharks and total amounts landed, and buyers must have federal permits and report all sharks purchased to the federal government. Exports are also reported, though the SSA supports enhancing the system for tracking shark fins after they leave the dock.

“This reprehensible activity harms law-abiding U.S. fishermen,” said Shaun Gehan, attorney for the SSA. “While some groups will use this unfortunate incident to push an agenda of banning fin sales, the fact is such laws will not dissuade criminals as would meaningful penalties such as those now before the Florida Legislature.” Nearly all fins harvested in the United States are exported to China.

The ability to sell fins is essential to the economic survival of SSA members. On average, fins account for fifty percent of the value of the landed catch. Given restrictive harvest limits and the costs associated with operating fishing vessels, loss of fin income would make it unprofitable for the fishery to continue. This would harm U.S. fishermen and their communities, while boosting profits for foreign fishermen not subject to the same strict conservation laws and oversight.

Sharks are managed by the National Marine Fisheries Service (NMFS) under a very restrictive quota system that has been in place since the mid-1990s. As a result, populations of large and small sharks have been sharply increasing. In its last survey, NMFS found the most sharks in the survey’s 29-year history, 65 percent more than the one prior. Given the success of domestic shark management, efforts to ban fin sales have been opposed by fishery managers and leading scientists specializing in sharks.
