More absurdness from the North Carolina Division of Marine Fisheries

December 31, 2015 — On January 1 we will have imposed on commercial fishermen (those who fish with nets) and people who like fresh seafood bought either from the local fish market or prepared in a local restaurant an example of the worst kind of government. That is, the imposition of regulations for the sake of regulation, without valid or reliable science or even common sense. The Division of Marine Fisheries will impose absurd regulations on the catching of flounder in North Carolina’s coastal waters.

The purpose of the regulations, plus the mission of the DMF in general in recent years, could be said to extinguish commercial fishing in the state’s waters.

DR. RAY HILBORN: Plenty of Sustainable Seafood Options Available

December 28, 2015 — The rising trend of “trash fish,” or unusual and underutilized seafood species, on fine dining menus in New York City was discussed last week in The New York Times by Jeff Gordinier. The idea is to, “substitute salmon, tuna, shrimp and cod, much of it endangered and the product of dubious (if not destructive) fishing practices,” with less familiar species that are presumably more abundant, like “dogfish, tilefish, Acadian redfish, porgy, hake, cusk, striped black mullet.”

Changing diners’ perceptions isn’t always easy, especially about seafood, but there is certainly momentum building for more diverse seafood species. Seafood suppliers are reporting record sales of fish like porgy and hake. Chefs feel good about serving these new species because, “industrially harvested tuna, salmon and cod is destroying the environment.” A new organization, Dock-to-Dish, connects restaurants with fishermen that are catching underutilized species and these efforts are highlighted as a catalyst for this growing trash fish trend. From a culinary perspective, this trend allows chefs to sell the story of an unusual and sustainable species, which more compelling than more mainstream species like tuna, salmon or cod. From a sustainability perspective, Gordinier implies that serving a diversity of seafood species is more responsible than the mainstream few that are “industrially caught” and dominate the National Fisheries Institute list of most consumed species in America.

While I applaud the desire to eat underutilized species, it seems as if the chefs interviewed don’t know much about sustainable seafood. Below are a few quotes from the article that give the impression that eating traditional species such as tuna, cod, salmon and shrimp is an environmental crime.

“Salmon, tuna, shrimp and cod, much of it endangered and the product of dubious (if not destructive) fishing practices”

“The chef Molly Mitchell, can’t imagine serving industrially harvested tuna or salmon or cod. “You can’t really eat that stuff anymore,” she said. “It’s destroying the environment.”

“Flying them halfway around the world may not count as an ecofriendly gesture, but these oceanic oddities are a far cry from being decimated the way cod has. “Hopefully they’ll try something new and not just those fishes that are overfarmed and overcaught,” said Jenni Hwang, director of marketing for the Chaya Restaurant Group.”

“A growing cadre of chefs, restaurateurs and fishmongers in New York and around the country is taking on the mission of selling wild and local fish whose populations are not threatened with extinction.”

FDA must develop plan to label genetically engineered salmon, Congress says

December 17, 2015 — The sprawling federal spending bill unveiled this week on Capitol Hill included a small passage with potentially big implications in the food world.

In two paragraphs on page 106, lawmakers instructed the Food and Drug Administration to forbid the sale of genetically engineered salmon until the agency puts in place labeling guidelines and “a program to disclose to consumers” whether a fish has been genetically altered. The language comes just a month after FDA made salmon the first genetically modified animal approved for human consumption and represents a victory for advocates who have long opposed such foods from reaching Americans’ dinner plates. At the very least, they say, consumers ought to know what they are buying.

The fish in the spotlight is the AquAdvantage salmon, produced by Massachusetts-based AquaBounty. The Atlantic salmon contains a growth hormone from a Chinook salmon and a gene from the ocean pout — a combination to help it grow large enough for consumption in 18 months instead of the typical three years.

Congressional GMO Labelling Fight Set For January

December 17, 2015 — Lawmakers are pledging to re-double efforts to pass legislation early next year to block state GMO labeling laws and set national disclosure standards.

The industry wanted to get a bill attached to the must-pass fiscal 2016 spending agreement that congressional leaders reached on Tuesday, but talks stalled and Senate Democrats stopped even a temporary preemption measure from being included.

“The clock’s ticking. We’ll be back in session in January and that’s got to be at the front,” said House Agriculture Chairman Mike Conaway, R-Kansas. “We’ve got it fixed in the House. We’ve just to get the Senate to move on it.”

Michigan Sen. Debbie Stabenow, the top Democrat on the Senate Agriculture Committee, has also pledged to make the issue a top priority in January. She had been leading negotiations on the legislation this fall and had said in October that she wanted a bill passed by the end of the year.

An industry lobbyist who didn’t want to be quoted by name said negotiations would “begin in earnest” right after the first of the year on broad legislation.

A Vermont labeling laws is set to take effect in July, and the failure of the federal preemption measure could embolden labeling proponents who are gearing up to push next year for labeling laws in New York state and Connecticut, said Patty Lovera, assistant director of Food and Water Watch, which supports the state labeling efforts.

Sen. Maria Cantwell Secures Key Provisions to Protect Pacific Northwest Seafood

December 15, 2015 — The following was released by the Office of Senator Maria Cantwell:

U.S. Senator Maria Cantwell today announced that her bipartisan bill—which will change the market name of “Alaska pollock” to “pollock”—will be included in the Congressional spending bill, also known as the ‘omnibus.’ The bill will legally change the acceptable market name essentially outlawing Pollock harvested in Russia from being passed off as “Alaskan Pollock” in the supermarket. Representative Jamie Herrera Butler (WA-3) sponsored the bill in the House.

In 2012, 113 million pounds of Russian Pollock—which is less sustainable and lower quality than pollock from Alaskan fisheries—was sold to U.S. consumers as “Alaska pollock.” 

“Alaskan pollock is one of the most sustainable fisheries in the world,” said Cantwell, a senior member of the Commerce Committee, “And American consumers deserve to know whether they are purchasing this high quality product or a cheap alternative with a misleading label. By changing the acceptable market name to pollock, it will be illegal to label pollock caught in Russia, as Alaskan. Americans will be able to shop with confidence, knowing that they are buying the real thing and not a knock–off.”  

The Genuine Alaska Pollock Producers (GAPP) supports these efforts and have previously cited several reasons for the requested change:                          

• The use of “Alaska pollock” as an acceptable market name is misleading to consumers;

•“Alaska pollock” is understood by consumers to connote a geographic origin, not a particular kind of food from any geographic origin;

• The use of “Alaska pollock” as an acceptable market name is inconsistent with other similar fish species; and

• U.S. government programs support other efforts to provide accurate information to consumers about the seafood they purchase.

Gulf Seafood Institute’s President Harlon Pearce Appointed to NOAA’s Marine Fisheries Advisory Committee

December 15, 2015 — Secretary of Commerce Penny Pritzker has appointed Gulf Seafood Institute’s President Harlon Pearce, along with three other new advisors, to the National Oceanic and Atmospheric Administration’s (NOAA) Marine Fisheries Advisory Committee. The Marine Fisheries Advisory Committee (MAFAC) advises the Secretary on all living marine resource matters currently the responsibility of the Department of Commerce.

According to NOAA, the expertise of MAFAC members is used to evaluate and recommend priorities and needed changes in national programs and policies, including the periodic reauthorization of the Magnuson-Stevens Act, Endangered Species Act and Marine Mammal Protection Act. The members represent a wide spectrum of fishing, aquaculture, protected resources, environmental, academic, tribal, state, consumer, and other related national interests from across the U.S., and ensure the nation’s living marine resource policies and programs meet the needs of these stakeholders.

As owner and operator of Harlon’s LA Fish in New Orleans, a seafood processing and distribution company, Pearce has more than 46 years of experience in the seafood industry.  He has been an advocate for developing strong and viable seafood industries, a “go to” source for the media and seafood events, and a guest speaker and lecturer.

A tireless spokesperson for Gulf seafood, he was instrumental in the foundation of the Gulf Seafood Institute, which advocates on behalf of the entire Gulf seafood community. Pearce previously served for nine years as the Louisiana Representative on Gulf of Mexico Fisheries Management Council and for 11-years was Chairman of the Louisiana Seafood Promotion and Marketing Board, a tenure which spanned both the devastating hurricane season of 2005 and the BP Deepwater Horizon Oil Spill.

NOAA Awards Funding for Research Projects to Study Climate Impacts on Fish and Fisheries

December 15, 2015 — The following was released by NOAA Fisheries:

Seven projects to increase understanding and response to climate-related impacts on living marine resources

Following release of the  NOAA Fisheries Climate Science Strategy, today the agency announced $5 million in new research funding to study the impacts of climate change on fish and fisheries of the Northeast Shelf Large Marine Ecosystem. The funds, which will be distributed over the next two to three years, will support seven new projects designed to increase our understanding of how climate change can affect fish stocks, fisheries, and the communities that depend on them for their livelihood.

“Warmer coastal and ocean waters and ocean acidification are already affecting our nation’s fisheries,” said NOAA Fisheries chief science advisor Richard Merrick, Ph.D. “NOAA is working to ensure the resilience of healthy, productive fisheries that are essential to U.S. coastal communities. Sustainable fisheries create jobs, stabilize coastal economies, enhance commerce, and help to meet the growing demand for seafood.” 

NOAA Research’s Climate Program Office and NOAA Fisheries Office of Science and Technology funded the projects through a competitive process and include collaborations between NOAA and academic scientists. In addition, these projects support the Administration’s Priority Agenda for Enhancing the Climate Resiliency of America’s Natural Resources.

Six projects support research to understand and respond to climate impacts on fish and fisheries in the Northeast Shelf Large Marine Ecosystem and the seventh will support a workshop focused on ecosystem tipping points in the North Pacific.

Global Supermarkets Selling Shrimp Peeled by Slaves

December 13, 2015 — SAMUT SAKHON, Thailand (AP) — Every morning at 2 a.m., they heard a kick on the door and a threat: Get up or get beaten. For the next 16 hours, No. 31 and his wife stood in the factory that owned them with their aching hands in ice water. They ripped the guts, heads, tails and shells off shrimp bound for overseas markets, including grocery stores and all-you-can-eat buffets across the United States.

After being sold to the Gig Peeling Factory, they were at the mercy of their Thai bosses, trapped with nearly 100 other Burmese migrants. Children worked alongside them, including a girl so tiny she had to stand on a stool to reach the peeling table. Some had been there for months, even years, getting little or no pay. Always, someone was watching.

No names were ever used, only numbers given by their boss — Tin Nyo Win was No. 31.

Pervasive human trafficking has helped turn Thailand into one of the world’s biggest shrimp providers. Despite repeated promises by businesses and government to clean up the country’s $7 billion seafood export industry, an Associated Press investigation has found shrimp peeled by modern-day slaves is reaching the U.S., Europe and Asia.

The problem is fueled by corruption and complicity among police and authorities. Arrests and prosecutions are rare. Raids can end up sending migrants without proper paperwork to jail, while owners go unpunished.

More than 2,000 trapped fishermen have been freed this year as a result of an ongoing Associated Press investigative series into slavery in the Thai seafood industry. The reports also have led to a dozen arrests, millions of dollars’ worth of seizures and proposals for new federal laws.

Lawsuit plaintiffs: Groundfish observer funding rule will ‘basically destroy industry overnight’

December 11, 2015 — A lawyer representing fishermen suing the federal government over a forthcoming requirement that they pay for the cost of bringing at-sea observers on their boats estimates that “more than half” of the US east coast groundfishermen will go out of business if the new rule takes effect.

Speaking to reporters on Dec. 10 about a lawsuit filed that day against the National Oceanic Atmospheric Administration (NOAA) and the US Department of Commerce, attorney Stephen Schwartz estimated that the rule change would “basically destroy the industry overnight”.

“That’s the fishermen with downstream effects on the crews, on buyers and sellers of seafood, on restaurants with kind of rippling effects throughout the entire economy of New England,” he said.

Schwartz works for Cause of Action, a non-profit Washington, D.C.-based legal advocacy group that is representing New Hampshire groundfisherman

David Goethel as well as the non-profit industry group Sector XIII  filed suit in federal court alleging that a NOAA requirement that groundfishermen begin paying for the cost of at-sea observers on Jan. 1 — a cost that NOAA has previously borne itself — violates existing federal laws including the Magnuson-Stevens Act.

According to Sector XIII manager John Haran, the at-sea observer funding rule will accelerate the decline of the east coast groundfish industry, which has already been in decline for years, he said.

Goethel, who operates a small dayboat from New Hampshire waters, agreed.

“We can not afford to pay for this. It’s that’s simple. I would ask everybody on the call, could you afford to pay $710 to pay for someone to ride to work with you everyday. We can’t either,” Goethel said.

Haran added fishermen are not clear why the cost for the at-sea observers is so high.

“The actual observer, the person on the boat gets paid between $15 and $20 per hour. How they get to $710 from there is one of the great mysteries of this whole program,” he said. “The fishermen are expected to pay for the observers’ training, for observer company overhead, for observer company profit even though we don’t know what that profit is.”

NOAA has defended the program arguing that it needs the information provided by the observers, but doesn’t have the resources to fund it itself.

Overfishing is Getting Filleted by Markets

December 9, 2015 — Overfishing is a serious threat to the nearly 200 million people who depend on the world’s oceans for sustenance. After all, nearly one in five people around the world consume fish as their primary source of protein and overfishing has deleterious cascade effects on other marine ecosystems.

Illegal and excessive fishing are to a degree inevitable because oceans, rivers and many lakes are publicly administered. This gives fishermen an incentive to take from them as much as is legally possible. Yet, market-based resource management is offering a concrete solution to this “tragedy of the commons” and has already begun alleviating strains on U.S. fish stocks.

The U.S. economy is intertwined with the fate of the high seas. By conservative estimates, commercial and recreational fishing alone account for 1.3 million jobs and nearly $60 billion in economic activity. Overfishing has pernicious effects on Americans’ livelihoods: commercial anglers can lose out on up to 80 percent of potential revenue when local fish species see drastic population decline, as was the case in New England when cod, flounder, and halibut populations were unexpectedly low in 2009.

With market-based resource management, data from September 2015 show that the total number of wild stocks placed on the “overfishing” watch list has fallen to its all-time lowest level since 1997. Since the 2007 reauthorization of the Magnuson-Stevens Act, annual catch limits (ACLs) have allowed the National Oceanic and Atmospheric Administration (NOAA) to reduce the number of overfished U.S. stocks by nearly 75 percent since 2007 alone (from 41 in 2007 to only 10 in 2014). ACLs create total tonnage allotments based on a series of population growth factors specific to certain fish species.
