Groundfish: NEFMC Takes Final Action on Framework 69 With Catch Limits for Four New Atlantic Cod Stock Units

December 10, 2024 — The following was released by the New England Fishery Management Council:

The New England Fishery Management Council took final action on Framework Adjustment 69 to the Northeast Multispecies (Groundfish) Fishery Management Plan when it met in Newport, Rhode Island December 3-5, 2024. The framework contains catch limits and management measures for the 2025 fishing year and beyond.

The Council received three reports before beginning its decision-making on Framework 69:

  • The Northeast Fisheries Science Center presented the peer-reviewed results of 2024 Management Track Stock Assessments for American plaice, pollock, witch flounder, Atlantic halibut, Georges Bank haddock, and Gulf of Maine haddock;
  • The Scientific and Statistical Committee (SSC) presented overfishing limit (OFL) and acceptable biological catch (ABC) recommendations for each of those newly assessed stocks; and
  • The Transboundary Management Guidance Committee (TMGC) presented recommendations for U.S./Canada shared groundfish resources on Georges Bank.

Groundfish: NEFMC Initiates Framework Adjustment 65 with Specifications, Rebuilding Plans, and Management Measures

April 22, 2022 — The following was released by the New England Fishery Management Council:

The New England Fishery Management Council initiated Framework Adjustment 65 to the Northeast Multispecies Fishery Management Plan when it met April 12-14, 2022 for a hybrid meeting in Mystic, CT. The framework will contain the following components:

  • Revised status determination criteria specifying when overfishing is occurring or a stock is overfished;
  • Revised rebuilding plans for Gulf of Maine cod and Southern New England/Mid-Atlantic winter flounder;
  • Fishing year 2023 and 2024 total allowable catches for the U.S./Canada management units of Eastern Georges Bank cod and Eastern Georges Bank haddock, as well as Georges Bank yellowtail flounder;
  • Fishing year 2023 and 2024 specifications for Georges Bank yellowtail flounder and Georges Bank cod, including a cod catch target for the recreational fishery;
  • Fishing year 2023, 2024, and 2025 specifications for 14 groundfish stocks – Georges Bank haddock, Gulf of Maine haddock, Cape Cod/Gulf of Maine yellowtail flounder, Southern New England/Mid-Atlantic yellowtail flounder, Georges Bank winter flounder, Gulf of Maine winter flounder, Southern New England/Mid-Atlantic winter flounder, American plaice, witch flounder, pollock, white hake, Atlantic halibut, ocean pout, and Atlantic wolffish;
  • Additional measures to promote stock rebuilding for Gulf of Maine cod and Southern New England/Mid-Atlantic winter flounder, and
  • Revised acceptable biological catch (ABC) control rules in consultation with the Council’s Scientific and Statistical Committee.

Working with Whiting Fishermen to Find Solutions

March 14, 2016 — The following was released by NOAA Fisheries:

Recently, commercial fishermen who fish for whiting as part of the small-mesh multispecies fishery asked us what it would take to make changes to this fishery. Specifically, whiting fishermen want to open some of the Gulf of Maine exemption areas earlier in the year.

In response, we convened a workshop on February 18 to clarify the reasons for the exemptions for the whiting fishery and the steps necessary for adjusting the regulations, including the data needed to evaluate any potential changes. This collaborative workshop included fishermen, researchers, New England Fishery Management Council staff, state marine fisheries agency personnel, and federal managers.

The whiting fishery is an “exempted fishery,” which means that fishermen are able to fish for specific species without being subject to certain Northeast multispecies regulations, such as mesh size requirements, provided the catch of other groundfish species is minimal. The Regional Administrator, in consultation with the New England Fisheries Management Council, authorizes exempted fisheries. There are currently several whiting exempted fishing areas within the Gulf of Maine (see map below). Vessels may fish for whiting with small-mesh trawls only within the designated exempted fishery areas and according to specific regulations.

Maine DMR to pay out last of $3 million in federal aid

March 8, 2016 — AUGUSTA — The Department of Marine Resources will soon be making the third and final payment of federal disaster relief funds to 32 eligible Maine-based fishermen who hold federal Northeast Multispecies (groundfish) permits. The payment will total $1.02 million.

To qualify, Maine groundfish permit holders must have landings of more than 5,000 pounds in any one fishing year from 2010-2013. In addition, permit holders must have landed a minimum of 5,000 pounds of groundfish in either fishing year 2013 or 2014. Fishing years run from May 1 to April 30.

“The intent of these criteria is to focus disaster relief efforts on permit holders who have historical dependence on groundfish and have had continued reliance on the groundfish fishery during the disaster years,” DMR Deputy Commissioner Meredith Mendelson said recently.

According to Meldelson, the department understands that the Maine groundfish industry saw declines in many years preceding the disaster declaration by the secretary of commerce. The declaration was made based on what were, at the time, prospective revenue losses from the major reduction in Gulf of Maine cod quota available for the 2013 fishing year. DMR’s allocation of relief funds reflects the impact of that specific reduction.

The payments allocated to eligible permit holders were based on a formula developed by DMR after several outreach meetings with industry. Those payments, ranging from approximately $9,100 to $44,044, will reflect landings in fishing years 2013 and 2014 individually and combined.

Maine DMR to Issue Third Round of Federal Disaster Relief Funds for Groundfishermen

March 1, 2016 — The following was released by the Maine Department of Marine Resources:

The Maine Department of Marine Resources will soon be issuing the third and final payment to thirty-two Maine-homeported commercial Northeast Multispecies (groundfish) permit holders who are eligible to receive direct assistance under federal disaster relief funding.

To be eligible, Maine-homeported groundfish permit holders must have landings of over 5000 pounds in any one Fishing Year from 2010-2013. In addition, permit holders must have landed a minimum of 5000 pounds of groundfish in either Fishing Year 2013 or 2014. 

“The intent of these criteria is to focus disaster relief efforts on permit holders who have historical dependence on groundfish and have had continued reliance on the groundfish fishery during the disaster years,” said Maine DMR Deputy Commissioner Meredith Mendelson. “We know that Maine’s groundfish industry has seen declines in many years preceding this disaster declaration.  However, the Secretary of Commerce’s declaration was made based on what were, at the time, prospective revenue losses from the major reduction in Gulf of Maine cod quota available for the 2013 fishing year. Accordingly, our allocation of relief funds reflects the impact of that specific reduction.”

The amounts allocated to eligible permit holders were based on a formula developed by the Maine Department of Marine Resources after several outreach meetings with industry. Amounts issued will reflect landings in Fishing Years 2013 and 2014 individually and combined.

Awards under this formula will range from approximately $9,100 to $44,044.

The funds are a portion of the $3.3 million allocated to Maine from the $75 million allocated by U.S. Congress to help with six fishery disasters, including the disaster declared in 2012 by the Secretary of Commerce as a result of significant quota cuts for key New England groundfish stocks.

Of the $75 million, $32.8 million was allocated to the Northeast groundfish industry. The allocation of those funds was negotiated among the state fisheries agency directors and announced in June, 2014.

The agreement split the $32.8 million evenly, allocating a third of the funds to each of three areas. $11 million was paid out as direct aid to permit holders in the northeast who have landed a minimum of 5000 pounds of groundfish stocks in any one fishing year since 2010.

In October, 2014, fifty-two of Maine’s federal groundfish permit holders received $32,500 each. In 2015, the DMR distributed $640,005 to help Maine’s groundfish fleet and related shoreside industries by rebating dealer landings and handling fees. 

Rhode Island’s Groundfish Economic Assistance Program Now Accepting Applications

December 10, 2015 — The following was released by the Rhode Island Department of Environmental Management:

A new federal funding opportunity is available for Rhode Island fishermen through the Groundfish Disaster Economic Assistance Program, a direct-aid disbursement plan funded by the NOAA in response to the September 12, 2012 Northeast Multispecies (groundfish) disaster declaration by the Acting Secretary of Commerce. The groundfish disaster was declared for the 2013 fishing year in the states of Rhode Island, New Hampshire, Massachusetts, Maine, Connecticut, and New York. 

On May 28, 2014 the state fishery directors from Rhode Island and other affected states, in partnership with NOAA, announced a three-part framework for the distribution of $32.8 million in federal disaster aid monies to the New England groundfish industry. Rhode Island has completed the distribution of about $1.4 million to 43 pre-qualified federally permitted commercial groundfishermen (phase one) and this week began accepting applications for phase two of this framework.  In this phase, Rhode Island will distribute $519,656 for additional assistance to the Rhode Island commercial groundfish industry.

This state-specific program will be used by DEM to mitigate economic hardship experienced by the commercial groundfish industry not previously addressed by the phase one aid to qualified federal permit holders. This objective responds to cumulative economic impacts, which include lost harvest opportunities because of reduced quota allocations, high costs to operate within a sector, past debt incurred to survive the management program, and added investment needed to continue in sector programs, all of which have contributed to decreased revenue for a significant portion of the industry. 

Phase two of Rhode Island’s aid disbursement, the Groundfish Disaster Economic Assistance Program, extends direct-aid payments beyond the federal permit holders, to the captains and crew members who worked aboard the 43 vessels during the same four-year period when the reduced quotas were having the most impact on the commercial industry. It also extends direct-aid payments to the for-hire permit holders who were active in the groundfish fishery during the same period, as well as captains and crew associated with those permitted vessels, thereby addressing the impacts incurred by that sector of the groundfish industry.

Rhode Island’s Groundfish Disaster Economic Assistance program addresses the restoration and sustainability of the State’s commercial groundfish industry by also providing direct aid for the administration of RI-based sectors, which play a central role in the management program and are in need of financial support to remain viable. It is the goal of this disaster aid to ensure the needs and interests of the groundfish community are being met so that we can promote long-term stability in the Rhode Island commercial fishing industry. NILS STOLPE: So how’s that “catch shares” revolution working out for groundfish?

FishNet USA/October 22, 2015 — NILS E. STOLPE — Most of you probably remember when newly appointed NOAA head Jane Lubchenco went to New England and announced that she was going to save our nation’s oldest fishery. But if it didn’t make a lasting impact on you, quoting from the Environmental Defense blog, EDFish by Tesia Love on April 8, 2009, “Sally McGee, Emilie Litsinger and I got to witness something pretty wonderful today.  Jane Lubchenco came to the New England Fishery Management Council meeting to announce the immediate release of $16 million to the groundfish fishery to help move the fishery to ‘sector” catch share management by providing funding for cooperative research to help fishermen get through a tough fishing year with very strict limits on fishing effort.”  She went on to quote Dr. Lubchenco “we need a rapid transition to sectors and catch shares. Catch shares are a powerful tool to getting to sustainable fisheries and profitability.  I challenge you to deliver on this in Amendment 16, to include measures to end overfishing.  I will commit the resources to my staff to do their part to ensure Amendment 16 is passed in June. We are shining a light on your efforts and we will track your progress.  There is too much at stake to allow delay and self-interest to prevent sectors and ultimately catch shares from being implemented.”

I’m sure that you were there with the rest of us, heaving a huge sigh of relief with visions of Dr. Lubchenco on her shiny white steed,  first riding to the rescue of the New England fishery, and then on to all of the rest of our struggling fisheries. “Hyo Silver! Away!”

So how did she do? A couple of years back NOAA/NMFS released the 2012 Final Report on the Performance of the Northeast Multispecies (Groundfish) Fishery (May 2012 – April 2013). It’s available at http://www.nefsc.noaa.gov/publications/crd/crd1401/. The report included a table – available at http://www.nefsc.noaa.gov/publications/crd/crd1401/tables.pdf – included a table titled Summary of major trends (May through April, includes all vessels with a valid limited access multispecies permit) for the fishing years 2009 to 2012. The table only takes up a single page, is pretty easily understood and is well worth your consideration in its entirety but I’ll take the liberty of synopsizing what I think are the major points it illustrates. In each of the four years the groundfish revenues, landed weight, number of active vessels that took a groundfish trip, the total number of groundfish trips, and the total crew days on groundfish trips decreased. The non-groundfish revenues and landed weight increased. The days absent on a non-groundfish trip increased slightly then decreased. 

And then we come to 2013 (it seems that according to NOAA/NMFS, 2014 hasn’t gotten here yet). Had the myriad benefits of Dr. Lubchenco’s and her ENGO/foundation cronies’ Catch Share Revolution finally arrived? Apparently, not quite yet. According to the 2013 Final Report on the Performance of the Northeast Multispecies (Groundfish) Fishery (May 2013 – April 2014), just about everything that was falling in FY 2009 to 2012 continued to fall in FY 2014. I won’t go over any of the details, but the corresponding Table 1 for that year is available at http://www.nefsc.noaa.gov/read/socialsci/pdf/groundfish_report_fy2013.pdf.

Oh well, I guess she deserves a few points for trying – and we shouldn’t forget that before she could really focus on fixing groundfish she was distracted by having to dump a couple of millions of gallons of Corexit into the Gulf of Mexico.

Thirteen species are included in the New England Fishery Management Council’s multi-species fishery management plan, the “groundfish” FMP. Four of those species support no or minimal directed fisheries. The landings of those that support a significant commercial fishery are in the table below (from the NOAA/NMFS commercial landings database). Looking at these data, it’s impossible to suggest that after years of intensive management this management regime is anything that could be considered a success – unless your idea of success is putting a whole bunch of people out of work. In fact only the most charitable among us could term it anything other than disaster – and it’s a disaster that has been in the making since long before Dr. Lubchenco so fatuously announced that she was going to fix it.

(I’ll add here that catch share management is not a cure-all for all that’s wrong with fishery management nor is it the reason for management failures – though at the time Dr. Lubchenco and her “team” apparently believed it was. It is nothing more than an option for dividing the catch among users. As such it can have profound socioeconomic impacts on participants in the fishery and on fishing communities that depend on it, but not on the fishery resources themselves.)

How might it be fixed? In the original FishNet article I quoted a couple of paragraphs from a National Academy of Sciences study Evaluating the Effectiveness of Fish Stock Rebuilding Plans in the United States (available at http://www.nap.edu/catalog/18488/evaluating-the-effectiveness-of-fish-stock-rebuilding-plans-in-the-united-states). I can’t think of anything more valuable than repeating those words here. On page 178 of the report the authors concluded “the tradeoff between flexibility and prescriptiveness within the current legal framework and MFSCMA (Magnuson-Stevens Fishery Conservation and Management Act) guidelines for rebuilding underlies many of the issues discussed in this chapter. The present approach may not be flexible or adaptive enough in the face of complex ecosystem and fishery dynamics when data and knowledge are limiting. The high degree of prescriptiveness (and concomitant low flexibility) may create incompatibilities between single species rebuilding plans and EBFM (Ecosystem Based Fisheries Management). Fixed rules for rebuilding times can result in inefficiencies and discontinuities of harvest-control rules, put unrealistic demands on models and data for stock assessment and forecasting, cause reduction in yield, especially in mixed-stock situations, and de-emphasize socio-economic factors in the formulation of rebuilding plans. The current approach specifies success of individual rebuilding plans in biological terms. It does not address evaluation of the success in socio-economic terms and at broader regional and national scales, and also does not ensure effective flow of information (communication) across regions.”

In other words, the fishery managers need more informed flexibility to adequately manage our fisheries. It has been the goal of the fishing industry’s friends in Congress to provide this necessary flexibility (with adequate safeguards, of course). Conversely it has been the goal of a handful of foundations and the ENGOs they support and a smaller handful of so-called fishermen’s organizations to prevent this, and it seems that they have been willing to resort to just about any tactics to do it. As they have been successful in their efforts the fishing industry has continued to lose infrastructure that will never be replaced and markets that will be next to impossible to recover – and the percentage of imported seafood that we consume will continue to increase in spite of the fact that our fisheries are among the richest in the world.

2,000 lb Possession Limit in Effect October 22 for Midwater Trawl Vessels in the GB Haddock AM Area

October 19, 2015 — The following was released by NOAA Fisheries:

Herring Possession Limit Reduced to 2,000 lb in the Georges Bank Haddock Accountability Management Area in Effect October 22 for Midwater Trawl Vessels

The Atlantic Herring Georges Bank Incidental Haddock Catch Cap for the 2015 fishing year has been harvested. 

As a result, herring midwater trawl vessels will be prohibited from fishing for or landing more than 2,000 lb of herring per trip or calendar day in or from the Herring Georges Bank Haddock Accountability Measure Area effective October 22. This limit will remain in place until the quota becomes available for the 2016 fishing year (expected on May 1, 2016). 

This action effectively limits the midwater trawl fishery in Herring Management Area 3 to 2,000 lb of herring per trip/day until May 1, 2016, because Area 3 falls within the Georges Bank Haddock Accountability Management Area. 

Herring vessels issued an All Areas or Areas 2/3 Limited Access Herring Permit may land haddock from the Herring Georges Bank Haddock Accountability Measure Area provided they have a Northeast Multispecies permit and are on a declared Northeast Multispecies day-at-sea.

NEW BEDFORD STANDARD-TIMES: Fishery management needs balance

September 30, 2015 — The requirement that the cost of at-sea monitors be paid by the fishermen who participate in the Northeast Multispecies Fishery is mere weeks away from being phased in.

Study by the National Oceanic and Atmospheric Administration suggests as many as 60 percent of affected boats could be pushed out of profitability by the requirement, based on estimates of monitors costing $700 per day.

Republican U.S. Rep. Kelly Ayotte of New Hampshire hosted a roundtable mid-month with NOAA representatives and fishermen to address the issue.

“We’re supposed to take into account that we don’t destroy the fishing communities,” Rep. Ayotte said, according to Sept. 18 report by the Portsmouth Herald. “(Requirements to protect fishermen) are being ignored in all this.”

She was referring to National Standard 8 of the Magnuson-Stevens Fishery Conservation and Management Act, which says measures used to manage the fishery must “take into account the importance of fishery resources to fishing communities by utilizing economic and social data,” consistent with the prevention of “overfishing and rebuilding of overfished stocks.”

The requirement for consistency, above, might explain why Greater Atlantic Regional Administrator John Bullard told Rep. Ayotte that “eliminating overfishing” supersedes all other priorities.

The Standard-Times is having a very difficult time trying to understand why a policy that will have such a clear negative impact on fishermen is being instituted when the beneficial impact on the resource — the fishery — is so unclear.

NEW BEDFORD STANDARD-TIMES: Environmental groups’ misguided spending on oceans

September 14, 2015 — Carlos Rafael famously and accurately predicted about five years ago that using the quota system known as catch shares in the Northeast Multispecies Fishery would drive small boats out of the water and consolidate licenses into the hands of a few.

His operation would be fine, he said, because of its size.

Now that government regulators have determined that fishermen will bear the cost of at-sea monitors, the pescatarian prognosticator has made another prediction. In a letter to the editor last week, the Oracle of the Ocean pointed out that analysis by the regulators, the National Oceanic and Atmospheric Administration, shows industry-paid monitoring will leave 60 percent of the fleet operating at a loss. By phone last week, the Waterfront Wizard predicted the requirement would further consolidate the groundfish industry into a mere handful of permit holders.

We beg Mr. Rafael’s indulgence with our playfulness, for our alliterative levity should not belie our genuine respect of his unique, invaluable insight into the fishing industry. He is, after all, known as the Codfather.

Mr. Rafael’s understanding of the multispecies fishery is significant, and his analysis is an attractive one, based as it is on experience and success.
