Undersea monument plan advocates hear fishermen’s concerns

August 31, 2016 — MYSTIC, Conn. — One hundred and fifty miles east of Cape Cod, a unique undersea landscape of deep canyons and high mountains supports a diverse ecosystem, abundant with colorful corals, fragile sponges, beaked whales, dragonfish and mussels adapted to living in methane hydrate seeps, that is being considered for protection as a National Monument.

Two leading advocates for the designation, which would be given by President Barack Obama under the American Antiquities Act before he leaves office in January, explained why they are lobbying for the designation Tuesday to an audience of both conservation advocates and commercial fishing representatives concerned about losing valuable fishing grounds.

U.S. Sen. Richard Blumenthal, D-Conn., and Peter Auster, retired University of Connecticut marine science professor and currently the senior research scientist at the Mystic Aquarium, made their case for declaring the New England Coral Canyons and Seamounts as a Marine National Monument during a program Tuesday evening at the aquarium.

But commercial fishing groups say the designation would cut off their access to productive areas for red crab, swordfish, tuna and offshore lobster harvests, among other species.

“Those areas have been used for hundreds of years,” said Joe Gilbert, owner of Empire Fisheries, which has operations in southeastern Connecticut and elsewhere along Long Island Sound.

He and other fishing representatives argued that if Obama uses the executive authority afforded him in the Antiquities Act to designate the area a monument, the federal and regional fisheries regulatory processes that require public input would be circumvented.

“We feel disenfranchised at this point,” Gilbert said.

Eric Reid of North Kingstown, R.I., who represents commercial fishing interests on the New England Fishery Management Council, said creating the monument would cause “localized economic damage” to the already stressed fishing industry, and advocated for a compromise being recommended by the Atlantic States Marine Fisheries Commission.

Battle over Cashes Ledge continues between fishermen, environmentalists

August 29, 2016 — Despite the Obama administration’s declaration that Cashes Ledge has been taken off the table as a possible location for a marine national monument, the divisive issue of the monuments continues to percolate nationally between fishermen and conservationists.

From Hawaii to New England, the lines are clearly drawn.

Conservation groups have sustained a steady lobbying campaign to convince President Obama to employ the Antiquities Act to create new marine national monuments in the waters around Cashes Ledge, about 80 miles off Gloucester, and the seamounts off southern New England and Monterey, California.

On Friday, Obama ended a contentious process in the Pacific Ocean when he expanded an existing marine national monument area in the northwest Hawaiian Islands to create the largest protected area on Earth — 582,578 square miles.

Fishing stakeholders and fishing communities have countered with their own public campaign that sharply criticizes the collateral impact of closing more areas to commercial and recreational fishing, as well as the method of using the Antiquities Act as an end-run around the Magnuson-Stevens Fishery Conservation Act.

“The Antiquities Act does not require transparency or a robust analysis of the science,” the Gloucester-based Northeast Seafood Coalition said in a statement. “It does not require any socioeconomic considerations be taken into account. No process is required other than an executive action by the president of the United States.”

The coalition and others, including several members of the Massachusetts congressional delegation and Gov. Charlie Baker, have tried to drive home the point that the current system of federal ocean management requires fishing businesses and communities to follow the established and intricate regulatory procedures established under Magnuson-Stevens.

To allow the creation of marine national monuments by what amounts to presidential fiat, they say, is unfair to those who have operated under the established rules and makes a mockery of Magnuson-Stevens.

“The New England Fishery Management Council is in charge of carrying out this requirement in our region,” the NSC said. “Last year, the council approved Omnibus Habitat Amendment 2 and is presently working on an Omnibus Deep Coral Amendment. These areas include the very areas now proposed and under consideration for a national monument.”

Marine Preserve Proposal Ignites Debate Over Fishing

August 22, 2016 — Proposals to create a vast national marine preserve off the New England coast are generating a whirlpool of debate that’s sucking in commercial fishermen, recreational anglers, environmentalists, multistate bureaucrats and politicians.

Environmental groups are calling on President Barack Obama to use his executive powers to establish a 6,180-square-mile New England Coral Canyons and Seamounts national monument. They insist it would protect a unique and ecologically critical marine environment lying about 150 miles off New England’s shores.

If Obama heeds those calls, virtually all fishing and commercial operations such as oil and undersea mining would be banned within the new national preserve.

The controversy has exposed deep fault lines between commercial fishermen fiercely opposed to new federal restrictions on their industry and many recreational anglers who argue the preserve would benefit fishing in the region.

Interstate fisheries councils and commissions involved in regulating fishing along the Atlantic coast are also involved in an effort to protect their jurisdiction over the proposed preserve.

The leaders of eight U.S. regional fisheries management councils have written to Obama warning that creation of the proposed marine monument would ignore federal mandates to “achieve optimum yield from the nation’s fishery resources and may negatively impact jobs and recreational opportunities.”

Northeast Trawl Advisory Panel Working Group – Aug. 2 meeting

July 29, 2016 — The following was released by the New England Fishery Management Council:

The Northeast Trawl Advisory Panel (AP) Working Group is scheduled to meet in Boston to discuss using commercial fishing vessels to supplement current stock assessment surveys conducted by the Northeast Fisheries Science Center.

WHAT IS THE WORKING GROUP:  The working group was created on June 1 by the Northeast Trawl Advisory Panel specifically to address how best to deploy additional survey capacity using chartered commercial fishing vessels funded by the science center.  The science center provides the working group with meeting summaries and reports, and the Mid-Atlantic Fishery Management Council provides staff support.

WHAT’S ON THE AGENDA:  The working group will receive a short update on upcoming witch flounder work; review the draft “terms of reference” for augmenting current survey efforts; conduct in-depth discussions on the full range of options; and draft recommendations for consideration by the broader Northeast Trawl Advisory Panel.  Final AP recommendations will be presented to the Mid-Atlantic and New England Councils.

Now that draft regional ocean plan is out…

July 19, 2016 — In Commercial Fisheries News May issue, the background, impending release, and need for fishermen to comment on the draft Northeast Regional Ocean Plan were discussed.

The Northeast Regional Planning Body (RPB) is now accepting written comments on the draft ocean plan through July 25, and will host a series of public meetings across the region.

A full list of meetings is provided on the RPB’s website. We encourage you to review the ocean plan and provide comments relevant to your fisheries.

On May 25, the RPB – comprised of six New England states, six federally-recognized tribes, nine federal agencies, and the New England Fishery Management Council – released the nation’s first draft Regional Ocean Plan.

Over four years in the making, and building on the efforts in the region that have occurred over the last decade, the Regional Ocean Plan (the plan) is intended to advance coastal and ocean data, improve engagement with ocean users, and enhance coordination among agencies who manage ocean and coastal resources.

Waters changing off Maine coast

June 30, 2016 — As I gear up to head back out onto the ocean, hoping for another strong lobster season, I’m reminded just how much these waters have changed.

Over the years, I’ve witnessed the impacts changes in our climate have brought to our fisheries — differing molt cycles, lobster migration into deeper, cooler waters and the effects that warming waters have had on shrimp and other species. We’ve all experienced the increased severity of weather events and heard the warnings about an increasingly acidic ocean.

Now we’re also hearing the clamor of those who seek to use ocean space for their industries, including renewable energy production, offshore aquaculture and others. Many of these new users require leases that restrict access for traditional ocean users.

With all of this happening simultaneously, it’s become more important than ever to find a balance between existing and new uses while also protecting everything that our ocean has to offer for future generations.

As more and more people — from recreational fishermen to major businesses — put demands on our ocean and coastal areas, it’s clear that it will require us to make many tough decisions. That’s why I’ve supported the regional ocean planning process as prescribed by the National Ocean Policy.

The process brought together representatives from across six New England states, six federally recognized tribes, nine federal agencies and the New England Fishery Management Council to produce a plan that provides a data portal of information about the region’s ocean and better coordinates and improves ocean management at all levels of government. Last month, this group — the Northeast Regional Planning Body — became the first in the nation to release a draft of its regional ocean plan (neoceanplanning.org/plan/).

I think back to when I served on the Maine Ocean Acidification Commission. At that time, it became clear to me just how much information is still needed to answer all the questions that come with complex ocean issues.

By gathering that needed information and data, we will be able to chart a course to help our coastal communities decide whether to gear up for the economic growth of new ocean uses such as renewable energy or aquaculture, expand efforts toward climate mitigation and remediation or try to retain the qualities and spatial freedom of our wild-caught fisheries. Now, through this plan, we have so much more of that information all in one place.

Saving Seafood Executive Director Talks Lost NOAA HabCam

 

WASHINGTON (Saving Seafood) – May 25, 2016 — A $450,000 camera used to survey scallops on the ocean floor was lost Friday when a NOAA-chartered vessel towed it too close to a known ship wreck, as reported yesterday by the New Bedford Standard-Times.

This morning, Saving Seafood Executive Director Bob Vanasse spoke with New Bedford 1420 WBSM morning host Phil Paleologos about the accident, saying it proves the need for changes to the Atlantic scallop survey.

“The Fisheries Survival Fund [which represents members of the Atlantic scallop fleet] has been arguing for some time that the Federal scallop survey should not be done just by one single piece of equipment on one single vessel, but that there should be backups,” Mr. Vanasse said.

Compounding the problem the lost camera will have on this year’s Federal scallop survey is the fact that respected scientist Kevin Stokesbury, from UMass Dartmouth’s School for Marine Science and Technology, did not receive government funding for his own survey. Dr. Stokesbury’s surveys, which use cameras dropped into the ocean to take pictures of the seafloor, had previously been funded every year since 1999.

Mr. Vanasse called the loss of NOAA’s HabCam habitat camera last week “a combination of really bad circumstances.” He raised concerns about researchers aboard the R/V Hugh R. Sharp piloting the expensive HabCam so close to the well-known and charted wreckage of the Bow Mariner, where a cable apparently snagged the sunken ship and detached the camera. He also pointed out that many industry leaders raised concerns that a volunteer worker was piloting the HabCam at the time of the accident.

NOAA researchers are beginning efforts to find the HabCam today, nearly a week after it was lost, and say they will be able to make up for lost time. But scallop industry experts are unconvinced, according to Mr. Vanasse.

“That doesn’t really make sense,” Mr. Vanasse said of the industry perspective. “If they plan to go out for a certain time, they do that because they need it.”

The timing issue is further complicated because NOAA leases the Sharp from the University of Delaware for a limited period of time at high expense. Even if NOAA is able to salvage the HabCam, it will likely take more than a week of valuable time, Mr. Vanasse said.

The lost HabCam is not the first issue NOAA has had a with a research vessel in recent weeks. Earlier this month the R/V Henry B. Bigelow, the ship that surveys for groundfish and many other species on the East Coast, was delayed due to mechanical issues with its generators. The Bigelow was already running more than a month behind before its generator problems. Mr. Vanasse pointed out that Dr. Bill Karp, director of the Northeast Fisheries Science Center, has been pushing for NOAA to charter commercial fishing boats as backups, including at April’s NEFMC meeting (skip to 31:51 to listen to Dr. Karp).

“We need higher ups at NOAA to listen to what Dr. Karp has been saying about needing backups on the groundfish survey,” Mr. Vanasse said. “And we need everybody at NOAA to pay attention to what the [Fisheries] Survival Fund has been saying about having backups on the scallop survey.”

Co-owner: New Bedford fish auction could see periodic closures over next month

May 24, 2016 — NEW BEDFORD, Mass. — The fish auction that’s been a daily institution on the city’s waterfront for decades could see periodic closures over the next month or so, as a co-owner said Monday that this year’s significant cut to the cod quota is keeping many boats tied to the docks, rather than bringing in fish.

Richard Canastra, co-owner of the Whaling City Seafood Display Auction since 1994, said Monday morning that in his view, “there won’t be” fish auctions on some days between now and July 4, when he expects commercial fishing activity to pick up again.

“There’s not many fishermen fishing anymore,” Canastra said as he stood outside the auction building on Hassey Street. “A lot of the boats are just tied up — they’re not going to fish. Why would they fish if there’s only so much (allowable) cod?”

The National Oceanic and Atmospheric Administration (NOAA), in conjunction with the New England Fishery Management Council, instituted a 62-percent reduction in the allowable catch for Georges Bank cod this year, in quotas that took effect May 1.

Former New Bedford Mayor John Bullard, now regional administrator for NOAA fisheries, has said the new regulations create “about a 95 percent cut” since 2012 in catch limits for Georges Bank cod, a key species for New Bedford’s fishing industry.

Government documents detailing the quotas say they’re, “intended to help prevent overfishing, rebuild overfished stocks, achieve optimum yield” and ensure that fishery management is based on the best data available.

Cape scallop fishermen cash in on grounds closer to home

May 23, 2016 — HARWICH PORT, Mass. — The scalloping was pretty poor north of Provincetown last month for the crew of Aidan’s Pride; they towed their dredge for hours just to get a hundred pounds.

So the Wellfleet scallop vessel, owned by Aidan Lapierre and captained by Sean Gray, was heading south to Maryland about three weeks ago, hoping for a more bountiful harvest, when it broke an outrigger in rough water transiting the Cape Cod Canal.

It turned out to be a fortunate break, as the delay lasted just long enough that they were still around when the National Oceanic and Atmospheric Administration’s fisheries office in Gloucester approved a plan May 3 to open a scallop-rich spot around 70 miles southeast of Saquatucket Harbor where Aidan’s Pride was tied up Thursday.

Catches in near-shore areas petered out over the past few years for members of what is known as the general category scallop fleet, smaller vessels around 40 feet in length that are only allowed to land 600 pounds of scallop meats a day. They were not able to harvest their allotted quota and petitioned NOAA and the New England Fishery Management Council to open a portion of the so-called Nantucket Lightship closed area exclusively to them because their vessels are not suited to the long trip to prime scalloping grounds on Georges Bank. In addition, the profits from the relatively small amount of scallops they were allowed to catch would quickly be eaten up by fuel costs.

Their only alternative: head south to the Mid-Atlantic.

But a window of opportunity opened after scientific surveys of the Nantucket Lightship area showed there weren’t enough mature scallops available to open it this year. Members of what is known as the limited access fleet — vessels 80 to more than 100 feet long which harvest as much as 17,000 pounds a day and are responsible for 95 percent of the scallop catch — wanted it kept closed to everyone.

“We chose not to go in there because the science said it wasn’t ready,” said Drew Minkiewicz, an attorney representing the Fisheries Survival Fund, which has many of the limited access fleet as members.

“We wanted the scallops to be larger, to get the maximum yield,” he said.

Since 2001, scallops have been managed under a rotational scheme much like letting a field lie fallow. Sampling is done to determine whether an area has enough large scallops to be opened to fishing. Areas with a lot of seed or immature scallops remain closed until they grow large enough for harvest.

It’s an approach that works but allowing someone into an area before it’s ready violates that management principle, Minkiewicz said. Scallopers faced with only being able to land 600 pounds would likely sort through the catch, discarding smaller animals in favor of the large ones that fetched higher prices, he said.

“They’re human,” he said. “We don’t blame them for it, but they will kill a lot more scallops than 300,000 pounds.”

Kevin Stokesbury, principal investigator at University of Massachusetts Dartmouth’s sea scallop research program, is also opposed to letting general category boats into the Lightship area, saying the dredge would likely kill a lot of small scallops. Surveys and studies by UMass Dartmouth’s School of Marine Science and Technology showed a small amount of growth actually doubled the amount of meat available. He agreed with Minkiewicz’s argument that killing off large numbers of young scallops, even if limited by a relatively small quota, could significantly affect future harvests in the area.

“While 300,000 pounds of harvest is not a lot compared to the biomass there, how many small scallops will you have to sort through to get to the few large ones?” he said.
