Feds protecting South Carolina waters for endangered whales

January 26, 2016 — A stretch of the southern Atlantic coast needed by endangered right whales to survive will receive more federal oversight under a decision that’s expected to put greater government scrutiny on efforts to locate and drill for oil and gas off the South Carolina seashore.

The National Oceanic and Atmospheric Administration on Tuesday declared the entire South Carolina and Georgia coasts as “critical habitat’’ for North Atlantic right whales, rare sea mammals that migrate from New England to southern waters. Parts of north Florida, New England and southern North Carolina also fall under the designation for the first time.

Tuesday’s decision doesn’t necessarily preclude oil and gas drilling in South Carolina or other states and it won’t add new regulations that would impede shipping or commercial fishing, federal officials said.

But it “would definitely make it harder’’ for oil and gas exploration to occur, said David Gouveia, a marine mammal coordinator for NOAA’s fisheries division. The critical habitat designation allows the government to more carefully review the proposals to search or drill for fossil fuels that might be buried in the sea floor, federal officials said. If concerns arise, the government could recommend changes.

Not only will the agency look at the direct impact of oil and gas development on right whales, but it also would examine how that could affect habitat important to the species’ survival, Gouveia said during a conference call with reporters. The government unveiled the proposal about a year ago and finalized the rule Tuesday.

To Save Its Salmon, California Calls in the Fish Matchmaker

January 15, 2016 — HORNBROOK, Calif. — On a frigid morning in a small metal-sided building, a team of specialists prepared to orchestrate an elaborate breeding routine. The work would be wet and messy, so they wore waders. Their tools included egg trays and a rubber mallet, which they used to brain a fertile female coho salmon, now hanging dead on a hook.

Diana Chesney, a biologist, studied a piece of paper with a matrix of numbers, each one denoting a male salmon and potential match for the female coho.

“This is the bible,” she said of the matrix. “It’s what Carlos says.”

John Carlos Garza, a geneticist based a day’s drive south in Santa Cruz, has become a key figure in California’s effort to preserve its decimated salmon stocks. Using the latest genetic techniques, he and his team decide which individual fish should be bred together. At several major state conservation hatcheries, like the coho program here at Iron Gate, no two salmon are spawned until after Dr. Garza gives counsel — a “salmon mating service,” he jokingly calls it.

His painstaking work is the latest man-made solution to help fix a man-made problem that is about 150 years old: dams, logging, mining, farming, fishing and other industries have so fractured and polluted the river system that salmon can no longer migrate and thrive. In fact, today, owing to the battered habitat, virtually all salmon in California are raised in hatcheries.

Traditionally, the practice entailed killing fertile salmon and hand-mixing eggs and male milt, or sperm, then raising the offspring packed in containers or pools. When they were old enough to fend for themselves, they were released to rivers or sometimes trucked or ferried to release points to find the ocean on their own, a practice that gave them a necessary transition before they hit saltwater and a semblance of the quintessential salmon experience of migrating to the sea and back. To that end, they eventually swam back to hatcheries, where they became the next breeders in the cycle.

While hatcheries have helped propagate the species, they have also created new problems. The salmon they produce can be inbred and less hardy through domestication, hurting their chances for surviving and thriving in the wild.

Sunken sanctuary: Former Omega Protein WWII-era vessel becomes artificial reef

December 15, 2015 — For much of the last decade, the MV Shearwater caught menhaden by the ton but in its new life, as part of the Del-Jersey-Land reef 26-miles off the coast, it will become a fish habitat and diving destination in the state’s artificial reef program.

The ship didn’t go easy into the deep last week. The stern sank first and the ship started to turn leaving just the bow out of the water. It took about six hours to fully sink after the seacocks opened and the interior compartments flooded.

The 176-foot-long vessel went down in 120 feet of water. It lays about one-half nautical mile from the 568-foot long USS Arthur W. Radford, a former Navy destroyer. The Radford was sunk at the artificial reef site in 2011 and has become a popular destination for divers and anglers.

“About three weeks ago, a state-record bluefish was caught there,” said Jeff Tinsman, the state artificial reef coordinator.

“These old freighters make ideal reefs because of the voids and cavities in them – they’re really the perfect sanctuary for fish,” Tinsman said. “But not long after this ship sinks, the fish will start to come ‘outside’ it to feed. Within a few weeks, blue mussels, sponges, barnacles and soft corals will attach themselves to the structure, and in about a year, the reef will be fully productive, for fish and fishermen alike.”

Whether to re-open shallow bays (less than six feet deep) of Pamlico Sound to mechanical harvest.The draft oyster plan amendment looks at:

  • Whether to continue the monitoring trigger of 26 percent legal-sized live oysters to determine when to close mechanical harvest (adopted in Supplement A to Amendment 2 to the N.C. Oyster Fishery Management Plan).
  • Whether to make hand harvest limits the same statewide.
  • How to mitigate harvest effort impacts on oyster resources in the Southern region.

The draft clam plan amendment looks at:

  • Whether to increase the recreational maximum daily harvest limit for hard clams.
  • Whether to allow the use of power hauling equipment in the hand harvest of hard clams.
  • Whether to modify mechanical clam harvest lines to exclude areas no longer fished.
  • The draft amendments to the oyster and clam plans also consider multiple changes to the shellfish lease program, changes to the shellfish license, and shading requirements for shellfish.

The draft 2015 Coastal Habitat Protection Plan contains four goals and four priority issues:

  • Goal 1 – Improve effectiveness of existing rules and programs protecting coastal fish habitats — includes five recommendations to enhance permit compliance, monitoring, outreach, coordination across environmental commissions and management of invasive species.
  • Goal 2 – Identify and delineate strategic coastal habitats — includes two recommendations regarding mapping and monitoring fish habitat, assessing their condition and identifying priority areas for fish species.
  • Goal 3 – Enhance and protect habitats from adverse physical impacts – includes eight recommendations on expanding habitat restoration, managing ocean and estuarine shorelines, protecting habitat from destructive fishing gear and dredging and filling impacts.
  • Goal 4 – Enhance and protect water quality – includes eight recommendations to reduce point and non-point sources of pollution in surface waters through encouragement of best management practices, incentives, assistance, outreach and coordination. This applies not only to activities under the authority of the Department of Environmental Quality, such as development and fishing, but for all land use activities, including forestry, agriculture and road construction.

Priority issues for the plan’s implementation actions include oyster restoration, living shorelines, reducing sedimentation in tidal creeks and developing metrics to evaluate habitat trends.

ACFHP Releases Request for Proposals to Study and/or Restore Black Sea Bass Habitat

December 7, 2015 — The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic Coastal Fish Habitat Partnership (ACFHP) is seeking research and/or restoration proposals to address black sea bass habitat issues in the Mid-Atlantic region (from Long Island Sound to Cape Hatteras), with an emphasis on the use of natural and/or artificial reefs and their ability to maintain and enhance fishery productivity. Projects can range from 12 – 24 months in length, and should include guaranteed monitoring for at least three years. The maximum award for an individual project is $225,000, and multiple highly ranked projects will be considered if the amount requested totals less than the $225,000 in available funds. All proposed artificial reef construction projects must be developed in coordination with the artificial reef manager in their respective state (contact information listed in the Request for Proposals) to be eligible for funding.

Enviros Push for “National Monuments” Off Northeast Coast that Could Ban Recreational Fishing

November, 2015 — A coalition of environmental groups including the Pew Charitable Trusts, the Conservation Law Foundation, and the National Resources Defense Council, is pushing hard to create a half-dozen “marine national monuments” in the Atlantic Ocean that would prohibit commercial fishing and could ban recreational fishing as well.

The coalition is encouraging President Obama to use his authority to designate the monuments through the Antiquities Act of 1906, which was created to “protect the objects of historic and scientific interest” and is supposed to be limited to “the smallest area compatible with proper care and management of the objects to be protected.” Through the Act, a president can unilaterally create these areas without any public or congressional oversight or input. A number of presidents have exercised this privilege in the past, yet most monuments have been designated on land or in the Western Pacific Ocean.

At the time of this writing the areas under consideration are not completely clear, but appear to include at least three canyons – Lydonia, Gilbert, and Oceanographer – along with four seamounts to the south, as well as Cashes Ledge some 50 miles offshore in the Gulf of Maine. Other canyons and seamounts are also reportedly under consideration.

It is clear to many of us, however, that the coalition’s intent in creating these monuments has little to do with historical or cultural preservation. As Maine’s Gov. Paul LePage put it, the monuments designations “would serve only one purpose – excluding commercial fishing from certain segments of the ocean.”

The recreational sector, however, needs to be very careful – and skeptical as well. At least one attorney for the Conservation Law Foundation (CLF) has suggested that recreational fishing would likely be allowed in the monuments, in order to garner support from sport fishermen, and indicated that it would be a real “win” for the recreational sector if just the commercials were prohibited in these areas.

But the rec sector isn’t taking the bait. “Just because a couple of environmental groups claim they wouldn’t oppose recreational fishing in the monuments doesn’t mean that sport fishing would be allowed once the final regulations are drafted in D.C.,” explained Frank Blount, chairman of the New England Fishery Management Council’s (NEFMC) Groundfish Committee and a party boat fleet owner in RI. “There’s no way to predict what the language in any monument designation will entail. We need to oppose the whole idea, right from the get-go.”

One of the biggest problems with the Antiquities Act of 1906 is that it strips away the open, democratic processes that protect these areas yet can allow sustainable and appropriate fishing activity. The open federal Fishery Management Council system is the vehicle by which this is best accomplished, and in fact the NEFMC has already implemented strong protections for Cashes Ledge, where most commercial fishing is already now prohibited. And in June, the Mid-Atlantic Fishery Management Council voted to protect 38,000 square miles of marine habitat in order to protect deep-sea corals.

A marine monuments designation, in contrast, would nullify these existing management actions, and deny the public any input into what new restrictions might, or should, be enacted. “Instead, it all becomes purely political,” says Jim Donofrio, the RFA’s Executive Director. “Whoever has the most influence on the administration and the president will get what they want in the way of restrictions in these areas. This is no way to manage our publicly-owned marine resources. We already have a transparent process via the Magnuson-Stevens Act. It’s certainly not perfect, to be sure, but it at least allows for public participation.”

Are “Strongly Protected” MPAs the Future of Ocean Conservation?

November 19, 205 — A new paper in science by Jane Lubchenco and Kirsten Grorud-Colvert discusses the recent progress and advocates for creating and enforcing “strongly protected” marine protected areas (MPAs). For the purposes of this paper, strongly protected MPAs are those that restrict all commercial activity and allow only light recreational or subsistence fishing. Today only 3.5% of the ocean is protected but only 1.6% is strongly protected. The 10% protection goal for coastal marine areas by 2020 decided recently at the Convention on Biological Diversity is too loosely defined and should be specific to strongly protected MPAs or marine reserves. However it should be noted that significant progress has been made in establishing more strongly protected MPAs in the past decade, which, “reflects increasingly strong scientific evidence about the social, economic and environmental benefits of full protection.”

The authors highlight seven key findings suggesting that such MPAs are indeed needed in a greater percentage of global oceans. Successful MPA programs must be integrated across political boundaries but also with the ecosystems they assist – an ecosystem-based management approach is essential. Engaging users almost always improves outcomes. MPAs may improve resilience to future effects of climate change, but there is no question that, “Full protection works,” such that primary ecological goals are almost always met with strongly protected MPAs.

In conclusion, six political recommendations are outlined. An integrated approach is equally important in the political balance for successful MPAs – other management schemes must be considered and dynamic planning is most effective in preparation for changing ecological systems. There is no one-size-fits-all method for MPAs. Top-down or bottom-up approaches have been successful and to determine the right strategy stakeholders should always be involved in the process. Perhaps most importantly, user incentives need to be changed in order to alleviate the economic trauma of short-term losers.

Judge bars boat from dredging for clams

November 19, 2015 — PROVINCETOWN — A judge has temporarily barred a Gloucester fishing vessel from dredging for clams off Herring Cove while a dispute about who governs such dredging in that area makes its way through court.

Barnstable Superior Court Judge Raymond Veary issued a temporary restraining order Nov. 3, after the Provincetown harbormaster’s staff followed the 70-foot Tom Slaughter as it dredged for surf clams the previous two days, Harbormaster Rex McKinsey said.

The Slaughter is one of three clam draggers whose owners are in court in separate actions fighting cease-and-desist orders issued by the Provincetown Conservation Commission to keep them from dredging up to 40 feet offshore without a permit.

Veary’s temporary order was to last until Friday, but according to Monte Rome, owner of the Tom Slaughter, it has been extended to Jan. 5 at his request.

Provincetown officials want to stop hydraulic dredging, a process that involves shooting water at 50 to 100 pounds of pressure into the sand to release the clams, because it disturbs the ocean floor and damages the habitat for fish, clams and other marine life, McKinsey said.

In 2007, the Conservation Commission passed a regulation banning hydraulic dredging in that area without a permit.

After a Century, Shortnose Sturgeon Return to Historic Habitat

November 17, 2015 — The following was released by NOAA Fisheries:

ORONO, Maine – Endangered shortnose sturgeon have rediscovered habitat in the Penobscot River that had been inaccessible to the species for more than 100 years prior to the removal of the Veazie Dam in 2013. University of Maine researchers confirmed evidence that three female shortnose sturgeon were in the area between Veazie (upriver of the dam remnants) and Orono (Basin Mills Rips), Maine in mid-October. Researchers had previously implanted these sturgeon with small sound-emitting devices known as acoustic tags to see if they would use the newly accessible parts of the river.

Among the most primitive fish to inhabit the Penobscot, sturgeon are often called “living fossils” because they remain very similar to their earliest fossil forms. Their long lives (more than 50 years) and bony-plated bodies also make them unique. Historically, shortnose sturgeon and Atlantic sturgeon (a related species also present in the watershed) had spawning populations in the Penobscot River as far upstream as the site of the current Milford dam, and provided an important food and trade source to native peoples and early European settlers. Overharvest and loss of suitable habitat due to dams and pollution led to declines in shortnose sturgeon populations and a listing as endangered under the U.S. Endangered Species Act (ESA) in 1967. In 2012, Gulf of Maine populations of Atlantic sturgeon were listed as threatened under the ESA.  

Today, a network of sound receivers, which sit on the river bottom along the lower river from Penobscot Bay up to the Milford Dam, detect movement and location of tagged fish. According to Gayle Zydlewski, an associate professor in the University of Maine School of Marine Sciences, the three individual fish observed were females. These fish have since been tracked joining other individuals in an area identified as wintering habitat near Brewer, Maine. Wintering habitat in other rivers is known to be staging habitat for spawning the following spring.

“We know that shortnose sturgeon use the Penobscot River throughout the year, and habitat models indicate suitable habitat for spawning in the area of recent detection upriver of Veazie, although actual spawning has not yet been observed,” Zydlewski said.

Since 2006, Zydlewski has been working with Michael Kinnison, a professor in UMaine’s School of Biology and Ecology, and multiple graduate students, including Catherine Johnston, to better understand the sturgeon populations of the Penobscot River and Gulf of Maine. Johnston, who has been tagging and tracking sturgeon in the Penobscot for two years to study the implications of newly available habitat to shortnose sturgeon, discovered the detections of sturgeon upstream of the Veazie dam remnants. Each new bit of information adds to the current understanding of behavior and habitat preferences of these incredible fish. 

“We’re very excited to see sturgeon moving upstream of where the Veazie Dam once stood, and into their former habitats,” said Kim Damon-Randall, assistant regional administrator of the National Oceanic and Atmospheric Administration (NOAA) Fisheries’ Protected Resources Division. “We need to do more research to see how they’re using it, but it’s a tremendous step in the right direction.”

Habitat access is essential for the recovery of these species. The removal of the Veazie Dam is only a portion of the Penobscot River Restoration Project, which, when combined with the removal of Great Works Dam in 2012, restores 100 percent of historic sturgeon habitat in the Penobscot. In addition to dam removals, construction of a nature-like fish bypass at the Howland Dam in 2015 significantly improves habitat access for the remaining nine species of sea-run fish native to the Penobscot, including Atlantic salmon and river herring.   

“Scientific research and monitoring of this monumental restoration effort has been ongoing for the past decade,” said Molly Payne Wynne, Monitoring Coordinator for the Penobscot River Restoration Trust. “The collaborative body of research on this project is among the most comprehensive when compared to other river restoration projects across the country,” Wynne said.

NOAA Fisheries is an active partner and provides funding for this long-term monitoring collaboration that includes The Penobscot River Restoration Trust, The Nature Conservancy and others. These efforts are beginning to shed light on the response of the river to the restoration project. Restoration of the full assemblage of sea-run fish to the Penobscot River will revive not only native fisheries but social, cultural and economic traditions of Maine’s largest river.
