NOAA Fisheries Seeks Comments on Proposed Rule: Framework 61 to the Northeast Multispecies Fishery Management Plan

June 24, 2021 — The following was released by NOAA Fisheries:

We are seeking public comment on an action developed by the New England Fishery Management Council that would set or adjust catch limits for groundfish stocks for the 2021 fishing year (May 1, 2021 – April 30, 2022), including the three stocks managed jointly with Canada. For 2021, Framework 61 would decrease six stock quotas, and increase four stock quotas compared to 2020. These revised catch limits are based upon the results of stock assessments conducted in 2020 and are intended to help prevent overfishing and rebuild overfished stocks.

This action would also revise the status determination criteria for Georges Bank and Southern New England/Mid-Atlantic winter flounder, implement a revised rebuilding plan for white hake, and implement a universal exemption for sectors to target redfish.

The comment period is open through 07-09-2021.

Northeast coral protection rule finalized

June 22, 2021 — A final rule setting aside coral protection areas on Georges Bank and in the Gulf of Maine was finalized Monday by NMFS, prohibiting the use of bottom-tending fishing gear with exceptions for red crab pots on Georges and lobster pots in the gulf.

The rule was developed by the New England Fishery Management Council after years of consideration with public comment and debate over balancing protection with sustainable long-term fisheries uses. Northeast cold-water corals are an important part of habitat for many fish and invertebrate species, including commercially important fish, according to NMFS.

The Mid-Atlantic Fishery Management Council went through a similar process before establishing the Frank R. Lautenberg Deep-Sea Coral Protection Area – named for the late New Jersey senator, a sponsor of ocean environmental legislation – in January 2017. The new Georges Bank protection area abuts the northeast edge of that zone on the outer continental shelf.

The Georges Bank Deep-Sea Coral Protection Area runs along the outer continental shelf in waters no shallower than 600 meters (1,968 feet) and extends to the outer limit of U.S. exclusive economic zone boundary to the east and north. The rule restricts use of bottom-tending commercial fishing gear to protect deep-sea corals from damage. Red crab pot gear is specifically exempt from the prohibition.

New coral protections coming to areas off New England

June 22, 2021 — Federal regulators have signed off on new protections for thousands of square miles of deep-sea corals off New England.

The National Oceanic and Atmospheric Administration said Monday it has approved a final rule that designates the coral protection areas on Georges Bank and in the Gulf of Maine. The largest of the underwater areas is called the Georges Bank Deep-Sea Coral Protection Area and it is located mostly southeast of Cape Cod, Massachusetts.

The protected zone places prohibitions on bottom-tending commercial fishing gear, with the exception of certain kinds of crab traps, NOAA officials said. It also creates a dedicated habitat research area called the Jordan Basin Dedicated Habitat Research Area south of the Maine coast.

NOAA said in a statement that the corals are “important sources of habitat for many species of fish and invertebrates, including commercially important fish species.”

Final Rule to Designate Coral Protection Areas on Georges Bank and in the Gulf of Maine

June 22, 2021 — The following was released by NOAA Fisheries:

Today, NOAA Fisheries signed a final rule to designate coral protection areas on Georges Bank and in the Gulf of Maine. Under the discretionary provisions for deep-sea coral protection in the Magnuson-Stevens Fishery Conservation and Management Act, the New England Fishery Management Council developed this action to reduce the impacts of fishing gear on deep-sea corals after considering long-term sustainable uses of the fishery resources in the area. The Council process took several years and included a high-degree of public input in the development of the final protection areas and associated measures. Deep-sea corals are important sources of habitat for many species of fish and invertebrates, including commercially important fish species.

This action:

  • Establishes the Georges Bank Deep-Sea Coral Protection Area. This area is on the outer continental shelf in New England waters. It complements the Frank R. Lautenberg Deep-Sea Coral Protection Area established by the Mid-Atlantic Fishery Management Council in January 2017.
  • Prohibits bottom-tending commercial fishing gear (with the exception of red crab pot gear) in the Georges Bank Coral Protection Area to protect deep-sea corals.
  • Designates the Mount Desert Rock and Outer Schoodic Ridge Coral Protection Areas in the Gulf of Maine. Vessels are prohibited from fishing with bottom-tending mobile gear in these areas. Vessels are still able to fish for lobster in these areas using trap gear.
  • Designates the Jordan Basin Dedicated Habitat Research Area in the Gulf of Maine as a dedicated habitat research area.

Atlantic Cod Stock Structure Workshops Scheduled for June, July 2021

May 21, 2021 — The following was released by the New England Fishery Management Council:

The biological stock structure of Atlantic cod and its implications for science and management will be discussed during two different rounds of public workshops. The first series, which begins on June 1, 2021, will cover the science aspects, while a second series, to be held later this year, will cover the management side.

An Atlantic Cod Stock Structure Working Group was formed in early 2018 to inventory and summarize all relevant peer-reviewed information about the stock structure of Atlantic cod in U.S. and adjacent waters.

Atlantic cod currently is managed as two stocks – Gulf of Maine and Georges Bank. However, the working group concluded in its 2020 report that the population of Atlantic cod in New England waters consists of five distinct biological stocks as follows:

  1. Georges Bank;
  2. Southern New England;
  3. Western Gulf of Maine and Cape Cod winter spawners;
  4. Western Gulf of Maine spring spawners that overlap spatially with the Western Gulf of Maine and Cape Cod winter spawner stock; and
  5. Eastern Gulf of Maine

Changes in Ocean Conditions and Human Activities Impacted the U.S. Northeast Shelf Marine Ecosystem in 2020

April 9, 2021 — The following was released by NOAA Fisheries:

Two new reports provide an updated picture of conditions supporting fisheries in the U.S. Northeast Shelf marine ecosystems. One report focuses on Georges Bank and the Gulf of Maine, two ocean regions off New England, and the other report focuses on the Mid-Atlantic Bight. These are the three major regions within the U.S. Northeast Continental Shelf Large Marine Ecosystem.

For the first time, the reports focus directly on how well we have achieved fishery management goals and the risks to achieving those goals posed by ecosystem changes and other human activities. Linkages between environmental conditions and managed species are also highlighted throughout the report. This focus ensures that scientists are providing ecosystem information in a form that the regional fishery management councils can use effectively.

Major findings in this year’s report include:

  • Seafood production trends downward
  • Recreational fishing effort is steady, but fewer anglers are taking for-hire trips
  • Waters continue to warm and marine heat waves continue
  • Less cold, fresh water is entering the Gulf of Maine
  • The Gulf Stream is further north
  • Chesapeake Bay’s warmer winter and cooler spring affected blue crab and striped bass<
  • More fish species are moving to the north and east of their historic distribution, some into deeper water

The reports also cover new and rising factors, including offshore wind energy development and COVID-19 effects on fishery harvests and scientific data collection. There are more than 20 offshore wind development projects proposed for construction over the next decade in the Northeast. They have the potential to impact many parts of the ecosystem. With sufficient data, subsequent reports will further address these factors.

NOAA Fisheries Announces Adjustments to the Possession and Trip Limit for the Common Pool Groundfish Fishery

March 10, 2021 — The following was released by NOAA Fisheries:

Effective on March 11, 2021, the new common pool possession and trip limits for Georges Bank (GB) cod, Gulf of Maine (GOM) cod, GOM haddock, Southern New England/Mid-Atlantic (SNE/MA) winter flounder, American plaice, and witch flounder are summarized in the tables below.  These increases are in effect through the end of the fishing year on April 30, 2021.

New FY 2020 Possession and Trip Limits

This action is intended to provide additional fishing opportunities and facilitate harvest of the common pool quotas.

MAINE: Lobstermen fear new rules as Biden revokes Trump executive orders on regulation

February 18, 2021 — New executive orders are flying off President Joe Biden’s desk.

Many of those orders seek to reinstate regulations lifted by former President Donald Trump or enact new ones.

Mainers who make a living on the water are particularly concerned about new regulations, and Maine’s Congressional delegation is concerned, as well.

They’ve sent multiple letters to federal agencies, attempting to inform the rulemaking process on fishery management plans.

Thousands of lobstermen say they fear that new regulations could leave them trapped.

“It could put a few of the smaller guys right out of business because they can’t compete with it,” lobsterman George Anderson said.

Conservation groups say it’s endangered whales that are feeling the pinch as they get tangled in rope.

NEFMC Receives Overview of 2020 Scallop Surveys, Biomass Estimates, and Initial 2021 Outlook

December 10, 2020 — The following was released by the New England Fishery Management Council:

During its December 1-3, 2020 webinar meeting, the New England Fishery Management Council got its first comprehensive look at 2020 scallop survey results for Georges Bank and the Mid-Atlantic. The results indicate that roughly two-thirds of the harvestable biomass – also known as exploitable biomass – is located in scallop rotational areas, and roughly one-third is available on open bottom. The Council will review Gulf of Maine survey results during its January meeting.

This year’s surveys were conducted entirely through the industry-funded Scallop Research Set-Aside (RSA) Program. The federal scallop survey was canceled due to complications associated with the COVID-19 pandemic. Here are a few highlights for Georges Bank and the Mid-Atlantic.

American Lobster Benchmark Stock Assessment Finds GOM/GBK Stock Not Overfished nor Experiencing Overfishing & SNE Stock Significantly Depleted: Assessment Introduces Regime Shift Methodology to Address Changing Environmental Conditions

October 22, 2020 — The following was released by the Atlantic States Marine Fisheries Commission:

The 2020 American Lobster Benchmark Stock Assessment presents contrasting results for the two American lobster stock units, with record high abundance and recruitment in the Gulf of Maine and Georges Bank stock (GOM/GBK) and record low abundance and recruitment in the Southern New England stock (SNE) in recent years. The GOM/GBK stock is not overfished nor experiencing overfishing. Conversely, the SNE stock is significantly depleted with poor prospects of recovery. Stock status was assessed using the University of Maine Stock Assessment Model for American Lobster (UMM, Chen et al. 2005), a statistical catch-at-length model that tracks the population of lobster by sex, size and season over time.

“On behalf of the American Lobster Board, I want to applaud the members of the Technical Committee and Stock Assessment Subcommittee for their exceptional work on the 2020 Benchmark Stock Assessment Report,” stated Board Chair Dan McKiernan from Massachusetts. “This assessment made a notable advancement in considering the impact of changing environmental conditions on lobster population dynamics.”

Extensive research has highlighted the influence of the environment on American lobster life history and population dynamics. Among the critical environmental variables, temperature stands out as the primary influence. Further, its range is experiencing changing environmental conditions at some of the fastest rates in the world. Therefore, considering these environmental influences is vital when assessing the lobster stocks and was a focal point of this stock assessment. Environmental data time series included water temperatures at several fixed monitoring stations throughout the lobster’s range, average water temperatures over large areas such as those sampled by fishery-independent surveys, oceanographic processes affecting the environment, and other environmental indicators such as lobster prey abundance.

Environmental time series were analyzed for regime shifts, which indicate a significant difference in the lobster’s environment and population dynamics from one time period to another. Regime shifts can change a stock’s productivity, impacting the stock’s level of recruitment and its ability to support different levels of catch. Temperature time series were also analyzed to quantify the effect of temperature on survey catchability of lobster and correct trends in abundance estimated from surveys by accounting for temperature-driven changes in catchability through time.
