Maine Lobstermen Lawsuit Over Boat Monitoring Tossed

November 26, 2024 — A federal judge is throwing out a lawsuit from Maine lobstermen over a rule that went into effect more than a year ago.

The rule requires lobstermen with federal fishing permits to put monitors on their boats, which tracks their location on the water.

Five lobstermen had argued that the monitors violate their constitutional rights to privacy, equal protection and due process.

Courts threaten to sink federal fishery monitoring

June 5, 2023 — NOAA’s plans to force fishermen to pay for their own surveillance hit a brick wall in 2023, and the Supreme Court could force more big changes to how the federal government keeps tabs on the state of U.S. fisheries.

While the agency has long relied on human observers and electronic tracking devices, many in the fishing industry who regard the monitoring as too expensive and an invasion of their privacy have sought relief in the courts — and so far this year, they’re winning.

NOAA suffered a major blow in February when a three-judge panel of the 5th U.S. Circuit Court of Appeals in Louisiana threw out a rule that would have required charter boats in the Gulf of Mexico to be equipped with electronic monitors to report fish catches. Fishermen complained that the devices would cost them as much as $3,000 per boat.

Say Goodbye to Bycatch: Fishing Smarter in the 21st Century

November 23, 2015 — Fishing nets are blind. They have been for thousands of years.

Just like our ancestors, today’s commercial fishermen drop their nets, or “trawls”, into dark, opaque waters. What they pull up is anyone’s guess.

In addition to the fish being targeted, their trawls also contain “by-catch”: unintended fish species and ocean wildlife that are tossed back because they cannot be sold. The thing is, by the time the nets are hauled up, most of the by-catch is already dead.

So what’s the problem with catching a few extra fish?

What if I told you that by-catch is a major contributor to overfishing and poses a significant threat to the world’s oceans? Currently, in the United States, approximately 1 in 5 fish caught by commercial fishermen are by-catch. That’s 2 billion pounds of fish and other marine species wasted each year. Imagine inadvertently capturing, killing, and disposing of 4,800 blue whales…what an enormous, destructive waste.

In attempting to solve the by-catch problem, Rob Terry, founder of SmartCatch, asked himself: what if commercial fisheries could see inside their trawls before they reel them in?

In 2014, the Lindblad Expeditions-National Geographic (LEX-NG) Fund issued a grant to Rob Terry to develop SmartCatch’s Digital Catch Monitoring System, or DigiCatch for short. With DigiCatch technology, fisherman can reduce by-catch by having eyes underwater to monitor their trawls.

Assessing Potential Impacts of Offshore Wind Farms in the Northeast Region

November 18, 2015 — The following was released by the Commercial Fisheries Research Foundation (CFRF):

CFRF is proud to announce the availability of a new report regarding fisheries research and monitoring protocols.  The report, Identifying Information Needs and Approaches for Assessing Potential Impacts of Offshore Wind Farm Development on Fisheries Resources in the Northeast Region, is the result of work conducted by the Commercial Fisheries Research Foundation and the Cornell Cooperative Extension program. Together we canvassed fisheries managers, scientists, and fishermen to provide Bureau of Ocean Energy Management (BOEM) recommendations for fishery resource research and monitoring specific to the Southern New England/New York Bight area. One of the principle recommendations of the report was to improve communication between BOEM, fishermen, and offshore wind developers in order to develop, prioritize, and review BOEM’s and lessees’ fisheries research and monitoring efforts.

ASMFC Atlantic Herring Section Approves Public Hearing Document on Draft Amendment 3 for Public Comment

November 3, 2015 — ST. AUGUSTINE, Fl. – The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic States Marine Fisheries Commission’s Atlantic Herring Section approved the Public Hearing Document for Draft Amendment 3 to the Interstate Fishery Management Plan (FMP) for Atlantic Herring for public comment. Draft Amendment 3 was initiated to strengthen spawning protections in Area 1A (inshore Gulf of Maine) and address concerns raised by the commercial fishing industry. The Public Hearing Document proposes (1) alternatives to the spawning monitoring program (protocol, default start dates, area boundaries, and length of the closure period); (2) removing the fixed gear set‐aside rollover provision, and (3) requiring a vessel’s fish hold to be emptied before leaving on a fishing trip.

Today’s rebuilt herring population is comprised of a broader range of age classes with older and larger fish compared to the population during overfished conditions. Analysis of more than a decade’s worth of data suggests larger herring spawn first and the timing of the start of spawning varies from year-to-year. Proposed alternatives to the current spawning monitoring program address inter-annual differences and provide additional measures to more adequately protect spawning fish in the areas where they spawn.

At the request of the fishing industry, the Public Hearing Document includes an option to adjust the fixed gear set-aside rollover provision. Currently, the set-aside of 295 mt is available to fixed gear fishermen through November 1, after which the remaining set-aside becomes available to the rest of the Area 1A fishery. The November 1 date was set because, typically, herring have migrated out of the Gulf of Maine by that time. Anecdotal evidence suggests herring are in the Gulf of Maine after November 1, therefore, fixed gear fishermen requested the set-aside be made available to them for the remainder of the calendar year.

Members of industry also suggested a requirement for fish holds to be empty of fish prior to trip departures. This provision would allow for full accountability and encourage less wasteful fishing practices by creating an incentive to catch herring to meet market demands. The New England Fishery Management Council included a complementary provision in its Framework Adjustment 4 to the Federal Atlantic Herring FMP.  

The states will be conducting public hearings on the Public Hearing Document this winter. Fishermen and other interested groups are encouraged to provide input on the Public Hearing Document either by attending state public hearings or providing written comment. A subsequent press release will announce the availability of the Public Hearing Document, details of the scheduled hearings, as well as the deadline for the submission of public comment.
