CALIFORNIA: Can sustainably caught swordfish make waves on the Central Coast?

December 31, 2018 — Will sustainably-caught swordfish receive a wave of support from Central Coast fishermen, consumers and restaurateurs?

Clean-fishing advocates sure hope so as efforts continue to phase out the use of drift gillnets — the mile-long, 100-foot-wide nets currently used to catch swordfish — which  commonly collect and kill protected species like whales, dolphins, and sea turtles.

On Sept. 28,  Gov. Jerry Brown signed Senate Bill 1017, which requires the state Department of Fish and Wildlife get funding for and enact a transition program that would help fishermen switch to alternative fishing gear.

Under the program, up to $10,000 would be offered for fisheries to turn in their drift gillnet permits, and transition to “clean-fishing” gear.

The California Department of Fish and Wildlife has until March of 2020 to roll out the drift gillnet “buyout.” However, the department still needs to raise $1 million to trigger the revocation of all drift gillnet permits. The money would have to come from federal funding or private donor sources.

NEW YORK: A Push for Offshore Oil

December 7, 2018 — A recent move by the Trump administration could lead the way to oil and gas exploration and extraction off the Atlantic coast.

The Washington Post reported on Friday that the National Marine Fisheries Service, a division of the National Oceanic and Atmospheric Administration, has approved five requests that will allow companies to conduct seismic surveys. The “incidental take” authorizations allow companies conducting such surveys — geophysical companies working on behalf of oil and gas corporations, The Post reported — to harm marine life as long as it is unintentional.

Such surveys would be conducted using seismic air guns, which emit loud blasts on a recurring basis, 10 seconds apart for 24 hours a day, often for weeks at a time, according to the environmental group Greenpeace. The sonic blasts, or “pings,” penetrate through the ocean and miles into the seafloor and can harm whales, dolphins, sea turtles, and fish. They can result in temporary and permanent hearing loss, habitat abandonment, disruption of mating and feeding, beachings, and death, according to Greenpeace.

Trump Said to Advance Seismic Surveys for Oil in Atlantic

November 30, 2018 — The Trump administration is taking a major step toward allowing a first-in-a-generation seismic search for oil and gas under Atlantic waters, despite protests that the geological tests involve loud air gun blasts that will harm whales, dolphins and other animals.

The National Marine Fisheries Service is set to issue “incidental harassment authorizations” allowing seismic surveys proposed by five companies that permits them to disturb marine mammals that are otherwise protected by federal law, according to three people familiar with the activity who asked not to be named before a formal announcement.

The firms, including TGS-NOPEC Geophysical Co. Asa and Schlumberger Ltd. subsidiary WesternGeco Ltd., still must win individual permits from the Interior Department’s Bureau of Ocean Energy Management before they can conduct the work, but those are widely expected under President Donald Trump, who has made “energy dominance” a signature goal.

U.S. Withdrawal of California Gillnet Protections for Whales, Turtles Ruled Illegal

October 29, 2018 — The Trump administration unlawfully withdrew a plan to limit the number of whales, turtles and other marine creatures permitted to be inadvertently killed or harmed by drift gillnets used to catch swordfish off California, a federal judge has ruled.

The decision requires U.S. fisheries managers to take steps to implement the plan, which calls for placing numerical limits on the “bycatch” of bottlenose dolphins, four whale species and four sea turtle species snared in swordfish gillnets.

As currently written, the regulation in question also would mandate suspension of swordfish gillnet operations altogether off Southern California if any one of the bycatch limits were exceeded.

The Pacific Fishery Management Council endorsed the plan in 2015, and it was formally proposed for implementation by the U.S. Commerce Department’s National Marine Fisheries Service the following year.

The rule was expected to gain final approval but was abruptly withdrawn instead in June 2017 under President Donald Trump, whose Commerce Department determined the cost to the commercial fishing industry outweighed conservation benefits.

The environmental group Oceana sued, accusing the Commerce Department of violating U.S. fisheries laws and the federal Administrative Procedures Act. Oceana also asked the courts to order the agency to put the bycatch limits into effect.

U.S. District Judge R. Gary Klausner declined to force the National Marine Fisheries Service to immediately implement the restrictions in a decision handed down Wednesday in Los Angeles.

But he sided with environmentalists in finding the agency’s reversal exceeded its authority and was “arbitrary, capricious or an abuse of its discretion.”

What happens to fish and other sea creatures underwater during a hurricane

October 18, 2018 — Hurricanes can be just as deadly for marine life, sometimes stranding them on land or far out at sea. But sometimes marine life benefits or even thrives after these extreme weather events.

Normally when a hurricane is headed for us, we run the other way. But not Isla. She’s a leatherback turtle who was meandering off the coast of Virginia when she accidentally swam straight into Hurricane Florence. Scientists were worried she’d get caught up in the worst of the storm but Isla managed to survive by swimming toward deeper waters.

Turns out, there’s a part of hurricanes we don’t often think about: What happens under the surface. And Isla is just one example.

Far out at sea, fish that live near the surface might feel some turbulence as a storm passes. But most sea creatures — including dolphins, whales, and sharks — avoid the rough surface water and swim to calmer seas. But it’s a different story near shore.

Changes in water temperature and salinity can be catastrophic for marine life. Hurricanes can generate massive waves. Which mix warm surface water with colder, saltier water below generating currents that extend up to 91 meters below the surface. These currents are so strong that they can sweep manatees inland to canals and ponds or away from the coastal waters they prefer, and out into the open ocean. Where they can become disorientated, and even die.

Hurricanes also bring heavy rain, so freshwater often floods coastal regions. And because freshwater is less dense than salt water, it sits on top of the sea water like oil on vinegar. Where it can prevent oxygen from reaching the salty layer below. And disrupt the salinity levels, which can lead to sores, lesions, and ultimately death in whales, dolphins, and porpoises.

Hurricanes also kick up dirt and sand in shallow seas. Which can kill fish by clogging their gills. Experts think this is probably one of the factors that killed an estimated 9.4 million saltwater fish in 1992, during Hurricane Andrew. The dirty, murky water also blocks sunlight from reaching corals and seagrass. In fact, scientists found that coral cover in the Caribbean decreases by 17% in just one year after a hurricane strikes. And that’s in addition to the stress coral already face from human interference.

But it’s not always so bad for sea life. After Hurricane Katrina damaged or destroyed almost 90% of fishing boats in the Mississippi Sound scientists observed a huge increase in dolphin births. Without the fishing boats, dolphins suddenly found themselves with more available prey which helped their populations thrive.

California bans giant ocean fishing nets blamed for killing sea turtles, whales

September 28, 2018 — Ending years of controversy and debate, Gov. Jerry Brown late Thursday signed a new law phasing out the use of giant ocean fishing nets used to catch swordfish, but blamed for accidentally killing sea turtles, dolphins and other sea creatures.

The bill, SB 1017 by state Sen. Ben Allen, D-Redondo Beach, requires the state to set up a program to buy back nets and fishing permits from commercial fishermen who work in the state’s drift gill net fishery.

The nets — giant nylon curtains that can stretch one mile long and extend 100 feet underwater — are used mostly by fishermen between San Diego and Big Sur. Although they are intended to catch swordfish, thresher shark and opah, studies have shown that they entangle dozens of other marine species, including whales, dolphins, sea lions and sea turtles, fish and sharks. Those animals, known as bycatch, are often thrown back overboard, injured or dead.

“There is no longer room in our oceans for any fishery that throws away more than it keeps,” said Susan Murray, deputy vice president for Oceana, an environmental group with offices in Monterey that pushed for the new law.

NOAA Funds Projects to Reduce Bycatch With Engineering

September 4, 2018 — A group of organizations is getting more than $2 million in grants to use engineering to try to reduce bycatch in fisheries.

Bycatch is the term for when fish and other animals are accidentally caught with gear that was seeking a different species. Bycatch poses problems for rare species of dolphins, turtles, sharks and other animals.

The National Oceanic and Atmospheric Administration is awarding more than $2.3 million to 14 projects as part of its 2018 Bycatch Reduction Engineering Program.

One of the recipients is Duke University, which will test the applicability of sensory-based bycatch reduction technology. Duke’s project seeks to reduce sea turtle bycatch in North Carolina.

The Council is also soliciting applicants to represent commercial and recreational interests on its System Management Plan (SMP) Workgroup. The newly formed workgroup will provide recommendations on managed areas in federal waters under the Council’s jurisdiction. The Council currently has system management plans in place for Deepwater Marine Protected Areas, Spawning Special Management Zones, and the Oculina Experimental Closed Area. Additional areas will be added, with the goal to eventually have a single System Management Plan in place for all managed areas.

Court Orders Seafood Import Ban to Save Vaquita

July 31, 2018 — Responding to a lawsuit filed by conservation groups, the U.S. Court of International Trade has ordered the U.S. Government to ban seafood imports from Mexico caught with gillnets that kill the critically endangered vaquita porpoise.

As few as 15 vaquita remain, and almost half the population drowns in fishing gillnets each year. Without immediate additional protection, the porpoise could be extinct by 2021.

This is the life line the vaquita desperately needs, said Giulia Good Stefani, staff attorney with the Natural Resources Defense Council, who argued the case before the Court.

The ruling follows a lawsuit filed in March by the Natural Resources Defense Council, the Animal Welfare Institute and the Center for Biological Diversity, and it affirms Congress’ mandate under the U.S. Marine Mammal Protection Act that the United States protect not just domestic marine mammals, but also foreign whales, dolphins, and porpoises.

Are Chesapeake Bay dolphins eating all the fish?

July 18, 2018 — Rockfish are a Chesapeake Bay delicacy pursued heavily by commercial and recreational fishermen alike.

But many say it’s been a poor year on the Bay and now a growing number are beginning to question whether an apparently increasing population of dolphins in the Bay might be to blame.

Researchers who have been tracking dolphins in increasing numbers said they don’t have any answers.

“We don’t have information to confirm one way or the other if there is any impact,” say Greg Bortz, a spokesman for the Maryland Department of Natural Resources.

Many commercial watermen said dolphins are chasing and eating valuable game species like rockfish, but there are many other environmental factors that are impacting the health of the Bay this season.

“We’ve had a lot of weather that isn’t normal,” said commercial fisherman Andy Mattes III, who noted heavy rains this spring and high temperatures this summer.

Mattes said low oxygen in much of the bay cause by polluted runoff is a major problem. He said blaming dolphins is too simplistic.
