Industry Says Fisheries “Will be Curtailed or Shut Down Entirely” if Grijalva MSA Bill Passes

September 26, 2022 — In a strongly-worded letter sent yesterday to Chairman Jared Huffman (D-CA) of the Natural Resources Subcommittee on Water, Oceans and Wildlife, over 40 seafood organizations and 100 individual members of the industry nationwide, asked Huffman to “pause the committee process and return to and review the detailed concerns that have been raised by stakeholders through testimony and direct submissions.”

HR 4690 was introduced by Huffman a year ago and a substitute was offered by Rep. Raul Grijalva (D-AZ), who chairs the House Committee on Natural Resources. That committee was marking the bill up yesterday, when the letter was sent. Support for the letter came quickly from the National Fisheries Institute (NFI), National Restaurant Association (NRA), National Retail Federation (NRF), and the National Council of Chain Restaurants (NCCR).

“On behalf of the U.S. fishing and seafood sector participants we represent we write in opposition to the Amendment in the Nature of Substitute offered by Chairman Grijalva on September 14, 2022 to revise your legislation, H.R. 4690, to reauthorize the Magnuson-Stevens Fishery Conservation and Management Act (MSA),” the letter began.

Testimony from industry stakeholders has focused on many new sections to the legislation that has governed how the U.S. manages federal fisheries since 1976. The draft bill includes new sections on Climate Change, bycatch, tribal representatives at the North Pacific Council, habitat protection, among others.

HUFFMAN, GRIJALVA, CASE ISSUE JOINT STATEMENT ON INSPECTOR GENERAL AUDIT OF WESTERN PACIFIC REGIONAL FISHERY MANAGEMENT COUNCIL

November 16, 2021 — The following was released by the Office of Congressman Jared Huffman:

Water Oceans and Wildlife Subcommittee Chair Jared Huffman (D-Calif.), Chair Raúl M. Grijalva (D-Ariz.), Rep. Ed Case (D-Hawaii) and Rep. Gregorio Sablan (D-CNMI) issued the following joint statement regarding the recent audit of the Western Pacific Sustainable Fisheries Fund (WPSFF) conducted by the Department of Commerce Office of the Inspector General.

The audit found that the Western Pacific Fisheries Management Council (WESPAC) and its sub-recipients claimed questionable costs of more than $1.2 million in awards – 40% of all costs it examined – and didn’t obtain required approvals or have sufficient documentation.

“The results are deeply alarming. The Inspector General’s audit is a necessary first step towards the transparency and accountability that is needed to ensure WESPAC is not wasting the taxpayers’ money it is entrusted with,” Chair Grijalva said. “As damning as this report is, it raises more questions about WESPAC than it answers. Their financial activities should continue to be examined.”

“The Western Pacific Council’s management of the Western Pacific Sustainable Fisheries Fund Award has long been questionable, and this audit of the Fund paints an unflattering picture of WESPAC’s financial activities, to say the least,” said Rep. Huffman. “As Chair of the Water, Oceans, and Wildlife Subcommittee, it is clear Congress must take action to improve oversight and management of WESPAC and ensure that government funds are being spent responsibly. On Tuesday, we are holding a hearing on my and Rep. Case’s bill, the Sustaining America’s Fisheries for the Future Act, which takes steps to address these issues by adding transparency and reporting requirements for the Fund.”

“The Inspector General’s report underscores the need for substantial reforms in the way that WESPAC does business. Our federal dollars should be spent on the critical mission of sustaining and conserving vital marine ecosystems, not on controversial awards and questionable and unsupported spending at the behest of council staff with potential conflicts of interest,” said Rep. Case. “This report is just the beginning of our inquiry and response. We must act on the report’s findings to prevent any further waste and abuse of government funds by WESPAC and potentially other regional fishery councils operating under the same rules.”

“The Inspector General found $1.2 million in questionable expenditures by WESPAC and breaches of the rules on sole-source contracts and other financial controls. This all confirms the concerns that led Chair Grijalva, Representatives Huffman and Case, and me to request this in-depth audit of how WESPAC uses federal funds,” said Rep. Sablan. “I look forward to the decision of NOAA’s Grants Management Division on the appropriate next steps to recover any money that was improperly paid.”

The WPSFF administered by the National Oceanic and Atmospheric Administration (NOAA) was established under the Magnuson-Stevens Fishery Conservation Act (MSA) and was intended to support conservation efforts in the U.S. Pacific territories and Hawai’i. Funds are provided by NOAA to WESPAC, which carries out contracts and subawards for projects. However, concerns raised from oversight of NOAA led to the audit request by Chair Grijalva, Rep. Huffman, Rep. Case and Rep. Sablan more than two years ago.

House Democrats Agree to $100 Million Allocation for Critically Endangered Species

August 31, 2021 — In a memo released by the House Natural Resources Committee, House Democrats will provide $550 million to the US Fish and Wildlife Service in the upcoming budget reconciliation package, including $100 million for some of the most critically imperiled species in the United States.

The legislation will include $25 million to conserve and restore four of the most imperiled types of endangered species in the United States: butterflies, eastern freshwater mussels, Southwest desert fish and Hawaiian plants.

“This is the largest investment in the recovery of endangered species in a generation, and I couldn’t be more thrilled,” said Brett Hartl, government affairs director at the Center for Biological Diversity. “If we’re going to tackle the extinction crisis and save these incredible species from the brink, this is exactly the type of bold action that’s needed.”

The reconciliation language mirrors Chairman Raúl Grijalva’s Extinction Prevention Act of 2021, which would fund on-the-ground conservation actions to stabilize the four groups of struggling endangered species.

A 2016 study found that Congress only provides approximately 3.5% of the estimated funding the Fish and Wildlife Service’s scientists say is needed to recover species. Roughly 1 in 4 species receives less than $10,000 a year toward recovery, and many of the endangered species that will benefit from this funding receive nothing for recovery in a given year.

Fishing interests fight ocean closures bill

November 20, 2020 — A national coalition of seafood industry and commercial fishery stakeholders is mobilizing against congressional legislation that would exclude commercial fishing from wide swaths of the nation’s fisheries.

The House bill, filed in late October by U.S. Rep. Raul Grivalja of Arizona, seeks to use “marine protected areas” to ban all “commercial extractive use” across 30% of the nation’s exclusive economic zone by 2030. The closures would be part of the so-called “30×30” strategy to conserve 30% of ocean habitat worldwide by the 2030 target date.

In a letter to Grivalja, more than 800 fishing stakeholders, including the Gloucester-based Northeast Seafood Coalition, framed the conservation-fueled proposal as an undermining threat to the Magnuson Stevens Fishery Conservation and Management Act and an assault on the economic viability of fishing communities from New England to Alaska.

“Members are the commercial fishing industry are very concerned about the attempt to undermine the Magnuson Act via these proposed pieces of legislation,” said Jackie Odell, executive director of the Northeast Seafood Coalition.

Ocean climate bill is a grab bag for marine stakeholders

November 18, 2020 — Rep. Raul Grijalva (D-Ariz.), chairman of the House Committee on Natural Resources, today introduced the Oceans-Based Climate Solutions Act of 2020.

We could start with the irony of a representative from Arizona introducing an oceans climate bill, hailing not only from a landlocked state, but one most known for its lack of water.

But let’s instead lead with the fact that the blueprint for this bill was introduced and failed to make it out of committee in California — one of the nation’s most progressive states. Now Gov. Gavin Newsom has made an end run around the legislative process by creating an executive order to effect the changes in the bill that could not pass with votes.

The federal bill is more than a mixed bag. Reading its 324 pages felt like swinging at a piñata packed with a mix of treats and lit fireworks.

Coalition of seafood industry members oppose new Ocean-Based Climate Solutions Act

November 17, 2020 — A coalition of more than 800 members of the U.S. seafood industry have signed a letter opposing a new bill that they say will undermine the nation’s “world-class system of fisheries management.”

The bill, the Ocean-Based Climate Solutions Act, was introduced in the U.S. House of Representatives in late October. The 300-page-long bill was co-authored by U.S. Rep. Raul M. Grijalva (D-Arizona) and U.S. Rep. Kathy Castor (D-Florida) and contains sweeping rule-making that touches on fisheries sectors.

LINDA BEHNKEN & MIKE CONROY: Sustainable fisheries are facing a moratorium

November 17, 2020 — American wild-caught seafood is integral to the nation’s food supply and to American food security. We’ve been working hard to keep it that way in the face of climate change. The people who catch fish for a living experience climate impacts directly. We recognized it early and we’ve responded. In fact, U.S. fishermen have been part of the solution to habitat conservation and climate responses for decades.

Nonetheless, some politicians and environmental organizations have embraced a version of an initiative called 30×30 (“thirty by thirty”) that would damage our nation’s sustainable fisheries and robust fisheries management process. Broadly, 30×30 aims to conserve 30 percent of habitat worldwide by the end of the decade — 2030. The 30×30 approach has been embraced by President-elect Biden’s campaign, and there’s talk he will sign an executive order on his first day in office.

We’re eager to engage with the new administration to address climate impacts and protect habitat. Proactive and durable ocean policy changes need to happen with us, not to us.

Our organizations have advocated for strong ocean conservation for decades, and we’ve built a fisheries management system that will continue to provide enduring protections to ocean habitat while insisting fishermen participate. The results are striking: we’ve established deep-sea habitat protection areas covering over 45 percent of U.S. waters off the West Coast. In 1998 we prohibited trawling off the entire coast of Southeast Alaska. Recently, the New England and Mid-Atlantic regions enacted major deep-sea coral protections that prohibit the use of impactful gear in sensitive areas.

Over 800 Seafood Industry Members Write to Oppose the Fisheries Provisions of the House Democrats’ Climate Bill

November 16, 2020 — Over 800 participants in our nation’s seafood economy wrote today to Chairman Raúl Grijalva of the U.S. House of Representatives Committee on Natural Resources to express deep concern regarding Title II of the Ocean-Based Climate Solutions Act, recently introduced by the committee Democrats. The signers of the letter argue that the bill would undermine our nation’s world-class system of fisheries management, harming fishermen and the coastal communities they sustain. They urged the chairman to fundamentally rethink Title II’s provisions.

Of particular concern is the bill’s mandate that would compel the Executive Branch to establish Marine Protected Areas (MPAs) that prohibit all commercial fishing activity across at least 30 percent of the nation’s Exclusive Economic Zone (EEZ) by 2030.  The proposal is known by the slogan “30 by 30”.

The House Natural Resources Committee plans a hearing tomorrow to cover this bill, among several others.

The letter was organized by the At-sea Processors Association, the National Fisheries Institute, Saving Seafood, and the Seafood Harvesters of America.

U.S. House of Representatives introduces bill with 25-GW by 2030 offshore wind target

October 22, 2020 — House Natural Resources Committee Chair Raúl M. Grijalva unveiled his Ocean-Based Climate Solutions Act at a virtual press conference with his co-lead, House Select Committee on the Climate Crisis Chair Kathy Castor, original cosponsors and a range of bill endorsers. This landmark legislation was introduced by more than a dozen members of the House of Representatives to address the ocean impacts of climate change and reform federal ocean management to better account for climate mitigation.

“The ocean is a powerful ally in the climate fight, and unleashing its potential will help us reach our goal of net-zero emissions by 2050 or earlier,” Castor said. “The Ocean-Based Climate Solutions Act incorporates many of the recommendations in our Climate Crisis Action Plan, which gives Congress a roadmap for creating a healthier, more resilient, and more just America. It will unleash the incredible power of the ocean and address the threat that offshore drilling poses to America’s coastal communities, including my own community in the Tampa Bay.”

The Act includes a national offshore wind target of 12.5 GW by 2025 and 25 GW by 2030.

AWEA CEO Tom Kiernan thanked the committee on including wind energy in the ocean bill.
