As Trump pares back ocean protections, California weighs expanding them

May 5, 2025 — Strands of kelp glow in the dim morning light off California’s Channel Islands as fish and sea lions weave through the golden fronds. It’s a scene of remarkable abundance — the result of more than two decades of protection in one of the state’s oldest marine reserves.

But farther out in the Pacific, life in the vast Pacific Remote Islands Marine National Monument faces a very different future. The Trump administration has moved to reopen 500,000 square miles (about 1.3 million square kilometers) of previously protected waters there to commercial fishing, in a dramatic rollback of federal ocean protections.

California, meanwhile, may be headed in the opposite direction. As it undertakes its first 10-year review of its marine protected area network, state officials, scientists, tribal leaders and environmental advocates are pushing not just to maintain protections but to expand them.

But expansion proposals have sparked debate among fishermen.

Trump opens swath of pristine Pacific Ocean to commercial fishing

April 18, 2025 — President Donald Trump on Thursday issued a proclamation saying he is easing federal restrictions on commercial fishing in a vast protected area of the central Pacific known as the Pacific Islands Heritage Marine National Monument.

Trump said he will allow U.S.-flagged vessels to fish within 50 to 200 nautical miles of the landward boundaries of the monument, which covers some 490,000 square miles of open ocean, coral reef and island habitats. Located south and west of Hawaii, the area is home to seven national wildlife refuges. It includes some of the Earth’s last pristine maritime environments, serving as a sanctuary for species such as endangered sea turtles, sharks and migratory birds, according to marine wildlife experts.

In a separate executive order Thursday, Trump also said he would reduce regulations on commercial fishing more broadly and asked his secretary of commerce to “identify the most heavily overregulated fisheries” and take action to “reduce the regulatory burden on them.”

Trump’s directives, which are likely to attract legal challenges, seek to weaken protections initially set up by his predecessors. President George W. Bush in 2009 established the monument and restricted oil exploration and commercial fishing within it. In 2014, his successor Barack Obama, expanded the protected area to more than 490,000 square miles.

Trump, in the proclamation, said existing environmental laws provide sufficient protection for marine wildlife in the area and that many of the fish species in the monument are migratory.

“I find that appropriately managed commercial fishing would not put objects of scientific and historic interest [within the monument] at risk,” he said.

Bob Vanasse, executive director of the commercial fishing trade group Saving Seafood, said in an email that the shift in policy “does not create a commercial fishing free-for-all in the monuments.”

“Commercial fishing in the monuments will be allowed only under fishery management plans that manage the fisheries sustainably under the Magnuson-Stevens Fishery Conservation and Management Act,” Vanasse said, referring to the law that governs fishing in federal waters.

Fact Sheet: President Donald J. Trump Unleashes American Commercial Fishing in the Pacific

UNLEASHING OPPORTUNITY IN THE PACIFIC: Today, President Donald J. Trump signed a proclamation to unleash American commercial fishing in the Pacific Ocean—a key component of the America First Fishing Policy.

  • The proclamation opens the Pacific Remote Islands Marine National Monument (PRIMNM) to commercial fishing, boosting the economy of American Samoa.
  • It allows U.S.-flagged vessels to fish commercially within 50 to 200 nautical miles of the PRIMNM’s boundaries.

EMPOWERING AMERICAN COMMERCIAL FISHERMEN: President Trump believes that removing unnecessary restrictions on American fishermen will strengthen the U.S. economy, support local communities, and restore fairness to an industry disadvantaged by overregulation and foreign competition.

  • The PRIMNM was first established by President Bush in 2009 and then expanded by President Obama, closing off over 400,000 square miles of the U.S. Exclusive Economic Zone in the Pacific.
  • The ban on commercial fishing within the PRIMNM did little to guard fish populations against overfishing, as tuna and other pelagic species are migratory in nature and do not permanently reside within the PRIMNM.
  • As a result of the prohibitions on commercial fishing, American fishing fleets have lost access to nearly half of the United States’ Exclusive Economic Zone in the Pacific Islands.

Trump Issues Proclamation on “Unleashing American Commercial Fishing in the Pacific”

WASHINGTON (Saving Seafood) — April 17, 2025 — President Donald J. Trump issued a proclamation modifying the management of the Pacific Remote Islands Marine National Monument (PRIMNM), which was previously established and expanded by Proclamations 8336 (2009) and 9173 (2014).

Key Points:

  • Commercial Fishing Allowed: The proclamation lifts the prohibition on commercial fishing in areas of the PRIMNM that are between 50 to 200 nautical miles from land and within the U.S. Exclusive Economic Zone (EEZ). Only U.S.-flagged vessels are permitted to fish, although foreign vessels may be allowed to transship U.S.-harvested fish.
  • Justification: The proclamation argues that commercial fishing, if properly managed, does not threaten the monument’s protected scientific and historic objects (e.g., fish, coral, birds, marine mammals). A Biden effort to conserve oceans is leaving out Indigenous peoples, report finds

July 3, 2024 — President Biden’s administration wants to create the largest non-contiguous protected ocean area in the world, but a new paper says the effort is failing to take into account the rights and perspectives of the Indigenous peoples most affected by the change.

The Pacific Remote Islands Marine National Monument was established in 2009 and currently preserves nearly half a million square miles of ocean surrounding seven islands in the central and western Pacific. The Biden administration is seeking to strengthen environmental protections by overlaying and expanding the area of protection up to 770,000 square miles and designating it as a national marine sanctuary. The monument already bans commercial resource extraction like deep-sea mining, but the proposed sanctuary would both expand the protected waters and give the whole area an additional layer of federal protection.

The expansion would also make a dent in the Biden administration’s goal to conserve 30 percent of the country’s land and waters by 2030.

However, according to Angelo Villagomez and Steven Manaʻoakamai Johnson, authors of the peer-reviewed article in Environmental Justice, the Biden administration has privileged Native Hawaiian perspectives (who are supportive of the expansion, which does not extend to the archipelago) over those of other Indigenous Pacific Islanders, namely Micronesians and Samoans, who have less political power in the U.S. system and have voiced more concerns about the proposal.

“Anti-Micronesian bias and colonialism are harming efforts to protect and manage waters surrounding U.S. overseas territories in the Pacific Islands,” the authors wrote. “The proposal is problematic because it has failed to meaningfully include the Indigenous people who live closest to the region and who have the strongest historical and cultural ties to the islands — Micronesians and Samoans.”

Council Offended by Removal of Last Vestiges of US Ocean Waters Open to Fishing

June 24, 2022 — The following was released by the Western Pacific Regional Fishery Management Council:

The Council supported permitting non-commercial fishing and prohibiting commercial fishing in the Monument Expansion Area of the Northwestern Hawaiian Islands (NWHI) (50 to 200 nautical miles). Council members were infuriated because continuing to close areas to fishing is an affront to indigenous peoples. Members stressed the importance of continuing indigenous cultures and practices. Guam Council Vice Chair Manny Dueñas said, “Permitting fishing perpetuates Hawaiian culture, and does not preserve it in a pickle jar. Whether they decide to or not, I want the Hawaiians to have the opportunity to be able to practice their culture.”

“It is important that we allow Native Hawaiian traditional practices, but minimize the impacts from non-native fishing,” said David Sakoda, Council representative for the State of Hawai‘i.

Council Executive Director Kitty Simonds asked, “How much more protection would we have by an overlay of the sanctuary? Closing these waters to protect migratory fish is futile when the fish move everywhere.”

The Council will develop the details for provisions related to non-commercial fishing in the NWHI, including Native Hawaiian practices and cooperative research to amend the Council’s Fishery Ecosystem Plans for initial action in September.

The Council also discussed a proposal to further expand the Pacific Remote Islands Marine National Monument (PRIMNM), closing waters 50 to 200 nautical miles seaward of Palmyra Atoll, Kingman Reef and Howland and Baker Islands. The existing PRIMNM already closes all waters 0 to 200 nm around Wake Island, Johnston Atoll, Jarvis Island, and closes waters 0 to 50 nm from the proposed island areas.

“With the additional restrictions that keep getting placed on indigenous fishermen, pretty soon no one will be able to go fishing. This has got to stop,” emphasized Monique Amani, Council member from Guam. “During the pandemic, the islands came together to utilize their subsistence traditions of fishing to support each other.”

Expansion would jeopardize the viability of the tuna cannery in American Samoa, the largest employer in the territory. The cannery relies on fish supply from the U.S.-flagged purse seine fleet, which has declined from 38 to 13 vessels. Closing the remaining U.S. waters of Howland, Baker, and Palmyra Islands forces U.S. purse seiners to fish farther away from American Samoa and thereby deliver their catch to closer ports, like Ecuador.

“More than half of the people in American Samoa live below the poverty level,” said Council Chair Archie Soliai. “If the president signs off on this, it will be in conflict with his executive order on advancing equity and environmental justice in underserved communities.”

CNMI Council member McGrew Rice added, “We need to consider that the Pacific Remote Islands monument is surrounded by more than 3,000 foreign vessels that fish in the Western and Central Pacific Ocean. All it’s doing is increasing fishing privileges for competing foreign fleets that don’t manage to our standards.”

Council members continued to express frustration with restricted access to fishing within monuments and sanctuaries in their areas. “What is the point of a monument expansion?” asked Guam Council member Chelsa Muña-Brecht. “Is it to preserve the pretty fish in the area? It doesn’t serve the community and doesn’t level the playing ground between U.S. and foreign fishers.”

The Antiquities Act that presidents use to establish monuments is not a transparent process, but implemented through a “top-down” approach that conflicts with equity and environmental justice principles. “The Antiquities Act was intended to protect burial sites and relics of indigenous people. It is not an appropriate approach to marine conservation – we have the MSA for that,” said John Gourley, Council vice chair from the CNMI. “Monument designation bypasses the courtesy of involving affected communities.”

Hawai‘i Council member Matt Ramsey said, “To avoid unintended consequences, it’s critical that stakeholder engagement occurs early on in the process of developing a fisheries management proposal. Those most impacted by a management action need to have an opportunity to learn about the proposed action and share their perspective.”

The Council will ask President Biden for a comprehensive evaluation of the unintended consequences of the proposed expansion and that any measures be evaluated through a transparent and public process prior to implementation.

Council Concerned With Lack of Support for Western Pacific Fishing Communities

June 22, 2022 — The following was released by the Western Pacific Regional Fishery Management Council:

On the first day of the Western Pacific Regional Fishery Management Council meeting, members learned that while the National Marine Fisheries Service (NMFS) FY2022 budget increased this year, the Council’s annual request was reduced by $343K. This cut will impact capacity-building efforts, the annual report on the status of fisheries in the region and the protected species program.

Council members were critical of the devaluing of fisheries in the Pacific Islands. Council Chair Taotasi Archie Soliai was concerned that Council programs are being impacted. “NMFS keeps talking about equity and justice, but this is not seen in our islands.”

Soliai continued, “Our economies and cultures depend on the ocean and fishing,” noting the proposed closure of the remaining waters of the Pacific Remote Island Areas north of American Samoa. Governor Mauga of American Samoa asked President Biden not to expand the Pacific Remote Islands Marine National Monument, while Governor Ige of Hawai‘i supported the request by the Pacific Remote Islands Coalition (PRIC). “Hawaii has a large, highly developed and diversified economy. American Samoa does not,” said Governor Mauga. “American Samoa is highly dependent on the United States for financial assistance to support our infrastructure, harbors, airports, hospitals, and schools. Manny Dueñas, Council vice chair from Guam, echoed the chair’s comments, noting that the reduction of funding and additional closures are a “personal and major concern to the fishing communities in the islands” and that “in the Marianas, we need to fish to feed our people.”

Council members discussed a delinquent NMFS draft bottomfish fisheries biological opinion (BiOp) that was provided to the Council less than three weeks ago for comments. The publication of the opinion took three years to develop and John Gourley, Council vice chair from the Commonwealth of the Northern Marianas (CNMI), commented, “fishermen have been waiting for this to be completed to ensure they weren’t adversely affecting the protected species in their area.”

Council members also expressed their frustration with BiOp delays for the Hawai‘i deep-set longline and American Samoa longline fisheries, noting the extended delays create uncertainties that cause anxiety. The Council Executive Director Kitty Simonds reminded the NMFS regional administrator that there is a policy directive that recognizes the Council’s unique role in helping NMFS comply with the Endangered Species Act. The Council remains optimistic that it will have the opportunity to review draft BiOps prior to its next meeting in September.

The Council also requested the U.S. Coast Guard station a fast response cutter in American Samoa to support U.S. coastal security, national and international fishery patrols, search and rescue and national defense. As international fisheries around American Samoa grow, the Council would like to ensure that illegal, unreported and unregulated fishing does not encroach into the U.S. exclusive economic zone.

The Council will convene tomorrow, Wednesday, June 22 for the second of its three-day meeting to review and potentially make recommendations on protected species, pelagic and international fisheries, and program planning and research. Federal Fishery Managers Weigh-In on Marine National Monument draft plans, COVID-19 Impacts to Fisheries and More

June 25, 2020 — The following was released by the Western Pacific Regional Fishery Management Council:

The Western Pacific Regional Fishery Management Council concluded the first day of its three-day virtual meeting yesterday with discussions and recommendations regarding the work of partner agencies and program planning. Topics ranged from marine national monuments, COVID-19 impacts, stock assessments, fisheries performance and more. The Council manages federal fisheries operating in waters offshore of the State of Hawai’i, the Territories of American Samoa and Guam, the Commonwealth of the Northern Mariana Islands (CNMI) and the US Pacific Remote Islands Areas.

The National Marine Fisheries Service (NMFS) Pacific Islands Regional Office (PIRO) reported that development of draft management plans for two marine national monuments are ongoing. The Pacific Remote Islands Marine National Monument (PRIMNM) and Marianas Trench Marine National Monument were established on Jan. 6, 2009, by presidential proclamation. Together with monument expansion of PRIMNM by President Obama on Sept. 29, 2014, the monuments prohibit US commercial fishing vessels from operating in nearly 600,000 square miles of US exclusive economic zone (EEZ) waters. PIRO Regional Administrator Michael Tosatto said NMFS and the US Fish and Wildlife Service are working to identify new and emerging issues to inform the PRIMNM management plan planning process and are evaluating the timeline for the public release of the Marianas Trench Marine National Monument draft management plan. The Council recommended that NMFS PIRO include the CNMI Monument Advisory Committee and the Territory of Guam in the review of the draft management plan for the Marianas Trench Marine National Monument. According to the presidential proclamations, the management plans were to have been developed within two years of establishment of the monuments.

NMFS Pacific Islands Fisheries Science Center (PIFSC) reported on the impacts of COVID-19 on the Hawai’i commercial fisheries and markets. The report shows that revenue dropped by 80% due to restaurant closures and travel/visitor restrictions. PIFSC Director Mike Seki also shared a tool PIFSC researchers built that provides a visualized market demand curve based on historical data. The tool allows industry to explore tradeoffs in market supply and price to meet objectives. The Council recommended that PIFSCcoordinate with agencies and industry representatives in the Territories to provide market monitoring analyses and demand tracking app for each area.

PIFSC Director Mike Seki als reported that three cruises on the NOAA ship Oscar Elton Sette and another on the NOAA ship Rainer have been cancelled due to COVID-19 impacts. Monk seal and turtle field camps have been delayed. Fisheries data collection training, surveys, biosampling, lab work, etc. have been reduced or suspended. The Council recommended that PIFSC coordinate with the Council and the Territory of American Samoa’s Department of Marine and Wildlife Resources to determine viable logistic solutions to continue the American Samoa research cruise. American Samoa bottomfish has been determined recently by NMFS to be overfished and subject to overfishing. The Council has two years to develop and implement a rebuilding plan for the stock in federal waters. Most of the fishery occurs in waters 0 to 3 miles offshore under jurisdiction of the Territory. Many fishery advisors, fishermen and scientists point to the lack of complete and accurate data as the reason for the pessimistic stock status determination.

The Council also agreed that the impacts of COVID-19 to the region’s fisheries should be noted in the Council’s 2020 Stock Assessment and Fishery Evaluation (SAFE) reports. The Council reviewed and approved the 2019 SAFE reports, which can be found on the Council’s website.

Rep. Amata Urges Fishing Access For National Food Security

March 20, 2020 — The following was released by The Office of Congresswomen Aumua Amata (R-American Samoa):

Thursday, Congresswoman Aumua Amata is urging President Trump to reopen fishing access as a matter of national food security during the worldwide economic and health crisis.

“At this time of global re-evaluation of world health and economics, I simply write to say that food security equals national security. Please use your Executive Order to immediately reopen the Pacific Remote Islands Marine National Monument (PRIMNM) to commercial fishing,” Aumua Amata states in her urgent letter to the President.

“American Samoa is home to the largest tuna cannery in the Country and the cannery needs restored access to the Monument to keep up with demand which has spiked over 30 percent in the past week alone for this key healthy, shelf-stable and staple product for American consumers,” she continues.

“Now is the time to reopen American waters to ensure an American supply chain with American boats fishing American waters and having American manufacturing plants processing essential staple foods for the American people,” says Congresswoman Amata.

She supports her request with prior communications from herself and Governor Lolo Moliga, including one cosigned by House Natural Resources Committee Ranking Member Rob Bishop of Utah. The Congresswoman closes with appreciation to the President for ongoing bold action in the effort to protect our country and his continued optimism.

Rep. Aumua Amata Urges Congress to Reform Marine Monuments

March 15, 2019 — The following was released by the office of Rep. Aumua Amata (R, American Samoa):

Congresswoman Aumua Amata gave a statement in the Committee on Natural Resources to make the case in Washington, D.C. that much-needed reforms are needed for the marine monuments on behalf of American Samoa. This full Committee Oversight Hearing was titled, Forgotten Voices: The Inadequate Review and Improper Alteration of Our National Monuments.

The text of her speech is as follows:

Talofa lava. Thank you, Chairman Grijalva and Ranking Member Bishop for holding this hearing today. The topic of today’s hearing is a bipartisan issue I have been strongly advocating for since I was first elected to Congress.

On January 6th, 2009, President Bush established the Rose Atoll Marine National Monument and the Pacific Remote Islands Marine National Monument with Proclamation 8337 and Proclamation 8336. On September 29th, 2014, President Obama expanded the Pacific Remote Islands Marine National Monument with Proclamation 9173. The American Samoan Government and its people were barely consulted before these monuments were established or expanded. As a result, our local fishermen were barred from accessing the waters that Samoans have been visiting for over a millennium.

The monuments serve a good purpose, and I fully support that effort, but not without local input, and not at the expense of access to our people who have utilized these areas for centuries, long before any relationship with the United States.

Many island economies are often heavily reliant on a single industry and in our case it’s the fishing industry.  Our tuna cannery is the dominant economic force in our community. American Samoa’s economy depends on access to our own EEZ. The establishment or expansion of the monuments and the restriction of all local fishing has had a major negative impact on American Samoa. We have lost two out of three of our canneries in the last decade alone.

Our fishermen are the most responsible and regulated in the world. As it stands currently, these fish swim through the monuments and are then caught by nations with little to no environmental regulations…that is not helping the sustainability for the future stock. Using the Antiquities Act to close U.S. waters to domestic fisheries is a clear example of federal overreach and regulatory duplication and obstructs well managed, sustainable U.S. fishing industries in favor of their foreign counterparts, especially when the Pacific Remote Islands Marine National Monument was arbitrarily expanded to over six times its size. It is now half a million square miles or an area the size of three California’s that now is off limits to U.S. domestic fishing.

Congress has already passed laws that ensures the protection and conservation of ecosystems and the species contained therein including the Magnuson-Stevens Act. The Department of Interior has asked the President to restore regulated fishing in the monuments because of the protections put in place by the Magnuson-Stevens Act, protections that the Antiquities Act does not have. Limited commercial fishing can be done without harm to fish stock sustainability or the environment because Congress has already passed and continues to update laws to ensure it.

The Rose Atoll and Pacific Remote Islands Marine National Monuments are just two local examples, and the establishment and alteration of our national monuments remains a bipartisan issue affecting the whole country. We need to be looking at the Antiquities Act, because any President from either party should not be permitted to establish or alter a declared monument without input from the public. To that end I am proud to cosponsor Mr. Bishop’s Monument Reform Bill again this Congress, and I want to make it clear that I will welcome legislation from either side of the isle that addresses this oversight.

The unilateral use of an executive order when declaring sites for a national monument designation is not the right way to go about protecting our lands and waters. American Samoans and the other indigenous and local groups represented here today should not have had their way of life so easily threatened by the establishment and alterations of monuments without their input.  We must ensure that all parties involved have a say, and I look forward to working with the committee on addressing what I hope remains a bipartisan issue.
