ISSF Report Shows Management of Many Tuna Stocks Falling Short of Marine Stewardship Council (MSC) Sustainability Standards

January 24, 2017 — The following was released by the International Seafood Sustainability Foundation:

WASHINGTON — Only 11 of 19 major commercial tuna stocks are being managed to avoid overfishing and restore depleted fish populations, in part because the majority (16) of them are not protected by well-defined harvest control rules (HCRs) from Regional Fishing Management Organizations (RFMOs), according to independent scientists in a report published by the International Seafood Sustainability Foundation (ISSF).

About the Report

In response to inconsistencies amongst assessments of tuna stocks against the MSC certification standard, “An Evaluation of the Sustainability of Global Tuna Stocks Relative to Marine Stewardship Council Criteria” takes a global, comprehensive approach to scoring stocks against certain components of the MSC standard. In addition, the report — authored by experienced MSC assessors Joseph E. Powers and Paul A. H. Medley and updated twice since first published in 2013 — is designed to:

  • Provide a basis for comparing between stocks scores as assessed by the same experts
  • Become a useful source document for future tuna certifications or in the establishment of tuna Fishery Improvement Projects (FIPs)
  • Offer a “snapshot” of the current status of the stocks, as well as the strengths and weaknesses of RFMOs
  • Prioritize ISSF projects and advocacy efforts against initiatives that will improve low performance indicator scores

The scores in this report focus on stock status (MSC Principle 1) and the international management aspects relevant to RFMOs (part of MSC Principle 3) and are based on publicly available fishery and RFMO data. Each of these Principles is evaluated in relationship to Performance Indicators (PIs) within each Principle.

Key Findings

The report scores tuna stocks (bigeye, yellowfin, albacore, and skipjack — but not bluefin) and each tuna RFMO (ICCAT, IATTC, WCPFC, and IOTC). An 80 is a passing score, below 60 is a failing score, and 60–79 would indicate a conditional pass, with the requirement that any deficiency is addressed within five years if a fishery were to become MSC-certified. The stock scores for each principle, which are comprised of scores for performance indicators within the principle, show that:

  • Principle 1: “A fishery must be conducted in a manner that does not lead to over-fishing or depletion of the exploited populations and, for those populations that are depleted, the fishery must be conducted in a manner that demonstrably leads to their recovery.”
    • Among seven tuna species in the Atlantic Ocean, only one — Northern Albacore, which “has recovered from biomass reductions several decades ago” — received an overall principle-level passing score.
    • In contrast, in the Pacific, only one stock — Western Bigeye, which has been undergoing a steady decline since the 1970s — received an overall principle-level failing score.
    • Likewise, in the Indian Ocean, only Yellowfin received an overall failing score. However, the outlook for that stock in 2016 is slightly more optimistic than it was in 2015.
    • Yellowfin stocks in the Eastern Pacific, Atlantic and Indian Oceans require rebuilding, as do Mediterranean Albacore; Atlantic Bigeye; and Western Pacific Bigeye and Eastern Pacific Bigeye.
    • Mediterranean Albacore and Western Pacific Bigeye had the most failing scores on individual performance indicators — including stock status, stock rebuilding, and harvest control rules and tools.
    • Only Eastern Pacific Skipjack received passing scores of 80 on each of the six performance indicators for Principle 1.
  • Principle 3: “The fishery is subject to an effective management system that respects local, national and international laws and standards and incorporates institutional and operational frameworks that require use of the resource to be responsible and sustainable.”
    • Two RFMOs examined in the report — WCPFC and IATTC — received passing scores for all seven performance indicators under Principle 3.
    • The other two RFMOs — ICCAT and IOTC — received conditional pass scores on these performance indicators: “consultation, roles and responsibilities” and “compliance and enforcement.” ICCAT was given a conditional pass score for “legal and customary framework.” Other performance indicators include “long term objectives”; “fishery specific objectives”; “decision-making processes”; and “management performance evaluation.”
    • All four RFMOs received overall principle-level passing scores from the authors.

The Evaluation report also includes detailed remarks on each stock, evaluations of the four RFMOs, and comprehensive reference citations.

As the authors note, the “status of stock determinations change continually with new data, new assessments and new findings.” A comparison of the December 2016 report to the previous March 2015 version reveals that good progress has been made in the adoption of interim harvest control rules for several stocks in IATTC and IOTC, as well as in the RFMO management frameworks (previously, both ICCAT and IOTC failed to score 80 or higher).

“ISSF applauds tuna RFMOs for improving their management frameworks,” comments Dr. Victor Restrepo, ISSF Vice President, Science. “While the slow pace is not ideal, it is evident that progress is being made. These improvements must continue if we are to ensure sustainable tuna fisheries into the future.”

While the Evaluation report focuses on tuna stock status and sustainability as well as on RFMO policies, it does not address national or bilateral fishing jurisdictions, gear- or fleet-specific ecosystem impacts, or specific fisheries’ ecosystems — all of which are also considered within the MSC assessment methodology.

Since 2011, ISSF has been an active stakeholder in MSC tuna fishery assessments and certifications. ISSF works to develop and implement verifiable, science-based practices, commitments and international management measures to help all tuna fisheries become capable of meeting the MSC certification standard without conditions.

Trump’s rise may bring big changes to main US fishing law

January 12, 2017 — Previously unsuccessful efforts to reform the US’s main federal fishing law, the Magnuson-Stevens Act, are positioned to move ahead under a Donald Trump administration.

New efforts to amend the US Magnuson-Stevens Act are expected from the new Congress, leaving some in industry concerned with any move away from a law judged by many to have worked reasonably well for four decades.

Some in industry have told Undercurrent News that they fear pressures to add more “flexibility” could allow political considerations to undermine science-driven decision-making currently enshrined in the bill, which forms the basis for most federal fishing regulation in US waters.

“Right now you might be looking at potential for a whole lot of changes and revisions,” said an Alaska-based source who wished to remain unnamed. “I would say there should be some anxiety about how far you go giving people flexibility that moves outside the scientific realm.”

But how drastically Magnuson Stevens might change, if at all, remains to be seen, he added.

HR 1335

One such effort, a bill known as HR 1335 sponsored by Alaskan Representative Don Young, faced a veto threat from president Barack Obama, who will be replaced by Trump on Jan. 20.

One of the bill’s central provisions would have reformed Magnuson-Stevens’s mandatory 10-year stock rebuilding timeline, incorporating additional flexibility. Instead of formally defining all stocks in decline as “overfished”, Young’s amendment would allow the term “depleted” when the reason for a stock’s decline is due to depredation or other non-fishing factors.

The White House Just Made It Easier To Know The Fish You’re Eating Is Actually Fish

December 9, 2016 — The Obama administration took a massive step in the fight against seafood fraud and illegal fishing on Thursday, introducing a rule that will help Americans know the fish they’re eating is truly what they paid for.

The National Oceanic and Atmospheric Administration will oversee the Seafood Import Monitoring Program, which will require about 25 percent of imported seafood to be traced from the boat or farm it comes from to the U.S. border. The rule is meant to curb the mislabeling of fish before it enters the U.S. (about 90 percent of fish we consume is imported) and cut down on overfishing. Businesses will have until the beginning of 2018 to comply.

“Today’s announcement is a groundbreaking step towards more transparency and traceability in the seafood supply chain,”said Beth Lowell, a senior campaign director for the environmental group Oceana, in a statement. “For the first time ever, some imported seafood will now be held to the same standards as domestically caught fish, helping to level the playing field for American fishermen and reducing the risk facing U.S. consumers.”

Three More Plead Guilty to Elver Trafficking as Part of DOJ’s Multi-State Investigation

December 1, 2016 — SEAFOOD NEWS — Harry Wertan, Jr., Mark Weihe and Jay James each pleaded guilty to selling or transporting elvers in interstate commerce, which they had harvested illegally, or knew had been harvested illegally, in South Carolina.  The offenses in the case are felonies under the Lacey Act, each carrying a maximum penalty of five years’ incarceration, a fine of up to $250,000 or up to twice the gross pecuniary gain or loss, or both.

The pleas were the result of “Operation Broken Glass,” a multi-ohurisdiction U.S. Fish and Wildlife Service (USFWS) investigation into the illegal trafficking of American eels.  To date, the investigation has resulted in guilty pleas for ten individuals whose combined conduct resulted in the illegal trafficking of more than $2.6 million worth of elvers.

“We will not allow the rivers of the United States to be the poaching grounds for international seafood markets,” said Assistant Attorney General Cruden. “The American eel is an important but limited natural and economic resource that must be protected.  Trafficking only undercuts the toil and honest efforts of those who obey the law.”

Elvers are exported for aquaculture in east Asia, where they are raised to adult size and sold for food.  Harvesters and exporters of American eels in the United States can sell elvers to east Asia for more than $2000 per pound.

Because of the threat of overfishing, elver harvesting is prohibited in the United States in all but three states: Maine, South Carolina and Florida.

“Today’s pleas in the illegal trade of American Eels are a tremendous step in preserving this important fishery,” said Colonel Chisolm Frampton for the South Carolina Department of Natural Resources, Law Enforcement Division.  “A multitude of state and federal agencies did outstanding work to bring this case to successful conclusion.”

Marine Scientist Follows Hot Fish as They Move to Cooler Waters

November 30, 2016 — Warming oceans have fish on the move, and one man is in hot pursuit.

That man, Rutgers University marine biologist Malin Pinsky, has tracked fish species all over North American waters to learn where they’re headed in search of cooler conditions.

Recently, he’s seen lobsters nearly disappear from Long Island Sound, driven out by disease and a series of warm summers. The delicacies are thriving in the cooler Gulf of Maine, but that may be temporary: Water temperatures there are rising faster than anywhere else in the North Atlantic. Pinsky has also observed Black sea bass, traditionally plentiful off Virginia, start to relocate to the Gulf of Maine and the waters off the New Jersey coast. And out west, Pacific halibut and arrowtooth flounder in the eastern Bering Sea off Alaska have shifted north toward the Arctic.

“It’s not one species in one place or a few species in a limited area,” Pinsky says of the moving populations. “It’s actually hundreds of species in North America shifting toward cooler waters, and that’s significant.”

The changes pose major questions for fishermen and fishery managers. As species move, will fishermen relocate their businesses to follow? How do fishery managers set rules when fish have moved to new areas where they may be more susceptible to overfishing? And will species such as lionfish, which are invasive in the Atlantic Ocean and thrive in warm Southern waters, suddenly appear in force farther north along the Atlantic coast? Even more confounding is the effect of temperature changes on species such as corals that have difficulty relocating to a more suitable place.

JIM HUTCHINSON JR: WILL ANGRY ANGLERS RESPOND TO FLUKE FIASCO?

November 28th, 2016 — Seriously, reading any further is just going to make you incredibly angry.

There’s no way to sugarcoat this, the coastwide quota for summer flounder (fluke) in 2017 is expected to be cut by about 40%. That means a shorter season, lower bag, an increase in size limits, or any combination of the three.

Pardon my French, but I told you that you’d be pissed!

The question is, what are you – what are we going to do about it?

NOAA Fisheries recently announced that their July 2016 summer flounder assessment shows continued overfishing and a fluke stock biomass in decline; in response, the federal government proposes a 30% reduction from catch limits previously implemented for the 2017 season, along with a 16% reduction from current 2018 allocations.

Because the Marine Recreational Information Program (MRIP) showed gross overharvest in the recreational sector in 2016, that means we’re officially “overfishing” the fluke stock. That’s not to say the stock is in trouble, but because MRIP showed anglers caught too many fish this past summer, we now have a summer flounder stock that is experiencing statutory overfishing.

Tech solutions to tackle overfishing, labor abuse at sea

November 28th, 2016 — Fishing boats used high-tech systems to find vast schools of fish for decades, depleting stocks of some species and leading to the complete collapse of others. Now more than a dozen apps, devices and monitoring systems aimed at tracking unscrupulous vessels and the seafood they catch are being rolled out — high-tech solutions some say could also help prevent labor abuse at sea.

Illegal fishing, which includes catching undersized fish, exceeding quotas and casting nets in protected areas, leads to an estimated $23 billion in annual losses, according to the United Nations. Meanwhile, overfishing close to shore has pushed boats farther out, where there are few laws and even less enforcement to protect workers from abuse. Slavery has been documented in the fishing sectors of more than 50 countries, according to U.S. State Department reports.

Earlier this year, U.S. Secretary of State John Kerry said using technology at sea could eventually mean “there is not one square mile of ocean where we cannot prosecute and hold people accountable…”

However, Phil Robertson, deputy Asia director of Human Rights Watch, cautions that catching human traffickers goes beyond finding boats.

FLORIDA: FWC OKS hogfish changes, other measures at meeting

November 23, 2016 — The Florida Fish and Wildlife Conservation Commission approved several conservation measures that are consistent with federal rules and set a new state management boundary for hogfish at its November meeting in St. Petersburg.

“Hogfish is an economically important species that is popular with the diving and angling community,” said Chairman Brian Yablonski. “This was not an easy decision, but will help balance the species’ needs while still offering opportunities for anglers.”

Hogfish is over-fished and undergoing overfishing in the Florida Keys and east Florida. Federal law requires the South Atlantic Fishery Management Council to end overfishing immediately and implement a 10-year rebuilding plan.

Because most hogfish off the Keys and east Florida are taken in Florida state waters, consistency with similar regulations pending approval in Atlantic federal waters is necessary to rebuild the stock.

HAWAII: Fishermen Catch 11% More Bigeye Tuna Despite Overfishing Status

October 27, 2016 — U.S. commercial fishermen hauled in 2.5 million pounds more bigeye tuna last year than they did in 2014, landing almost all of it out of Honolulu, according to a federal report released Wednesday.

Bigeye landings in 2015 totaled 25.8 million pounds, an increase of nearly 11 percent compared to last year. 

And that tuna was worth a bit more too, averaging $3.17 per pound in 2015, up from $3.08 in 2014, according to the most recent Fisheries of the United States report by the National Marine Fisheries Service.

Overall, U.S. commercial fishermen landed 32 million pounds of seafood last year operating out of Honolulu, the 27th highest nationally by weight. 

But that seafood — mostly bigeye tuna, which fetches top dollar in local sashimi markets and high-end restaurants — was worth $97 million, making it the sixth-highest catch in the country by value. 

Bigeye tuna continues to be subject to overfishing, however. It’s one of 28 stocks on the federal overfishing list. Only 9 percent of fishing stocks monitored by the feds are subject to overfishing, according to the National Oceanic and Atmospheric Administration.

DON CUDDY: A clean sweep on the ocean floor

October 4th, 2016 — Most of the reporting in the media about commercial fishing and declining stocks in the Northeast dwells on how dire the situation has become with the fault generally attributed to fishermen and “overfishing.”

The view on the waterfront is very different, however. Fishermen have long maintained that there is a huge disconnect between what they see on the water and the conclusions derived from the surveys and stock assessments made by the National Oceanaic and Atmospheric Administration. Their claims have been dismissed as self-serving. Now it seems the fishermen have a strong case. On a recent bottom trawl survey, a typical industry net caught four times as many flatfish as the rig used on the government trawl surveys.

For years, fishermen have clamored for more collaborative research using industry vessels. They were largely ignored. But in August, Dr. Bill Karp, director of the Northeast Fisheries Science Center in Woods Hole, revealed a plan for NOAA Fisheries to shift all or part of its trawl surveys from its research vessel, the Henry B. Bigelow, to commercial fishing boats. At the same time, from Aug. 7-21 the Point Judith fishing vessel Karen Elizabeth was at sea conducting a twin-trawl survey on behalf of the Science Center with a team of scientists working alongside the crew.

The boat was rigged to tow two nets simultaneously, each of the type used on the Bigelow, with one significant difference. One net was fitted with a rockhopper and the other had a chain sweep. Because different fish species behave differently, fishermen use a chain sweep, attached to the leading edge of the net and in contact with the sea floor, when targeting flatfish such as witch flounder. These fish hide in the sediment on soft bottom to evade predators. You will hear fishermen refer to fishing boats with rockhoppers as “hard bottom boats” because those boats typically go after other species such as cod and haddock which tend to be found over rocky or gravel bottom.

The Bigelow uses a rockhopper on every tow, despite surveying in our multispecies fishery. That is because this gear allows nets to be towed across a variety of habitats. A net equipped with a chain sweep is prone to snag on a rocky bottom. Its exclusive use of a rockhopper has been a point of contention with the fishermen since the Bigelow commenced operations in these waters. Fishermen openly questioned its accuracy in estimating flatfish abundance. The survey work on the Karen Elizabeth has provided the evidence that their skepticism is well founded. Here are some relevant quotes taken from the Science Center’s own paper, authored by the scientists who were on the Karen Elizabeth to conduct the study:

“On average, catch rates in the experimental chain sweep gear were about 4-fold the catch rates of the rockhopper sweep gear used on the standard survey.”
