Boat operators warned to steer clear of whales

April 25, 2016 — State environmental officials this week issued a “high risk” warning to boat operators asking them to stay alert after five North Atlantic right whale mother and calf pairs were spotted foraging on plankton in Cape Cod Bay.

According to the advisory from the Massachusetts Division of Marine Fisheries, the highly endangered whales were seen feeding Thursday in the western part of the bay during an aerial survey conducted by researchers from the Center for Coastal Studies.

Marine Fisheries officials reissued the warning to boat operators on Sunday, fearing that a close encounter could lead to someone accidentally striking the whales.

“Given their behavior and the proximity to vessel traffic, the situation presents a high risk of vessel collision to a sensitive and important segment of the right whale population,” according to a statement.

MASSACHUSETTS: Will Sea Bass Quota Go Up or Down?

April 7, 2016 — Last year, sea bass literally put some commercial fishermen in the black.

The black fish with the delicious pure white meat abundantly filled local waters and made up some financial losses for fishermen curtailed by otherwise stringent regulations on striped bass, cod, flounder and other lucrative species.

But that might change soon.

In a memo dated March 18 from the Division of Marine Fisheries in Boston, while regulations for striped bass, bluefish, fluke and scup will likely remain unchanged this year in Massachusetts, “Regulations for black sea bass have been amended to achieve a mandatory 23 percent harvest reduction.”

The Massachusetts regulatory agency says these revisions are being implemented along the entire Atlantic seaboard via “emergency rulemaking” to take effect prior to the onset of the 2016 season. Public hearings will be held to discuss proposals before changes are finalized.

The Draft Addendum proposes changes to the incidental bycatch limits for non-trap gear (e.g., otter trawls, gillnets) and non-lobster trap gear (e.g., fish, crab, and whelk pots). For non-trap gear, the Draft Addendum includes options to maintain, increase, or eliminate the bycatch limit, while options for non-lobster traps include establishing bycatch limits of varying size or maintaining no limit on these gears. The intent of the Draft Addendum is to cap incidental landings of Jonah crab while ensuring the inclusion of current participants in the Jonah crab fishery. The FMP currently prescribes a 200 crab per calendar day/500 crab per trip incidental bycatch limit for non-trap gear; however, concerns were expressed over the appropriateness of these limits. Data submitted by the New England Fishery Management Council and NOAA Fisheries illustrate while 97-99% of trips from 2010 through 2014 were within the current limit, there were several trips above the limit. Furthermore, current bycatch landings were sufficiently low, accounting for approximately 0.1% of total landings.

Bycatch limits for non-lobster trap gear were added as a second issue for consideration in the Draft Addendum to address concerns regarding the lack of effort controls on non-lobster traps and the potential for trap proliferation. Data submitted by NOAA Fisheries show between May 1, 2013 and August 31, 2015, 194 trips landed Jonah crab with whelk pots, crab pots, and fish pots. Of these, 80 trips landed 100 crab or fewer and 115 trips landed 200 crab or fewer.  Approximately 45 trips landed between 200 and 500 crab and 40 trips landed more than 450 crab.  Landings from Maryland show between 2012 and 2015, 33 trips landed Jonah crab with fish pots. All of these trips were under 200 pounds. Reports also indicated from 2014-2015, 36 trips landed Jonah crab with whelk pots. Average landings per trip with whelk pots were under 500 pounds; however, there is concern that these whelk pot landings may in fact be rock crab, a closely related species which is often misreported as Jonah crab.

Fishermen and other interested groups are encouraged to provide input on the Draft Addendum either by attending state public hearings or providing written comment. Bill to Expand Lobster Sales Adopted by Massachusetts State Senate

January 28, 2016 — BOSTON — The following was released by the Office of State Senator Bruce Tarr:

The State Senate today adopted a bill which updates Massachusetts’ lobster laws to permit the processing, sale, and transportation of cooked and frozen in-shell lobster parts.

Senate Minority Leader Bruce Tarr (R- Gloucester) sponsored the measure to end prohibitions on in-state sales and processing of lobster parts to accommodate the growing interest of consumers.  The bill, supported by the Massachusetts lobster industry, is expected to cause an expansion of lobster processed in state and a reduction in lobster diversions to Canadian processors. 

“This bill will allow more American lobsters currently being harvested and purchased here and subsequently processed in Canada, to be prepared for market in Massachusetts,” said Tarr. “The net effect of modernizing the law will bolster local economic activity for lobstermen, processors, and local restaurants and food stores.”

Tarr expressed appreciation for coastal Senators Mark Montigny (D- New Bedford),Vinny deMacedo (R- Plymouth), Daniel Wolf (D-Harwich) and Michael Rodrigues (D-Westport) for their efforts to strengthen the industry and in championing the bill.

“The time has come to eliminate such outdated restrictions on lobster processing and sales in the Commonwealth.  Easing constraints on processing operations will allow a thriving industry to further invest in our local economy through expanding operations and creating new jobs.  I commend Senator Tarr’s leadership as the sponsor of this bill and am proud to have partnered with him in seeing this through to passage.  It is my hope the House will quickly follow the Senate’s lead to have a bill on the Governor’s desk as soon as possible.” said Senator Montigny.

“I am thrilled that the Senate has taken steps to bring this bill forward with a unanimous vote and I know that the lobstermen will be pleased with the advancements that we’ve made,” said Senator deMacedo.

The lobster industry is a critical part of the Commonwealth’s economy and heritage with more than 900 licensed lobstermen.  A similar law in Maine has boosted Maine’s economy, produced local outlets for product sales, and created jobs in the state.

“The action of the Senate today helps consumers, suppliers and lobstermen, I expect that we will see an economic boost for the lobstermen in my district and in other coastal communities in the state as well,” said Senator Rodrigues.

 “Our historic lobster industry deserves the opportunity to be more creative and flexible in how they market and sell their popular product,” said Cape and Islands Senator Wolf. “This legislation is a huge help in that regard, and will create economic benefits that will ripple through our coastal communities.”

While the sale of live, cooked, and canned lobster is legal in the state, the legislation expands the industry market with the inclusion of other lobster products. The Senate bill allows Department of Public Health licensed wholesale dealers to process unfrozen lobsters, authorizes the importation of unfrozen shell-on lobster parts and tails, and it allows for the retail of previously frozen raw in-shell tails.

The Massachusetts Division of Marine Fisheries will be responsible for maintaining essential regulations including enforcing minimum lobster shell size standards and processing standards. The lobster fishery adheres to stringent state regulations including trap limits and the release of live juveniles.

The bill now moves to the House for further consideration.

MASSACHUSETTS: South African scientist, Cape Cod officials talk shark spotting strategies

January 25, 2016 — This past summer, it seemed as though Atlantic great white sharks, once thought to be elusive and rarely seen, were suddenly everywhere.

Popular beaches were closed to swimming as great whites moved north in the waning days of summer away from what is thought of as their stomping ground — the relatively remote and unpopulated Monomoy islands — and into the heart of tourist country.

Earlier this month, beach managers, town officials and Cape Cod National Seashore representatives met for the first time in more than a year to consider ways to protect the millions who will come to Cape beaches this summer. It is the first in a series of similar monthly meetings this winter.

“What it told me is we’re on the right track. Education is big,” Orleans Natural Resources Director Nate Sears said about a presentation by South African shark scientist Alison Kock at the Jan. 12 workshop hosted by the Seashore.

Kock’s visit was paid for by the nonprofit Atlantic White Shark Conservancy, the main fundraiser for shark research by Massachusetts Division of Marine Fisheries scientists Greg Skomal and John Chisholm. Kock is the research manager for Cape Town’s Shark Spotters Program, which employs locals to scan beaches with binoculars from high vantage points and warn beach officials of sharks. Along with the Save Our Seas foundation, the group sponsors shark research and conservation while attempting to keep beachgoers safe.

“I am very impressed by the proactive stance being taken on the Cape,” Kock wrote in an email from South Africa after her visit. Nothing happened in Cape Town until after a series of fatal attacks on swimmers and surfers a decade ago, she said. Kock praised the signs and brochures that have been in place on Cape beaches for two years.

MASSACHUSETTS: Hearing on new herring rules this afternoon in Gloucester

January 5, 2016 — Interstate regulators are holding a hearing for fishermen in Gloucester today about a plan to amend some of the rules for Atlantic herring fishing.

The Atlantic States Marine Fisheries Commission is soliciting comments about the amended rules. The proposal includes alternatives to the current spawning monitoring program and changes to the requirements about a boat’s condition before it leaves on a fishing trip.

Today’s meeting in Gloucester begins at 2 p.m. at the state Division of Marine Fisheries’ Annisquam River Station at 30 Emerson Ave.

Draft Addendum XXVII was initiated to consider extending use of regional management approaches for the 2016 recreational summer flounder fishery, including an option that would allow for a Delaware Bay specific region. The Draft Addendum also includes options for extending use of ad-hoc regional management approaches for black sea bass recreational fisheries in 2016 and 2017. In the event the options in Draft Addendum XXVII are not approved for management, the Board extended the current summer flounder regional management approach for use in 2016.

In 2014, the Board approved Addendum XXV to shift away from traditional use of state-by-state harvest targets under conservation equivalency to use of an alternative regional strategy for managing summer flounder recreational fisheries. Based on its success in keeping recreational harvest within the RHL and providing greater regulatory consistency among neighboring states, this strategy was extended for use in 2015. State-by-state harvest targets previously utilized under conservation equivalency created difficulties for some states as overages occurred due largely to state shares and limits not reflecting local summer flounder abundance and its availability to recreational fishermen. In 2014 and 2015 management regions were the following: 1) Massachusetts; 2) Rhode Island; 3) Connecticut-New Jersey; 4) Delaware-Virginia; and 5) North Carolina.

The Draft Addendum also proposes two options for the 2016 black sea bass recreational fishery (1) coastwide measures or (2) the continued use of management measures by northern (Massachusetts – New Jersey) and southern regions (Delaware – North Carolina). The regional management approach has been used since 2011 and offers advantages over coastwide regulations by addressing geographic differences in the stock (size, abundance and seasonality) while maintaining the consistent application of management measures by neighboring states.

Off the hook – Researchers find mortality of cod caught and released off Gloucester is half of original estimate

December 21, 2015 — With cod at historically low population levels and commercial fishermen limited to landings that are just a fraction of what they once were, the recreational catch is now believed to account for as much as one-third of total landings of Gulf of Maine cod.

But recreational landings data was considerably poorer than the commercial data, which made it hard to estimate their true impact on the population or know the effectiveness of regulatory measures.

Solving the cod crisis will take a lot of research. Now, scientists are no longer restricted to their lab. As a recent study shows, creative thinking and technology can turn the ocean into a lab, and the results can be more precise and minimize the regulatory impact on fishermen.

A key missing piece in the puzzle was information on how many fish died after they were released by anglers. Lacking key data such as length and weight of released cod resulted in the assumption that 100 percent of those fish died. Missing data can lead to underestimating the population size, with overly strict regulations, said Michael Palmer, National Marine Fisheries Service research fishery biologist.

Researchers started collecting length and weight data in 2005 after regulators tightened reporting requirements for recreational fishermen. In 2011, a panel arrived at a consensus that 30 percent of cod released by anglers died. But Palmer was concerned that there were no directed studies, in the U.S. or internationally, to truth-test the estimate.

Judge bars boat from dredging for clams

November 19, 2015 — PROVINCETOWN — A judge has temporarily barred a Gloucester fishing vessel from dredging for clams off Herring Cove while a dispute about who governs such dredging in that area makes its way through court.

Barnstable Superior Court Judge Raymond Veary issued a temporary restraining order Nov. 3, after the Provincetown harbormaster’s staff followed the 70-foot Tom Slaughter as it dredged for surf clams the previous two days, Harbormaster Rex McKinsey said.

The Slaughter is one of three clam draggers whose owners are in court in separate actions fighting cease-and-desist orders issued by the Provincetown Conservation Commission to keep them from dredging up to 40 feet offshore without a permit.

Veary’s temporary order was to last until Friday, but according to Monte Rome, owner of the Tom Slaughter, it has been extended to Jan. 5 at his request.

Provincetown officials want to stop hydraulic dredging, a process that involves shooting water at 50 to 100 pounds of pressure into the sand to release the clams, because it disturbs the ocean floor and damages the habitat for fish, clams and other marine life, McKinsey said.

In 2007, the Conservation Commission passed a regulation banning hydraulic dredging in that area without a permit.
