Fishery regulators will discuss possible rise in minimum lobster size

July 28, 2022 — Fishing regulators will gather in Virginia next week to talk about the potential of raising the minimum size lobsters need to be in order to be harvested by New England fishermen.

The Atlantic State Marine Fisheries Commission’s lobster management board is meeting on Tuesday to discuss the implications of a proposal that would install new minimum size limits and other regulations for the crustaceans, either gradually over time or triggered by lobster populations dipping below a certain level.

The proposal was drafted to protect the lobster population as surveys show indications of potential future decline. The idea has rankled many Maine lobstermen, who claim the Pine Tree State often bears the hardest brunt of any new regulations, despite having some of the strictest rules in place already.

Maine lobstermen currently have the lowest maximum size limits in New England. They can only keep a lobster if the distance between its eyes and the start of the tail is at least 3 ¼ inches but no longer than 5 inches. This is done to protect future populations and the most productive breeders.

Other areas of New England have different size limits and could undergo area specific changes under the proposal.

For Maine, one option being considered by regulators is increasing the minimum size by 1/16 of an inch if the abundance of lobster drops by 17 percent, and then again at 32 percent. Another would raise the minimum size gradually between 2023 and 2025.

Analysis done by the commission projected that raising the legal size minimum could increase the number of lobsters that reached maturity, allowing for more resilient populations.

Lobster price drops add pressure on an already strained industry

July 26, 2022 — After over a year of historically high prices that netted the lobster industry national attention – and articles questioning whether consumers could stomach $34.00 for a lobster roll – the wharf price for the species has reportedly dropped all the way back down to “normal” levels and even beyond.

The price lobstermen were getting at the dock in 2021 was historically high, with fishermen in Maine getting roughly $8.00 per pound and Canadian lobstermen in Newfoundland getting as much as $10.14 per pound, according to the Fish Food and Allied Workers Union.

Now, fishermen in Maine are reporting they are getting as little as half the price of what they received last year – and in some cases even less than that. Despite the precipitous drop, that price is still within the norm: Fishermen in Maine, according to statistics compiled by the Maine Department of Marine Resources, got on average $4.05 per pound for the entire year in 2018, which comes out to around $4.78 when adjusted for inflation.

The pricing pressures are compounded by the ongoing struggle over right whale regulations. New NOAA regulations changed the requirements for fishermen and instituted a ban area, but a new court ruling found that even that hasn’t gone far enough to bring the fishery into compliance with the Endangered Species Act.

In the end, the lobster industry in the U.S. state of Maine is largely decentralized, making each situation different from fisherman to fisherman. The Maine Lobster Marketing Collaborative told SeafoodSource that lobstermen acknowledge the price is largely out of their control.

Court ruling again highlights need for better data about how lobster fishing impacts right whales

July 15, 2022 — A federal judge ruled last week that federal fisheries regulators are not doing enough to protect North Atlantic right whales, an endangered species, from fishing gear used by New England’s lobster and crab fisheries.

The ruling – and the changes that it might compel – are another blow to Maine’s lobster industry. But, more, it is a condemnation of the National Marine Fisheries Services plans to protect the whales, which are thought to number less than 400. The judge, James Boasberg of the U.S. District Court for the District of Columbia, blasted the agency for approving a plan last year that allowed for continuing entanglements of whales in lobster and crab gear while gear changes were implemented to reduce these entanglements. For example, the plan allowed 2.6 entanglements in lobster and crab gear that could cause death or serious injury to right whales each year through 2025, although NMFS calculated that only 0.8 entanglements should be allowed in federal waters to preserve the whale population.

At the same time, we’d encourage the lobster industry to move beyond messages that emphasize fighting regulations to highlight some of the many changes they have already made to reduce the threat to right whales. For example, many lobstermen in Maine are in the midst of replacing their trap lines with lines that will break away if hit by a whale. They are also marking their gear to better identify if rope from Maine is entangling right whales.

Judge Boasberg acknowledged this work, but essentially warned that it might not be enough. In his opinion, which is littered with marine metaphors, he also recognized the harm that more stringent restrictions could have on the lobster industry. That, he wrote, is why he asked the parties to work together to come up with more protective solutions.

As years of negotiations, rule changes and lawsuits have shown, this is no easy task. But, it is better than having draconian measures imposed by a court.

MAINE: Maine politicians blast ‘unfair’ court decision targeting lobster gear

July 14, 2022 — A federal circuit court has reinstated a ban on lobster fishing gear in a nearly 1,000-square-mile area off New England to try to protect endangered whales.

The National Marine Fisheries Service issued new regulations last year that prohibited lobster fishing with vertical buoy lines in part of the fall and winter in the area, which is in federal waters off Maine’s coast. The ruling was intended to prevent North Atlantic right whales, which number less than 340, from becoming entangled in the lines.

The circuit court sent the case back to the district court level, but noted in its ruling that it does not think the lobster fishing groups that sued to stop the regulations are likely to succeed because Congress has clearly instructed the fisheries service to protect the whales.

Commercial fishing groups have filed lawsuits about new rules designed to protect the whales because of concerns that the regulations will make it impossible to sustain the lobster fishing industry. The industry, based mostly in Maine, is one of the most valuable in the U.S., worth more than $500 million at the docks in 2020, according to the National Oceanic and Atmospheric Administration.

Conservation groups have called for tighter laws. Tuesday’s ruling is “a lifesaving decision for these beautiful, vulnerable whales,” said Kristen Monsell, an attorney at the Center for Biological Diversity who argued the case at the circuit court.

MAINE: Whale rule changes coming on two tracks

January 9, 2019 — Maine lobstermen and their representatives, along with state fisheries regulators, continue in the trenches of debates about how much the Maine lobster fishery is implicated in the decline of the North Atlantic right whale.

Ongoing efforts to protect the whales from entanglement with fishing gear may result in two different new sets of regulations, Sarah Cotnoir, resource coordinator for the Maine Department of Marine Resources, and Patrice McCarron, executive director of the Maine Lobstermen’s Association, told the Zone B Council last week.

The two sets of regulations come from parallel processes under two federal laws, the Marine Mammal Protection Act (MMPA) and the Endangered Species Act (ESA).

WASHINGTON — Soon after he’s sworn in as the 45th President of the United States, Donald Trump will dine on Maine lobster, Gulf shrimp, and Seven Hills Angus beef, to name a few dishes.

These foods are all on the menu for the inaugural luncheon, a long-standing tradition in which the Joint Congressional Committee on Inaugural Ceremonies hosts a meal for the president and vice president at the Capitol following the inaugural address.

The committee organized its first luncheon in 1953, when lawmakers welcomed President Dwight Eisenhower for creamed chicken, baked ham and potato puffs in the Capitol’s Old Senate Chamber.

Dishes, consumed between toasts, gift presentations and speeches, often encompass foods from the home states of the new leaders, though Trump’s menu owes heavily to California, not his home state of New York or Vice President-elect Mike Pence’s state of Indiana.

President Barack Obama’s 2013 luncheon boasted a menu of steamed lobster, grilled bison and apple pie.

Trump’s, which will be held in the Statuary Hall, will feature three courses.

The first, Maine lobster and Gulf shrimp with saffron sauce and peanut crumble, will be accompanied by a J. Lohr 2013 Arroyo Vista Chardonnay.

The Gulf shrimp may be a tribute to Florida, where Trump’s Mar-a-Lago resort is located and which the President-elect has called his “second home.”

RICHARD NELSON: Maine lobstermen know the threat posed by climate change. Now is the time to act.

December 13th, 2016 — I rose the other morning and began my preparations to head out on the water from Friendship Harbor to take up the my last load of lobster traps. My thoughts turned from from closing out my season to chuckling over my selection of boots for the day. My dear wife had made a special trip to the attic a month and a half ago to bring down my insulated winter boots, and I became aware of the fact that, with temperatures again climbing to the mid-40s, they would remain unworn this year.

Many of the thoughts and decisions fishermen make are based on conditions in the environment in which we work. This is certainly not something new. Maine’s lobster industry, which is dependent on a healthy ocean and an abundant resource of lobsters, has a long established heritage of conservation. Our good management decisions of the past include throwing back both the large breed stock lobsters and small lobsters, putting escape vents in traps and returning egg bearing female lobsters into the water, marking them to ensure they are protected through future molts. We saw the need to set trap limits and become a limited access fishery, all the while remaining a small-boat, owner-operated fleet.

Although these choices have helped create a fishery that is flourishing while others are not, we face environmental challenges that are beyond local control and more complex than our marine management system can address.

Why It’s Harder Than You’d Think to Serve Local Seafood in California

November 1, 2016 — In a nation where 90 percent of the seafood consumed is imported from foreign countries, Mitch’s Seafood in San Diego is rarity. The menu is mostly made up of a fish from local fishermen and, with the exception of clams and mussels, everything is wild-caught.

“We get as much from Southern California as we can; and then being right here on the border and having a personal experience with Baja California, I consider [fish from there] local, too,” Mitch Conniff, the owner, says.

On an October evening, the menu might feature big eye tuna, calamari, halibut, swordfish, and cabrilla from San Diego. Conniff usually sources from half a dozen fishermen in San Diego, many of whom are his close friends and relatives. White shrimp comes from Mazatlan in Mexico and gold spot bass hails from San Carlos in California. Spiny lobster caught in California—95 percent of which is typically exported to China—is on the menu as well.

It’s a diverse catch that is surprisingly affordable, considering how the prices of certain species of local California seafood have been made insanely expensive because of Chinese demand.

Last year, the California spiny lobster retailed close to $30 a pound. That is an astronomical figure compared to the retail price of Maine lobster, which was around $9 a pound for wholesale. Maine lobster accounts for 90 percent of the United States lobster market.

How a national craze caused lobster prices to boil over

October 26th, 2016 — Your next fresh lobster dinner, drizzled in butter and lemon, might crack your budget.

Restaurants are having to fork over more money this year to get their hands on prized Maine lobsters, and that means your dinner bill could soar to $60 a plate. Blame robust demand.

The coast-to-coast craze of lobster roll food trucks has made lobster more affordable, and abroad the appetite for the crustaceans is growing as well, experts say.

“The demand for this product now is really unprecedented,” said Annie Tselikis, marketing director for Maine Coast Co., a live lobster wholesaler based in York, Maine. She spoke Monday just before boarding a flight for a seafood trade show in South Korea, a major customer of North American lobsters along with China and others.

Live lobster prices on a wholesale basis reached $8.50 for a 1.25-pound hard-shell lobster in August, the highest level in a decade, according to Urner Barry, a leading seafood price tracker and a partner in Seafood News.

You’d have to go back to 2008 for the last time lobsters were even above $5 for this time of year, said John Sackton, editor and publisher of Seafood News. Since that time they’ve fluctuated between $3.90 and $4.85 until this year when they’re up again over $7.

“Lobster demand usually follows the stock market and general economy,” said Bob Bayer, director of the Lobster Institute at the University of Maine. “When the economy is good, lobster demand is good.”

Are Maine lobsters invading Europe? Even among Swedes, not everyone’s buying it

April 11, 2016 — There’s a bounty on the head of any Maine lobster found in Scandinavian waters.

Homarus americanus is a parasite-carrying, disease-spreading invasive alien threatening to breed infertile hybrids and destroy the local species.

That’s the view of researchers and politicians in Sweden, where Maine’s biggest export product is a feared intruder. Swedish officials describe a race against time to stop the invasion as they try to convince the 28-member European Union to halt all imports of the North American lobster, a move that could cost Maine lobstermen almost $11 million a year.

But some European chefs, whose patrons value the meaty North American crustacean over its tiny European cousin, say such a ban is premature and would have dire consequences for their establishments.

Sweden has been sounding the alarm since 2008, when a trawler first netted three North American lobsters with rubber bands on their claws off its west coast. Since then, 32 North American lobsters have been caught in Swedish waters, a sign they had been released into the ocean or escaped despite national prohibitions to hold American lobsters in net cages. Most of them have been caught in the Gullmar Fjord, causing increasing alarm among researchers at the Department for Aquatic Resources in the Swedish city of Lysekil.
