Lobstermen’s group launches $10 million fundraising push to ‘save’ industry jobs

November 17, 2021 — The Maine Lobstermen’s Association announced a three-year, $10 million fundraising campaign Tuesday to raise money for the fishery’s fight against impending regulations that industry members say could “eliminate the fishery and end Maine’s lobstering tradition.”

It named the fundraising campaign “Save Maine Lobstermen” and created a website at savemainelobstermen.org.

Earlier this year, the National Marine Fisheries Service released a 10-year plan, known as a biological opinion, to help protect the critically endangered North Atlantic right whale from deadly entanglements in fishing gear.

The first phase of the plan, released in August, adds requirements that include state-specific gear marking, weak points in rope to allow entangled whales to break free, and a 967-square-mile seasonal closure off the coast of Maine to reduce risks to whales by 60 percent this year and 98 percent over 10 years.

Endangered whales off US coast at center of fierce fight

November 16, 2021 — A judge ruled in favor of Maine’s multimillion-dollar lobster industry, pushing back on efforts to protect endangered species and limit how much fisherman can capture marine life.

The seafood industry is a huge part of Maine’s economy; in 2018 the state’s lobster fishery alone was valued at more than $400 million and brought in approximately 119 million pounds of lobster. According to the National Oceanic and Atmospheric Administration (NOAA), American lobster was the most valuable single species harvested in the U.S.

But all that harvesting has affected marine life. The North Atlantic Right Whale Consortium (NARWC) announced in October that the North Atlantic right whale population dropped to 336 in 2020, an 8 percent decrease from 2019. The group said 2020 was the lowest number for the species in nearly 20 years.

The federal government had attempted to protect endangered right whales, with Secretary of Commerce Gina Raimondo authorizing a partial closure of a fishing zone along the Maine coast that would have prohibited the use of buoy lines that many marine life are hurt or killed by. It was intended to restrict commercial lobster fishing for four months and was the first step in a 10-year plan to protect North Atlantic right whales.

Lawsuit over whale protections off Maine’s coast to proceed

November 15, 2021 — A federal judge has declined to throw out a lawsuit against the federal government seeking tougher rules to protect critically endangered North Atlantic right whales from collisions with ships.

The lawsuit, filed by the Center for Biological Diversity, Conservation Law Foundation and other environmental groups in 2012, seeks to force the National Marine Fishery Service (NMFS) to take aggressive steps to protect the right whale population by setting a speed limit for vessels to prevent collisions.

The groups filed a new petition to the court last year accusing the federal agency of dragging its feet on responding to their request for new whale protection rules.

The Biden administration had asked the court to dismiss the lawsuit, but U.S. District Court judge Amit Mehta ruled on Wednesday that the federal agency “cannot ignore its obligation to fully and properly consider a petition for rulemaking.”

MASSACHUSETTS: New Bedford is a shining sea of possibilities

November 10, 2021 — Stand here on Leonard’s Wharf, near where the Acushnet River empties into Buzzards Bay, and you’re surrounded by boats with colorful hulls and elaborate rigs. They help power the nation’s most lucrative fishing port, hauling hundreds of millions of dollars worth of scallops, fish, and lobsters from the Atlantic Ocean to be sold worldwide.

Next door, behind a rusty chain-link fence, sits a huge old power plant, long unused. The 29-acre site is one of two on New Bedford’s waterfront that is poised to host the assembly of massive wind turbines that would be shipped out and mounted in the Atlantic Ocean, promising much-needed clean energy for the Northeast.

Whether these two industries — one ages old, the other being birthed on the fly — can coexist in New Bedford harbor and out in the ocean will say a lot about the future of one of the most distinctive places in Eastern Massachusetts, a city that has for most of its 234 years drawn a living from the sea.

“The waterfront has always provided an opportunity for people,” said Laura Orleans, executive director of the New Bedford Fishing Heritage Center, who has spent a quarter-century telling the stories of New Bedford’s maritime history. “There have been a lot of people from many different cultures who have been very successful making a living on our waterfront.”

NOAA awards $2M in climate-related lobster research 

November 9, 2021 — Several  Maine scientists have received federal funding to learn how the American lobster is affected by environmental change in the Gulf of Maine and across New England.   

The National Oceanic and Atmospheric Administration  Sea Grant  announced $2 million in grant s late last mont h for six projects as part of the American Lobster Initiative. The initiative looks to bridge critical gaps in knowledge for Maine’s iconic species.  

“Given the importance of lobster to the economy and culture of Maine, I’m thrilled to have these new projects join the growing initiative,” said Amalia Harrington, a marine extension team member with Maine Sea Grant at the University of Maine. “The more we learn now, the better prepared our lobster industry will be in the future.”

ASMFC American Lobster Management Board Webinar Scheduled for December 6 from 1 – 3 PM

The Atlantic States Marine Fisheries Commission’s American Lobster Management Board will meet via webinar on December 6th from 1 – 3 PM. The purpose of the meeting is to consider approval of Draft Addendum XXIX: Electronic Vessel Tracking in the Federal American Lobster and Jonah Crab Fisheries for public comment. The Draft Agenda is available at http://www.asmfc.org/files/Meetings/AmLobsterBoardDec2021/AmLobsterBoardDraftAgenda_Dec2021.pdf. Meeting materials will be available by November 30th.

Public Comment Guidelines

With the intent of developing policies in the Commission’s procedures for public participation that result in a fair opportunity for public input, the ISFMP Policy Board has approved the following guidelines for use at management board meetings:

For issues that are not on the agenda, management boards will continue to provide opportunity to the public to bring matters of concern to the board’s attention at the start of each board meeting. Board chairs will ask members of the public to raise their hands to let the chair know they would like to speak. Depending upon the number of commenters, the board chair will decide how to allocate the available time on the agenda (typically 10 minutes) to the number of people who want to speak.

For topics that are on the agenda, but have not gone out for public comment, board chairs will provide limited opportunity for comment, taking into account the time allotted on the agenda for the topic. Chairs will have flexibility in deciding how to allocate comment opportunities; this could include hearing one comment in favor and one in opposition until the chair is satisfied further comment will not provide additional insight to the board.

For agenda action items that have already gone out for public comment, it is the Policy Board’s intent to end the occasional practice of allowing extensive and lengthy public comments. Currently, board chairs have the discretion to decide what public comment to allow in these circumstances.

In addition, the following timeline has been established for the submission of written comment for issues for which the Commission has NOT established a specific public comment period (i.e., in response to proposed management action).

1.Comments received by 5 PM on Monday, November 29 will be included in the meeting materials.

2.Comments received by 10 AM on Friday, December 3 will be distributed electronically to Board members prior to the meeting.

The submitted comments must clearly indicate the commenter’s expectation from the ASMFC staff regarding distribution.  As with other public comment, it will be accepted via mail, fax, and email.

Maine relies on its marine life, but climate change will alter what that means

October 28, 2021 — Steve Train used to finish work by 1pm. In those days, Mr Train—who has worked as a lobsterman in Maine for more than 30 years—didn’t have to travel far to find the critters. Now he sometimes wraps up closer to 4pm. Some lobsters are still close to shore, but rising temperatures have pushed many of them into deeper, cooler waters that take longer to reach. Where Mr Train will find the creatures has turned into something of a guessing game. “More of us are hunting all the time,” he says, as he sips a mezcal margarita from Luke’s Lobster, a waterfront restaurant in Portland’s historic Old Port. This is where he docks his boat, sells his catch and, three or four days a week, stops in for lunch (often a lobster BLT, lobster roll or fried haddock bites). Lobstering is more than a job, he says. “It’s a culture.”

Warming waters have done more than change lobstermen’s schedules—they have disrupted entire ecosystems, the Gulf of Maine among them. The Gulf of Maine’s waters have warmed faster than 99% of the world’s ocean over the past 30 years. Experts attribute some of that to changing currents. The effects of the Gulf Stream from the south have grown stronger and have begun to constrict the flow of the Labrador current, which delivers cold water from the North Atlantic to the Gulf of Maine. “The magnitude of change is really going to be dependent on how much water temperatures change,” says Kathy Mills, a research scientist at the Gulf of Maine Research Institute. So far, the heat has altered the patterns of the state’s two most profitable species, lobsters and soft-shell clams, with some experts and industry folk worried about the potential for further population declines. Maine’s overall commercial landings brought in more than $500m last year, but maintaining those profits will require flexibility—at the least, it means acknowledging the gulf may look vastly different in years to come.

Federal rules are sinking Maine’s lobster industry

October 25, 2021 — As a lifelong Maine lobsterman, I understand the inherent dangers of my job. I keep watch on the forecast knowing that sudden weather changes can make the difference between a successful day at work and putting my crew’s life at risk. These days, however, the hazard posed by Mother Nature does not compare with the perfect storm of regulations coming out of Washington that threaten my job, our way of life and may eventually sink a fishery that has supported communities and generations of families here in Maine.

In May, National Marine Fisheries Service released a nearly 1,000-page document outlining a 10-year plan that mandates a seemingly unreachable goal to reduce risk from our industry to the endangered North Atlantic right whale by 98 percent. This not only affects me, but nearly 10,000 other men and women who make their living hauling traps.

The fisheries service rolled out the first phase of this plan in August, requiring new gear modifications to add more traps to each buoy line while simultaneously making each line weaker. These measures reduce risk by removing a lot of rope from the ocean and help any entangled right whale to break free from the lines that remain, but they will most certainly make a lobsterman’s already dangerous job even more so.

Recently, a federal judge in Bangor temporarily delayed a seasonal closure of more than 950 square miles of prime lobstering ground off Maine. While we are relieved with this decision, the proposed closure reflects just one in a long line of decisions in the government’s plan that is supposed to protect right whales. The problem is this misguided plan takes aim at the wrong target and may destroy our industry while doing little to help protect the whale.

Maine’s top elected officials urge feds to throw out new lobstering rules

October 25, 2021 — Maine’s top elected officials are urging the federal government to throw out and rewrite a set of controversial new rules regulating Maine’s lobster fishery, calling the process “flawed and unfair.”

In a letter sent Thursday to U.S. Commerce Secretary Gina Raimondo, U.S. Sens. Susan Collins and Angus King, U.S. Reps. Chellie Pingree and Jared Golden, and Gov. Janet Mills lauded a federal judge’s decision last week to block the enforcement of a seasonal closure of a large section of the Gulf of Maine that was slated to go into effect Monday.

The National Marine Fisheries Service has said the closure area is necessary to protect the critically endangered right whale, but many in the lobster industry, and now U.S. District Judge Lance Walker, argue that the science used to support the closure is questionable.

They urged Raimondo to immediately resolve what they called the rule’s many shortcomings.

Judge is right that more data needed before part of ocean put off limits to lobster harvesting

October 22, 2021 — A federal judge’s order last week to temporarily stop the planned closure of a large swath of the Gulf of Maine to lobster fishing is welcome news to Maine’s lobster industry, but also to those who believe that data should guide decisions about protecting endangered North Atlantic right whales.

In August, federal fisheries regulators announced new rules for lobster fishing gear and the closure of 950 square miles of ocean about 30 miles off the coast from Mount Desert Island to Casco Bay to traditional lobster fishing from October to January. Ropeless fishing, a new and largely untested way of setting and retrieving traps using a smartphone, would still be allowed in this area under the rules. The closure was set to go into effect this week.

The new regulations came despite years of pleas from lobstermen, Maine elected officials and this editorial board that any decisions about measures to be taken to protect the whales needed to be made based on actual data about where and how whales are being injured, entangled and, too often, killed.

Without better data, Maine’s lobster industry was being asked to make substantial — and costly — changes that may not have addressed the biggest threats to right whales. Other threats include collisions with shipping vessels.
