Lobstermen rescued offshore after wave causes boat to sink

January 16, 2017 –YORK, Maine — The Coast Guard says it rescued two lobster fishermen off the coast of Maine after their vessel began to sink.

The sinking happened Friday when a wave hit the 45-foot lobster boat Miss Mae & Son about 17 miles off shore from York. The Coast Guard says the boat’s pumps couldn’t keep up with the water.

The Coast Guard says the fishermen jumped into the water when a response boat arrived and the boat’s crew was able to pull them on board. The water temperature was 42 degrees Fahrenheit.

The fishermen were returned to Portsmouth Harbor without injuries. The Coast Guard says the fishermen did the right thing by signaling for help and bringing survival gear.

Seafood Industry Fights Back Against Obama’s Fish Fraud Laws

January 13, 2017 — Even your humble local sushi joint will (hopefully) offer a dizzying array of seafood, from fluke to lobster to sea urchin. But chances are high that your sashimi isn’t what it seems: According to one report a couple years back from the ocean advocacy group Oceana, as much as 74 percent of fish sold at sushi spots in the US is fraudulent. Per that report, 92 percent of what’s sold as “red snapper” and 71 percent of what’s sold as “tuna” are actually imposter species of fish.

Seafood fraud is nothing new, and another Oceana report found that overall, 20 percent of all types of seafood sold nationally was mislabeled. Often, endangered fish of dubious origin can be passed off as more sustainable types of fish.

Last month, in an effort to enhance transparency for consumers and allow traceability of fish coming to US shores from foreign waters—where shady international fishing operators often use illegal methods to haul in catch en masse—the Obama administration announced rules that would require seafood importers to be able to trace the origin of each and every fish sold in the US back to an individual boat or fish farm.

Now, however, fishing industry players are fighting back, and have sued the government for placing what they say is an onerous and expensive burden on importers who already follow the rules.

The rule, which would go into effect on January 1 of 2018, requires importers to keep track of sourcing information for 13 priority species including tuna, swordfish, cod, and other species that are often mislabeled and overharvested. Importers would need to specify when and where a fish was caught, and would have to hold onto the data for two years. A new Seafood Import Monitoring Program within the National Oceanic and Atmospheric Administration would oversee the program.

When the program was announced, Kathryn Sullivan, a NOAA Administrator said, “As a global leader in sustainable fisheries management and seafood consumption, the US has a responsibility to combat illegal practices that undermine the sustainability of our shared ocean resources. We designed this program to further ensure that imported seafood is legally harvested and truthfully represented, with minimal burden to our partners.”

Lobster prices high as catch drops and China imports climb

January 11, 2017 — Lobster lovers are used to adjusting to high prices, but this winter, they’re shelling out even more for the cherished crustaceans because of a lack of catch off of New England and Canada and heavy exports to China.

Winter is typically a slow season for U.S. lobster fishermen and an active one off Atlantic Canada. But catch is slow in both countries this year, in part because of bad weather, industry sources said.

And the winter months are also an important time for exports to lobster-crazy China, which celebrates its New Year holiday Jan. 28. It’s increasingly popular to celebrate the Chinese New Year with American lobster. That’s causing demand at a time when supply is low.

American consumers who were paying $9 to $11 per pound for a live lobster in September — already higher than the previous year — are now sometimes paying upward of $13 per pound. There are enough lobsters to go around, but China’s demand is likely to only grow, said Bill Bruns, operations manager at The Lobster Company of Arundel, Maine.

“They are building infrastructure to meet more demand,” Bruns said, who added that China’s middle class “hasn’t stopped growing, and they keep eating.”

American lobster exports to China have topped 12 million pounds and $85 million in value for three years in a row. The country imported a fraction of that amount as recently as 2010, when it imported less than a million pounds of the crustaceans.

Meanwhile, prices charged by wholesalers in the U.S. are rising, too. The wholesale price of a 1 ¼-pound live hard shell lobster rose about a dollar in the New England market from December to January, when it was $7.75 per pound, according to Urner Barry commodities publishing service.

Lobstermen brace for third year of fishing ban

January 9, 2017 — It’s a classic New England scene, colorful lobster traps stacked up along a dock.

But for fishermen in South Shore lobster ports, those grounded traps are a symbol of hard times ahead.

A ban that keeps most of their gear out of the water for the winter is entering its third year, despite arguments that it causes them unfair economic hardship.

“If it made sense, that would be one thing,” Irvine Nash, a lobsterman for 48 years, said as he stood on a dock in Green Harbor. “But it don’t,” he said.

Behind him, fishermen were pulling traps out of the water and loading them on trucks. They will sit empty in yards and garages until May, when the government lifts the ban.

Under a recent rule from the National Marine Fisheries Service, all traps from outer Cape Cod to Cape Cod Bay and parts of Massachusetts Bay must be out of the water by Feb. 1. That’s an area just under 3,000 square nautical miles.

The federal agency first imposed the ban in 2015, to decrease the likelihood of endangered North Atlantic right whales, which come to Cape Cod Bay every winter, from entangling themselves in lobster lines.

There are now only about 520 right whales left, according to the North Atlantic Right Whale Consortium, up from about 300 in the 1990s.

Lobster Boat Owner Facing Manslaughter Charges Is Freed On Bond

December 23, 2016 — A Cushing lobsterman has been charged with manslaughter in the deaths of two crewmen who were lost at sea when his boat capsized and sank near Matinicus Island during a storm in 2014.

Federal prosecutors have accused Christopher A. Hutchinson of taking oxycodone, using marijuana and drinking alcohol before taking out his boat, No Limits, early on Nov. 1, 2014, with two crewmen aboard. Tomas Hammond, 26, and Tyler Sawyer, 15, were never found after the boat flipped in heavy seas and sank several miles west of Matinicus as it was headed back to its home port in Tenants Harbor. Hutchinson, 28, made it into a life raft and was rescued.

He pleaded not guilty to the charges at a hearing in U.S. District Court in Portland on Monday. Dressed in a tie-dyed T-shirt and blue athletic pants, Hutchinson responded to questions from Magistrate Judge John Rich and appeared shaken and tired.

Hutchinson had a court-appointed attorney during the hearing, but said he had retained an attorney to represent him. His family attended the hearing but declined to comment about the case. The families of Hammond and Sawyer didn’t return calls seeking comment Monday.

Hutchinson, who was arrested Monday, will be held in detention until a bail hearing scheduled for Thursday. If convicted, he faces up to 10 years in prison and a $250,000 fine.

Hutchinson has been charged under the Seaman’s Manslaughter Statute, a little-used statute in the U.S. criminal code dating to the 1800s that is used in cases of misconduct or negligence by anyone responsible for managing a vessel, including a captain, pilot or owner.

The indictment charged Hutchinson in the deaths of Hammond, of Richmond, and Sawyer, of St. George and Waldoboro, on Nov. 1, 2014.

The boat was headed for a fishing area called Eleven Mile Ridge, despite National Weather Service warnings of dangerous weather and sea conditions.

After hauling lobster traps for several hours, Hutchinson decided to return to Tenants Harbor about 10:30 a.m., court documents say. Hutchinson tried to “surf” the waves, capsizing the boat.

In an interview a few days after the sinking, Hutchinson said the No Limits was on the way back to the mainland when the seas and winds quickly intensified, causing the 45-foot lobster boat to flip.

Hutchinson said that when the trio left the Linda Bean dock in Tenants Harbor early that morning, the wind was not blowing. He said he had fished that area off Matinicus for six years. He said his boat was large enough that he was not concerned about the weather.

Diners Still Have a Crustacean Crush as Lobster Prices Jump

December 21st,2016  — Compared with most lunch sandwiches, the lobster rolls Alex Robinson sells from the side of his blue Happy Lobster Truck in downtown Chicago were already pricey. So, he was worried customers would go elsewhere after he started charging $17 instead of $15 to cover higher costs.

Turns out, Americans still have a crush on the crustaceans, and many are more than willing to pay up. Even after the price increase this year, Robinson says he hasn’t lost any business. The 4 ounces (113.4 grams) of wild-caught Maine lobster that he drizzles with butter and a touch of mayonnaise on a bread roll remain his best-selling item.

“We haven’t had anyone who said it wasn’t worth it,” said Robinson, who owns the truck. “Prices are going up, and it’s still staying popular.”

Four years after a glut led to the cheapest lobsters since the 1980s, prices on average are up 37 percent this year and the highest on record going back decades. While U.S. and Canadian fisherman have caught more than ever in recent years, output hasn’t kept pace with demand. Exports to China surged, and American restaurants that got used to low-cost seafood have added lobster to spice up everything from soups and salads to macaroni and cheese.

“The market now is outstripping the supply,” said Bernie Berry, president of the Yarmouth, Nova Scotia-based Cold Water Lobster Association, which represents fisherman in Canada. “I don’t think we can catch enough lobsters.”

Canadian claw and knuckle meat — a common variety used in lobster rolls –averaged $28.31 per pound (454-gram) this month, up 7 percent from a year earlier and well above the 10-year December average of $17.85, according to Urner Barry, a Toms River, New Jersey-based researcher that has been tracking food prices since 1858. In July, the average reached $29.44, the most ever.

Changing Climate, Oceans and America’s Fisheries

December 19th, 2016 — Fishing communities face extra challenges, as droughts, floods, rising seas, ocean acidification, and warming oceans change the productivity of our waters and where wildlife live, spawn and feed. And there is much at risk – marine fisheries and seafood industries support over $200 billion in economic activity and 1.83 million jobs annually.

NOAA last year set out a national strategy to help scientists, fishermen, managers and coastal businesses better understand what’s changing, what’s at risk and what actions are needed to safeguard America’s valuable marine resources and the revenues, jobs and communities that depend on them. Today, NOAA released regional action plans with specific actions to better track changing conditions, provide better forecasts, and identify the best strategies to reduce impacts and sustain our marine resources for current and future generations. Implementing these actions will give decision-makers the information they need now to sustain our vital marine resources and the many people that depend on them every day.

We are seeing dramatic changes, particularly in cooler-ocean regions like New England and Alaska where warming waters over the last twenty years are pushing fish northward or deeper to stay in cooler waters. In New England, known for its cod and lobster fishing, ocean temperatures have risen faster than many other parts of the world. Changes in the distribution and abundance of these and other species have affected where, when and what fishermen catch, with economic impacts rippling into the coastal communities and seafood businesses that depend on them. With better information on current and future shifts in fish stocks, fisheries managers and fishing industries can better plan for and respond to changing ocean conditions.

Maine lobster fishery achieves MSC sustainability certification

December 15, 2016 — The following was released by the Marine Stewardship Council:

The Gulf of Maine lobster fishery has achieved certification to the Marine Stewardship Council (MSC) Fisheries Standard. Certification proves that all commercial vessels licensed by the State of Maine and the National Marine Fisheries Service (NMFS) that fish within the Atlantic States Marine Fisheries Commission Lobster Conservation Management Area 1 and sell lobster to the Maine Certified Sustainable Lobster Association meet rigorous sustainability requirements. The MSC’s science-based standard is the world’s most credible and recognized standard for environmentally sustainable wild-caught seafood.

Craig A. Rief, President of the Maine Certified Sustainable Lobster Association said: “Maine lobster is known domestically and around the world as an iconic species that defines high quality seafood. With MSC certification, our customers have the assurance that Maine lobster is harvested in a sustainable way and will be available long into the future.”

The Maine Certified Sustainable Lobster Association (MCSLA) is a group of New England lobster wharf operators, processors, dealers and wholesalers. In September 2014, the MCSLA submitted the Gulf of Maine lobster fishery to independent, third-party assessment against the MSC standard for sustainable and well-managed fisheries. The members of the MCSLA are: Cape Bald Packers Ltd; Chicken of the Sea Frozen Foods; Cozy Harbor Seafood, Inc.; Craig’s All Natural, LLC; D. C. Air & Seafood, Inc.; East Coast Seafood, LLC; Eastern Traders; Inland Seafood; and Maine Coast Shellfish LLC. The sustainability certification for the Gulf of Maine lobster fishery is in parallel with a separate MSC certification for the fishery that was achieved in 2013.

The Gulf of Maine is the center of the US lobster industry, accounting for more than two-thirds of the nation’s lobster landings. Over four thousand commercial fishermen actively harvest Maine lobster. Lobster catches in Maine have continued to increase, to 127 million pounds in 2013, well above all previous values. The Maine Department of Marine Resources reports the total landed value for Maine lobster in 2013 was $364 million, a $22 million increase over 2012 and $30 million over 2011. Maine lobster is sold live, fresh and frozen in domestic and international markets.

Brian Perkins, MSC regional director – Americas, said: “The MSC’s vision is for oceans to be teeming with life for future generations. We are extremely pleased to see the Gulf of Maine lobster fishery succeed in the MSC process and we hope to be their partner in creating and maintaining new markets.”

The independent assessment of the Gulf of Maine lobster fishery was conducted by SAI Global Assurance Services, an accredited third-party conformity assessment body. SAI Global Assurance Services assembled a team of fishery science and policy experts to evaluate the fishery according to the three principles of the MSC Fisheries Standard: the health of the stock; the impact of fishing on the marine environment; and the management of the fishery. The MSC process is open to stakeholders and all results are peer reviewed.

Maine men lose licenses after allegedly removing eggs from female lobsters

December 14th, 2016 — The Department of Marine Resources has suspended for six years the licenses of two lobstermen who allegedly removed eggs from female lobsters.

Dexter Bray Jr., 36, of Stonington and Phillip Poland, 42, of Cushing also face a year in jail and fines of more than $1,000 if they are found guilty of the misdemeanor crimes, according to a release from Department of Marine Resources spokesman Jeff Nichols.

After an investigation prompted by an anonymous complaint received in the spring that Bray was “scrubbing” lobsters — artificially removing eggs from the underside of a female lobster’s tail — he was charged with removing the eggs of two female lobsters.

Investigators determined that Bray had attempted to sell two egg-bearing female lobsters at a lobster co-op in Stonington, according to the release.

The Marine Patrol also received an anonymous complaint about Poland, which spurred an investigation that allegedly revealed Poland had “scrubbed” the eggs from three lobsters.

“Scrubbing lobsters is one of the most serious violations of marine resource laws we see,” Maine Marine Patrol Col. Jon Cornish said in the release. “By removing eggs to make a short-term monetary gain, criminals deny future generations of fishermen the opportunity those eggs represent. Just as important, they undermine the work law abiding harvesters do every day to sustain this important resource.”

Two Men Have Lobster Licenses Suspended for Six Years for Removing Eggs from Lobsters

December 14th, 2016 — The following was released by The Maine Department of Marine Resources: 

The Commissioner of the Maine Department of Marine Resources has suspended the lobster licenses of two men for removing the eggs from female lobsters. The violation is a Class D crime which, in addition to license suspension, is punishable by up to a year in jail and fines in excess of $1,000.

The licenses of Dexter Bray, Jr., 36 of Stonington and Philip Poland, 42 of Cushing have been suspended for 6 years as a result of separate investigations conducted earlier this year by Maine Marine Patrol.  

The Bray investigation, led by Marine Patrol Officer Rustin Ames, resulted in charges of removing the eggs of two female lobsters for which Bray is facing fines of up to $1,600 in addition to as much as a year in prison and the license suspension.

The crime came to light by an anonymous complaint received in the spring by Officer Ames that Bray was “scrubbing” lobsters, which is the act of artificially removing eggs from the underside of a female lobster’s tail.

Officer Ames followed up on the complaint and began an investigation that involved Marine Patrol Specialist Sean Dow. The investigation revealed that Bray had landed and attempted to sell two egg-bearing female lobsters at a lobster co-op in Stonington.   

The Poland investigation, led by Marine Patrol Officer Brandon Bezio, resulted in charges of removing eggs from three female lobsters for which he faces up to a year in prison and fines up to $1,900 in addition to his license suspension.

This investigation also began with an anonymous complaint received during the summer. Officer Bezio followed up on the complaint and, with the help of Marine Patrol Officer Matthew Wyman, and Specialist Corrie Robert, determined that Poland had scrubbed the eggs from three lobsters in his possession. 

“Scrubbing lobsters is one of the most serious violations of marine resource laws we see,” said Marine Patrol Colonel Jon Cornish. “By removing eggs to make a short-term monetary gain, criminals deny future generations of fishermen the opportunity those eggs represent. Just as important, they undermine the work law abiding harvesters do every day to sustain this important resource.”

“I’m extremely proud of the thorough investigation conducted by the Officers involved in these cases,” said DMR Commissioner Patrick Keliher. “These are very difficult cases to make and the Officers did an outstanding job bring this behavior to and end.”

 Bray, who fished in lobster Management Zone C, was notified after a length of suspension hearing on November 2, 2016 with Commissioner Keliher that his license would be suspended for six years, allowing him to regain his license on May 19, 2022.

 Poland, who fished in Zone D, was notified after a length of suspension hearing on November 15, 2016 with Commissioner Keliher that his license would be suspended for six years, allowing him to regain his license on July 8, 2022.
