MAINE: Sen. Collins continues efforts to support Maine lobster industry

February 10, 2022 — U.S. Sen. Susan Collins (R-ME) recently joined a bipartisan, bicameral effort with several Maine lawmakers to continue advocating for their home state’s lobstermen and women, who are working to meet new federal requirements by May 1 that are expected to increase their financial losses.

The lawmakers expressed “renewed urgency” in requesting a delay in the National Marine Fisheries Service’s (NMFS) implementation of the new Atlantic Large Whale Take Reduction Plan final rule, which requires U.S. lobster and Jonah crab fisheries to modify their gear by May 1, according to a Feb. 7 letter they sent to U.S. Commerce Secretary Gina Raimondo.

“The economic harm imposed by the gear conversion deadline will be severe, and the scarcity of required gear is making it difficult — if not impossible — for lobstermen to achieve timely compliance,” wrote Sen. Collins and her Maine colleagues, who included U.S. Sen. Angus King (I-ME), U.S. Reps. Chellie Pingree (D-ME) and Jared Golden (D-ME), and Maine Gov. Janet Mills (D).

Depending upon the number of commenters, the board chair will decide how to allocate the available time on the agenda (typically 10 minutes) to the number of people who want to speak.

For topics that are on the agenda, but have not gone out for public comment, board chairs will provide limited opportunity for comment, taking into account the time allotted on the agenda for the topic. Chairs will have flexibility in deciding how to allocate comment opportunities; this could include hearing one comment in favor and one in opposition until the chair is satisfied further comment will not provide additional insight to the board.

For agenda action items that have already gone out for public comment, it is the Policy Board’s intent to end the occasional practice of allowing extensive and lengthy public comments. Currently, board chairs have the discretion to decide what public comment to allow in these circumstances.

In addition, the following timeline has been established for the submission of written comment for issues for which the Commission has NOT established a specific public comment period (i.e., in response to proposed management action)

· Comments received by 5 PM on Monday, February 15 will be included in the supplemental materials.

The submitted comments must clearly indicate the commenter’s expectation from the ASMFC staff regarding distribution.  As with other public comment, it will be accepted via mail, fax, and email.

MAINE: Lobstermen fear offshore tracking data would be used against them

January 20, 2022 — Maine lobstermen objected Tuesday to a proposal from interstate fishing managers that would require offshore lobstermen to have electronic trackers on their boats.

An arm of the Atlantic States Marine Fisheries Commission is considering implementing the tracking requirements on federally-permitted lobster and Jonah crab fishermen in order to collect data on where and how they fish. At a public hearing on Tuesday, commission officials laid out the proposal and heard concerns from lobstermen across the northeast.

The managers hope the data will help with fish stock assessments, interactions with protected species such as right whales, enforcement and ocean planning.

Lobstermen currently don’t have to report where they fish but competition for space could become more prevalent as other uses, such as aquaculture, marine protected areas and offshore energy, emerge. Officials said this data could help regulators understand how new uses could affect the fishery, something that’s currently challenging because they don’t know where fishermen drop their traps.

Hearings set for new electronic lobster boat tracking rules

December 20, 2021 — Interstate fishing managers are holding a series of public hearings next month about a plan to implement electronic tracking for lobster boats.

An arm of the Atlantic States Marine Fisheries Commission is considering implementing the tracking requirements for lobster and Jonah crab boats that have federal permits. Regulators have said the requirement could help protect rare North Atlantic right whales and give scientists more information about the lobster and crab population.

The lobster industry is facing a host of new rules to protect the right whales, which number less than 350 and are vulnerable to entanglement in fishing gear.

The virtual hearings will be for specific states or regional in nature.

ASMFC American Lobster Board Releases American Lobster Draft Addendum XXIX/ Jonah Crab Draft Addendum IV for Public Comment

December 14, 2021 — The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic States Marine Fisheries Commission’s American Lobster Management Board has approved for public comment Draft Addendum XXIX to Amendment 3 to the Interstate Fishery Management Plan (FMP) for American Lobster and Draft Addendum IV to the Jonah Crab FMP. The Draft Addenda were initiated in August 2020 to consider implementing electronic tracking requirements for federally-permitted vessels in the American lobster and Jonah crab fisheries, with the objective of collecting high resolution spatial and temporal effort data.

The collection of enhanced spatial and temporal data via electronic tracking devices in the offshore fishery would support managers in addressing a number of challenges facing the fishery. Electronic tracking data would greatly improve the stock assessment’s ability to estimate exploitation and abundance for American lobster, as the trackers would allow size composition data to be linked to harvest at a finer spatial resolution than what is currently possible. Additionally, the data could improve the models used to assess the location of vertical lines in the fishery and their associated risk to endangered North Atlantic right whales, which could impact federal risk reduction requirements for the fishery. Characterizing the footprint of the U.S. lobster fishery will also be critical to ocean planning efforts to minimize spatial conflicts with other ocean uses such as aquaculture, marine protected areas, and offshore energy development, as well as provide fishery managers tools to help maintain industry fishing grounds. Last, the efficiency of law enforcement efforts could be significantly improved with data to help enforcement officials locate widely dispersed gear in the offshore fishery. 

The Commission and its member states from Maine to Virginia will be conducting a series of hearings to gather public input on the Draft Addenda. Due to the COVID-19 pandemic, most hearings will be conducted via webinar; some hearings will be state-specific and others regionally-focused. The Draft Addenda include two options for proposed management programs. The first is status quo or no changes to the current program, and the second is to implement electronic tracking requirements for federally-permitted American lobster and Jonah crab vessels with commercial trap gear area permits for Lobster Conservation Management Areas 1 through 5 and Outer Cape Cod. Under this option, the specified permit holders would be required to install an approved electronic vessel tracking device to their vessel prior to beginning a fishing trip to collect and transmit spatial data. The devices would collect vessel locations every minute, which would allow for the distinction between transiting and fishing activity, as well as the estimation of traps per trawl. The Draft Addenda also describe administrative processes at the Commission, state, and federal levels for successful implementation of the management program to ensure the data collected meet the needs of state and federal partners.

Lobster Lawsuit: Maine org sues feds over right whale rules

September 28, 2021 — On Monday, Sept. 21, the Maine Lobstermen’s Association filed a lawsuit challenging NMFS’ new rule for Northeast lobster and Jonah crab fisheries.

The rule, filed on Aug. 31, is a modification of the Atlantic Large Whale Take Reduction Plan and is supposed to reduce the risk of entanglements to North Atlantic right whales in U.S. waters. The association says the modifications address only the perceived risk of Maine fisheries, which have no documented right whale interactions.

The lawsuit, filed against NMFS and the Secretary of Commerce in U.S. District Court for the District of Columbia, argues that “the federal government’s draconian and fundamentally flawed 10‐year whale protection plan… will all but eliminate the Maine lobster fishery yet still fail to save endangered right whales.” The result would put both fishermen and whales in harm’s way, industry leaders have said.

NOAA looks at other fisheries in effort to help whales 

September 7, 2021 — With new rules for the lobster fishery issued last week, federal regulators are now looking at potential changes to other fisheries on the east coast to cut down on the risk of injuries to several types of whales.   

The National Oceanic and Atmospheric Administration plans to hold two scoping sessions this fall to get input on their efforts to cut down potential entanglements and whale mortalities.   

Officials at the National Oceanic and Atmospheric Administration are considering changes to other trap and pot fisheries other than lobster and Jonah crab in Maine and other New England states, as well as amendments to the east coast gillnet fishery.
