Harsher penalties for lobstermen who cheat get legislative support

May 4, 2017 — A legislative committee voted unanimously Wednesday to toughen penalties on lobstermen who fish too many traps or use “sunken trawls,” as part of an industry-supported effort to crack down on lawbreakers.

“I do think this is going to get people’s attention and will hopefully make people realize that it doesn’t pay to cheat,” said Patrice McCarron, executive director of the Maine Lobstermen’s Association.

Lawmakers are considering a suite of requests from the Maine Department of Marine Resources for more enforcement tools and tougher sanctions against violators in an industry worth more than $500 million last year.

A bill unanimously endorsed by the Marine Resources Committee, L.D. 575, would allow DMR’s commissioner to order longer license suspensions for lobstermen who violate the laws on the first offense and, in several cases, permanently revoke the licenses of repeat offenders.

For instance, violators caught fishing more than the legal limit of 800 traps or fishing “sunken trawls” without marker buoys would face a minimum three-year suspension – up from the current one year – and could lose their licenses for up to 10 years. Removing or “scrubbing” the eggs from female lobsters would result in a minimum four-year license suspension, and “molesting” other fishermen’s traps could result in a suspension from two to six years. The current maximum for molesting gear is three years.

Elver prices rebounding

May 3, 2017 — With a month still left in the fishing season that ends May 31, the price of elvers (technically, glass eels) is on the rise, but many fishermen have already filled their annual quota and are dumping juvenile eels back into the water.

According to Ellsworth elver buyer Bill Sheldon, there are still plenty of elvers in the water, but that’s not doing the fishermen any good. Some harvesters with just 1 or 2 pounds of quota remaining have had to toss 15 to 20 pounds of elvers overboard to avoid overfishing their allocations.

“It’s a shame when you consider the economics of Hancock and Washington counties,” Sheldon said on Monday.

Maine elver harvesters are limited to a total annual landings quota of 9,616 pounds set by the Atlantic States Marine Fisheries Commission. According to preliminary figures released by the Department of Marine Resources, as of 6 p.m. on Sunday, dealers had reported buying just under 7,218.4 pounds from licensed harvesters, approximately 75 percent of the annual limit. With 31 days still to go in the season, only 2,397.6 pounds of quota remained available to harvest.

On Monday, Sheldon said that after falling to $1,150 per pound, the going price for elvers was $1,300 and going up.

The price “seems to have bottomed out,” Sheldon said. “My expectation is that it will increase slowly to the end of the season.”

According to DMR, the average price harvesters have received for elvers so far this season is $1,311. A few years ago, the price reached $2,600 per pound.

JERRY FRASER: Big lobster is watching

April 28, 2017 — It’s been a while since Red Bridges paid me $1 a day to bait lobster traps. Nine years old and not especially tall, I couldn’t reach deep in the bait barrel, so Red would pitchfork the redfish into a bushel basket for me. Between his having to do that and my eating half his lunch — unless he brought cold bean sandwiches — I was probably getting 99 cents more than I was worth.

Another benefit was cussing. Red was by no means vile in his use of language but he could cuss with the best of them and if, for example, our gear wound up with another fisherman’s, he would let loose with a stream I would later reprise for my friends. Of course, on the rare occasions his wife came along for the day, sitting in her lawn chair on the back deck, you’d have thought we were a couple of altar boys.

This was the 1960s. Lobstermen at Perkins Cove in Ogunquit, Maine, fished a couple hundred wooden traps, if that, from wooden boats. They built their own traps and knitted their own heads. Bait was $5 a barrel and the bait man delivered twice a week. Electronics typically consisted of a flasher, and not everyone had a radio.

Some things haven’t changed. Lobstering has always had pirates who harvest shorts and v-tails or regard buoy color as a notion whose significance varies with the visibility. In years past the state of Maine was seldom called in to adjudicate disputes. Fishermen sorted things out on their own in accordance with local tradition. In some cases, a word to the wise was enough, particularly if delivered by someone who might have been described as an “elder statesman.” Sometimes more assertive remedies were necessary. Occasionally, a dispute could result in an all-out trap war.

Lobstermen tired of conflicts support bill to allow GPS tracking of boats

April 25, 2017 — Lobstermen fed up with cohorts who violate fishing regulations testified in favor of a bill to allow Marine Patrol officers to secretly install tracking devices on fishing vessels suspected of illegal activity without first obtaining a warrant.

While a smaller faction opposed the bill, both sides agreed that Maine faces a growing “epidemic” posed by a small number of law-breakers fueling dangerous conflict and threatening the stewardship ethos within the state’s most valuable fishery. They also agreed that the Maine Department of Marine Resources needed more enforcement tools, but lobstermen differed on whether DMR’s commissioner should be allowed to authorize the installation of GPS tracking devices without getting a judge’s approval.

“It is coming to a point where violence will happen and I don’t want to see it happen,” Jason Joyce, a Swans Island lobsterman. “I’ve fished my whole life … the department is full of people who (committed to) criminal justice and they are not trying to impose anything on us as an industry. They are trying to help us out and they need the tools to do it.”

Critics raised concerns about giving the DMR commissioner – a political appointee – too much power and criticized what they said was overly broad or sweeping language in the bill.

“We need to help our law enforcement, yes, but the way the bill is written presently is not the way to do it,” said Rock Alley, a Jonesport fishermen and president of the Maine Lobstermen’s Union.

Lobstering in Maine always has been a rough-and-tumble industry where territorial disputes, personal conflicts or perceptions of wrong-doing can lead to sabotaged traps, sunken boats and occasional violence. But those tensions have risen to new levels in recent years, including the loss of more than $350,000 in gear during an intense “trap war” in the Swans Island-Stonington area last year, and one lobsterman’s boat being sunk at its mooring three times.

Maine lobstermen hauled in 130 million pounds of the crustaceans last year worth an estimated $533 million.

State law already allows Marine Patrol officers to obtain a warrant from a court to covertly install surveillance devices such as GPS trackers on vessels when officers have probable cause to believe the operator is engaged in criminal violations. But many serious crimes in Maine’s lobster industry – such as fishing more than the maximum 800 traps or hauling another fisherman’s gear – are civil violations that therefore require officers to provide targeted fishermen with at least 24 hours’ notice before installing tracking devices.

The bill under consideration in the Legislature, L.D. 1379, would allow the DMR commissioner to authorize the covert installation of a GPS tracking device in cases where Marine Patrol officers show “probable cause” of a civil violation.

Commissioner Patrick Keliher said conflicts between lobstermen are “indisputably” increasing as some lobstermen fish too many traps, set gear outside of their designated zone or fish “sunken trawls” without buoys to evade detection. Keliher, who called the bill “the most important piece of legislation” of his tenure as DMR commissioner, said he feared the actions of a few bad apples threatened to erode the conservation ethic of the industry.

Elver landings rising slowly, but price stays low

April 18, 2017 — A little more than three weeks into the 10-week fishing season, Maine elver dealers have reported buying about 30 percent of the total annual 9,616-pound landings quota allocated to the state’s fishery.

As of 6 p.m. on Sunday, according to figures the Department of Marine Resources described as “extremely preliminary,” dealers had purchased a total of 2,828.908 pounds of elvers and reportedly paid harvesters a total of $4,057,115 — an average price of $1,434 per pound.

That price may be misleading, though. On Patriots Day morning, an elver dealer in Ellsworth was paying $1,150 per pound and advising the fishermen who sell to him to hold on to their eels for a few days in hopes the price would rise.

At this time last year, dealers in the Ellsworth area were offering harvesters $1,300 per pound, with the low price reportedly a reflection of a weak market in Asia.

For the past two seasons, Maine harvesters have landed fewer elvers than allowed under their quota: 5,259 pounds in 2015 and 9,400 pounds last year. In 2015, the average price of elvers was just under $2,172 per pound and, at times, the price has soared above $2,400 per pound.

Trapped by heroin: Lobster industry struggles with its deadly secret

April 3, 2017 — Maine lobstermen are plagued by opioid addiction, leading to deaths, ruined lives and even fishing violations to pay for the habit. Some in recovery also recognize the challenge: Getting help to an intensely independent breed that rarely asks for it.

Until last year, when he finally kicked a 20-year heroin habit, Tristen Nelson had always been too high to even notice the best things about being a lobsterman in Down East Maine, like the beauty of a Bucks Harbor sunrise or the freedom of fishing two dozen miles offshore.

He loves those things about his job now, but for two decades the 35-year-old Machias man only lobstered to make the quick cash he needed to buy heroin. He would spend all his money, up to $60,000 for six months of work, on drugs. And he would end every fishing season broke.

His captains didn’t care if he showed up high, as long as he came ready to work. He hauled traps like a madman at dawn, fueled by his morning fix. By noon, however, the drug would start to wear off. He would slow down and hope each trap hauled was the last.

“I was just one more junkie on a lobster boat, counting down the hours until I could get my cash, until I could score,” Nelson said. “All those years I didn’t even realize that I had the best job in the world. … What a waste.”

The Gulf of Maine is full of people battling addictions. Nelson has hauled traps beside them, shot up with them and attended their funerals. And now, as somebody who has kicked the habit, he is trying to help other fishermen find their way into recovery.

“There are guys like me in every port,” Nelson said. “Anyone says different, they’re blind.”

For years, industry leaders and regulators ignored the drug use. They didn’t want to risk tainting the iconic image of the Maine lobsterman, that rough-and-tumble ocean cowboy who braves the elements to hunt lobster, the backbone of the state’s $1.6 billion-a-year industry. And the lobstermen were intensely private, preferring to battle their demons on their own and rarely asking for help.

That is starting to change. As addiction surfaces in newspaper obituaries, public memorial services and fishermen’s forums, and is blamed as a motive for an increasing number of the state’s fishing crimes, industry leaders now admit that America’s deepening opioid epidemic is feeding on the labor force of the state’s most valuable fishery.

“Addiction is a disease and it is a problem within this industry,” Commissioner Pat Keliher of the Department of Marine Resources told the Maine Fishermen’s Forum last month. “I am certainly not making the statement that it is everybody in this industry, but it is a problem.”

There is no way to compare heroin use among Maine lobstermen with any other profession. The state doesn’t keep its drug use statistics that way, and it will not identify the 378 drug overdose victims in 2016, including 313 who died of heroin or other opioids. While some coastal towns, such as Machias, openly acknowledge drug use in the fleet and talk about what can be done, others, like Stonington, the state’s lobster capital, remain reluctant to do so.

Maine fishermen see warning signs in lobster surge

March 23, 2017 — After Maine’s lobster industry set sales records for a second straight year, area fishermen are enjoying the boom while the water is warm.

Literally.

Rising sea temperatures are benefiting Maine’s iconic crustacean, leading to an increase in population while other marine species, such as soft-shell crabs, have suffered a decline, according to fishermen who spoke at a March 16 Maine Coast Fishermen’s Association panel.

But the factors for today’s success may portend tomorrow’s economic and cultural disaster, according to some area fishermen.

“We’re going to start going down when it gets warmer,” Maine Lobstermen’s Association President Dave Cousens told the audience at the Frontier Cafe.

Cousens was joined by MCFA President Gerry Cushing, of Port Clyde; Chebeague Island fisherman Alex Todd, and lobsterman Steve Train of Long Island.

Between July and October 2016, Cousens said, the ocean temperature was 60 degrees where he fishes in South Thomaston – a rise of three degrees since he began hauling traps three decades ago.

If temperatures rise three more degrees, he said, “lobster larvae will not survive. That’s what we’re facing.”

Last year, Maine fishermen hauled a record $130 million pounds of lobster, and the industry saw its value rocket $30 million, according to the Department of Marine Resources.

But the panelists warned the boom will be temporary.

“You don’t have to look too far south to see what’s coming,” Cousens said, noting the sharp demise of lobster populations off Cape Cod, Massachusetts, and Long Island, New York.

“That line’s just moving north,” Scott Moody, owner of Moody’s Seafood in Cundy’s Harbor, agreed the next day over the phone.

Moody, a fourth-generation lobsterman, fished in Harpswell for 30 years before starting his wholesale business, which includes five retail locations along Maine’s coast.

He buys directly from lobstermen and shellfish harvesters, and sells their product mostly to a distributor in Boston.

“In shellfish, we’ve seen a big turn,” Moody said last week. “I used to buy about $1 million in soft-shell (clams) in the Harpswell location,” at 337 Cundy’s Harbor Road.

“Since the climate change, I’m doing ($750,000) in hard-shell and only $250,000 in soft-shell,” he said.

Years ago, waiting to unload at his Boston distributor, “I’d be sitting behind five or six trucks of soft-shell clams,” he recalled. “They started to disappear. Then I’ve see guys bringing in hard-shell.”

He explained how warming waters increased the number of predators, such as Japanese green crabs, that can smash a clam’s soft shell.

Conflict in Gulf of Maine Scallop Fishery

March 23, 2017 — Since the start of the scallop season this month, Jim Wotton has dragged heavy dredges along the seabed off Gloucester, hauling in as much as 200 pounds a day of the valuable clams, the area’s federal limit for small-boat fishermen.

Now, to his dismay, dozens of larger, industrial-sized boats have been steaming into the same gray waters, scooping up as many scallops as they can. Unlike their smaller counterparts, the large vessels have no quota on the amount they can catch; they’re only limited by the number of days they can fish.

It’s a regulatory loophole that small-boat fishermen fear could wipe out the resurgent scallop grounds in the northern Gulf of Maine. This year, officials at the National Oceanic and Atmospheric Administration estimate that the large boats are likely to catch about a million pounds of scallops – roughly half of the area’s estimated stock.

“That would be devastating,” said Wotton, 48, who fishes out of Friendship, Maine. “They’re taking our future. There won’t be anything for us next year.”

Trump wants to end grants that support Maine fishing jobs

March 20, 2017 — The national $73 million Sea Grant program, which includes about a dozen researchers affiliated with the University of Maine, could be eliminated if Congress approves drastic budget cuts proposed for the National Oceanic and Atmospheric Administration by President Trump.

Funding for the state’s Department of Marine Resources and for collecting weather and climate data in the Gulf of Maine also could be put at risk by the president’s proposal.

Paul Anderson, director of the Sea Grant program at University of Maine, said Tuesday that the money NOAA has funded for the program has been “money well spent” because it has helped draw additional funding to Maine and has helped spur economic development.

“I think [Trump] has just got a fundamentally different attitude about government,” Anderson said Tuesday, without going into further detail. “What [people can do to try to protect the program] is write to our congressmen and senators.”

Trump’s administration already is considering slashing funding for the U.S. Coast Guard, which is part of the Department of Homeland Security, and for the Environmental Protection Agency, which provides about 20 percent of Maine’s Department of Environmental Protection annual funding. Now, according to the Washington Post, the federal Office of Management and Budget is looking to cut funding for the National Oceanic and Atmospheric Administration by 17 percent.

No one knows who ‘owns’ rockweed in Maine

March 10, 2017 — For 15 years, shore-front property owners, rockweed cutters and Maine Department of Marine Resources regulators have attempted to balance the competing interests that have tended to define the state’s rockweed industry.

Maine case law has produced mixed opinions on the question of who actually owns the olive-brown algae that is used in fertilizer and in some consumable products.

But a Washington County Superior Court case could help settle what’s become a contentious rockweed debate.

At high tide, rockweed floats on the water’s surface along the Maine coast, its rubbery, olive-brown plant strands buoyed by a series of air bladders. At low tide, it drapes shore-front rocks to provide protective habitat for crabs and other creatures. It was a source of fertilizer for English colonists who spelled out access rights in the Massachusetts Bay Colony’s Colonial Ordinance of 1641-1647. Since then, though, who owns Maine’s rockweed – or Ascophyllum nodosum, as it is known in scientific circles – remains an unanswered question for property owners, conservationists and harvesters.

Gordon Smith is a Portland attorney who represents several Washington County landowners upset that their shore-front properties have become targets for rockweed harvesters. They’ve made Acadian Seaplants Ltd. the focus of a lawsuit filed in Superior Court. The Nova Scotian biotech company is the largest independent manufacturer of marine plant products of its type in the world. Smith says that based on his reading of case law, it is clear to him that landowners control access in the inter-tidal zone of their property – a point he repeatedly made during arguments in court last week.
