ASMFC Summer Flounder, Scup and Black Sea Bass Board Approves Scup Addendum XXIX & Finalizes 2017 Black Sea Bass Recreational Management Measures

May 12, 2017 — The following was released by the Atlantic States Marine Fisheries Commission:

ALEXANDRIA, Va. — The Atlantic States Marine Fisheries Commission’s Summer Flounder, Scup and Black Sea Bass Management Board approved Addendum XXIX to the Summer Flounder, Scup and Black Sea Bass Fishery Management Plan. The Addendum shortens the length of the commercial scup summer period and extends the length of the winter II period (Table 1).

This action seeks to allow for the better utilization of the commercial quota, which has been under-harvested since 2011. Specifically, the change in quota period length allows for higher possession limits for a longer period of time each year, thus increasing the likelihood the commercial fishery will fully harvest the quota. The quota allocation for each period remains unchanged. The Mid-Atlantic Fishery Management Council (Council) also took the same action through Framework 10. The Council will forward its recommendation to NOAA Fisheries for final approval.The Board and Council’s action will not affect the 2017 quota period start and end dates; these changes will likely be implemented for 2018 commercial quota. The Addendum will be finalized and available on the Commission website, www.asmfc.org (on the Scup webpage), within the next few weeks.

The Board also reviewed the final 2016 black sea bass recreational harvest estimates and considered changes to current measures to meet the 2017 RHL. Based on the performance of the 2016 fishery, which indicated a reduction is needed to stay within the 2017 RHL, the Board set the possession limit for wave 6 (November/December 2017) at five fish in state waters from Rhode Island through New Jersey. All other state measures remain unchanged from 2016.

Other New England Groundfish Sectors Demand Equitable Distribution of Rafael Permits

May 8, 2017 — SEAFOOD NEWS — The Sustainable Harvest Sector, one of the fishery cooperatives authorized by the New England Fishery Management Council, has called again for NMFS to redistribute Carlos Rafael’s fishing permits to the entire industry, by returning the catch history to the entire region.  Below is a statement from the Board of this Sector, making the case as to why NMFS should act in this manner. They also rightly state that any geographic preference, such as permanently awarding a portion of quota to New Bedford, requires an extensive public consultation and rulemaking, as such geographic allocations are outlawed under Magnuson except in very special and specific cases.

Fair and Just Compensation in the Case of Carlos Rafael

As Carlos Rafael’s criminal case of money laundering and fishery fraud winds toward closure, the National Marine Fisheries Service must confirm how to re-allocate Rafael’s fish harvesting privileges.  The government plans to seize thirteen vessels and fishing permits. That still leaves Rafael with dozens more boats and permits to continue operating, and many fishermen believe he should be expelled from the fishery entirely.  But whether it’s thirteen permits seized or the three dozen he owns, each one has some amount of fishing rights ‘attached’ to it which must be re-allocated.

The New England Fishery Management Council is the primary federal body which controls quota allocation, and it already has a re-allocation mechanism in place.  Several years ago, the Council voted that the harvesting rights attached to any permit surrendered to the government would be proportionally redistributed to all remaining permits in the fishery.

Though the Council perhaps did not envision a seizure of this magnitude, the mechanism actually works quite well here.  Carlos Rafael has a long history of breaking a myriad of fishing rules, including quota-busting, violations of fishing time limits, closed area incursions, and false catch reporting to the government.  The nearly twenty publicly available settlement agreements with the government follow a timeworn, repeat pattern: A violation, followed by a negotiated fine which is just the cost of doing business in a criminal enterprise.

Rafael stole from every other fisherman in New England.   Over the last five years, his boats poached fish from waters off Downeast Maine to the Rhode Island coast.  While everyone else was suffering under severe cuts to their allowable catch of cod and flounder, Rafael simply decided those cuts didn’t apply to him, and smuggled the fish ashore anyway.

So the Council’s re-allocation mechanism rewards those who play by the rules.  If offers some relief to fishermen working under stringent catch limits which might be a bit higher if not for Rafael and his complicit captains.   It buttresses the logic that as the crimes were committed throughout the region, relief should be distributed throughout the region as well.

The City of New Bedford believes Rafael’s thirteen permits should be confiscated, then locked to that port in perpetuity.  This is an understandable position but is morally bereft.   Locking the quota to that port denies redress to the vast majority of Rafael’s victims.  The City of New Bedford has only benefitted from Rafael’s continuous criminal acts.  It is unseemly to enjoy those benefits for twenty years then, once the scam is exposed, seize them for all time.

New Bedford is by far the nation’s richest fishing port and has been for at least a decade, landing $300-$400 million of seafood annually. In contrast, the entire New England groundfishery is presently worth $60 million.  It is a vibrant and diverse waterfront which will not, by the Mayor’s own admission, succumb to Rafael’s misdeeds.  And New Bedford will benefit from the Council’s mechanism, via quota re-allocation to other boats already based in that port.  Everybody gains.

Neither the governing Council, nor the National Marine Fisheries Service which implements the Council’s policy directives, has ever contemplated restricting quota even to the New England states, never mind individual cities.  Changes of that magnitude take years to develop and mountains of public input – which the Council already conducted, as part of its fishery management plan.  The redistribution mechanism is already in place, it has passed legal muster, and – particularly in this case – it is just.

Commercial Harvest of Vermilion Snapper in South Atlantic Federal Waters will Open for Two Days on December 14 and 15

December 12, 2016 — The following was released by the South Atlantic Fishery Management Council:

Commercial harvest of vermilion snapper in federal waters of the South Atlantic will reopen for two days on December 14 and December 15, 2016. Commercial harvest will reopen 12:01 a.m. (local time) on December 14 th and close 12:01 a.m. (local time) on December 16 th. During the two-day opening, the commercial trip limit for vermilion snapper is 555 pounds whole weight or 500 pounds gutted weight.

On October 11, 2016, the commercial quota for the July through December 2016 season was projected to be met, and NOAA Fisheries closed the season. However, a recent landings update indicates that the vermilion snapper quota was not met. The 2017 January through June fishing season opens at 12:01 a.m. (local time) on January 1, 2017.

Catch quota implemented to protect swordfish

November 23, 2016 — A world body of fishing and shipping nations approved a catch quota yesterday to protect the overharvested Mediterranean swordfish, the EU and conservation group Oceana said.

The limit was set at 10,500 tonnes for 2017 at a meeting of the 51-member International Commission for the Conservation of Atlantic Tunas in Vilamoura, Portugal.

It will be reduced by three per cent per year between 2018 and 2022.

“It’s done. Finally, ICCAT on its 50th anniversary moved a step forward on this too long-neglected stock,” Oceana’s Ilaria Vielmini said in the coastal town where the commission held its annual meeting.

Fishing Report: Stricter summer flounder limits on the way

August 19, 2016 — This season some recreational anglers felt summer flounder (fluke) fishing was good, others felt it was way off. The truth is that there are fewer summer flounder in the water.

The Atlantic States Marine Fisheries Commission and the Mid-Atlantic Fishery Management Council (MAFMC) announced on Monday that they modified specifications for summer flounder, reducing catch limits in 2017 for both recreational and commercial fisheries by about 30 percent.

The 2016 assessment update indicates that summer flounder has been on a downward trend. The summer flounder spawning stock biomass has been on a downward trend for the last six years. Fish managers have taken action with 30-percent reductions proposed for 2017, both recreational harvest limits and commercial quotas. How this will play out with Rhode Island, Connecticut, New York and Massachusetts fishing regulations for 2017 remains to be seen, but no doubt more conservative regulations are on the way.

Previously implemented specifications for scup, black sea bass and bluefish were reviewed but essentially kept the same pending fishery changes and any new scientific information.

The ASMFC’s actions are final and apply to Rhode Island state waters but how they are implemented is to be determined. The council will forward its federal waters recommendations regarding summer flounder specifications to NOAA Fisheries Greater Atlantic Regional Fisheries administrator for final approval.

Feds back off controversial plan to close commercial bluefish fishery mid-season

August 5, 2016 — The Long Island bluefish fishery will not be closed mid-season as the National Oceanic and Atmospheric Administration announced last month, which prompted an outcry from federal and state elected officials and commercial fishermen.

A new federal rule will now allow transfers of bluefish quotas from the coast-wide recreational quota to the commercial quota, ensuring that the fishery can continue to harvest bluefish for the remainder of the season, the governor and members of the New York congressional delegation announced yesterday. As a result, 1.58 million pounds from the recreational fishing sector will be transferred to the commercial quota.

“With this common sense, flexible decision by the NOAA, we have reeled in a major win for Long Island’s commercial fishing boats,” said Sen. Chuck Schumer. “With the quota transfer, our Long Island fishing boats – who were facing a harsh and premature closing of the fishery — can keep earning, employing others and harvesting their catch. The feds did the right thing by heeding the call and supporting an industry that has deep history on Long Island.”

Science on Menhaden Continues to Support Increased Quota

August 3, 2016 — The following was released by the Menhaden Fisheries Coalition:

Peter Baker, the Director of U.S. Oceans, Northeast for the Pew Charitable Trusts, argues in a recent article that fisheries managers should not raise the coastwide Atlantic menhaden harvest level (“10 Reasons to Maintain the Atlantic Menhaden Catch Limit in 2017”). But this recommendation goes against the last two years of menhaden science, which found in 2015 that the stock is healthy and sustainably managed, and this year finds that the quota can be significantly and sustainably raised.

Mr. Baker writes that “the [Atlantic States Marine Fisheries Commission] created the first coastwide catch limit in 2013 and set the allowable catch lower than the amount taken in preceding years in order to help menhaden rebuild.” In fact, the cuts were made to address overfishing that turned out never to have existed. The quota cut was instituted following a flawed stock assessment in 2010 that underestimated the health of the menhaden population, leading to an unnecessarily strict quota. Contrary to that assessment, menhaden was, and remains, a healthy and vibrant stock.

The numbers are not better now because cuts allowed the stock to rebuild, but rather because the earlier numbers were inaccurately low and have been corrected in the most recent assessment. The more recent, accurate ASMFC assessment, released in 2015, conclusively found that menhaden was “neither overfished nor experiencing overfishing” – in other words, the stock is sustainable and successfully managed.

Scientists with the ASMFC Menhaden Technical Committee recently gave regulators further evidence in favor of a quota increase. In a series of simulations – 9,000 to be precise – the Technical Committee analyzed what would happen if the menhaden quota was raised by various increments, up to a 40 percent increase. Their conclusion: there is a zero percent chance of overfishing occurring should the quota be increased.

Mr. Baker also questions the ecological effect a quota increase would have. Menhaden play a role in the food chain, with juvenile menhaden—menhaden from ages 0-1—serving as food for larger predators. Commercial fishermen do not fish for juvenile menhaden, a fact supported by the available data.

Additionally, Mr. Baker alleges that striped bass and weakfish populations are diminished because they have a lack of menhaden to consume. But striped bass and weakfish are susceptible to a wide variety of environmental factors, which regularly cause fluctuations in the population.

Lastly, Mr. Baker argues that the public supports the existing quota limitations based upon the results of online petitions with leading questions, funded and promoted by his organization.  The accuracy of Pew’s campaigns notwithstanding, commercial fisheries are not managed by popularity contests.

Over the past three years, commercial fisheries and related industries have suffered lost revenue and workers have lost jobs.  We now know that the unnecessarily low quotas were based on flawed data.

It is time to set quotas based on solid data and scientific review, not by demands made in well-funded media campaigns from the Pew Charitable Trusts and other special interest groups.

Commission could increase menhaden catch

August 2, 2016 — New Jersey commercial bait fishermen want to see the coastwide catch of menhaden increased nearly 80,000 metric tons.

“We’re focused on the science. If the science supports an increase, we want to take it,” said Jeff Kaelin from Lunds Fisheries, a commercial fishing operation in Cape May.

The amount of menhaden fishermen will be able to take from the water next year will be decided Wednesday in Alexandria, Virginia, when the Atlantic States Marine Fisheries Commission meets.

The Atlantic Menhaden Technical Committee has given the ASMFC options that would allow the catch to increase by as much as 10,000 to 80,000 metric tons.

Only one option is to keep the status quo at 187,880 metric tons. There is no option to reduce the catch.

Kaelin said Jersey purse seiners have been shut out of the fishery since July 4, after fishermen reached their allocation for this year. He said if they had more quota, they could be selling bait to New England lobstermen who are clamoring for bait.

AL DUDLEY: Stock Assessments Overwhelmingly Support Raising Atlantic Menhaden Quotas

August 2, 2016 — SEAFOOD NEWS — This week, fisheries managers have the chance to expand opportunities for fishermen as they consider a scientifically supported increase in the coastwide menhaden quota. Although generally not consumed in their own right, menhaden are the bait of choice for both commercial and recreational fishermen and are prominent producers of the Omega-3 nutrients often used in health supplements.

In recent years, commercial fishing of menhaden has been needlessly restricted by the Atlantic States Marine Fisheries Commission (ASMFC), the regulatory body charged with managing the species and maintaining the health of the stock. In 2012, based on the results of a stock assessment that was later found to have inaccurately underestimated the strength of the menhaden population, the ASMFC cut the annual menhaden harvest by a deeply felt 20 percent.

This year, as the ASMFC discusses potentially raising the quota, the science clearly and without a doubt demonstrates the menhaden stock is healthy, vibrant, and not in any conceivable danger of becoming overfished.

In an analysis earlier this summer produced by the ASMFC’s Menhaden Technical Committee, scientists analyzed the potential results of an increase in the menhaden quota for the 2017 fishing season. The Committee experimented with nine different potential increases, from simply maintaining the menhaden quota at its current level to increasing it by 40 percent. For each increase, the Committee ran 1,000 separate simulations, to ensure the data were accurate and all variables possible were accounted for. After this thorough and exhaustive study, the Committee concluded that increasing the menhaden quota for the 2017 fishing season poses a zero percent chance of resulting in overfishing.

These results build upon the positive findings of the 2015 menhaden assessment, which overturned the inaccurate results of the previous assessment when it found the stock to be sustainably managed, neither overfished nor subject to overfishing.

The Committee was comprised of 21 different scientists, representing 13 different states up and down the Eastern Seaboard. In addition, the Committee had representatives from the National Marine Fisheries Service, which has been in favor of limiting menhaden fishing in the past. That such a diverse wealth of scientists and regulators agreed raising the quota would have virtually no likelihood of overfishing is testament to the exhaustive and rigorous nature of their efforts.

When the ASMFC meets this week, they intend to discuss the motion for a raise in the annual menhaden quota. Now it is time for them to either fish or to cut bait. The evidence does not lie – menhaden are not at risk of overfishing with a raised quota.

Latest Scientific Analysis Supports Increased Atlantic Menhaden Quota

Aug 1, 2016 – The following was released by the Menhaden Fisheries Coalition:

WASHINGTON (MFC) – An analysis conducted by scientists at the Atlantic States Marine Fisheries Commission (ASMFC) finds that the coastwide Atlantic menhaden quota can be substantially raised without impacting the sustainability of the species.

In a memo by the ASMFC’s Atlantic Menhaden Technical Committee on June 22, the Committee described projections it ran using nine different potential quota levels for the 2017 fishing season. These projections found a 0 percent chance of overfishing menhaden in 2017, even when menhaden quota was increased by up to 40 percent. Projections were run 1,000 times for each potential quota level to ensure that a full range of potential scenarios were accounted for in the estimates.

The Atlantic Menhaden Technical Committee is composed of 21 scientists from 13 states along the U.S. Atlantic coast and the National Marine Fisheries Service. The Committee’s projections were short-term (2014-2017) to eliminate uncertainty inherent in longer-term projections.

The ASMFC will hold its summer meeting August 2-4 in Alexandria, Va., where it will discuss, among other topics, Atlantic menhaden, and the possibility of raising its quota for 2017.

Atlantic menhaden catch totaled 171,900 mt tons in 2014. The ASMFC set menhaden quota at 187,800 mt for 2015 and 2016.

In 2015, the ASMFC’s Atlantic menhaden stock assessment found that the menhaden stock was healthy and sustainably managed, with the species neither overfished nor experiencing overfishing. It also found that fishing mortality is at an all-time low, and that menhaden fecundity (egg production) has been strong in recent years. Based on these findings, the ASMFC raised the menhaden quota by 10 percent last year.

Menhaden are used to produce fishmeal, fish oil, and fish solubles due to their high concentration of healthy Omega-3 fatty acids. They are also prized for their use as bait in other fisheries.
