MASSACHUSETTS: New right whale protection regs leave Cape Cod fishermen feeling trapped

March 25, 2021 — It’s pretty easy to guess what Jon Tolley does for a living.

His house on the quarter-acre lot is nearly surrounded by gravel, with bright yellow and black fishing traps neatly stacked all around.

Tolley is gearing up for the fishing season, and he was outside at a work station Wednesday, a hoodie his only protection against the cool air of early spring. Tolley is headed for a hip replacement in a month, but that wasn’t his only concern.

New state regulations, the result of a lawsuit seeking to protect highly endangered North Atlantic right whales, require that he fit the buoy lines on all 1,200 of his lobster, conch and black sea bass traps with special sleeves that release under the pressure of an adult whale.

Along with collisions with ships, entanglement in vertical fishing line attaching lobster and other pots to buoys is one of the top causes of right whale mortality.

Report to policymakers: ‘Remove barriers’ and ‘go big’ on offshore wind off MA coast

March 19, 2021 — Environmental organizations from Massachusetts, Maine and Rhode Island released a report Thursday outlining what they see as the enormous potential for offshore wind power to help the region and the nation reach carbon reduction goals in the energy sector.

“We know we can go big on offshore wind, and we are positioned really uniquely in New England,” said Hannah Read, offshore wind associate for Environment America at a press conference Thursday.

The report, Offshore Wind for America, called for policymakers to remove barriers to industry growth and promote clean energy.

Massachusetts has been a leader in promoting the offshore wind industry as the first to require utilities doing business in the state to include wind energy as a portion of the power they sell to ratepayers. The nation’s first utility-scale offshore wind farm will likely be Vineyard Wind. Located about 14 miles southwest of Martha’s Vineyard, the farm is expected to generate enough electricity to power 400,000 homes and businesses and reduce carbon emissions by 1.6 million tons a year, according to company statements.

MASSACHUSETTS: Report: Shellfish industry under threat as oceans grow more acidic

February 11, 2021 — Carbon emissions and wastewater are making the ocean more acidic, an accelerating chemical reaction that could threaten the ability of young scallops, oysters and lobsters to survive to maturity, according to a report published by the Massachusetts legislature on Tuesday.

A coalition of scientists, conservationists and representatives from the seafood industry found that a third of mollusks could be wiped out within 80 years if ocean waters continue to acidify at current rates. The effect on lobsters and crabs is less clear, though they are suspected to be more resilient.

“We’re running out of time before the consequences of ocean acidification become truly catastrophic,” said State Rep. Dylan Fernandes, a Democrat from Cape Cod who co-founded the coalition.

The group’s 84-page report says that oceans have been acidifying since the industrial revolution by soaking up excess carbon dioxide in the atmosphere. When the gas dissolves, it triggers a chain reaction that raises acidity and saps the ocean of carbonate ions that shellfish use to grow their shells, making them more vulnerable to predators and bruising waves.

It’s hardly the first time scientists have predicted doom for New England’s seafood industry, but the report found rising ocean acidity is threatening scallops, the very species that fishermen in New Bedford and other nearby ports turned to to survive an earlier ecological catastrophe: the overfishing of cod.

MASSACHUSETTS: Statewide Ban on Lobstering Approved, With Exemption for Vineyard

February 1, 2021 — State fishing regulators overwhelmingly approved a first-of-its-kind seasonal lobstering ban to protect the North Atlantic right whale on Thursday — but exempted Vineyard and south shore waters from the restrictions after local fishermen expressed concerns about the proposal.

The new regulations, which ban commercial lobstering from Feb. 1 through May 15 in all state waters north and east of Cape Cod — but not the Island — were approved in a 6-1 vote with one abstention by the state Marine Advisory Commission during a dramatic hearing Thursday morning. The new rules differ substantially from an initial Department of Marine Fisheries recommendation that would have banned lobstering statewide.

Regulators also rejected a measure that would have barred lobstering vessels over 29 feet from using single pot lines, partially at the urging of Vineyard representative on the commission Dr. Shelley Edmundson, who asked to form a committee on the proposal. Other approved regulations include weaker rope and a recreational ban in all state waters from Nov. 1 through May 15.

The new seasonal commercial ban comes as a flurry of lawsuits and right whale deaths from entanglement have forced federal and state regulators to act fast in an effort to preserve the species and fall in line with the Environmental Protection Act. State regulators hope to use the new conservation measures to obtain an Incidental Take Permit from the National Marine Fisheries Service, which is required for the continued operation of the lobster fishery.

As fishermen weather the winter cold, are they truly prepared for survival?

January 27, 2021 — The temperatures were awfully chilly this weekend.

On Saturday night, 27 degrees at Provincetown Municipal Airport, with winds at 25 miles per hour and gusts to 37. The low Saturday night was 22 degrees.

It felt like the first truly freezing temperatures this winter on the Outer Cape.

That chill is a reminder of what fishermen have to consider every time they leave the dock.

At a December training in Sandwich, 25 crewmen and captains from Cape and New Bedford fishing vessels sat down in slushy snow to wriggle into what could be the most important article of clothing they will ever try on.

They call them Gumby suits, or immersion or survival suits. A survival suit is bright orange with oversized hands and feet and a tight-fitting hood that reveals only a small moon of flesh: eyes, nose and mouth. The water temperature on that training day was 47 degrees, and Dan Orchard, the vice president of Fishing Partnership Support Services, had the men suit up and jump into the water within a half-hour of arrival. Going from comfort to cold, disorienting water temperatures was about as close to the real thing as could be had shoreside.

Beware ’30×30′ in federal climate bill

January 27, 2021 — 30×30, a major provision in the Ocean-Based Climate Solutions Act that would ban all commercial fishing in at least 30 percent of U.S. oceans by 2030, has drawn widespread opposition by fishermen and fisheries scientists since it was introduced in the House of Representatives last year. In a letter to Congress last November, over 800 participants in the U.S. seafood economy wrote that 30×30 “would undermine our nation’s world-class system of fisheries management.” 

In an open letter to Congress last December, a group of fisheries scientists wrote that 30×30 “is not based on the best scientific information available” and “will decrease flexibility of the fishery management system to adapt to climate change.” 

The following is excerpted from an article by Doreen Leggett, communications officer at the Cape Cod Commercial Fishermen’s Alliance, published by Wicked Local:

Commercial fishermen rely on the sea and are often more aware of the changing ocean environment than anyone else.

Take fisherman Kurt Martin of Orleans. For close to three decades he has kept daily logs of everything from where he fishes to weather conditions, water temperatures and depth.

A few things stand out: Fog that was virtually synonymous with Chatham is becoming a rarity, summer ocean temperatures have increased about 10 degrees and walking around an iced-in Pleasant Bay come Christmas is a distant memory.

Meanwhile, the lobster fishery south of the Cape is much diminished while Canada’s is growing as warmer water pushes north. Martin said the lobster fishery on the Cape is “stable” now.

“But we are basically on the edge of disaster. We can definitely see the trend of the shift being made.”

Climate change has pushed commercial fishermen to change their business plans, the way they fish, what they fish for, even their home ports. But when far-reaching climate legislation was drafted and filed in the House of Representatives last year (by a representative from Arizona), fishermen were shut out of the conversations. They may be shut out of their fishing grounds as well.

There are many positives in the 300-page bill, but one section would harm fishing communities across the nation, hamstring buy-local movements, increase seafood imports, and complicate efforts to combat climate change.

The initiative, dubbed 30×30, a focal point in the House version of the Ocean-Based Climate Solutions Act, would require “protection” of at least 30 percent of U.S. oceans by 2030 by banning “all commercial extractive use” in broad swaths of the ocean, circumventing the country’s sustainable fishery management process. (Specific areas have not yet been identified.)

President Biden’s flurry of actions to protect the environment reignites a controversy about the Atlantic’s only marine monument

January 22, 2021 — Last June, as part of a concerted campaign to dismantle the environmental policies of the Obama administration, Donald Trump met with fishermen in Maine and signed a proclamation that allowed commercial fishing in nearly 5,000 square miles of federally protected waters southeast of Cape Cod.

But elections have consequences, and on Wednesday President Joe Biden signed an executive order that could overturn Trump’s decision and restore the first marine national monument in the Atlantic Ocean to its former status, part of a flurry of executive actions Biden took on his first day in office to reverse many of the Trump administration’s environmental rollbacks.

Environmental advocates called the first steps promising, a welcome change from the policies of the past four years.

In response to Biden’s order, representatives of fishing groups urged the new administration to consult them before overturning Trump’s policies.

“The hope of the fishing industry is that if the Biden administration is endeavoring to unite the country, then the Biden administration will actively reach out to fishing communities and not only discuss the marine monument with them but listen to the fishing communities’ concerns and act upon those concerns,” said Andrew Minkiewicz, an attorney at the Fisheries Survival Fund in Washington, D.C.

He and others urged the Biden administration to respect the traditional fishery management process, which allows for councils composed of fishermen, environmental advocates, and regulators to determine where and how much fishing can occur.

“I believe, as long as this is reviewed fairly, in terms of the science and law, there’s no reason that fishing shouldn’t be allowed there,” said Bob Vanasse, executive director of Saving Seafood, a Washington-based group that represents commercial fishermen. “It’s sustainable. But if it’s a political decision and about Obama’s legacy, then it’s going to be a problem.”

More restrictions considered for Massachusetts lobstermen

January 4, 2020 — To protect North Atlantic right whales, regulators want to expand an annual three-month ban on the use of lobstering equipment off Cape Cod Bay to include all Massachusetts waters.

Since 2015, federal regulations have banned the use of lobstering equipment from Feb. 1 until at least April 30 off Cape Cod Bay and beyond, shutting down the local industry for the winter. The goal is to reduce the chances of whales becoming entangled in the gear.

Right whales are common in Cape Cod Bay during late winter and early spring, especially during March and April.

New technology expected to play a key role in shark research

December 29, 2020 — There was precious little good news in 2020, but at least, for the second year in a row, we didn’t see any shark attacks on the Cape.

Unfortunately, the same could not be said for Maine, where a great white shark killed a New York City woman while she was swimming in Harpswell in July. It was the first such attack in the state’s recorded history.

Cape Cod’s first shark attack was in 2012 — the first fatality in Massachusetts in 82 years occurred in Wellfleet in 2018.

The Maine death, along with an increase in the frequency of sightings and detection of tagged white sharks along the New England coastline, helped spur the foundation of the regional New England White Shark Research Consortium this month with the goal of sharing information and research.

With the largest population of great white sharks on the East Coast, Cape Cod is home to cutting-edge research intended to protect the species as well as the millions of beachgoers who come to the peninsula each summer for fun in the surf. While much of that research effort still lies in finding and observing these large marine predators the old-fashioned way with spotter planes and boats, new technologies give scientists hope they will unlock the mysteries of behavior and life history that will allow sharks and humans to coexist.
