Mote teams up to research sharks and other migratory species

November 5, 2019 — Mote Marine Laboratory is bringing its long history of shark expertise to a new consortium studying highly migratory species, thanks to new funding from the National Oceanic and Atmospheric Administration (NOAA) Sea Grant program. The Pelagic Ecosystem Research Consortium (PERC) will have a goal of improving stock assessment, management and sustainability of highly migratory species, such as tuna, swordfish and sharks, in the Atlantic Ocean and Gulf of Mexico. PERC is being led by the University of Maine, with partners from Mote Marine Laboratory, Nova Southeastern University and Auburn University.

The PERC award was one of three competitive grants totaling $2 million, awarded through the 2019 Sea Grant Highly Migratory Species Research Initiative. More information about the national initiative is on the NOAA Fisheries website. This new Sea Grant initiative was championed by U.S. Senators Marco Rubio (R-Fla.), Susan Collins (R-Maine) and Richard Shelby (R-Ala.), who together recognized the national need for this research.

PERC will conduct projects in five areas of research focused on bycatch reduction, increased understanding of life history, post-release mortality and other objectives for multiple species of highly migratory fish in the Northwest Atlantic and Gulf of Mexico.

Comprehensive information on the life history of highly migratory species is lacking, including data on age, growth, indices of abundance, reproduction, post-release and natural mortality, infectious disease, anthropogenic disturbance, habitat utilization/migratory behavior and stock structure.

Sarasota’s Mote ramping up shark research through NOAA grant

Alabama Snapper Season of 47 Days Approved By NOAA

April 10, 2018 — The National Marine Fisheries Service [NMFS] has officially accepted Alabama’s plan to manage its own seasons for recreational red snapper fishing — paving the way for 47-day seasons in the next two years.

As Lagniappe has previously reported, the plan manages the season lengths in state and federal waters off the Alabama coast is part of a two-year pilot program approved by the Gulf of Mexico Fishery Management Council in February.

For the first time in years, Gulf states will be able to manage recreational snapper fishing off their respective coasts through individual Exempted Fishing Permits (EFPs) submitted to NMFS.

The decision comes after years of shorter and shorter snapper seasons that frustrated anglers and commercial fisherman alike until a consortium of Gulf leaders negotiated a compromise through U.S. Commerce Secretary Wilbur Ross that extended the 2017 season.

Gov. Kay Ivey announced Friday that Alabama’s plan, which will create a 47-day season, will be in place for the next two years. In 2018, it will run from June 1 to September 2 on Fridays, Saturdays, and Sundays and the entire week on the Fourth of July. It would run concurrently in state waters and in federal waters, which begin nine miles from the coast.

“I am very pleased that the U.S. Department of Commerce, through the National Marine Fisheries Service, has granted Alabama an Exempted Fishing Permit for the next two red snapper seasons,” Ivey said of the plan’s approval. “Following the directives from President Trump to cut down on federal regulations, this decision empowers Alabama to manage our resources instead of bureaucrats in Washington.”

Ivey also noted the EFP program was made possible by language Sen. Richard Shelby added to the FY2017 Commerce, Justice, and Science Appropriations bill. It directed the NMFS to develop the pilot program to allow states more control over reef fish management activities.

In a statement, Ivey said Alabama’s red snapper fishery is a big part of “the coastal culture and economy of” of the state and thanked Shelby and Rep. Bradley Byrne for their congressional efforts to give Alabama more autonomy in managing its coastal resources.

She also made a special note of the efforts Alabama is also indebted to Conservation and Natural Resources Commissioner Chris Blankenship made to push for alternatives to federal snapper seasons that had become shorter and shorter in recent years.

“The red snapper management granted by the EFP will allow Alabama to use the information from the Alabama Snapper Check Program, as well as the terabytes of fisheries data we have collected on the red snapper population in the Alabama Artificial Reef Zones, to show we can sustainably manage this fishery,” Blankenship said “I would like to thank Marine Resources Division Director Scott Bannon and Chief Biologist Kevin Anson for shepherding the permit request through the regulatory process.”

The federal charter season for red snapper is not included in Alabama’s new permit and is expected to be announced by NMFS sometime in April, though it is expected to be longer than the 2017 federal charter season, which stretched 49 days.

Ivey’s office said data collected through the Alabama Snapper Check Program the past four years was critical in securing the additional red snapper fishing days, and reminded fishermen they are still required to report their red snapper harvests through the program.

Only one report is required per vessel trip, and anglers can provide details via a smartphone app available under “Outdoor Alabama” in the iTunes or Google Play app stores; online at www.outdooralabama.com; or by paper forms available at select coastal public boat launches.

After turbulent 2017, states want to control snapper fishery

February 14, 2018 — A year after the Trump administration likely broke the law by allowing overfishing of red snapper, five Gulf of Mexico states now want special power to manage the species in federal waters in 2018 and 2019.

They’re likely to get their way, too.

Unlike last year, the new plan would not allow sports anglers in Florida, Texas, Louisiana, Mississippi and Alabama to exceed federal quotas, but the states would get the authority to call the shots in setting their own fishing seasons in federal waters.

Daryl Carpenter, the owner of Reel Screamers Guide Service in Grand Isle, La., and president of the Louisiana Charter Boat Association, can’t wait, saying the federal management system is broken and “has failed to come up with any type of fix.”

“It’s too dominated by non-interested groups, by your green groups who want to hug and cherish the fish,” he said. “You can get nothing done in the federal system. … I’m 100 percent in favor. The states need to take control of this and get the federal government out of our damn life.”

Critics say that ceding control to the states would be a mistake, arguing that federal officials long have led the way in rebuilding the red snapper population and remain the most qualified to do the job.

“The federal management process is the most open and transparent, no matter how frustrating,” said Shane Cantrell, executive director of the Charter Fisherman’s Association and the owner of Galveston Sea Ventures in Galveston, Texas.

All five states are pushing the idea as an experiment that would be allowed under the Magnuson-Stevens Fishery Conservation and Management Act of 1976, the nation’s premier fishing law.

They want NOAA Fisheries to give them “exempted fishing permits.” Those permits allow fishing that would normally be banned under federal law, usually as pilot projects done in the name of research.

“It allows us to exempt certain fishing activities from the regulations,” said Roy Crabtree, administrator for the NOAA Fisheries Southeast Region in St. Petersburg, Fla.

“How well will it work? Well, time will tell,” Crabtree said. “But I think a lot of people will argue that we’ve had some quota overruns in the past and we’ve had a lot of dissatisfied customers, so I think we do need to try something different.”

Many state officials say that NOAA is all but certain to sign off on the exempted fishing permits, after Alabama Republican Sen. Richard Shelby got Congress to include language in a fiscal 2017 appropriations bill that directed the agency to come up with a pilot program to give states more control.

After the Gulf of Mexico Fishery Management Council voted on Feb. 1 to approve the plans, Alabama officials said they were one step closer to taking over management of the red snapper.

Trump team may have broken law to score red snapper win

December 19, 2017 — The Trump administration scored last week when a House panel voted to give Gulf of Mexico states more power in managing the popular red snapper, but court records suggest it may be a tainted victory.

Internal memos show that Commerce Secretary Wilbur Ross and a top adviser may have knowingly violated federal fisheries law in June when they extended the Gulf red snapper season, hoping the move would pressure Congress to act.

In a June 1 memo, Earl Comstock, the Commerce Department’s director of policy and strategic planning, told Ross that a longer season “would result in overfishing” of the stock by as much as 40 percent and possibly prompt a lawsuit.

But Comstock urged Ross to extend the season anyway, saying it could lead to “a significant achievement” by forcing Congress to liberalize the federal law and transfer more authority to Gulf states.

“It would allow a reset in the acrimonious relationship and set the stage for Congress to adopt a long-term fix,” Comstock told Ross.

Comstock followed up with a second memo on June 7, reminding his boss that both the White House and a dozen congressmen from Gulf states had asked Ross to explore the possibility of a longer fishing season.

The next week, Ross decided to extend the season from three to 42 days, much to the joy of recreational anglers in Florida, Texas, Louisiana, Mississippi and Alabama (Greenwire, Sept. 20).

Critics say the memos offer proof that Commerce and NOAA Fisheries plotted to bypass the Magnuson-Stevens Fishery Conservation and Management Act, a 1976 law that sets quotas as a way to rebuild overfished stocks, including the red snapper.

“I appreciate it when people are transparent about their intentions,” said Janis Searles Jones, the CEO of Ocean Conservancy, a nonprofit environmental group.

Commerce made the memos public as part of its response to a lawsuit filed in July in U.S. District Court in Washington by Ocean Conservancy and the Environmental Defense Fund. The complaint accuses Ross, NOAA and NOAA Fisheries of mismanagement by allowing overfishing.

How Many Red Snapper Are in the Gulf of Mexico?

November 22, 2017 — Several stakeholder groups have expressed concerns that there are more red snapper in the Gulf than currently accounted for in the stock assessment.

In 2016, Congress directed the National Sea Grant College Program and NOAA Fisheries to fund independent red snapper data collections, surveys and assessments, including the use of tagging and advanced sampling technologies. Sea Grant and NOAA Fisheries worked collaboratively to transfer federal funds to Mississippi-Alabama Sea Grant offsite link to administer the competitive research grant process and manage this independent abundance estimate.

To conduct the independent study, a research team of 21 scientists from 12 institutions of higher learning, a state agency and a federal agency was selected by an expert review panel convened by the Mississippi-Alabama Sea Grant Consortium. The team secured $9.5 million in federal funds for the project through a competitive research grant process, and together with matching funds from the universities, the project will total $12 million.

Lawsuit alleges government colluded with sportfishing sector on red snapper

October 19, 2017 — SEAFOOD NEWS — Three additional documents have emerged as part of the lawsuit filed against the US Commerce Department that appear to show an intent to end-run normal channels of public comment and regulated processes for regional council activities, only to serve the needs of the sportfishing industry.

The lawsuit, filed by Ocean Conservancy and the Environmental Defense Fund last July, focused on mismanagement of the Gulf Red Snapper fishery, but documents released last week show the recreational industry expects a level of allowance that flies in the face of the legal requirements of the Magnuson Stevens Act, and the processes for managing fisheries that is contained within it.

The documents are part of a 70-page package submitted by the government in response to the plaintiff’s lawsuit. They show clear intent to receive special treatment when it comes to taking more of the annual catch, and broader influence on choosing who sits on the regional management councils, a process specified by the Magnuson-Stevens Act (MSA) which is poised for reauthorization in 2018.

Moreover, in at least three instances, Department of Commerce employees, after briefing sports industry stakeholders on the requirements of MSA, go on to suggest various legislative — not regulatory — “fixes” for breaking the rules with the red snapper action.

Indeed, the documents point to a blurred state of authorities and influence wielding between the Commerce Department and the US Congress. Whether it is a beleaguered agency’s attempts to protect its standing among Gulf states or an intentional violation of the law remains unclear, but no one is disputing that the regulations within MSA are clear, and have, in the case of red snapper, been ignored.

A letter to commerce secretary Wilbur Ross from Ben Speciale, president of Yamaha Marine Group, was sent on April 3, less than a week after Ross met with Speciale, Mike Nussman, Scott Deal and Pat Murray to discuss the need for a National Oceanic and Atmospheric Administration (NOAA) fisheries administrator who had experience with the recreational sector. Chris Oliver was hired as head of NOAA Fisheries two and a half months later.

Nussman is the president of the American Sportfishing Association, Deal is from Maverick Boats and Murray is from the Coastal Conservation Association.

Ross posed questions to the group and asked them to respond later. One topic that may have been brought up — Ross certainly raised it frequently during his confirmation hearing and in separate interviews following his confirmation — was ways to reverse the seafood imbalance of trade.

It was a topic Speciale responded to in his April 3 letter to Ross.

“We support imposing assessments on imported seafood based on the country of origin’s management program,” wrote Speciale. “We believe this will help level the playing field and allow our domestic commercial fishermen to increase revenue without increasing their landings. We also support efforts to promote aquaculture….and we must not forget that all recreational landed fish are consumed in the US,” Speciale pointed out.

“Promoting recreational fishing is a conservation-minded way of increasing the consumption of US-caught fish,” he wrote.

Speciale did not elaborate on the ramifications of increased per capita consumption coming from sports landings and the impact on sustainably managed populations of fish.

Speciale’s first request was about more red snapper for Gulf of Mexico anglers.

“…we must return to a recreational red snapper season of no less [than] the 60 days for the 2017 and 2018 seasons,” he wrote.

“I understand that the Gulf of Mexico Fishery Management Council and the regional administrator for NOAA Fisheries in the southeast region will present obstacles to this initiative, but they must be overcome so that we may restore a sense of fairness for recreational anglers.”

Speciale continued: “Excessive precaution and fear of frivolous litigation from the environmental industry has created a massive bureaucrat roadblock that has been unfair to anglers and stifled our industry.

“We ask that you overcome these obstacles at the regional fishery management councils and Regional Administrators’ Offices.”

Speciale’s second request was to appoint a person within the Office of Policy and Strategic Planning (currently headed up by Earl Comstock) to have direct oversight on all regional fishery management council appointments. Further, that every appointment should be made only after coordinated consulting with the recreational industry.

Finally, Speciale asked for NOAA Fisheries to adopt a long-term strategy to increase public access to state and federal waters and “eliminate any management effort or technique that attempts to privatize federal fisheries, which are and should remain a public resource.”

Almost two months later, as the red snapper season caught its quota in a matter of days, Shannon Cass-Calay, Chief of the Gulf and Caribbean Branch of the Sustainable Fisheries Division at NOAA Fisheries’ Southeast Fisheries Science Center ran the numbers on what the impact a 45-day extension would have on the red snapper stock in the gulf.

She sent a summary of the research to five of her colleagues, asking them to consider it, emphasizing the uncertainties in the data, and warning that an extended season “…will very likely cause catches to exceed OFL (Over Fishing Limit) and delay recovery by 4-6 years. Each additional overage will degrade the condition of the stock further.”

The final dissemination of that memo is not known, but it must have reached Earl Comstock, because he referenced it in one of two memos to Secretary Ross in early June.

After consulting with all five gulf state fisheries managers, Comstock asked Ross if he could move ahead on crafting an extension to the red snapper season. At the bottom of his first memo to Ross, dated June 1, Comstock hand wrote “Secretary said go with two days plus holidays. OK to proceed.”

On June 7, Comstock sent a memo to Ross preparing him for a hearing on appropriations where Senator Shelby (R-AL) may ask Ross about the gulf snapper issue. He also presented two options for the extension and asked Ross to pick one.

“As discussed, under either option the increased angler catch will result in the overall catch limit for this year being exceeded by 30% and 50%,” Comstock explained to Ross. “Either option would mean that, absent Congressional action to modify the Magnuson-Stevens Act requirements for the gulf, the recreational season next year would be significantly reduced.  All the state fishery managers know this, but agree the coordinated action has the greater long-term benefit,” Comstock wrote.

He acknowledged that either option will be opposed by commercial fishermen and charter operators, and “it will almost certainly draw a lawsuit.”

Comstock noted that any plaintiffs in a suit “cannot get a temporary restraining order because the Magnuson-Stevens Act prohibits them. However, they might be able to get an injunction based on the argument we are violating a recent court order that stopped a 2% reallocation from commercial to recreational that the Gulf Council had adopted,” he wrote.

A third new document appears to depict a National Marine Fisheries Service administrator suggesting work arounds for an action that would be in direct violation of MSA. It’s a memo from Harry Blanchet, Biologist Administrator of the Fisheries Division, Louisiana Department of Wildlife, to John Searle, the Congressional staffer to Louisiana Representative Steve Scalise. Searle had been in discussions with the state fisheries department regarding the red snapper situation.

Blanchet, who also sits on the Gulf Council’s Science and Statistical panel, warned Scalise that “recreational red snapper harvest for 2017 may well overrun the recreational allocation by a substantial amount, and as a result, overall harvest may overrun the total allowable catch.”

Blanchet, like those before him, warned Searle that, “historically, and required by Magnuson, those over-runs would have to be paid back in following years, resulting in even lower recreational quota and thus federal seasons,” he told Seale.

Blanchet’s solution was a waiver.

“My thought was that a simple waiver of those Magnuson requirements in another bill in the current Congress could help a lot in terms of allowing there to be a federal waters recreational red snapper season in 2018. I understand that you may want to do a lot more, but just want to be sure that those payback provisions to not come back to bite next year,” he wrote.

Senators add shrimp to seafood import monitoring program implementation plan

July 28, 2017 — Efforts to include shrimp in the Seafood Import Monitoring Program when it takes effect Jan. 1 of next year advanced in Congress on Thursday, the American Shrimp Processors Association (ASPA) said in a release.

Senate appropriations committee chairman Thad Cochran and commerce, justice and science appropriations subcommittee chairman Richard Shelby added language to the FY2018 commerce, justice and science subcommittee bill to ensure that shrimp is fully integrated into the program on the same timeline as other species, the association said.

Previously, shrimp was expected to be phased in at a later date than majority of other priority species, which have a mandatory compliance date of Jan. 1.

David Veal, ASPA executive director, commended the decision. He said Cochran and Shelby showed they care about the survival of the US shrimp industry and continued economic opportunity and job growth of coastal communities.

Senator Shelby leads way on more data on Gulf red snapper populations

March 27, 2017 — Alabama Sen. Richard Shelby paved the way for the National Oceanic and Atmospheric Administration to land a multimillion-dollar grant to innovate Gulf of Mexico reef-fish survey assessments and technologies.

This $9.5 million grant program, authored by Shelby, is directed by the 2016 Appropriations Act. The goal is to produce a more-accurate estimate of Gulf red snapper populations and improve fishing access.

Alabama Senator Shelby Seeks Solutions For Gulf Fisheries To Flourish

February 8, 2016 — At 6’3” Richard Craig Shelby, the senior Senator from Alabama, casts a long shadow on the Halls of Congress, welding influence felt in banking, energy, commerce, defense, science and fisheries, especially Gulf of Mexico fisheries.

“I like fresh seafood,” said the Senator relaxing back in his leather chair at the head of his Capitol Hill office conference table. “I especially like Gulf Scamp (a highly prized game and commercial fish in the grouper family). I could live on scamp, my wife and I never throw a piece of that away.”

The Alabama Senator has a single purpose when it comes to the Gulf of Mexico. “I want to make sure the Gulf remains healthy, and that the fish are abundant as they can be, and that all three fishing sectors; commercial, charter-for-hire and recreational, as well as all Americans, continue to benefit from them,” he said.

Born in Birmingham on the sixth of May in 1932, Shelby received a law degree from the Birmingham School of Law. First elected to the Senate in 1986 after winning a tight race as a Democrat, he was among a group of conservative Democrats. In 1994, midway through his second term, he switched allegiance to the Republican Party.

Currently he chairs the Senate Committee on Banking, Housing, and Urban Affairs, and the Senate Commerce, Justice and Science Appropriations Subcommittee, and sits on the Committee on Rules and Administration.

Constant Gulf Seafood Supporter

During his term on Capitol Hill, Shelby has been a constant supporter of Alabama and Gulf Seafood, as well as the thousands of people working hard to deliver it to the American people everyday.

“I like to fish, it’s is a great sport,” he told Gulf Seafood News in an exclusive interview. “I enjoy the outdoors.”

In his soft Southern drawl, the Senator said he wants the Gulf seafood industry to flourish because everyone benefits from seafood. “It’s nutritious and provides jobs for thousands upon thousands along the Gulf coast, as well as across the country,” he said. “Be it commercial, charter-for-hire or recreational, I am interested in maintaining abundant, healthy seafood in the Gulf of Mexico that is available to all.”
