New York governor calls for approving 90-MW offshore wind farm

January 13, 2017 — New York’s Long Island Power Authority should approve the 90-megawatt South Fork Wind Farm energy project as an early step toward developing up to 2.4 gigawatts of offshore power for the state by 2030, Gov. Andrew Cuomo said in his annual address to state lawmakers.

It would be the single biggest commitment by a coastal state, and the South Forks project 30 miles off Long Island’s East End proposed by Deepwater Wind LLC faces stiff opposition from commercial fishermen and other critics. But contract negotiations that dragged out last summer are now close to final the LIPA board could vote on it this month.

Cuomo said the authority can “ensure it is developed responsibly and cost-effectively for all stakeholders.”

“New York’s unparalleled commitment to offshore wind power will create new, high-paying jobs, reduce our carbon footprint, establish a new, reliable source of energy for millions of New Yorkers, and solidify New York’s status as a national clean energy leader,” Cuomo said. The state’s Offshore Wind Master Plan will be ready in 2017, and pave the way for the 2.4 billion-GW target, or enough electricity to power 1.25 million homes.

In that same time frame, the Cuomo administration has an ambitious target to a full 50% of New York state’s energy from renewable sources by 2030. Meanwhile, the potential closing of the aging Indian Point nuclear plant on the Hudson River in the early 2020s means the state’s biggest metro center will need power from other sources.

Legal Proceedings Preserve Fishing Industry Rights as New York Wind Energy Lease Sale Proceeds

December 15, 2016 — The following was released by the Fisheries Survival Fund:

Last week, a group of fisheries organizations, communities and businesses filed suit against the Bureau of Ocean Energy Management (BOEM), seeking a temporary restraining order to delay today’s auction of leasing rights to the proposed New York Wind Energy Area. The suit also sought a preliminary injunction to prevent BOEM from executing any resulting wind energy lease.

The plaintiffs allege that BOEM did not adequately consider the effect on the region’s fishermen of a 127-square-mile wind farm off the coast of New York and New Jersey.

Subsequently, a scheduling agreement was reached between the parties that allows the court to take adequate time to deliberate carefully on the case’s important issues. The plaintiffs agreed to withdraw their motion for a temporary restraining order that would have delayed the scheduled auction. Although the auction is proceeding today, under BOEM’s final sale notice for the auction, the lease will not be final until further steps, as outlined in the sale notice, are completed.

On Monday, Judge Tanya Chutkan of the United States District Court for the District of Columbia set a court schedule on the plaintiffs’ motion to preliminarily enjoin BOEM’s execution of any lease resulting from today’s auction. The schedule concludes with a hearing in Federal court on February 8.

Under Judge Chutkan’s order, if the lease is ready to be executed before the court is able to rule on the plaintiffs’ preliminary injunction motion, BOEM must provide the court no less than 14 days notice. If that notice is provided, the preliminary injunction proceedings will be expedited.

The Fisheries Survival Fund, representing the majority of the U.S. Atlantic scallop industry, is the lead plaintiff in the case. The lease area includes documented scallop and squid fishing grounds, which serve as essential fish habitat and grounds for other commercially important species, including black sea bass and summer flounder. It is also an important foraging area for threatened loggerhead sea turtles and critically endangered North Atlantic right whales.

Other organizations joining as plaintiffs include the Garden State Seafood Association and the Fishermen’s Dock Co-Operative in New Jersey; the Long Island Commercial Fishing Association in New York; and the Narragansett Chamber of Commerce and Rhode Island Fishermen’s Alliance.

Joining as plaintiffs are the City of New Bedford, Mass.; the Borough of Barnegat Light, N.J.; and the Town of Narragansett, R.I.

Also joining are three fishing businesses: SeaFreeze Shoreside, Sea Fresh USA and The Town Dock.

Hearing Postponed; New York Wind Auction To Proceed As Planned

December 14, 2016 — The U.S. Department of the Interior’s (DOI) Bureau of Ocean Energy Management (BOEM) has reportedly come to an agreement with fishermen groups that recently filed a lawsuit to delay the upcoming lease sale of the New York Wind Energy Area.

The Fisheries Survival Fund (FSF) was the lead plaintiff in a suit seeking a preliminary injunction to delay the lease sale for the development of an offshore wind project located approximately 11 miles off the coast of Long Island, N.Y.

The lease sale, scheduled for this Thursday, can now proceed as planned, reports the Associated Press, which says the lawsuit has been delayed so that both parties can have more time to prepare more documents. A hearing is now scheduled for Feb. 8, 2017.

Fishing groups seek Atlantic wind farm delay

December 8, 2016 — MINEOLA, N.Y. — Commercial fishing companies, trade groups and three fishing-based municipalities are seeking to delay the lease sale of an Atlantic Ocean site between New York and New Jersey that federal officials envision as the home of a massive offshore wind energy project.

The Associated Press obtained a copy of a 45-page motion ahead of its filing Thursday in federal court in Washington, D.C. It seeks a temporary restraining order halting the Dec. 15 lease sale. Those seeking a delay include groups representing scallop and squid fishermen, the Long Island Commercial Fishing Association and the city of New Bedford, Massachusetts.

The motion seeks to delay the Bureau of Ocean Energy Management’s plans for developers to build a 127-square-mile, 194-turbine offshore wind farm. The United States still has no offshore wind projects online, though BOEM has awarded 11 commercial offshore wind leases for sites in the Atlantic. Some major projects have been delayed by political opposition.

A BOEM spokeswoman said the agency doesn’t comment on pending litigation.

The country’s first offshore wind farm, a tiny project off Rhode Island with just a few turbines, is expected to debut this month.

The court motion argues that BOEM failed to consider alternative sites and contends that besides negative impacts on scallop and squid fishing, others who harvest fish species including summer flounder, mackerel, black sea bass and monkfish also would be negatively affected. When it announced final plans for the lease sale earlier this fall, BOEM said it had removed about 1,780 acres from the initial proposal because of environmental concerns.

The plaintiffs referred to that as a “diminutive change” in their motion. The fishing groups said they aren’t opposed to wind farms. But they argue that site alternatives weren’t considered and that conducting site analysis after a lease sale is completed will be too late.

“BOEM must carry out the proper analysis prior to officially leasing out areas to companies for construction, due to the importance of this fishery area,” said James Gutowski, president of the Fisheries Survival Fund, who is a scallop fisherman from Barnegat Light, New Jersey; the group is the lead plaintiff in the lawsuit.

“It must adequately and accurately characterize the potential impacts to the industry from construction on this site,” Gutowski said.

Scallop & Fishing Industry, Municipalities, Sue Feds to Ensure Seafood Interests Are Considered in NY Bight Wind Energy Project

December 8, 2016 — The following was released by the National Coalition for Fishing Communities:

WASHINGTON — December 8, 2016 – The Fisheries Survival Fund (FSF), which represents the majority of the limited access Atlantic scallop fleet, is the lead plaintiff in a lawsuit seeking a preliminary injunction to delay an anticipated lease sale for the development of a 26-mile long wind farm project approximately 11 miles off the coast of Long Island, scheduled for December 15, 2016. The story was broken today by the Associated Press.

The filing alleges that the leasing process for the Bureau of Ocean Energy Management (BOEM) did not adequately consider the impact the proposed New York Wind Energy Area would have on the region’s fishermen. The site chosen for the 127 square mile wind farm is in the waters of the New York Bight on vital, documented scallop and squid fishing grounds, which serves as essential fish habitat and grounds for other commercially important species, including black sea bass and summer flounder. It is also an important foraging area for threatened loggerhead sea turtles and critically endangered North Atlantic right whales.

The lawsuit argues that fishermen’s concerns regarding the location of the lease area received “virtually no attention or analysis” from government officials ahead of the planned December 15 lease sale, despite fishing stakeholders repeatedly making their concerns known. It further states that BOEM failed to identify the proposed wind farm’s environmental, economic, social, and cultural impacts, and failed to “consider alternative sites in an open, collaborative, public forum.”

Several other members of the National Coalition for Fishing Communities (NCFC)—including commercial fishing organizations, businesses, and communities that depend on the sustainable use of Atlantic Ocean resources—have joined the lawsuit. The suit was filed against Secretary of the Interior Sally Jewell, BOEM, and BOEM Director Abigail Hopper.

Organizations joining the lawsuit include: the Garden State Seafood Association and the Fishermen’s Dock Co-Operative in New Jersey; the Long Island Commercial Fishing Association in New York; and the Narragansett Chamber of Commerce and Rhode Island Fishermen’s Alliance in Rhode Island.

The City of New Bedford, Massachusetts, the nation’s top-grossing fishing port; the Borough of Barnegat Light, New Jersey; and the Town of Narragansett, Rhode Island have joined as plaintiffs. Also joining are three fishing businesses: SeaFreeze Shoreside, Sea Fresh USA, and The Town Dock.

The New York Bight consists of the waters from Cape May Inlet in New Jersey to Montauk Point on the eastern tip of Long Island, and offshore to the outer edge of the Continental Shelf, where the coasts of New York and New Jersey form an upside-down L around shallow waters of the Atlantic Ocean.

The plaintiffs are represented by the law firm of Kelly, Drye & Warren.  The case will be heard by Judge Tanya Chutkan in the United States District Court for the District of Columbia, Case No. 1:16-cv-02409.

Is Offshore Wind Safe? Fishermen Study Effects As First Farms In The US Set To Open Soon

November 30, 2016 — After years of setbacks, the first commercial American offshore wind farm is now just days away from producing electricity to the energy grid, while scientists and fishermen off the New England coast continue to assess the potential impact of turbines on the sea life in the area.

The pilot project, known as the Block Island Wind Farm, could change the way the 9,734 square-mile island powers itself but could also disrupt the fishing patterns in areas near the turbines—an unattractive prospect for local fishermen. Because of such an unprecedented undertaking, project fishermen have expressed concern that there could still be impending disruptions to their livelihoods.

“You don’t know what’s gonna happen once electricity starts flowing through the wires,” Anthony Ponte, a fisherman there, told Boston NPR affiliate WBUR in a report published Monday. Ponte said that he hadn’t noticed any issues yet.

RHODE ISLAND: Assessing Environmental Impacts Of The Block Island Wind Farm

November 28, 2016 — The nation’s first offshore wind farm off the coast of Block Island will start producing electricity any day now. It’s a pilot project that will change the way the people on this small island power their homes and businesses. They’ve relied on importing diesel fuel up to this point.

Today we bring you a story about another group that has a stake in this project: fishermen. A small crew of fishermen has been working with scientists to gather data and learn how fishing will or won’t change around the wind turbines.

Every month for the past four and a half years, Captain Rodman Sykes has sailed out toward the Block Island Sound with his crew and a small group of scientists.

They tow a fish net and scrape the seafloor twice in three different locations: within the area of the Block Island Wind Farm and in areas close to it for reference.

“Mostly skates, there’s a sea bass and a few small scup, sea robins, dog fish,” Sykes says aloud as he stands over the fish to inspect them each time his crew brings up the net and releases the catch. “Not much else, but a good sample. So we’ll go on to the next station.”

While Sykes redirects his vessel to the next sampling area, scientists get right to work: sorting fish by species, taking their weight, and measuring their length.

First US off-shore wind farm to start generating power

September 7, 2016 — The first off-shore wind farm in the U.S. is nearing completion off the coast of Rhode Island. In the past there’s been opposition to these ventures. But this one, which has been planned as a demonstration project, has managed to go forward.

A Rhode Island company, Deepwater Wind, is behind this nearly $300 million project. The five turbines were recently finished after more than a year of construction.

“The first off-shore wind farm in America will be ready to start spinning its blades, and that’s a momentous occasion, believe me,” said Jeffrey Grybowski, Deepwater’s CEO and a former chief of staff for Rhode Island Gov. Donald L. Carcieri.

But there is another constituency which isn’t so keen on these off-shore wind farms: commercial fishermen. In this part of the Atlantic they catch squid and cod, and there’s a scallops fishery, which alone generates a half billion dollars a year. They’re worried that their livelihood will suffer. And in fact, in Rhode Island commercial fishing was disrupted during construction and one operation had to be relocated.

Confusion after LIPA wind farm meeting postponed

July 25, 2016 — New York State’s decision to postpone LIPA’s consideration of an offshore wind farm that is popular with environmentalists prompted confusion and rancor in its aftermath, as the Cuomo administration works on a wind-energy blueprint that could include other areas directly off Long Island.

A presentation prepared by the Long Island Power Authority this month – before the state stepped in recently and nixed a LIPA trustee vote – included a map of up to six “potential” New York wind-energy areas, including a long, straight swath 12 miles off the coast of the entire South Fork.

Another site comprises more than 100,000 acres in an area beyond an existing wind-energy area that LIPA and Con Edison previously had identified about 12 miles from Long Beach. Fishing groups oppose use of the location for a wind farm.

The New York State Energy Research and Development Authority, which has taken over that LIPA-Con Ed project, has been working for months on a comprehensive plan for wind energy for the state. A draft “blueprint” of that plan is due out in coming weeks.

A map similar to LIPA’s that lists the same six potential wind energy areas for New York appears in the state’s April cost analysis for Clean Energy Standard. In it, NYSERDA identified the South Fork coastal area off the Hamptons as having the potential to produce 3,081 megawatts of wind power from about 385 turbines rated 8 megawatts each.

The U.S. Bureau of Ocean Energy Management, which leases ocean sites, has yet to receive any formal request for the Hamptons-area site or other proposals beyond NYSERDA’s, said spokesman Stephen Boutwell.

If it were to, he said, the agency would work with the New York Renewable Energy Task Force, which includes federal and state agencies, local governments and tribes, to “identify other users of the areas and environmental concerns to assess the suitability of areas for leasing.”

Should the state move forward with any of the additional wind-energy areas listed in the LIPA and NYSERDA maps, they can expect opposition from fishing groups.

“Those [potential] wind-energy areas would destroy multiple fisheries,” said Meghan Lapp, fisheries liaison for Seafreeze Ltd., a Rhode Island commercial fishing group. Added Drew Minkiewicz, an attorney for the Fisheries Survival Fund, representing commercial scallopers, “All of them [wind-energy areas] are right smack dab in the middle of scallop grounds.”

Mid-Atlantic Ocean Plan Requests Public Comments

July 21, 2016 — Coastal managers and policy advisers representing the six Mid-Atlantic states have issued a draft Mid-Atlantic Ocean Plan, a new approach to shaping management decisions regarding ocean resources in the region.

The Mid-Atlantic Regional Planning Body (RBP), with representatives from New York, New Jersey, Pennsylvania, Delaware, Maryland and Virginia, two federally recognized tribes, federal agencies and the Mid-Atlantic Fishery Management Council, led the three-year, ocean planning process with input from thousands of marine stakeholders and released a draft plan on July 5.

The plan focuses on nine major areas of ocean use: national security, ocean energy, commercial and recreational fishing, ocean aquaculture, maritime commerce and navigation, sand management, non-consumptive recreation, tribal interests and uses, and critical undersea infrastructure. The plan is now open for a 60-day public comment period until Sept. 6.

“The plan provides a refreshing understanding of diverse ocean uses from an integrated point of view – that is the intertwined human, commercial and natural ecosystem upon which we all depend,” said Anne Merwin, director of ocean planning at Ocean Conservancy. “And remember, the plan is a living document that will mature as new data becomes available and needs change.”

Under the new plan, state and federal agencies have committed to using better data and working with local stakeholders such as fishermen, offshore wind developers, maritime interests, educators, tourism businesses and recreational organizations on planning and permitting projects that could impact important fisheries, habitats, cultural sites and commercial enterprises in the region.
