Pacific Fishery Management Council Approves Pacific Sardine Rebuilding Plan

September 17, 2020 — BUELLTON, Calif. — The following was written by D.B. Pleschner, executive director of the California Wetfish Producers Association:

Thousands of fishermen, processors and allied fishing businesses along the west coast thank the Pacific Fishery Management Council for taking final action on a rebuilding plan for the “northern” stock of Pacific sardine that achieves the balance between conservation and fishing communities mandated by the Magnuson Stevens Fishery Conservation and Management Act (MSA).

This action was required by the MSA after the “northern” sardine stock was declared “overfished” in 2019, when the biomass estimate fell below 50,000 mt. The Council decision came after many months of hard work by stock assessment scientists, modelers, the Coastal Pelagic Species (CPS) Management Team and the Council’s Science and Statistical Committee (SSC), to build and analyze a Rebuilder model based on the 2020 “northern” sardine stock assessment, which covered a period of low recruitment. The herculean effort attempted to forecast future sardine population growth and rebuilding time scenarios under various harvest alternatives.

“The Council’s unanimous decision to support the Management Team’s recommendations shows that they understand reality, the big picture,” said Diane Pleschner-Steele, Executive Director of the California Wetfish Producers Association, representing California fishermen and processors. “Our sardine harvest policy already has a built-in rebuilding plan. The Council closed the main directed fishery in 2015, and sharply reduced incidental harvest rates last year. Further cuts would drive many fishing businesses out of business, and we appreciate the Council’s acknowledgement of that prospect.”

The environmental group Oceana immediately issued a press release decrying the Council action, accusing fishery managers of irresponsible mismanagement. Oceana and other environmental activists based their arguments on the Rebuilder model that scientists, the Management Team and the Council all acknowledged did not reflect reality because it could not model the environmental cycles driving sardine productivity, nor could it predict the future. Further, it assumed that the total harvest allowance was caught every year.

Oceana’s accusation, “fishery managers have failed to learn from the mistakes of history,” does not pass the straight face test when all the facts are presented. During the great sardine decline in the late 1940s, the historic sardine fishery harvested 50 percent or more of the standing stock. Today’s sardine fishery harvest amounts to only 0.6 percent of the northern sardine population — very close to 0 US harvest, which was modeled as Alternative 2, and showed disastrous economic impacts to fishing communities in California and the West Coast because it curtailed major fisheries. Commercial fisheries that take sardines incidentally include market squid, anchovy and mackerel in California and Pacific whiting, pink shrimp and groundfish along the entire West Coast. In addition, the live bait fishery relies on sardines and serves a billion-dollar recreational fishing enterprise.

The Council decision illuminates a dicey problem: sardine fishery management policy assumes that two sardine stocks exist along the west coast and Mexico, divided by a temperature barrier at about 62 degrees F. But the Council manages only the “northern” stock, and in recent years, stock assessments have subtracted thousands of tons of sardines found in waters warmer than 62 degrees on the assumption that those were “southern” sardines that migrated up from Mexico. Stock assessments also are now based on annual NOAA summer acoustic trawl (AT) surveys that begin in the Pacific Northwest and move south, not reaching California waters until late August, when water temperatures are typically above 62 degrees. Thus, most California sardines are now omitted from “northern” stock assessments on the assumption they are “southern” sardines. Also, NOAA research ships are too large to survey near shore, where most fishing occurs in California. For the past few years, fishermen have testified to a growing abundance of sardines on their fishing grounds yearlong. But complicating matters even further, for management purposes, all sardines landed are subtracted from the “northern” sardine harvest allowance, regardless of sea temperature. This catch-22 sets the backstory for the Council’s final decision.

Due to Covid-19 restrictions the Council meeting was conducted via webinar, and parade of fishermen, seafood processors and community representatives testified to the hardship they are already experiencing under current restrictions. They all voiced unanimous support for Alternative 1, “status quo” fishing regulations. The Management Team also recommended Alternative 1 as the most balanced and flexible choice. Environmental groups testified as well, and all supported Alternative 3, a static five percent harvest rate hard-wired for close to 20 years, based on Rebuilder model analysis, that would have cut current harvest levels nearly in half, precipitating harsh economic impacts.

In their deliberations, Council members highlighted the flexibility of the “status quo” sardine Harvest Control Rule (HCR) that sets harvest limits based on current environmental conditions. They concurred with scientists and the Management Team that the Rebuilder model does not reflect reality; it can’t model the natural high and low productivity cycles of sardines. Council members recognized that the HCR’s precautionary harvest limits are designed to provide forage for predators. Respecting both the need for conservation and the needs of fishing communities, Washington Councilmember Phil Anderson commented that he would rather provide a little more harvest now to keep fishing communities viable. Otherwise they might not survive into the future. Council chair Marc Gorelnik summarized discussion with his comment, “Mother Nature bats last.”

Scientists and Council members alike recognize that environmental conditions are key to stock rebuilding, as they have been for eons even without fishing. The Management Team pointed out that actual fishery catches in the past five years, since the main directed fishery was closed, have averaged only about 2,300 metric tons, far short of the allowed annual catch target, and most of the catch is “southern” stock sardines. The Council also recognized that the current HCR equates to a built-in rebuilding plan because it has flexibility to reduce catches in relation to the biomass, and also includes automatic actions to further restrict fishing in low abundance years. The Council has already reduced the fishery as far as feasibly possible. Now Mother Nature needs to do the rest.

All things considered, the Council made the proper rebuilding plan decision, following the MSA mandates to specify a time period for rebuilding that is as short as possible, taking into account the biology of the stock and needs of fishing communities. The MSA does allow directed fishing to continue when rebuilding an overfished stock, and does not require instant recovery or the most drastic action be taken. Optimum Yield is a long-term goal. The MSA also allows flexibility in developing a rebuilding plan. The plan will be updated when new information is available – nothing is cast in stone.

In light of evidence of recruitment and the abundance of sardines that California fishermen have been reporting inshore of AT surveys, fishery representatives are asking for a review of the rebuilding plan in 2021 as soon as possible after the next coastwide sardine survey, which was cancelled in 2020 due to Covid-19 restrictions, and will for the first time in 2021 include a survey of nearshore waters, in a collaborative effort using fishing industry vessels. The fishing industry is dedicated to help improve the science underpinning stock assessments. “If stock assessments were accurate,” said Corbin Hanson, a highline fisherman who has fished sardines as well as other CPS for more than a decade, “sardines would not be declared ‘overfished.’”

Oceana provides USD 1 million to California gillnet buyback program

September 17, 2020 — Environmental conservation group Oceana announced on Monday, 14 September, that it contributed USD 1 million (EUR 845,500) to California’s efforts to end the drift gillnet fishery in the U.S. state.

Oceana’s contribution matches state funding and goes toward a buyout program for fishermen who have been using the controversial gear to catch swordfish. The buyout program was part of a state law passed two years ago that calls for their elimination by 31 January, 2024.

Brexit without an EU-UK fisheries agreement would bring great risk, campaigners warn

September 11, 2020 — Allowing the United Kingdom and the European Union to part ways at the end of this year without an agreement on fisheries in place post-Brexit would open the door to overfishing and pose a serious risk to many fish stocks and marine ecosystems, campaign groups have warned.

On 8 September, the E.U. and U.K. began a new round of post-Brexit trade deal negotiations, with fisheries and fishing rights again expected to take center stage as one of the main obstacles to a broader deal.

Why everything you’ve heard about ‘ropeless’ crab fishing gear is false

August 26, 2020 — Is the so-called “ropeless” fishing gear the silver bullet for solving the perceived problem of marine mammal interactions in California’s crab fisheries?

Several profit-driven environmental groups, including Oceana, would like the public and the California Department of Fish and Wildlife to believe these baseless claims.

That’s because these groups are ramping up efforts to force California’s historic and economically most important fishery — which helps create $400 million annually for working families — to adopt expensive, impractical and unproven new fishing gear which would force most crab fishermen out of business.

But the problem is that neither the science, nor any other reliable data, support their false claims. “Ropeless” gear is not a silver bullet — in fact, it’s actually dangerous — and ironically, it still has ropes. Nor are marine mammal populations currently at any significant risk.

Francine Kershaw, staff scientist with the Natural Resources Defense Council, has misleadingly asserted that “off the West Coast, the number of deaths of humpback whales caused by entanglements are now high enough for the population to slip into decline.”

Global Fishing Watch launches transshipment portal, gets agreement with Costa Rica

July 30, 2020 — Global Fishing Watch has launched a public web portal to track the activity of at-sea transshipment, and has also signed an agreement with the government of Costa Rica to give it access to its vessel-tracking data.

Global Fishing Watch is a partnership between Google and the advocacy groups Oceana and SkyTruth founded in 2015. The new portal, hosted on Global Fishing Watch’s platform, aims to reveal the breadth of transshipment activity worldwide, with the goal of raising awareness among fish suppliers and consumers of the commonality of transshipment and improve transparency. The Pew Charitable Trusts contributed to the development of the portal to guide its effectiveness and application, according to Global Fishing Watch CEO Tony Long.

New Online Tool Launched to Track Ship Speeds in Areas Frequented by Right Whales

July 22, 2020 — Oceana has released a new online tool that allows anyone to track ship speeds in speed zones designed to protect North Atlantic Right Whales along the east coast of the U.S. and Canada.

Using Global Fishing Watch data, which is a component of the new tool called Ship Speed Watch, Oceana Canada tracked ship speeds in the Cabot Strait from April 28 to June 15, 2020.

During the 49-day period, Transport Canada asked vessels longer than 13 meters to slow down to 10 knots.

Only a few complied, with 67 percent of the ships (464 out of 697) traveling faster than the 10-knot limit, and some traveling 20 knots or faster.

New technology promises to save the whales by reducing the need for crab fishing lines.

July 16, 2020 — After a slightly better year in 2017, the number of whales getting entangled in fishing gear has gone back up, according to a new report from the National Marine Fisheries Service. Researchers confirmed 105 whale entanglements nationwide in 2018, the latest year for which data is available, noting the number is “much higher” than average.

These findings come as a possible solution emerges out of a collaboration being led by Monterey Bay conservationists, fishermen and fishing gear designers.

On the Pacific coast, whales pass through stretches of ocean that are important for Dungeness crab fishing and they sometimes get caught in lines connecting traps on the ocean floor to buoys at the surface. Technology that is under development would all but eliminate vertical lines and buoys. Using ropeless or pop-up innovations, these new crab traps would sit idly on the ocean floor until receiving an acoustic signal from the fisherman. Only then would the trap release a rope and buoy to the surface.

“We are working with fishermen to see what works and what doesn’t and what allows the fisherman to survive economically,” says Geoff Shester, a Monterey-based scientist with nonprofit Oceana. “The Monterey Bay is the epicenter of the whale entanglement issue.”

Blockchain Will Let You Track Salmon From Sea to Dinner Plate

June 26, 2020 — Consumers around the world will soon be able to know intricate life details of the salmon they eat with a new blockchain initiative from top exporter Norway.

The Norwegian Seafood Association has partnered with International Business Machines Corp. and technology provider Atea ASA to gather data on how salmon is bred, stored and shipped, information that consumers will eventually access by scanning a QR code. That will help Norway’s suppliers differentiate their premium products from other exporters, curb origin fraud and cut waste.

“Blockchain lets us share the fish’s journey from the ocean to the dinner table,” said Alf-Goran Knutsen, chief executive officer of Kvaroy Arctic, a supplier that’s part of the initiative. “This is now more timely than ever.”

Sustainable Seafood Could Feed A Billion People A Day, Says Oceana

June 10, 2020 — It might come as a surprise to hear that Oceana, the world’s largest international advocacy organization dedicated solely to ocean conservation, would be advocating for seafood consumption, especially given that overfishing is a major driver in the decline of ocean wildlife populations. But while overfishing has caused a decline in 34.2% of the world’s fish stocks, potentially leading to the depletion of a quarter of all fish by the end of the century, sustainable fisheries, on the other hand, are beneficial for fish populations, the environment and people.

The premise of sustainable fisheries lies in the belief that fishing practices that adapt to the reproductive rate of fish and maintain the health and productivity of wild fish stocks are not only critical to the sustainable growth of fish species, but also to the health of the surrounding marine ecosystem, coastal communities and the planet.

“Seafood eaters who choose sustainably managed wild seafood can feel good about their choice,” says Jacqueline Savitz, Chief Policy Officer at Oceana. “A healthy, fully restored ocean could feed a billion people a seafood meal every day, forever.”

Environmental groups fight rollback of marine monument protections

June 10, 2020 — Environmentalists are vowing they will sue to reinstate fishery closures to a marine national monument 130 miles southeast of Cape Cod that President Donald Trump removed by executive order last Friday at a meeting held in Maine.

 

The Northeast Canyons and Seamounts Marine National Monument was created by President Barack Obama in 2016 using the Antiquities Act of 1906, a process President George W. Bush used to create a national marine monument off Hawaii in 2006, as well as 15 presidents dating back to Theodore Roosevelt. The Antiquities Act was used, proponents said, because it can be put in place more quickly than fisheries regulations that can take years, if not decades, to be implemented. Also, the protections are in theory permanent, whereas other fisheries regulations are often amended.

“We’re taking them to court,” said Peter Shelley, senior counsel at the Conservation Law Foundation. “It’s a matter of putting the paperwork together and getting the strongest case possible.”

“It’s very clear that the president can establish these areas, but he has no authority to modify or remove them,” said Gib Brogan, fisheries campaign manager at Oceana.

Similar cases are being fought around two other national monuments, Bears Ears and Grand Staircase-Escalante, both in southern Utah. Trump stripped both monuments of federal protections by dramatically reducing them in size in December 2017 to allow for mineral extraction, mining, and off-road use.

Brad Sewell, director of the Natural Resources Defense Council’s oceans division, said his organization also intends to challenge the Northeast Canyons rollback in court.
