West Coast Salmon Seasons Set After Week of Tensions, Struggles

April 13, 2018 — SEAFOOD NEWS — This week the Pacific Fishery Management Council adopted ocean salmon season recommendations that provide recreational and commercial opportunities for most of the Pacific coast, and achieve conservation goals for the numerous individual salmon stocks on the West Coast.

“It has been another challenging year for the Council, its advisers, fishery stakeholders and the public as we strive to balance fishing opportunities with the conservation needs we are facing on Chinook and coho salmon stocks, both north and south of Cape Falcon,” Council Executive Director Chuck Tracy said in a press release. “The Council has recommended ocean salmon seasons on the West Coast this year that provide important protections for stocks of concern, including Lower Columbia River natural fall Chinook, Puget Sound Chinook, Washington coastal coho, and Sacramento River fall Chinook.”

Fisheries in Washington and northern Oregon, referred to as “North of Falcon” due to Cape Falcon being located near Nehalem in northern Oregon, depend largely on Columbia River Chinook and coho stocks. Overall, Columbia River fall Chinook forecasts are considered low to moderate compared to the recent 10-year average. Hatchery coho stocks originating from the Columbia River together with natural stocks originating from the Queets River and Grays Harbor are expected to return at low levels resulting in very low harvest quotas, as was the case in 2017.

Washington state and tribal co-managers struggled during the week’s Council meeting to find solutions. Finally, on Tuesday, they agreed to fishing seasons that meets conservation goals for wild fish while providing fishing opportunities on healthy salmon runs.

A variety of unfavorable environmental conditions, including severe flooding in rivers and warm ocean water, have reduced the number of salmon returning to Washington’s rivers in recent years, Washington Department of Fish and Wildlife fish program leader Ron Warren said. In addition, the loss of quality rearing and spawning habitat continues to take a toll on salmon populations throughout the region, where some stocks are listed for protection under the federal Endangered Species Act, he said.

The overall non-Indian total allowable catch for the area is 55,000 Chinook coastwide, compared to 90,000 last year, and 47,600 marked hatchery coho, the same as last year. Fisheries are designed to provide harvest opportunity on healthy Chinook returns primarily destined for the Columbia River, while avoiding coho stocks of concern.

Non-Indian ocean commercial fisheries north of Cape Falcon include traditional, but reduced, Chinook seasons in the spring (May-June) and summer season (July through mid-September). Non-Indian ocean commercial fisheries in this area will have access to a total of 27,500 Chinook, compared to 45,000 Chinook last year, and a marked coho quota of 5,600, the same as last year.

Tribal ocean fisheries north of Cape Falcon are similar in structure to past years, with quotas that include 40,000 Chinook and 12,500 coho, the same as last year.

“It’s critical that we ensure fisheries are consistent with ongoing efforts to protect and rebuild wild salmon stocks,” Warren said in a press release. “Unfortunately, the loss of salmon habitat continues to outpace these recovery efforts.”

In California and Oregon south of Cape Falcon, will be limited, as expected, due to Klamath River and Sacramento fall Chinook and also to Oregon Coast natural coho — but some opportunities in Oregon are better this year than last.

“While this won’t be a banner year for ocean salmon fishing, overall it’s an improvement from 2017. This is particularly true for communities on the Southern Oregon coast, which were hit hard by 2017’s salmon closures,” Oregon Department of Fish and Wildlife Deputy Fish Division Administrator Chris Kern said in a press release.

Commercial fisheries from Cape Falcon to Humbug Mt. in Oregon will open on May 4 and will and continue through Aug. 29 with intermittent closures. This area will also be open continuously in September and October, with weekly limits and a depth restriction in October.

Fisheries from Humbug Mt., Oregon, to Humboldt South Jetty, California, will be open intermittently from May through August. Monthly quotas will be in place for the Oregon portion of the Klamath Management Zone from June through August. In 2017, all Oregon commercial salmon trolling was closed south of Florence.

“I want to thank the many advisors, tribal members, agency staff, and members of the general public, who all worked hard to ensure that conservation goals for salmon stocks are met while providing fishing opportunities for communities up and down the West Coast,” Kern said.

In the California portion of the KMZ, monthly Chinook quotas will be in place from May through August. The quotas all feature landing and possession limits, and the Californian portion of this area will be open five days a week.

Between Horse Mountain and Pigeon Point, the Fort Bragg and San Francisco areas, the area will be open for a week in late July, most of August and all of September. From Pigeon Point to the Mexico border, the Chinook season will be open during the first week in May and the last two weeks of June. There will also be a season from Point Reyes to Point San Pedro (a subset of the San Francisco area), consisting of two five-day periods in October.

After the last week of tensions, Council members, state advisers and tribes did leave the meeting with a bit of positive news: a renewed commitment by Indian and non-Indian fishermen to work together for the future of salmon and salmon fishing, Northwest Indian Fisheries Commission chair Lorraine Loomis said.

“No fisherman wants to catch the last salmon. We know that the ongoing loss of habitat, a population explosion of hungry seals and sea lions and the needs of endangered southern resident killer whales are the real challenges facing us today. We must work together if we are going to restore salmon to sustainable levels,” she said.

Council chairman Phil Anderson noted fishermen bear the burden of conserving these fish populations while their demise is largely out of the seafood industry’s control.

“This year’s package includes some very restrictive seasons in both commercial and recreational fisheries along the entire coast,” Anderson said. “Low abundances of Chinook and coho are in part due to the poor ocean conditions the adult fish faced as juveniles when they entered the ocean, and poor in-river habitat and water conditions.”

These recommendations will be forwarded to the National Marine Fisheries Service for approval by May 1, 2018.

Alabama Snapper Season of 47 Days Approved By NOAA

April 10, 2018 — The National Marine Fisheries Service [NMFS] has officially accepted Alabama’s plan to manage its own seasons for recreational red snapper fishing — paving the way for 47-day seasons in the next two years.

As Lagniappe has previously reported, the plan manages the season lengths in state and federal waters off the Alabama coast is part of a two-year pilot program approved by the Gulf of Mexico Fishery Management Council in February.

For the first time in years, Gulf states will be able to manage recreational snapper fishing off their respective coasts through individual Exempted Fishing Permits (EFPs) submitted to NMFS.

The decision comes after years of shorter and shorter snapper seasons that frustrated anglers and commercial fisherman alike until a consortium of Gulf leaders negotiated a compromise through U.S. Commerce Secretary Wilbur Ross that extended the 2017 season.

Gov. Kay Ivey announced Friday that Alabama’s plan, which will create a 47-day season, will be in place for the next two years. In 2018, it will run from June 1 to September 2 on Fridays, Saturdays, and Sundays and the entire week on the Fourth of July. It would run concurrently in state waters and in federal waters, which begin nine miles from the coast.

“I am very pleased that the U.S. Department of Commerce, through the National Marine Fisheries Service, has granted Alabama an Exempted Fishing Permit for the next two red snapper seasons,” Ivey said of the plan’s approval. “Following the directives from President Trump to cut down on federal regulations, this decision empowers Alabama to manage our resources instead of bureaucrats in Washington.”

Ivey also noted the EFP program was made possible by language Sen. Richard Shelby added to the FY2017 Commerce, Justice, and Science Appropriations bill. It directed the NMFS to develop the pilot program to allow states more control over reef fish management activities.

In a statement, Ivey said Alabama’s red snapper fishery is a big part of “the coastal culture and economy of” of the state and thanked Shelby and Rep. Bradley Byrne for their congressional efforts to give Alabama more autonomy in managing its coastal resources.

She also made a special note of the efforts Alabama is also indebted to Conservation and Natural Resources Commissioner Chris Blankenship made to push for alternatives to federal snapper seasons that had become shorter and shorter in recent years.

“The red snapper management granted by the EFP will allow Alabama to use the information from the Alabama Snapper Check Program, as well as the terabytes of fisheries data we have collected on the red snapper population in the Alabama Artificial Reef Zones, to show we can sustainably manage this fishery,” Blankenship said “I would like to thank Marine Resources Division Director Scott Bannon and Chief Biologist Kevin Anson for shepherding the permit request through the regulatory process.”

The federal charter season for red snapper is not included in Alabama’s new permit and is expected to be announced by NMFS sometime in April, though it is expected to be longer than the 2017 federal charter season, which stretched 49 days.

Ivey’s office said data collected through the Alabama Snapper Check Program the past four years was critical in securing the additional red snapper fishing days, and reminded fishermen they are still required to report their red snapper harvests through the program.

Only one report is required per vessel trip, and anglers can provide details via a smartphone app available under “Outdoor Alabama” in the iTunes or Google Play app stores; online at www.outdooralabama.com; or by paper forms available at select coastal public boat launches.

Request for Comments: Proposed Charter Vessel Electronic Reporting Requirements and Modifications to Current Headboat Electronic Reporting

NOAA Fisheries requests comments on a For-Hire Reporting Amendmentand proposed rule, which if implemented, would establish electronic reporting requirements for charter vessels with federal permits and would modify the reporting deadline for headboats. The South Atlantic Fishery Management Council approved the For-Hire Reporting Amendment in an effort to improve data collection and fisheries management.

SUMMARY OF PROPOSED CHANGES

What would the For-Hire Reporting Amendment and proposed rule do?

The For-Hire Reporting Amendment and proposed rule would require charter vessels with a federal charter vessel/headboat permit for Atlantic Coastal Migratory Pelagics, Atlantic dolphin and wahoo, or South Atlantic snapper-grouper speciesto submit electronic reports by Tuesday following the end of each reporting week, which runs from Monday through Sunday, using NOAA Fisheries approved hardware and software applications.

The For-Hire Reporting Amendment would also change the day that headboats are required to submit an electronic fishing record from Sunday to Tuesday following the end of a reporting week, reducing the time when reports are due from seven to two days.

Why are the proposed actions needed?

The South Atlantic Fishery Management Council (South Atlantic Council) is working to enhance data collection for better fisheries management. Accurate and reliable fisheries information about catch, effort, and discards is critical to population assessments and management evaluations. The South Atlantic Council believes that weekly electronic reporting for federally permitted charter vessels could provide more timely information than the current Marine Recreational Information Program (MRIP) survey, and more accurate and reliable information for many species with low catches, low annual catch limits, or for species that are only rarely encountered by fishery participants. This proposed action is intended to improve information collected from federally permitted for-hire vessels in the Atlantic. The proposed change to the reporting day for headboat vessels would make the reporting day for the headboat sector consistent with the proposed reporting day for charter vessels.

How would the electronic reporting for charter vessels work? Do I need to have a computer?

NOAA Fisheries is currently evaluating potential software applications for the electronic reporting program, and is considering the use of software applications that are already being used by partners in the region, including “e-trips online” and “e-trips mobile,” which are products of the Atlantic Coastal Cooperative Statistics Program.

These programs would require the use of a computer or tablet with access to the internet. We are looking into the possibility of using smartphones for reporting in the future. If the rule is implemented, outreach sessions will be held to explain the reporting program software and requirements.

What type of information would be collected?

Charter vessels would be required to submit information such as: start and end dates, start and end time, start and end fishing location, vessel and captain identification, number of crew, method of fishing, hours fished, depth fished, species kept, species discarded, charter fee, fuel used, and fuel price per gallon. These core data elements may be modified through coordination with the South Atlantic Council. This information would be required to be reported regardless of where fishing occurs or what species are harvested. If no fishing occurs in a particular week, an electronic no-fishing report would be required.

Does this electronic reporting program replace MRIP?

Even if the new electronic reporting program is implemented, charter vessels with a federal permit would still need to report to MRIP. Currently, landings and discards from federally permitted charter vessels in Atlantic coastal migratory pelagics, Atlantic dolphin wahoo, and South Atlantic snapper-grouper fisheries are monitored through a MRIP survey of charter vessels. Fishing effort is calculated based on a monthly sample of federally permitted charter vessels through a phone survey, which is transitioning to a new mail survey. Catch rate observations and catch sampling are provided through dockside monitoring. If NOAA Fisheries implements the electronic reporting requirements described in the For-hire Reporting Amendment, the MRIP survey of charter vessels would continue until the proposed electronic reporting program described in the For-hire Reporting Amendment is certified by NOAA Fisheries, and then the electronic reporting program would replace the MRIP survey of charter vessels.

What if I also have federal for-hire permits for fisheries in other regions such as the Gulf of Mexico or Mid-Atlantic? Do I have to submit multiple reports?

To reduce duplicative reporting by charter vessels, fishermen with federal charter vessel/headboat permits subject to electronic reporting requirements in other regions would not be required to report to multiple times. Instead, federal permit holders would be required to comply with the electronic reporting program that is more restrictive, regardless of where fishermen are fishing.

For example, the NOAA Fisheries Greater Atlantic Regional Fisheries Office (GARFO) has implemented an electronic reporting requirement for owners and operators of a charter vessel or party boat (headboat) issued a federal for-hire permit for species managed by Mid-Atlantic Fishery Management Council to submit an electronic vessel trip report using NOAA Fisheries-approved software within 48 hours of completing a for-hire fishing trip (82 FR 42610, September 11, 2017). Because NOAA Fisheries GARFO requires more restrictive reporting than what is proposed in the For-hire Reporting Amendment, owners and operators of a vessel issued a federal for-hire permit for species in both the Mid-Atlantic and South Atlantic would be required to report under the electronic reporting program managed by GARFO, regardless of where fishing occurs or what species are caught.

The Gulf of Mexico Fishery Management Council (Gulf Council) has recommended for-hire electronic reporting for charter vessels that is more stringent than those reporting requirements contained in the South Atlantic For-hire Reporting Amendment. The proposed Gulf of Mexico for-hire electronic reporting program would require trip-level reporting, a pre-trip notification to NOAA Fisheries, and location information monitored by a vessel monitoring system, among other requirements. Therefore, an owner or operator of a charter vessel that has been issued federal charter vessel/headboat permits for applicable fisheries in both the Atlantic and the Gulf of Mexico would be required to comply with the Gulf Council’s more stringent for-hire electronic reporting program requirements, if the Gulf Council’s amendments to address for-hire electronic reporting are approved and implemented.

Does the For-Hire Reporting Amendment and proposed rule make any changes to the headboat sector?

Currently, headboats submit an electronic fishing report to NOAA Fisheries via the internet by the Sunday following the end of each reporting week, which runs from Monday through Sunday. The For-Hire Amendment and proposed rule would shorten the time to report and proposes that headboats submit electronic reports to NOAA Fisheries by the Tuesday following the end of a reporting week. This is a change in the grace period to prepare and submit reports from seven days to two days.

Does the For-Hire Reporting Amendment and proposed rule implement a video monitoring requirement for charter vessels?

No. In 2008, through Amendment 15B to the Fishery Management Plan for Snapper-Grouper of the South Atlantic Region, a provision was implemented that requires those with a charter vessel/headboat permit for South Atlantic snapper-grouper to use video monitoring technology if landing snapper-grouper species and selected by the Science Research Director. Since then, no vessels have been selected to use video monitoring and the Southeast Fisheries Science Center is not actively pursuing a video monitoring program. The For-Hire Reporting Amendment does not change the requirement specified through Amendment 15B.

Proposed Rule Would Reduce Red Grouper ACLs in South Atlantic Fisheries by 82%

April 6, 2018 — SEAFOOD NEWS — In response to a 2017 assessment showing red grouper stock was overfished, undergoing overfishing and not making rebuilding progress, NMFS is proposing a dramatic reduction in the 2018 and 2019 annual catch limits for the stock.

Under the proposed rule, the total ACL for 2017 was 780,000 pounds, with 343,200 pounds allotted to the commercial sector. This year, those figures would drop to 139,00 pounds for the total ACL and 61,160 pounds for the commercial sector. The ACL in 2019 would increase slightly, to 150,000 pounds, with a corresponding commercial sector quota of 66,000 pounds. The ACL and sector amounts for 2020 would also increase slightly.

This is a cut of 82% vs. 2017.

NMFS is currently seeking comments on the proposed rule for Abbreviated Framework Amendment 1 to the Fishery Management Plan for the Snapper-Grouper Fishery of the South Atlantic Region, which addresses red grouper in the South Atlantic. Comments are due by May 3.

The proposed rule is based on actions taken by the South Atlantic Fishery Management Council in June, September and December 2017. The reductions are based on a low-recruitment scenario. The expedited framework of this rule will adjust the ACLs for the next few years while the Council and NMFS finish development of Amendment 42 to the fishery management plan that is designed for comprehensive rebuilding of the red grouper stock.

Red grouper is typically a secondary species caught in association with targeted species such as snowy grouper, black sea bass, greater amberjack, snapper species and others, depending on the location. At the same time, red grouper landings have been declining in recent years.

In 2016, the commercial ACL was 343,200 pounds but fishermen landed only 13 percent, or 44,995 pounds. Landings in 2015 of 66,610 pounds were only 19 percent of the commercial ACL.

“The reduced level of observed landings is supported by anecdotal information received from commercial and recreational stakeholder who often state that red grouper are not being seen in large quantities in the South Atlantic,” documents for the April 2018 SAFMC meeting say. “A productivity regime shift and certain environmental factors could be driving the low observed numbers of fish, and the recent (since 2005) poor recruitment may or may not continue into the future … .”

The reductions are not expected to cause significant issues for the commercial sector since landings already have been dropping.

“With a large reduction in the ACL, commercial harvest of red grouper is expected to become primarily bycatch while fishermen target other snapper grouper species,” the Socio-Economic Profile of the Snapper Grouper Fishery in the South Atlantic Region document said. ” … While unlikely, a reduction in the red grouper ACLs could increase occurrences of regulatory discards if fishermen continue to encounter the species if the ACL is reached and possession and retention is prohibited.”

The Council documents also indicate an early closure of red grouper in 2018 is unlikely.

NPFMC plans final action on halibut sport fishing limits, permits

April 5, 2018 — Federal fisheries managers plan final action in April on proposals that would require annual renewal of charter halibut permits and for new restrictions to limit guided sport halibut harvests.

The two issues are scheduled for several hours of discussion and a vote of decision on April 5, during the spring meeting of the North Pacific Fishery Management Council in Anchorage.

The council’s preliminary preferred alternative for an annual renewal process for charter halibut permits includes a requirement for charter halibut permit holders to renew those permits annually through an application to the Restricted Access Management Program of the National Marine Fisheries Service. Permit holders would have to include on the application their permit number, along with the permit holder’s name, address, phone number, and or email address and the holder’s ownership structure.

During its initial consideration of the permit renewal options last October the Council added another option for consideration that would include a question on the application on the permit holder’s use and leasing behavior. At the time the council neither adopted or rejected that option, leaving it on the table for further consideration.

New York Lawmakers Go To Bat Over Fisheries Cutbacks

April 5, 2018 — The federal government is proposing a 12 percent reduction for the recreational black sea bass fishery in 2018,  despite the fact that scientists say the black sea bass fishery has been rebuilt to two-and-a-half times what regulators consider to be sustainable, and New York State is fighting back.

State Senator Ken LaValle and State Assemblyman Fred Thiele agree with DEC Commissioner Basil Seggos that “non-compliance is a legitimate remedy” for this cutback, stating that “this action discriminates against the State of New York. It would have a significant adverse effect on the Long Island economy” in a joint statement issued Monday.

“This has not been an isolated case of discrimination against New York State,” they added. “Unfortunately, this is part of a long history of federal action that has strangled the fishing industry in New York to the benefit of other states. DEC advocacy for our fishing industry is long overdue.”

New York, Massachusetts, Rhode Island and Connecticut filed an appeal with the Atlantic States Marine Fisheries Commission over the catch reduction on March 16, and Mr. Seggos expects an answer by late April or early May. He has told the press he plans to litigate the matter if the state does not win the appeal.

“The State of New York should utilize every legal and administrative tool at its disposal to overturn this ill-considered federal proposal,” said Mr. Thiele and Mr. LaValle. “New York should not be at a disadvantage with other states on the East Coast. Again and again, we have seen politics replace science to the detriment of New York State fishermen, whether they are recreational anglers, charter boat captains, or commercial fishermen. When the federal government is arbitrary and capricious, the state must say “no.”

In late March, New York Governor Andrew Cuomo and Attorney General Eric Schneiderman announced they had filed an appeal over commercial summer flounder (fluke) quotas set by the Mid-Atlantic Fishery Management Council of the National Marine Fisheries Service, and were also looking into taking action on New York’s quotas on black sea bass and bluefish.

For 2018, New York commercial fishing daily trip limits for fluke were set at 50 pounds. New York commercial fishermen are allowed to take just 7.6 percent of the fluke allocated among the mid-Atlantic states. These tight restrictions, compounded by monthly limits aimed at keeping the landings in check throughout the year, led to a closure of commercial fluke fishing here last fall.

Canada issues safeguards to protect right whales

March 29, 2018 — OTTOWA, Canada — New restrictions on snow crab fishing, along with new restrictions on ship speeds and $1 million more each year to free marine mammals from fishing gear, have been put in place this year to protect North Atlantic right whales, Canadian government officials announced Wednesday.

“We’re confident that these measures will have a very significant impact in protecting right whales,” Fisheries and Oceans Canada Minister Dominic LeBlanc said.

But, LeBlanc said, he and Transport Minister Marc Garneau are prepared to modify the new restrictions or add more as the weeks and months unfold.

Canada was under pressure to act after the deaths of 12 right whales last summer in the Gulf of St. Lawrence from June to September, most either hit by ships or from gear entanglement.

“Our resolve is to avoid the kind of situation we had last year,” LeBlanc said.

That resolve in Canada is encouraging, said attorney Jane Davenport with the Defenders of Wildlife, a U.S.-based environmental group that with two other groups have sued the National Marine Fisheries Service and two other agencies for failing to protect right whales from lobster gear entanglements.

With the 12 dead in Canada last year and at least four identified dead off Cape Cod and the Islands, and with only five births, the North Atlantic right whale population is expected to dip below 451 from 2016.

“The government of Canada may be late to the table, not realizing the risk in the Gulf of St. Lawrence, but at least they’ve gotten off the stick and they’re moving forward,” said Davenport, who said she worries about what she says is a slower, less-well-funded pace in the U.S. “We need a moonshot, that kind of government investment,” she said.

Biologist Mark Baumgartner, head of the North Atlantic Right Whale Consortium, said he was encouraged by the proposed measures in Canada, which also include more airplane and boat surveys of right whales. That amount of surveillance means that any entangled or killed whales will have a good chance of being detected, Baumgartner said.
