New England Fishery Council Honors Steve Correia of Fairhaven, MA

April 20, 2016 — The following was released by the New England Fishery Management Council:

Former Massachusetts state fishery scientist Steven Correia received the New England Fishery Management Council’s (NEFMC) Janice Plante Award of Excellence for 2016 at its meeting today in Mystic, CT. While the now-retired Fairhaven resident was employed by the Massachusetts Division of Marine Fisheries for over 30 years, Steve was honored by the NEFMC for his extraordinary contributions to federal fisheries management.

The annual Janice Plante Award of Excellence, first awarded to Janice herself in 2015 for her outstanding news coverage of New England’s fisheries, was established to pay special tribute to those who have displayed outstanding commitment and contributions of time and energy in service to the Council fishery management system.

For the last 26 years Steve served the NEFMC in various ways. He was a member of the technical teams that provide the scientific underpinnings of the Council’s management actions. To that end, he was a charter member of the Scallop Plan Development Team, or PDT, beginning in 1991 and served on the Groundfish PDT from 1994 through 2015, during one of the most challenging periods faced by the New England Council.

But he also was a key contributor to nearly all of the Council’s major PDTs at one time or another. The standing joke among his colleagues was that Steve was the most valuable Council employee who was not on the NEFMC payroll. He was Chairman of the Multispecies Monitoring Committee from 1997 through 2001 and during other periods was a member of the Atlantic Herring, Monkfish, Red Crab, and Dogfish PDTs, always bringing ideas, analysis, and integrity to the job.

During the development of the Groundfish Fishery Management Plan (FMP) as we know it today, he was influential in designing effort controls to reduce fishing pressure on fish stocks of concern and stock rebuilding programs, harvesting “sector” rules, and methods to establish and account for catch limits. As a member of the Scallop PDT, Steve participated in the development of the rotational management system and the early scallop closed area access programs. He also helped develop measures to protect river herring and shad that were eventually included in the NEFMC’s Herring Fishery Management Plan.

Steve frequently contributed to the stock assessments supporting each fishery management plan. Through his long experience, he was able provide key perspectives to management challenges, often helping less experienced Council staff better understand the context of management choices. He also served on the Council’s Scientific and Statistical Committee in 2011 and several years on its Research Steering Committee.

He touched nearly every management decision made by the Council since at least 1990. His hard work and technical skills were valued by every PDT chair and significantly improved the analyses that supported Council actions. During his many years of service Steve Correia was an invaluable asset to both staff and the Council alike.

Scallop fishermen poised for fight over shellfish

April 19, 2016 — PORTLAND, Maine — Scallop fishing has increased dramatically off some parts of New England recently, and fishermen and regulators will soon meet to discuss how to avoid overexploiting the valuable shellfish.

The concern over scallop fishing centers on the northern Gulf of Maine, a management area that stretches roughly from the waters off of Boston to the Canadian border. Scallop grounds off of northern Massachusetts have been especially fertile, prompting increased fishing in that area.

The New England Fishery Management Council, a regulatory arm of the federal government, will hold a public meeting about the issue Wednesday and decide how to proceed.

Part of the concern arises from the fact that different classes of fishing boats harvest scallops in the area, and not all of them are restricted by a quota system. Alex Todd, a Maine-based fisherman who fishes off of Gloucester, Massachusetts, said he and others feel the rules are not equal.

“We’re playing by two different sets of rules,” Todd said, adding that fishermen who follow the quota system could reach quota as soon as next month.

But Drew Minkiewicz, an attorney for Fisheries Survival Fund who represents many fishermen who don’t have to abide by the quota system, said he thinks the boats can coexist.

2016-2017 Sea Scallop Research Set-Aside Recommended Awards Announced

April 7, 2016 — The following was released by NOAA:

NOAA Fisheries Northeast Fisheries Science Center and the New England Fishery Management Council are pleased to announce that 15 research projects have been selected for support from the 2016 Sea Scallop Research Set-Aside (RSA) program. The projects address the council’s research priorities for the nation’s highest-valued single species commercial fishery.

Twenty-five researchers from nine different organizations will be awarded 2016-2017 research grants valued at $15.6 million. These projects are funded by proceeds from selling a portion of the annual sea scallop quota “set aside” for this purpose. Award recipients are located in Maine, Massachusetts, New Jersey, Rhode Island, and Virginia and include universities, non-profit research and education organizations, and commercial fishing vessels and businesses.

Research set-aside programs are unique to federal fisheries in the northeast region. Under RSA programs, no federal funds are provided to support the research. Selected projects receive allocations “set-aside” within established quotas for this purpose under the particular fishery management plan. Successful applicants partner with the fishing industry to harvest their set aside award to generate funds for the research. There are active research set-aside programs for Atlantic sea scallops, Atlantic herring, and monkfish.

The New England Fishery Management Council established the sea scallop RSA program to address research that will support management of the scallop resource. The Council sets the research priorities and researchers compete for funding through a federal grant competition managed by NOAA Fisheries. All of the funds derived from quota sales are used to support research and compensate industry partners. NOAA Fisheries does not retain or use any of these funds.

This year, more than 30 proposals were received for consideration. Six of these are two-year projects. Proposals were evaluated and ranked for technical merit and responsiveness to Council research priorities.

Ten projects will address the Council’s highest research priorities, including intensive and broad-scale resource surveys, bycatch reduction, scallop meat quality, and scallop area management. Five projects focus on other Council priorities, such as sea scallop biology and productivity, habitat impact research, and reducing the risk of sea turtle interactions with the scallop fishery.

Proposals underwent a two-stage review – one for technical merit and one for responsiveness to management priorities.

Proposals for sea scallop surveys were evaluated and ranked by a technical panel that looked at merit as well as how the work met recommendations from a recent peer review of all sea scallop survey methods used in the region. All other proposals were each evaluated for technical merit by three subject matter experts. Each technical reviewer submitted scores and comments on each proposal. A management panel made recommendations on priority projects, based on current management priorities.
The technical review scores, in conjunction with recommendations from the management panelists, are the basis for RSA survey funding decisions.

Sea Scallop Resource Surveys Recommended for Funding

These surveys, combined with the annual NOAA Fisheries sea scallop survey, will provide a comprehensive picture of the scallop resource by the end of this summer. The data collected are expected to support the Council’s area management decisions for 2017 and beyond.

Arnie’s Fisheries Inc. will conduct an optical survey of the Elephant Trunk Access Area using the HabCam V3 instrument system, looking at scallop numbers, sizes, and density in order to generate harvestable biomass estimates.

The Virginia Institute of Marine Science (VIMS) will conduct a fine-scale dredge survey of the Mid-Atlantic sea scallop resource from the Virginia/North Carolina border to Block Island, Rhode Island. VIMS will also conduct high-resolution abundance and distribution surveys in and around the Nantucket Lightship Closed Area, and in Georges Bank Closed Area II and the surrounding area to the south, where secondary objectives include finfish bycatch species composition and catch rates; scallop product quality and disease research; and commercial and survey scallop dredge performance.

The Wood Hole Oceanographic Institution, as part of their habitat research on the northern part of Georges Bank, will conduct a high resolution HabCam survey to support near-term scallop area management decisions of this area that is undergoing considerable management changes. Lund’s Fisheries are co-principal investigators.

As requested by the New England Fishery Management Council, the survey technical review panel not only considered technical merit, but also the results of a recent peer review when evaluating proposals for sea scallop surveys. That review, conducted in 2015 by the Center for Independent Experts, examined all of the primary survey methods for assessing sea scallop abundance in the region, several of which are supported through the scallop RSA program. The technical panel ensured that proposals were responsive to the peer review findings.

Bycatch Mitigation Projects

For the fifth year, UMASS Dartmouth’s School of Marine Science and Technology will use their award to support a yellowtail flounder bycatch avoidance system.To address low allocations of yellowtail flounder in the scallop fishery, these researchers will work with the limited-access and general category scallop fleets to deploy the bycatch avoidance system in fishing grounds on Georges Bank and in southern New England.

Reducing bycatch through scallop dredge gear modifications is the focus of two projects proposed by the Coonamessett Farm Foundation, Inc. The Foundation plans to design and test gear designed to reduce flatfish bycatch through modification to the dredge bag, and the use of a modified flounder sweep attached to the dredge bail, filming interactions to monitor the effectiveness of the gear modifications.

The Coonamessett Farm Foundation will also continue its seasonal bycatch survey on Georges Bank, collecting information on yellowtail flounder bycatch rates and other bycatch species relative to scallop meat yield. Data will also be used to evaluate sea scallop health and meat quality, provide maturity data for several flounder species, estimate the prevalence of a potentially significant parasite in yellowtail flounder, and examine lobsters for shell disease while also collecting biological data.

For the eighth Coonamessett Farm will tag up to 30 loggerhead sea turtles with water activated tags. They will also observe sea turtle behavior using a remotely operated vehicle, take biological samples, and collect length and weight measurements. This work provides information on sea turtle distribution and behavior in the Mid-Atlantic and southern New England, where there is overlap between sea scallop fishing activity and turtle distribution. Co-principle investigators include Virginia Institute of Marine Science, the Atlantic Offshore Lobstermen’s Association, and Roger Williams University.

Sea Scallop Biology, Meat Quality, and Productivity Projects

The Virginia Institute of Marine Science will study sea scallop age structure and growth rates over time. Under a separate grant, VIMS will develop a framework for mark-recapture studies to estimate natural mortality, growth and movement of scallops and the effects of scallop density on those factors.

Researchers at the University of Massachusetts, Dartmouth campus investigating scallop meat quality will focus on how the infection that causes “gray meat” in sea scallops is transmitted.

Researchers at Virginia Institute of Marine Science, with colleagues at Rutgers University, will study how a nematode parasite affects scallop meat quality and provide insight into how industry and management can assess and predict impacts to the scallop stock and meat quality.

Coonamessett Farm Foundation will demonstrate the feasibility of a seeding program to enhance and stabilize scallop recruitment while documenting the factors that affect seed survival.

Woods Hole Oceanographic Institution will investigate the impact of scallop fishing in habitat management areas using the REMUS autonomous underwater vehicle.

NMFS Partially Approves Herring Framework Adjustment 4: Empty Fish Hold Provision Not Adopted

April 6, 2016 — The following was released by the Atlantic States Marine Fisheries Commission:

The National Marine Fisheries Service (NMFS) partially approved Framework Adjustment 4 to the Federal Herring Fishery Management Plan—the final rule published today, April 4th. The empty fish hold provision, which was recommended by the New England Fishery Management Council and provisionally adopted by the Atlantic States Marine Fisheries Commission (ASMFC) in Amendment 3 to the Interstate FMP, was not approved. The justification for not approving this provision is provided in the following excerpts from the final rule. The final rule can be found at: https://federalregister.gov/a/2016-07583.

NMFS could not approve the empty fish hold provision because “…there is insufficient support in the record to conclude that herring vessels are harvesting excess fish and discarding unsold fish at sea. The costs associated with a herring trip, including fuel, crew wages, and insurance, are substantial, so it is unlikely that vessel operators are making herring trips to harvest fish that will ultimately be discarded.”

In addition, NMFS determined “Framework 4’s proposed waiver provides no way of verifying the amount of fish reported relative to the amount of fish left in the hold. Therefore, NMFS does not believe that this measure contains a viable mechanism to verify whether harvested fish that are left in the hold were reported by the vessel.”

Ultimately, “Because the measure lacks a mechanism to verify or correct the amount of fish reported on the VTR, the measure is unlikely to improve catch monitoring in the herring fishery. In contrast, the compliance and enforcement costs associated with the measure may be high.”

As stated in Amendment 3, implementation of the empty fish hold provision is contingent on federal adoption. Since NMFS did not approve this provision, ASMFC will maintain status quo measures on this issue. Under status quo there is no requirement to empty vessel holds of fish prior to a fishing trip departure. Drug testing a touchy issue on New Bedford’s waterfront

April 4, 2016 — NEW BEDFORD, Mass. — The thrum of the boat’s engine was audible last fall as local scalloper Rick Lynch, 44, talked frankly about his personal experiences and observations of drug use on New Bedford’s waterfront, now and nearly 30 years ago.

A New Bedford native who lives in Dartmouth, Lynch has been around long enough to fall into a few bottles, or needles, and climb back out again. He said he’s been sober for about 15 years, and a captain of scallop boats for about 14. Lynch supports mandatory drug testing in the fishing industry, but the idea might gain little traction on the regulation-wary waterfront — even after drug arrests on outbound fishing boats last month.

Understanding Lynch’s views about the present, though, means hearing about his past. He said he was 16 when he started working on local fishing boats, in the late ‘80s.

“Back then, Union Street was crazy,” Lynch said. “There was cocaine running around, there was heroin everywhere. There used to be bags of cocaine on the galley table on the boat, because we were working crazy hours back then, you know. Everything was illegal, in what we did fishin’. I mean, we brought in illegal small scallops because there was a scallop count back then. We were jumping over the Canadian line and staying up for days because we’d loaded the boat so much. Guys were eating No-Doz like they were going crazy — or eating Dexedrine, diet pills.

“And then when we came home, we drank,” Lynch continued. “All weopi did was drink. For years, I didn’t make it one block up Union Street, you know? I wasn’t even of age to drink and I had a tab at the National club, you know? I was 17 years old and I had a tab in a bar. Because that was acceptable if you were a fisherman back then — the police didn’t even go into those bars back then. If they did, they were drinking with us.”

In the wake of those times, and amid what could be a rising wave of drug use on New Bedford’s waterfront — where federal and local law enforcement raided 11 boats and made four opiate arrests over two days in March, in the second such raid this year — Lynch floated the idea of mandatory drug tests on commercial fishing boats, for crew members as well as captains and mates.

“I mean, there is no mandatory drug testing in this industry, you know, where there is in every other maritime industry,” Lynch said. “You get on a tugboat, you gotta have drug tests. You get on a ship, you gotta have drug tests.”

New drug-testing policies are just one idea of many that could rise to the surface as groups including Fishing Partnership Support Services, the Massachusetts Fishermen’s Partnership and others work to provide resources and support for fishermen amid the nationwide opioid epidemic, which is devastating entire communities and knows no borders.

Several longtime fishermen and industry leaders told The Standard-Times, though, that despite last month’s arrests and a drug-related death on the water in February, mandatory testing could be a tough sell.

Retired fisherman Rodney Avila, for example, said imposing mandatory drug tests on crew members would be one more regulation for fishermen and boat owners who already feel beset by them.

“There’s enough mandates on the fishing industry as it is,” said Avila, who owned three New Bedford-based groundfish boats, or “draggers,” between 1968 and 2013. “How much can these guys take?”

Avila is a former marine superintendent for New Bedford’s Harbor Development Commission and a former SouthCoast member of the New England Fishery Management Council. He emphasized — as have numerous fishermen, industry leaders and city officials in recent weeks — that the drug arrests unjustly stain the scores of clean, hard-working fishermen in New Bedford.

At-sea monitoring fees are the latest threat to New Hampshire’s dwindling fishing industry

April 1, 2016 — Working as both a biologist and a fisherman, David Goethel brings a unique perspective to the state and federal fishery management boards he’s an adviser on. 

“I’ve spent all my life acting as a translator because they speak all different languages,” says Goethel, who worked as a research biologist at the New England Aquarium before he became the owner and operator of the Ellen Diane, a 44-foot fishing trawler based out of Hampton. 

But the most recent disconnect between the factions has resulted in Goethel and other groundfishermen filing a federal lawsuit. 

After delaying the regulation for years, the National Oceanic and Atmospheric Administration is now requiring groundfishermen to pay for the at-sea monitoring program — at a cost of an average $710 per trip, conducted at random. The monitoring is done to ensure that the fishermen adhere to groundfish catch quotas set in May 2010 by the New England Fishery Management Council, under NOAA. (Groundfish include cod, haddock and other common bottom-dwelling species.)

Marine monuments proposal near Cape Cod stirs debate

April 1, 2016 — In September of 2014, President Barack Obama expanded on a national marine monument created by President George Bush in 2006.

The protection of more than 490,000 square miles of ocean surrounding a group of remote Pacific islands from commercial fishing remains the largest marine reserve in the world.

This week, marine scientists and a battalion of environmental groups made their case for a similar presidential designation of two more national marine monuments, Cashes Ledge, to the north of Cape Cod, and the Coral Canyons and Seamounts Area, a collection of five deep-water canyons and four extinct volcanoes 150 miles southeast of the Cape.

Environmentalists gathered over 150,000 comments, as well as letters from hundreds of marine scientists and more than 50 state legislators from New England states in support of the designations. Proponents believe the change would be relatively painless for the fishing industry.

“When you look at a map of fishing effort, you couldn’t choose anyplace in New England that has less,” said Peter Baker, the Pew Charitable Trusts director for U.S. Oceans Northeast. “Cashes is the last best example of an intact ecosystem.”

Number of New Hampshire groundfishermen continues to decline

March 30, 2016 — PORTSMOUTH, N.H. — The number of New Hampshire boats fishing for groundfish has continued to decline, with only five full-time groundfisherman left in the state.

Fishermen have been catching haddock, cod and flounder off the coast and selling it in New Hampshire for centuries. But fishermen said that quotas and regulations over the past decade that are meant to protect groundfish have made it almost impossible to make a living.

The regulations have also affected other fishermen. At Tuesday’s regional meeting of the New England Fishery Management Council, some complained they were unable to catch herring to use as bait because they were in the same area as regulated groundfish.

President Obama Will Not Designate Cashes Ledge as a National Monument

WASHINGTON (Saving Seafood) — March 25, 2016 — Earlier today, a spokesperson for the White House Council on Environmental Quality told the Associated Press that Cashes Ledge is “not under consideration for a [national monument] designation at this time.” According to attendees at meetings held yesterday in Massachusetts, Christy Goldfuss, Managing Director at the White House Council on Environmental Quality, stated, “Based on feedback we received, we are not considering Cashes Ledge for any kind of action at this time.” Located approximately 80 miles offshore in the Gulf of Maine, Cashes serves an important and historic area that has been fished commercially and recreationally for decades.

The Northeast Seafood Coalition and Associated Fisheries of Maine noted in a joint statement that, “Consideration of National Monument designations in the offshore Canyon areas of Southern New England remains ongoing, and affected fishermen should remain vigilant in assuring that any concerns they may have are addressed.”  Fishing interests including the Atlantic red crab fishery, offshore lobster fishery, squid, mackerel, butterfish, tilefish, albacore wahoo,dolphinfish (mahi mahi), and others have interests in areas that remain on the table. Pelagic longline, rod and reel and greenstick fisheries including yellowfin tuna, bluefin tuna, bigeye tuna and swordfish could also be affected.

The New England Fishery Management Council (NEFMC) is in the midst of an ongoing process working with fishing, environmental and scientific interests to protect deep sea coral and other important sea bottom attributes in the Northeast Canyons. NEFMC executive director Tom Nies told Saving Seafood, “The Council’s recommendations to protect Cashes Ledge are still being reviewed as part of our Omnibus Habitat Amendment. The Council has not taken a position on any of the monument proposals that have been circulated, but the meeting in Boston did give us the opportunity to explain our deep-sea coral amendment process directly to Ms. Goldfuss. We are very pleased that CEQ traveled to New England to give us this opportunity. I think the industry and state representatives present also appreciated this face-to-face meeting and we all look forward to a continuing dialogue.”

In response to the announcement, Terry Alexander, President, Associated Fisheries of Maine said, “Commercial fishermen in New England face continuous regulatory uncertainty, so it is a relief to know that there is one less restriction on fishing to worry about. We believe that the President was persuaded by a lack of scientific information to support such a designation, as well as the position expressed by stakeholders that decisions about closing areas to fishing should take place under the process outlined in the Magnuson Stevens Fishery Conservation and Management Act (MSA).”

Vito Giacalone, Chair of Governmental Affairs for the Northeast Seafood Coalition said, “We are relieved by the President’s decision to forego a National Monument designation on Cashes Ledge, As stakeholders who participated in a lengthy, thorough and transparent public process to identify and protect important marine habitats such as Cashes Ledge, we are grateful and pleased to hear that the MSA process we all followed has been acknowledged and respected by the Obama Administration. We are sincerely grateful that the President, after gathering all pertinent facts, saw that the use of Executive Order was unnecessary in light of the process that has already taken place through the New England Fisheries Management Council.

The American Antiquities Act of 1906 provides authority for the President to declare national monuments by public proclamation on lands owned or controlled by the Government of the United States, but fishing representives attending the meeting expressed concern that establishing an Atlantic marine monument usurps the public, inclusive Council/NMFS processes already undertaken and ongoing.

While the process in New England is ongoing, similar processes in the Mid-Atlantic were praised by environmental groups. For their efforts Garden State Seafood Association (GSSA) Executive Director Greg DiDomenico and Mid Atlantic Fishery Management Council (MAFMC) Chairman Rich Robbins were lauded last September as as Conservation Leaders by the New York Aquarium. In October, the two men were honored again together with GSSA president Ernie Panacek as Regional Ocean Champions by the Urban Coast Institute at Monmouth University. “The process in the Mid-Atlantic should be the model for developing targeted habitat protection in New England,” said Mr. DiDomenico. “An open, collaborative process is the best way to build on these efforts.”

NOAA Fisheries Seeks Comments on Proposed Groundfish Catch Limits and Modifications to the At-Sea Monitoring Program

March 23, 2016 — We are seeking public comment on a proposed rule that would set 2016-2018 catch limits for all 20 groundfish stocks, adjust the groundfish at-sea monitoring program, and adopt several sector measures.

Catch Limits

The new catch limits proposed for all 20 groundfish stocks are based on stock assessments conducted in late 2015.

The proposed allocations for Gulf of Maine cod, Georges Bank cod, Southern New England/Mid-Atlantic yellowtail flounder, and witch flounder could limit the operation of the groundfish fishery. However, these reductions are necessary to prevent overfishing for these stocks, which are all at historically low levels.

Based on the proposed allocation increases for Gulf of Maine haddock (150 percent) and Gulf of Maine cod (30 percent), we are proposing trip limit increases and season extensions for the recreational groundfish fishery in a separate action.

At-Sea Monitoring

The 2016 fishing year (May 1, 2016, through April 30, 2017) is the first full year that sectors will be responsible for the costs of at-sea monitoring. We worked with the New England Fishery Management Council to develop a set of reasonable modifications to the at-sea monitoring program to make the program more cost-effective while still reliably meeting monitoring groundfish catch.

The proposed changes include:

  • Elimination of the coverage requirement for certain sector trips with low groundfish bycatch;
  • Adjustment of method  NOAA Fisheries uses to set the annual coverage level to use more years of discard information and stock health to predict coverage levels; and
  • Reduction of the target at-sea monitoring coverage level of 14 percent for the 2016 fishing year (down from 24 percent for 2015).
