Fishing industry says it doesn’t endorse Vineyard Wind’s ‘consensus plan’ for transit lanes

December 11, 2018 — The fishing industry said Vineyard Wind distorted its words on Monday.

A release by Vineyard Wind said the offshore wind company endorsed a “consensus” transit corridor plan supported by the fishing industry, but multiple people within the fishing industry told The Standard-Times they didn’t support or endorse the plan.

The consensus within the industry is a 4-mile wide transit lane. Vineyard Wind’s endorsed plan called for 2-mile wide corridors.

“It’s frustrating for the fishing because we’re coming with options even though we’re losing tremendous ground and we’re losing a lot of traditional transit (lanes),” said Meghan Lapp, a fisheries liaison for Seafreeze Ltd. “But we’re still trying to come to the table to make something work and in light of this press release, it doesn’t really seem like it’s being reciprocated.”

The model endorsed by Vineyard Wind is one developed in a September meeting in New Bedford. Eric Hansen, a New Bedford scalloper, attended the meeting and remembered the plan being thought of as a worst-case scenario for the fishing industry.

December 10, 2018 — Massachusetts is home to the nation’s top fishing port. More than $300 million in seafood lands in New Bedford every year.

But the kinds of seafood are changing.

Rising ocean temperatures are driving southern fish species into our coastal waters. Today’s there are strict catch limits on Massachusetts’ state fish, the Atlantic cod. Scallops are now the New Bedford fishing industry’s primary source of revenue.

In response, local researchers are developing artificial intelligence to promote smarter fishing. And private companies are working on alternatives — including bioengineered fish and even fish flesh grown in laboratories.

New England fishery council under fire for clam, wind decisions

December 10, 2018 — A decision this week by the New England Fishery Management Council to vote down a resolution that would’ve allowed clam harvesting in a 280 square mile area off Nantucket Shoals is drawing fire from the clam industry and others, South Coast Today, a New Bedford, Massachusetts-based newspaper, is reporting.

In particular, critics are pointing to the council’s decision to allow offshore wind development to continue in a 1,400 square mile area in a similar region, according to the newspaper.

“It’s amazing to me that they’ve turned this complete blind eye on really the most intrusive project that’s ever come on the East Coast, which is wind,” Scott Lang, a former New Bedford mayor and attorney for the clam industry, is quoted as saying. ”… They’re acting like that’s something we’re just going to have to live with, but a fishery that’s been around for a couple hundred years is a threat to the habitat.”

JACK SPILLANE: A rogue agency gets set to shut down another New Bedford fishery

December 10, 2018 — Scott Lang has been around fisheries issues for a long time.

Both when he was mayor and afterwards.

In 2013, Lang helped organize the Center for Sustainable Fisheries as a grassroots lobbying group to try to make sure New Bedford fishermen were not totally forgotten by NOAA. He’s worked for the industry for a long time and seen a lot of arguments from both sides back-and-forth over the years.

But until last week, he said he had never seen NOAA make a decision to close a fishery with no science behind it. Not even questionable science, as for years NOAA has used for New England groundfishing limits in the opinion of many.

NOAA’s decision to close the Rose and Crown Zone and Zone D to surf clammers is based on anecdotal evidence related to UMass Dartmouth scientist Kevin Stokesbury’s research for the scallop industry, first done almost two decades ago.

The camera net device Stokesbury invented was for measuring scallop habitats but NOAA has used his science to measure clam beds. It’s not the same, Stokesbury told The Standard-Times. The images his survey produces are of the ocean floor about a kilometer apart and clammers often dredge in much shorter distances.

The clammers have offered to do surveys that will be more applicable to clam beds in the areas of Nantucket Shoals in question. They would need about three years to do that but they would have to keep fishing in the closed areas in order to pay for it.

NOAA’s treatment of wind industry called into question after closure of clamming areas

December 6, 2018 — Offshore wind development appeared on Tuesday’s agenda at a New England Fishery Management Council meeting, however, it wasn’t expected to pop up during discussion on closures affecting the clamming industry.

Peter Hughes, a liaison for the Atlantic Council, couldn’t digest the fact that an offshore wind leasing area identified in a similar region extends upwards of 1,400 square miles, while the clamming industry, which sought less than 300 square miles off of Nantucket Shoals, couldn’t receive approval.

The notion only gained traction after the council voted against the resolution the clamming industry had wanted, which would have provided exemption to the 280 miles of harvesting area. Instead, the council adopted a modifed version that closed Rose and Crown and Zone D to clamming.

“It’s amazing to me that they’ve turned this complete blind eye on really the most intrusive project that’s ever come on the East Coast, which is wind,” said Scott Lang, former New Bedford mayor and attorney for the clam industry. ”… They’re acting like that’s something we’re just going to have to live with, but a fishery that’s been around for a couple hundred years is a threat to the habitat.”

Both Hughes and Lang said they supported offshore wind, but the fishing industry should receive the same cooperation from NOAA.

Upcoming vote could be ‘devasting’ for New England clams

December 3, 2018 — While New Bedford gains its notoriety as the scallop capital of the world, Massachusetts is known for its clam chowder.

A New England Fisheries Management Council meeting in Newport scheduled for Tuesday could affect the latter.

An afternoon agenda item will discuss the possibility of closing an area in Nantucket Shoals, that the clam industry calls vital to its survival.

“If they close this down, it will be devastating to the whole industry,” Vice President of Operations for Nantucket Sound Seafood LLC Michael Costa said.

To prevent the action, the surf clam industry has rallied together and sought the legal services of former New Bedford mayor and attorney Scott Lang.

The coalition consists of Atlantic Capes, Seawatch International, Nantucket Sound Seafood, and Intershell Seafood International.

More questions than answers emerge from New York wind meeting

December 3, 2018 — A horde of New Bedford fishermen and representatives from the city’s Port Authority shared a train ride down to New York City for a meeting involving an offshore wind project south of Long Island.

The Intergovernmental Renewable Energy Task Force meeting was held to discuss a guide the Bureau of Ocean Energy Management released earlier this month outlining potential leasing sites. The day long dialogue, though, may have only introduced more questions rather than provided answers.

Executive Director of the Port Authority Ed Anthes-Washburn said no timeline emerged or what possible next steps lie ahead in the project only that the hope was that environmental studies could begin in early 2019.

Fishermen to NOAA: ‘We spend more time getting away from the fish than we do catching the fish’

November 30, 2018 — The fishing industry pleaded with NOAA on Thursday afternoon for the one thing the agency couldn’t promise: urgency.

“Unfortunately with the management process that we have, to abide by the law, which obviously we have to do as a federal agency, we have to abide by the law,” NOAA’s Northeast Regional Administrator Mike Pentony said. “We are subject to constraints. It is very difficult for us to react, to change quickly.”

To better understand the constraints experienced both by NOAA and the commercial fishing industry, about two dozen people involved in fishing, its regulations and development discussed the obstacles and solutions for about two hours during a monthly roundtable conversation held by the Port of New Bedford.

The turnout at the School of Marine Science and Technology was one of the best the meeting has seen, Pamela Lafreniere of the Port Authority said.

The roundtable looked at what vision the fishermen and NOAA have for the groundfish industry and then touched on quota.

A common theme emerged from the fishing industry as it pelted Pentony with grave concerns regarding the future of the groundfish fishery.

“This is the very bottom and the most discouraged mount of fishermen that I’ve seen since I’ve been involved in fisheries and that goes back to the mid-70s,” fisherman Ed Barrett said.

“I can’t tell you how bad it is. You can ask any fishermen,” fisherman Ron Borjeson said. “We spend more time getting away from the fish than we do catching the fish.”

New Bedford Fishing Boat Captain Sentenced

November 29, 2018 — The former captain of a New Bedford fishing boat owned by Carlos Rafael, a/k/a “The Codfather,” was sentenced today in federal court in Boston for interfering with a U.S Coast Guard (USCG) inspection of a fishing boat off the Massachusetts coast.

Thomas D. Simpson, 57, of South Portland, Maine, was sentenced in U.S. District Court to two years of probation, with the first four months to be served in home confinement with electronic monitoring, and ordered to pay a $15,000 fine. In August 2018, Simpson pleaded guilty to one count of destruction or removal of property subject to seizure and inspection.

Simpson was the captain of the fishing vessel Bulldog, a New Bedford based commercial fishing vessel and one of several fishing vessels owned by Carlos Rafael. On Sept. 25, 2017, Rafael, often referred to as “The Codfather,” was sentenced in federal court in Boston to 46 months in federal prison on a variety of charges related to the operation of his commercial fishing business.

On May 31, 2014, the Bulldog was engaged in commercial fishing off the cost of Massachusetts when the U.S. Coast Guard (USCG) boarded the vessel to perform a routine inspection of the Bulldog and its fishing equipment. At the time of the boarding, the Bulldog’s net was deployed in the water and the crew was actively fishing. The USCG Boarding Officer encountered Simpson in the Bulldog’s wheelhouse and instructed Simpson to haul in the fishing net for inspection. The fishing net is controlled from the wheelhouse by an electric winch, which Simpson activated, but instead of hauling the fishing net onto the vessel, he let out more of the cable which attaches the net to the vessel. When the USCG Boarding Officer realized that Simpson was letting the net out, he instructed Simpson to stop and to haul the net in. Simpson ignored the order and continued to let out cable until the net became detached from the Bulldog and sank.

Judge returns two vessels to Carlos Rafael’s wife

November 29, 2018 — The wife and another business partner of Carlos Rafael will retain ownership of two of the four fishing vessels seized by the federal government as part of the penalties for the array of crimes committed by the man known as “The Codfather.”

U.S. District Court Judge William G. Young, in his final order of forfeiture, said the F/V Lady Patricia and the F/V Olivia & Rafaela — and all federal fishing permits associated with each vessel — will be forfeited to the federal government as part of the final seizure agreement.

Young also ordered the forfeiture of $306,490 to the federal government in addition to the $17,500 judgment already paid by Rafael as part of his plea agreement.

Two of the other forfeited vessels — the Bulldog and Southern Crusader II — will be released to corporations that include Rafael’s wife, Conceicao Rafael, as an owner.

The 75-foot Bulldog will be released to B & D Fishing Corp. and Conceicao Rafael. The 81-foot Southern Crusader II is set to be released to R and C Fishing Corp. The corporation, according to the order, includes Conceicao Rafael and Joao Camarao as owners.

The convicted and currently incarcerated Carlos Rafael, according to the order, ceases to hold any “right, title or interest” in either the forfeited or released vessels. The order, however, retains Carlos Rafael’s ability to defend himself against any future claims from NOAA Fisheries.
