Handling and Release of Prohibited Atlantic Sharks

June 21, 2017 — The following was released by NOAA:

NOAA Fisheries has released a new video to help anglers identify dusky and other prohibited shark species. Focused on safe handling and release of sharks and current fishing regulations, the video accompanies a suite of educational materials. We have updated our Recreational Shark Identification and Regulations Placard, added a new Prohibited Shark Identification Placard, and updated our handling and release brochure. All of these materials are available for download.

New Regulations

Beginning January 1, 2018, recreational fishermen, including charter/headboat fishermen that fish for, retain, posses, or land sharks in federal waters of the Atlantic Ocean, Gulf of Mexico, and Caribbean must have a valid “shark endorsement” added to their HMS permit. Atlantic tunas General category and Swordfish General Commercial permit holders must also have a shark endorsement for registered tournaments. The video is required viewing for permit holders requesting the shark endorsement, and will be followed by a brief, educational quiz.

Congressman Young Welcomes Selection of Chris Oliver as Assistant Administrator for NOAA Fisheries

June 20, 2017 — The following was released by the office of Congressman Don Young:

Alaska Congressman Don Young today shared the following statement of support on the appointment of Chris Oliver, Executive Director of the North Pacific Fishery Management Council, as Assistant Administrator for NOAA Fisheries:

“The Secretary got this one right – it’s the right pick for Alaska and for the country,” said Congressman Don Young. “This decision underscores the leadership and qualifications of Chris Oliver, who has spent his lifetime working to build Alaska and the North Pacific into the gold standard for fisheries management. Chris’ depth of knowledge and experience, as the head of the North Pacific Fishery Management Council, will bring much needed expertise to a position tasked with addressing some of the most challenging aspects of fisheries management throughout the United States. I look forward to working with Chris during his tenure as Assistant Administrator – I know he’ll be a huge asset to NOAA.”

NOAA, USGS and partners predict third largest Gulf of Mexico summer ‘dead zone’ ever

June 20, 2017 — Federal scientists forecast that this summer’s Gulf of Mexico dead zone – an area of low to no oxygen that can kill fish and other marine life – will be approximately 8,185 square miles, or about the size of New Jersey.

This would be the third largest dead zone recorded since monitoring began 32 years ago – the average Gulf dead zone since then has been 5,309 square miles.

The Gulf’s hypoxic (low oxygen) and anoxic (oxygen-free) zones are caused by excess nutrient pollution, primarily from human activities such as agriculture and wastewater. The excess nutrients stimulate an overgrowth of algae, which then sinks and decomposes in the water. The resulting low oxygen levels are insufficient to support most marine life and habitats in near-bottom waters, threatening the Gulf’s fisheries.

The Gulf dead zone may also slow shrimp growth, leading to fewer large shrimp, according to a NOAA-funded study led by Duke University. This could mean higher costs of large shrimp at the marketplace and an economic ripple effect on the Gulf shrimp fisheries.

“The Gulf’s summer hypoxic zone continues to put important habitats and valuable fisheries under intense stress,” said Rob Magnien, director of NOAA’s Center for Sponsored Coastal Ocean Research. “Although there is some progress in reducing nutrients, the effects of the dead zone may further threaten the region’s coastal economies if current levels remain.”

This NOAA-sponsored forecast is based on nutrient runoff and river discharge data from the U.S. Geological Survey. The forecast assumes typical weather conditions, and the actual dead zone could be disrupted by hurricanes and tropical storms.

This year’s predicted large size is due mainly to heavy May stream flows, which were about 34 percent above the long-term average and had higher-than-average nutrient loads. The USGS estimates that 165,000 metric tons of nitrate – about 2,800 train cars of fertilizer – and 22,600 metric tons of phosphorus flowed down the Mississippi and Atchafalaya rivers into the Gulf of Mexico in May.

Alaskan appointed to head U.S. fisheries management for NOAA

June 20, 2017 — Chris Oliver of Anchorage has been appointed to manage fisheries nationally for the National Oceanic and Atmospheric Administration, the Trump administration announced Tuesday.

Oliver has since 2000 led the North Pacific Fisheries Management Council, for which he has worked for 27 years. He gained broad support for the position from fisheries groups and members of Alaska’s congressional delegation.

Oliver’s first day as assistant administrator for NOAA Fisheries was Tuesday. He relocated to the Washington area for the job. The position is a political appointment but does not require Senate confirmation.

Oliver said in a statement that he plans “to make long-term sustainability the top priority, while looking for ways to maximize fishing opportunities for the benefit of recreational and commercial fishermen, processors, coastal communities, and the economies which depend upon them.”

“Oliver’s background and expertise will be an asset at NOAA Fisheries as they work to reduce our nation’s $11 billion seafood trade deficit,” said Commerce Secretary Wilbur Ross.

The agency is responsible for managing sustainable U.S. fisheries under the Department of Commerce, as well as recovery and protection of species of whales, sea turtles and corals.

N.J. fishermen make their case to feds as fluke battle rages on

June 20, 2017 — With New Jersey’s summer flounder fishing industry on the line, Garden State officials made their case to NOAA fisheries on Tuesday afternoon.

In a hearing with the federal agency, New Jersey Department of Environmental Protection officials argued that the state’s regulations for summer flounder (or fluke) fishing reach conservation equivalency with new federal regulations.

The cornerstone of New Jersey’s argument: That the state’s proposed regulations will actually preserve more of the summer flounder stock than the measures being put forth by the feds.

Tuesday’s call was closed to the press, but in a statement following the call NJDEP spokesperson Bob Considine described it as a “good discussion.” He added that New Jersey emphasized its plan would protect more breeding females, thus making a brighter outlook for the future of the fluke stock.

The showdown between NOAA and New Jersey fishermen has been building throughout the spring. On June 1, the Atlantic States Marine Fisheries Commission declared New Jersey to be out of compliance with fluke regulations.

The dispute is now being considered by NOAA Fisheries, and U.S. Secretary of Commerce Wilbur Ross, for a final decision. If the out-of-compliance finding is upheld, a moratorium on fluke fishing in New Jersey could be instated until the state returns to compliance.

For fish, the good and bad of warming ocean waters

June 19, 2017 — According to a recent study published in “Progress in Oceanography,” some fish species will thrive in warmer waters — and others, not so much.

Using a detailed climate model and historical observation data, researchers at NOAA and The Nature Conservancy modeled the shifting thermal habitats of over 50 species along the Atlantic coast, from North Carolina to the Gulf of Maine.

“So it’s basically a picture of the water temperature and the depths that individual species are most commonly associated with,” says lead author Kristin Kleisner, now a senior scientist at the Environmental Defense Fund’s Fisheries Solutions Center.

Ocean temperatures in the region are expected to increase 6.6 to 9 degrees Fahrenheit (3.7 to 5.0 degrees Celsius) by the end of the century, according to NOAA. For many species, like summer flounder, striped bass and Atlantic croaker, researchers found warming oceans could lead to increased habitat availability.

“Those are all species that are currently caught off the more southern portions of our coastline and they’re associated with warmer waters,” Kleisner says. “And these guys might do pretty well as climate changes and new areas of suitable thermal habitat open up for them.”

Kleisner is careful to point out that the study only considered water temperature and depth in its picture of thermal habitats. Other factors like ocean acidification could change the game for lobsters, for example, which otherwise stand to gain from warming waters. “That could be a pretty big wild card,” she says.

Meanwhile, for species like Atlantic cod, Acadian redfish and others found in northern coastal areas, the study’s picture “was not so rosy,” Kleisner says. That’s not to say these species won’t find suitable water temperatures in deeper waters, or further north, she adds — but their habitats may shift out of reach for some fishermen.

LoBiondo, NJ officials blast Trump’s offshore drilling proposal

June 19, 2017 — U.S. Rep. Frank LoBiondo, R-2nd, called a move by the Trump administration to conduct seismic testing in the Atlantic Ocean “barbaric” and “insane” during a press conference Monday.

Seismic air guns are used to find gas and oil pockets deep beneath the ocean floor. President Donald J. Trump signed an executive order in April aimed at expanding offshore drilling near the East Coast, and, earlier this month, five companies applied to conduct seismic testing — including in an area just south of Cape May.

Environmentalists, local politicians and tourism officials gathered Monday afternoon near the 30th Street beach in Avalon to signal their opposition to seismic testing and offshore drilling.

“We in Cape May County have a $6.3 billion tourism business,” Cape May County Freeholder Director Gerald Thornton said. “Now I want you to imagine an oil spill out there today, with this wind blowing on the beach.

“We can’t afford that, ladies and gentlemen,” he added.

During seismic testing, air is blasted into the ocean floor every 10 seconds for an extended period of time. LoBiondo said he attended an air-gun demonstration last year.

“The decibel level for this seismic air gun is up to 250 decibels.” LoBiondo said. “That would blow a human ear out.”

Industry groups say seismic surveys have been conducted in the United States and around the world for decades, with little adverse impacts. The National Marine Fisheries Service, or NMFS, the agency seeking the seismic testing permits, has said that air-gun operations would include measures to monitor and mitigate any harm to marine mammals.

Chris Oliver Appointed to Lead NOAA Fisheries

June 20, 2017 — Chris Oliver, the former Executive Director of the North Pacific Fishery Management Council, has the support of much of the commercial fishing industry. Earlier this year, over 55 companies and fishing organizations, including several National Coalition for Fishing Communities members, wrote to the Trump Administration in support of Mr. Oliver’s nomination.

The following release was published today by NOAA:

Today, Secretary of Commerce Wilbur Ross, with concurrence from the White House, named Chris Oliver Assistant Administrator for NOAA Fisheries. The Texas native assumed his new position on June 19, taking the helm from Acting Assistant Administrator Samuel Rauch who will return to his position as the Deputy Assistant Administrator for Regulatory Programs.

As the agency’s new Assistant Administrator, Oliver will oversee the management and conservation of recreational and commercial fisheries including some aspects of marine aquaculture, the preservation and maintenance of safe sources of seafood, and the protection of marine mammals, marine protected species, and coastal fisheries habitat within the U.S. exclusive economic zone. He will also manage an agency with a strong presence nationally with 4,800 people in five regional offices, six science centers, and 24 labs and fish stations in 15 states and U.S. territories.

Oliver most recently served as Executive Director of the North Pacific Fishery Management Council, a position he held for the past 16 years. He has been with the Council since 1990, also serving as a fisheries biologist and then deputy director. During his tenure as executive director he led the way on several cutting edge management initiatives, including development of limited access privilege programs and fishery cooperatives and catch share programs, the North Pacific’s comprehensive onboard observer program, numerous bycatch reduction programs, extensive habitat protection measures, commercial and recreational allocation programs, and coastal community development programs. He was also responsible for all administrative and operational aspects of the Council process, and lead staffer for legislative and international issues.

“I understand how important stakeholder involvement, transparency, and best available science are to making the right policy decisions and I plan to ensure those tenets of the Magnuson-Stevens Act are applied across the board while I am leading the agency,” he said. “I intend to rely heavily upon the regional expertise of the eight fishery management Councils and the associated NOAA Fisheries Regions and Science Centers, and to ensure they have the resources necessary to effectively tackle region-specific issues.”

Through his long-time participation in the Council Coordination Committee and various international regional fishery management organizations, Oliver gained extensive knowledge of the national and international fisheries issues facing the agency.

Originally from Rockport, Texas, Oliver was also a Research Associate at Texas A&M University from 1987-1990, working with federal and state agencies on management issues associated with Gulf of Mexico shrimp fisheries, giving him both personal and professional experience with fisheries in the Gulf of Mexico. He holds a BBA in Business Management and a Master’s degree in Fisheries Science, both from Texas A&M. Oliver enjoys many outdoor activities and is an avid hunter and fisherman. He and his wife Maggie of 34 years have two sons, Christopher and Nicholas.

“I look forward to leading NOAA Fisheries and working with our partners to rebuild U.S. fisheries and conserve and recover protected resources where necessary, promote domestic marine aquaculture production where appropriate, maintain our reputation for world-renowned science and analysis, and do so while maximizing fishing opportunities for the benefit of recreational and commercial fishermen, processors, and the coastal communities which depend on them for generations to come,” said Oliver.

TWO IMPORTANT WEST COAST GROUNDFISH STOCKS REBUILT

June 20, 2017 — The following was released by the Pacific Fishery Management Council:

Two important West Coast groundfish stocks that were formerly overfished have now been rebuilt.

Bocaccio and darkblotched rockfish, which are managed by the Pacific Fishery Management Council, were under strict rebuilding plans that have constrained West Coast fisheries for more than a decade. Bocaccio was declared overfished in 1999, and darkblotched rockfish in 2000; both were rebuilt well before their original target dates.

The Pacific Fishery Management Council is one of eight regional fishery management councils that manage ocean fisheries in the United States. Altogether, the Pacific Council manages more than 100 species of groundfish.

Managing groundfish fisheries under rebuilding plans has been an immense challenge for the Council and the National Marine Fisheries Service (NOAA Fisheries). These plans required sharp reductions in commercial and recreational fisheries targeting groundfish, which included widespread fishing closures through the establishment of Rockfish Conservation Areas off the West Coast and other measures. Since 2003, managing overfished species through area closures such as the Rockfish Conservation Areas has helped to reduce fishing impacts and rebuild overfished groundfish species.

In addition, the groundfish fleet has had to limit fishing for other more abundant species to avoid unintentional catch of the overfished stocks.

“The rebuilding strategies used to achieve this conservation success, coupled with favorable environmental conditions for groundfish productivity, have paid huge dividends in rebuilding our overfished groundfish stocks and resurrecting West Coast groundfish fisheries,” said Council Chair Herb Pollard.

The successful rebuilding of these species reflects the support and sacrifice of West Coast ports and fishermen who recognized the difficult actions and fishing cutbacks necessary to restore the stocks. The rebuilding of bocaccio and darkblotched rockfish will lead to increased harvest opportunities beginning in 2019.

“By working together, we’ve brought bocaccio and darkblotched rockfish back to where they will again be part of a sustainable West Coast groundfish fishery that creates renewed opportunity for the fishing fleet, as well as more options for seafood consumers,” said Barry Thom, Regional Administrator of NOAA Fisheries West Coast Region.

Between 1999 and 2017, ten West Coast groundfish stocks were declared overfished, as surveys documented their declining numbers. Pacific whiting, for example, was declared overfished in 2002. The Council, working with NOAA Fisheries and the fishing industry, reduced commercial harvests. Combined with strong reproduction and recruitment, the fishing cutbacks led to the rapid rebuilding of Pacific whiting by 2004. The Council and NOAA Fisheries developed rebuilding plans for the other nine overfished stocks—bocaccio, darkblotched rockfish, lingcod, canary rockfish, cowcod, Pacific ocean perch, widow rockfish, petrale sole, and yelloweye rockfish.

Lingcod was declared rebuilt in 2005, and widow rockfish in 2012. Both petrale sole and canary rockfish were declared rebuilt in 2015. Rebuilding plans remain in place for three remaining overfished species: cowcod, Pacific ocean perch, and yelloweye rockfish. New assessments for Pacific ocean perch and yelloweye rockfish will be reviewed this summer and may be adopted in September. Cowcod is expected to be rebuilt by 2019.

“The Council is a transparent, science-based, inclusive approach to fisheries management,” said Council Executive Director Chuck Tracy. “Our progress in rebuilding overfished stocks shows the effectiveness of this approach. West Coast fisheries are a model of sustainable resource management, and they will continue to provide healthy seafood, jobs, and support for coastal communities, as well as access to this resource for all Americans.”

Process

The bocaccio and darkblotched rockfish assessments were developed by scientists at NOAA Fisheries and were reviewed by the Council’s scientific advisory bodies.  NOAA Fisheries confirmed the stocks’ status as rebuilt on June 16.

Council Role  

The Pacific Fishery Management Council is one of eight regional fishery management councils established by the Magnuson Fishery Conservation and Management Act of 1976 for the purpose of managing fisheries 3‐200 nautical miles offshore of the United States of America coastline.  The Pacific Council recommends management measures for fisheries off the coasts of California, Oregon, and Washington.

NOAA Fisheries Announces New Voluntary Speed Restriction Zone South of Nantucket

June 20, 2017 — The following was released by NOAA:

NOAA Fisheries has established a voluntary vessel speed restriction zone south of Nantucket, MA established to protect an aggregation of three right whales sighted in this area on June 15, 2017. 

Mariners, please avoid or transit at 10 knots or less inside the area (map below).
