Right whale extinction threat is being overstated, lobstermen fear

April 9, 2018 — The math of protecting right whales from extinction is scary stuff: The stakes are high, scientific opinion varies and some rescue plans could make it impossible for lobstermen to earn a living.

Getting that math right matters when the futures of right whales and Maine’s lobster industry are so closely intertwined. Right whale numbers have dwindled to about 450 because of deadly ship strikes, fishing gear entanglements and low birth rates, while Maine’s lobster industry is the backbone of the state’s coastal economy, raking in about $434 million from landings in 2017 and generating another $1 billion for Maine in post-dock revenues.

“This will be the largest challenge for this industry,” said Commissioner Pat Keliher of the Maine Department of Marine Resources.

Those who fish for lobster in Maine and manage the fishery claim that their side of the whale story, and peer-reviewed species projections, are being lost in the extinction din.

Regulators claim they already have a right whale management plan in place and that it’s working. Despite the industry’s size, and the up to 3 million lobster traps in the water, no scientist or whale advocate has ever linked a whale death back to Maine’s lobster fishery, Keliher said. Dead whales have washed ashore in Maine, but they can swim for miles before they die, and carcasses can drift, too. No dead whale has ever been found in marked Maine ropes, officials say.

“None of the mortalities have any relationship back to the Maine fishery,” Keliher said Thursday at a Lobster Advisory Council session on right whale strategy.

In wake of menhaden quota increase, some states rejoice as others push back

April 9, 2018 — Changes to the menhaden quota allocation on the East Coast of the U.S.A. have been met by support from some states, while others are pushing back.

The Atlantic States Marine Fisheries Commission (ASMFC) decided in November 2017 to increase the menhaden catch limit from 200,000 metric tons to 216,000 metric tons for the 2018 and 2019 seasons. Menhaden typically are utilized for the high amount of omega-3 fats they contain, and their oils are used dietary supplements, animal feed, lipstick, and many other products. The fish also serves as bait for a number of commercial fisheries along the coast, particularly in the crab and lobster industries.

While the overall quota was increased, it was also redistributed. Some states, like Maine, saw their quotas jump enormously.

“Maine’s quota jumped to 2.4 million pounds (1 million kilograms) – 13 times the quota available in 2016 and 2017,” said Jeff Nichols, director of communications for the Maine Department of Marine Resources. “The number of harvesters that reported landings associated with Maine’s total allowable catch (TAC) in 2017 is too few to report because of confidentiality provisions in law. However, 17 vessels participated in the episodic event fishery and 13 in the incidental catch fishery, both of which are triggered once the TAC is met.”

An episodic event was triggered last year in Maine, allowing fishermen to catch far more than the typical quota. The Interstate Fishery Management Plan for menhaden allows the Atlantic Menhaden Management board to set aside one percent of the total allowable catch for “episodic events.”

“Episodic events are defined as any instance when a qualified state has reached its individual state quota, prior to 1 September, and has information indicating the presence of unusually large amounts of menhaden in its state waters,” said Max Appelman, fishery management plan coordinator for the ASMFC.

Elver prices soar to new heights amid shortage, Asian demand

March 30, 2018 — PORTLAND, Maine — The price of baby eels in Maine is soaring to record highs at the start of a season in which buyers expect to pay more for the valuable fish.

Baby eels, called elvers, are an important part of the worldwide Japanese food trade. Maine fishermen harvest them from rivers and streams so they can be sold as seed stock to Asian aquaculture companies.

The average price per pound to fishermen through the first week of the 2018 season was $2,608, the Maine Department of Marine Resources said Friday. The most elvers have ever sold for in a full season was $2,172 per pound, in 2015, and they sold for a little more than $1,300 per pound last year.

Fishermen in Maine, which has the only significant elver fishery in the U.S., are poised for high prices this year because of a poor harvest in Asia. The early part of Maine’s season has been held back somewhat by bad weather, but harvesters are looking forward to a good year, said Darrell Young, co-director of the Maine Elver Fishermen Association.

“Hoping that when there’s eels around, they fight over them,” Young said. “When mother nature decides she wants to turn around.”

The season opened March 22, and fishermen had about 95 percent of their 9,688 pound quota remaining through Thursday evening, the state marine agency reported on its website. The season runs until June 7, and the first week was somewhat slow, which fishermen expected at the end of a cold winter.

Scallop fishermen near end of season

March 21, 2018 — PEMBROKE, Maine — The Maine scallop fishing season opened during the first week of December and now, with two weeks or less remaining, reports on how good a season it has been are decidedly mixed.

On the good side of the ledger, there seemed to be plenty of scallops, often in places where none have been seen for years, Melissa Smith, who coordinates scallop management for the Department of Marine Resources, said last week.

With the season ending for draggers on March 29 along the Downeast coast (divers get six more days between March 30 and April 14), Smith said, only one of the seven rotational management zones that were open to fishing at the start of the season has been fully closed to fishing. Last year as the season ran down, only two of the seven rotational areas open at the season’s start remained fully open at its end.

“While emergency closures are still occurring each season,” Smith said in an email, “we’re observing that more harvestable area is remaining open during the season.”

The extended openings and “the expansion of harvestable scallops back to traditional beds,” she said, are indicators of the growth of the growth of the scallop resource in inshore waters.

According to Portland scallop dealer and former resource manager at DMR Togue Brawn, “they’re finding some nice pockets of big stuff still, which is a good indicator that the measures we put in place years ago are working.”

Without the closures and limits, the little “bump” in scallop population that occurred naturally “would have been just that. Guys would have found some nice patches and wiped them out. Now we’ve got something that could last.”

If there are more harvestable scallops around, their abundance may not be benefiting the pocketbooks of Maine’s fishermen.

Maine fleet keeps an even keel despite lower lobster landings

March 7, 2018 — As expected, Maine lobster landings dropped in 2017. The fleet landed 110.8 million pounds, a 16 percent decline in volume from 2016’s 132.5 million pounds, according to preliminary data released my the Maine Department of Marine Resources.

Value was down as well, by $106 million from 2016’s all-time record value of $540.4 million to $433.8 million (the average price per pound dropped from $4.08 to $3.91).

Despite marking the largest single-year decline in the fishery’s history, the 2017 season still ranks as the sixth highest volume and fourth highest value in the state’s history.

The season also marks the seventh year in a row with landings over 100 million pounds, which had never happened prior to 2011.

“The past year has underscored what I’ve been saying for years now — that change is inevitable and we must be prepared,” DMR Commissioner Patrick Keliher said in a press release. “This year’s decline in lobster landings is by no means a signal that the sky is falling. But it does highlight the need to make sure our management measures adapt to change. This is true for all fisheries. It is the best way to ensure resilience of our marine resources and opportunity for future generations.”

Zooming in on Maine’s lobster zones, the most significant landings decline came in Zone F, where lobstermen caught 25 percent less than the previous year, catching 10.95 million pounds compared to 2016’s haul of 14.67 million pounds. Landings dropped about 17 percent in Zones C, D and G; 15 percent in Zone E; 13 percent in Zone A; and 12 percent in Zone B.

Portland Press Herald: Time for Maine to look past lobster boom years

February 2, 2018 — There is an economic principle that’s usually attributed to Herbert Stein, who worked for the Nixon administration and The Wall Street Journal.

Stein’s law: If something can’t keep going forever, it won’t.

Maine’s lobster industry is near the peak of a historic boom, making it the state’s most lucrative fishery. In the last 30 years, lobster landings have increased from 20 million pounds a year to 130 million. No one expects the catch to keep growing forever. The question is not whether it will decline, but when.

Scientists from the Gulf of Maine Research Institute, the University of Maine and the National Oceanic and Atmospheric Administration have applied computer modeling to that question and have proposed an answer. In a report issued last month, they identified 2014 as the peak of the lobster population and predicted a long, slow decline of 40 to 62 percent by 2030, with the catch returning to levels in line with what was seen in the 1990s.

The Maine Department of Marine Resources has disputed the study and questioned the value of its computer models. Since no one was able to predict the historic rise in the lobster population, Commissioner Patrick Keliher said, he doubts the ability of scientists to accurately predict their decline.

He’s right, but there is plenty of reason to take this report seriously and use it as a planning tool. There’s a lot we can’t know about the future, but what we know about what’s happening in the present supports the report’s predictions.

Maine Fisheries Officials Oppose New Lobster Catch Data Requirements

January 17, 2018 — ELLSWORTH, Maine — SEAFOOD NEWS: The state’s top fisheries official says Maine lobstermen should not be subjected to stricter requirements for reporting their catch to federal regulators.

Patrick Keliher, commissioner of Maine Department of Marine Resources, also said he is confident he can convince the Atlantic States Marine Fisheries Commission to drop the idea.

The interstate fisheries commission is considering a proposal that would require all Maine lobstermen to file daily summaries of how much lobster they catch, how their fishing gear was configured, and where it was set, among other details. Now, each year Maine randomly selects 10 percent of all licensed lobstermen — roughly between 700 and 800 — to report much of the same information. But in addition to 100 percent reporting, the commission also is leaning toward requiring more specific data about where lobster gear is set, which many lobstermen consider a confidential trade secret.

The data help regulators estimate how many lobster are off the East Coast, how much gear is involved in the fishery, where and how often it is used, and how lobster fishing might overlap with other marine activities or otherwise impact the marine environment. The commission feels Maine’s data is insufficient and that its policy is unfair to other states, which require all of their lobstermen to file such reports.

Maine lobstermen, who like other fishermen generally distrust government oversight, overwhelmingly dislike the idea.

At a meeting on the topic Thursday night at the local high school, Keliher asked approximately 50 fishermen to raise their hands if they supported the proposal. None of them did.

Keliher said he understands their trepidation.

For one, the change would cost the state hundreds of thousands of dollars a year to implement, he said. Plus, the data that Maine already collects can be adjusted to give regulators the kind of broad information they want.

He told the group that he will recommend to the commission that Maine instead continue its current practice for catch reports.

“That’s what I’m going to argue for when I go down to D.C.,” next month, he said at the meeting.

Many also see a mounting need for documenting the impact of lobster fishing along the East Coast, especially in federal waters, where more and more of the ocean is being eyed for various uses. Both trans-Atlantic shipping and cruise ship traffic in the Northeast have expanded significantly in recent decades. More recently, interest has soared in ocean energy development projects such as offshore wind farms, liquefied natural gas terminals and possibly oil drilling. Conservation measures to protect whales, corals, declining fish populations and marine habitat also have risen.

Many fishermen acknowledge that increased scrutiny and interest in both marine activities and conservation means they will have little choice but to provide fishing data to regulators. But some argue that better information, rather than just more, can address the need for reliable data without placing undue burdens on Maine fishermen or on the state.

“If you don’t have information, you can’t make good decisions,” said Trescott lobsterman Bill Anderson.

Maine also should try to increase the amount of data it collects on lobster fishing in federal waters, roughly more than three miles out, because that is where the overlap in designated marine uses is increasing the most, he added.

Keliher agreed with Anderson’s points. He said Maine would stop collecting reports from inactive license holders who have no worthwhile data to share and from non-commercial license holders, who fish far fewer traps and less often than commercial fishermen.

The commission is accepting public comment on the proposal until 5 p.m. Monday, Jan. 22. It has not set a timeline for implementing the changes.

Maine objects, but regulators vote to keep shrimp fishery closed for 2018

November 30, 2017 — Regional fisheries managers voted Wednesday to keep Maine’s commercial shrimp fishery closed for another year amid assessments showing record-low numbers of shrimp in the Gulf of Maine.

The northern shrimp section of the Atlantic States Marine Fisheries Commission opted to extend for a fifth year, through 2018, the moratorium on shrimp fishing in northern New England to allow depleted stocks to rebuild. Fishermen and Maine’s representatives on the shrimp panel had been pushing for a modest commercial fishery – ranging from 500 to 2,000 tons – but failed to convince their counterparts from Massachusetts and New Hampshire.

“After 40 years in this business, I know that Mother Nature has a remarkable ability, if we leave the spawning stock in the water, to recover,” said Mike Armstrong, the Massachusetts Division of Marine Fisheries representative to the panel. “I’m not convinced that is going to happen … but I want to give this stock a chance to recover for a few more years.”

The decision frustrated Commissioner Patrick Keliher of the Maine Department of Marine Resources, who responded by saying Maine would not participate in the planned 13.3-ton “research set-aside” fishery for shrimp.

Maine: Scallop farm first of its kind in local waters

November 30, 2017 — Just about one year after father-and-son fishermen Marsden and Bob Brewer returned from Japan, where they learned new scallop-farming techniques firsthand, Bob Brewer was granted a 3.23 acre experimental aquaculture lease southwest of Andrews Island. It is the first scallop farm of its kind in Penobscot Bay.

The Brewers can grow up to 200,000 Atlantic sea scallops using lantern nets, where mesh nets, each 10 floors deep, hang from a 600-foot longline.

“It’s a big circular tube with floors,” Bob Brewer said. “They’re used in Japan. That’s where we learned how to do it.”

Brewer grows the scallops from seed, caught in spat bags while he and Marsden are out lobstering.
