Legislation Introduced to Reform Seasonal H-2B Guest-Worker Program

November 9, 2015 — Legislation has been introduced in the House of Representatives to reform the H-2B seasonal guest-worker program. H.R. 3918, the Strengthen Employment and Seasonal Opportunities Now Act also known by its acronym the SEASON Act, will reform the guest-worker program used by American employers to hire foreign workers for temporary and seasonal work, such as forestry, seafood processing, and other industries.

Introduced by House Small Business Committee Chairman Steve Chabot from Ohio, House Judiciary Committee Chairman Bob Goodlatte of Virginia, Congressman Andy Harris of Maryland, and Congressman Charles W. Boustany, Jr., MD of Louisiana, the SEASON Act is designed to bring needed reforms to the H-2B program in order to protect American workers, help U.S. employers who play by the rules hire seasonal guest-workers, save taxpayer dollars, and ensure the H-2B program is truly a temporary, seasonal guest-worker program.

“New regulations for the H-2B visa program issued by the current Administration are increasing the red tape and creating higher costs for the small and seasonal businesses using the H-2B program,” said Gulf Seafood Institute member Frank Randol, owner of Randol’s Restaurant and a shellfish processor who depends on guest-worker labor. “Many of our Gulf seafood processing plants were unable to open in 2015 due to a lack of labor. The industry will struggle to survive if they have a second year without these workers. This legislation is desperately needed.”

From croaker to clams: Commercial fishing in Ocean City

November 8, 2015 — Ocean City is home to a substantial commercial fishing fleet that works our surrounding waters to harvest marketable resources from clams to swordfish.

Visitors to the resort can see the commercial boats tied up at the West Ocean City harbor and some might wonder what they fish for and how. The following is a short description of a few of the commercial fishing operations that go on around Ocean City.

Local “trawlers” are typically large steel or wood hulled fishing boats that pull trawl nets across the bottom and catch a variety of fish such as flounder, striped bass, croaker, sharks, bluefish, squid, rays, horseshoe crabs and anything else they might scoop up in their net. Also known as “draggers,” these boats can sometimes be seen working the waters just a mile or two from the beach.

Another type of trawler sometimes seen by fishermen 30-40 miles offshore are those that drag nets for scallops which are clam-like critters that lay on top of the sea floor. As soon as the scallops are brought up on deck they’re taken to a little shucking shed on the stern or side of the boat, where they’re opened and the edible meat removed.

Clams are caught both offshore and in the bay. The big, chowder-type clams are taken in the ocean by huge steel-hulled boats that pull a large metal dredge across the bottom. Water is pumped down from the boat to the front of the dredge and used to blast away the mud and sand the clams are buried in, and then the dredge scoops them up.

ASMFC Horseshoe Crab Board Sets 2016 Specifications for Horseshoe Crabs of Delaware Bay Origin

November 5, 2015 — ST. AUGUSTINE, Fl. – The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic States Marine Fisheries Commission’s Horseshoe Crab Management Board approved the harvest specifications for horseshoe crabs of Delaware Bay origin. Under the Adaptive Resource Management (ARM) Framework, the Board set a harvest limit of 500,000 Delaware Bay male horseshoe crabs and zero female horseshoe crabs for the 2016 season. Based on the allocation mechanism established in Addendum VII, the following quotas were set for the states of New Jersey, Delaware, Maryland and Virginia, which harvest horseshoe crabs of Delaware Bay origin:

The Board chose a harvest management program based on the Technical Committee and ARM Subcommittee recommendation. The ARM Framework, established through Addendum VII, incorporates both shorebird and horseshoe crab abundance levels to set optimized harvest levels for horseshoe crabs of Delaware Bay origin. Previously the horseshoe crab abundance estimate was based on data from the Benthic Trawl Survey conducted by Virginia Polytechnic Institute, however, due to the Benthic Trawl Survey not having been conducted in recent years, a composite index of the Delaware 30ft Trawl Survey, New Jersey Delaware Bay Trawl Survey, and New Jersey Ocean Trawl Survey was used instead. Funding has been secured for the Benthic Trawl Survey to be conducted in 2016.

The Horseshoe Crab Technical Committee, Delaware Bay Ecosystem Technical Committee, and the ARM Subcommittee also recommended the ARM Framework be reviewed and updated in 2016. The Board agreed with this recommendation, with specific interest in re-considering the thresholds to allow the harvest of female horseshoe crabs, as well as the recent listing of red knot as a threatened species under the Endangered Species Act by the U.S. Fish and Wildlife Service. The ARM subcommittee will develop specific recommendations to the Board on changes to the ARM Framework in 2016.

‘Ghost fleet’ offers treasure trove of wildlife, history in the Potomac

November 2, 2015 — NANJEMOY, Md. — Hidden beneath the waters of the Potomac River are dozens of sunken ships known as a “ghost fleet” that sailed from the Revolutionary War to after World War I, and now, thanks to the Chesapeake Conservancy, the public can experience these underwater ships and the unique ecosystem that has grown around them from their desktops.

The conservancy has teamed up with Terrain360, a Richmond, Virginia, company, to take panoramic shots of Mallows Bay and the more than 100 shipwrecks located there, piecing them together to create a virtual tour of the bay that you can find here.

The bay, tucked along the shores of the Potomac River in Charles County, Maryland, is home to the largest collection of historic shipwrecks in the Western Hemisphere. But the sunken ships have also created a marine habitat full of fish, birds and other wildlife, which the conservancy hopes to protect.

Visitors to the bay will spot an engine rising from the mist. Trees growing from the hull of a sunken ship seem to form an island that’s shaped like a ship. And the rusty hull of another ship can be seen rising above the waterline further out from the shore. Nearby is a menhaden fishing boat dating to the 1940s that was used during World War II.

MARYLAND: Down year seen for oysters

October 8, 2015 — Watermen dredging the muddy bottom of the Chesapeake Bay and its tributaries for oysters may not haul in the bounty that some recent years have produced, the Maryland Department of Natural Resources cautions as a new season gets underway.

“We’ve had good harvests the last couple years,” said Chris Judy, the department’s shellfish division director. But “we will no longer enjoy the spotlight on our oysters because other oysters are going to enter the market in a stronger way this year.”

The season kicked off Oct. 1, as it always does, but largely in name only. The same nor’easter that chewed at Delmarva’s beaches and rained out a weekend of activities at the beginning of the month kept most watermen off the water. But they were out in force after the skies cleared.

“It looks like we got the whole state of Maryland working on one bar off Tangier Island,” said Greg Price, a waterman based out of Chance in Somerset County. “I counted 55 boats this morning.”

Those freshly caught oysters are already finding their way into refrigerator cases.

“At first it was a little dreary because of the storm, but we’re booming now,” said Miranda Taylor, manager of Ocean Highway Seafood and Produce in Pocomoke City.

Chesapeake waters are warming, study finds, posing challenges to healing bay

October 14, 2015 — The Chesapeake Bay’s waters are warming, in some places more rapidly than the region’s air temperatures, researchers from the University of Maryland say. If unchecked, scientists say, the trend could complicate costly, long-running efforts to restore the ailing estuary, worsen fish-suffocating dead zones and alter the food web on which the bay’s fish and crabs depend.

Drawing on remote sensing by satellites, researchers at Maryland’s Center for Environmental Science found that water temperatures have risen since the 1980s across more than 92 percent of the Chesapeake and its river tributaries. The study appeared in the October issue of the journal Remote Sensing of Environment.

The increase averaged nearly 1.2 degrees Fahrenheit per decade, according to Andrew J. Elmore, co-author of the study and a geologist at the center’s Appalachian laboratory in Frostburg.

Baltimore and other parts of the bay showed up as “hot spots,” with warmer water than surrounding areas. Elmore and his co-author, Haiyong Ding, a visiting scholar from China, say the heat anomalies appear to be linked to spreading urbanization and to warm-water discharges from power plants.

“In the case of power generation, we’re deliberately increasing the temperature of water,” Elmore said. “With urbanization, it’s not intentional, but it’s an effect.”

No Atlantic Monument, but New Marine Reserves Announced at Chile Conference

October 5, 2015 — President Barack Obama declared new marine sanctuaries in Lake Michigan and the tidal waters of Maryland on Monday, while Chile blocked off more than 200,000 square miles of the Pacific Ocean near the world-famous Easter Island from commercial fishing and oil and gas exploration.

The announcements came as top officials, including U.S. Secretary of State John Kerry, attended an international conference on marine protection in the Chilean port city of Valparaiso. Several nations also outlined plans for tracing seafood imports to combat overfishing and stemming increased pollution in the ocean.

The new protected waters in the United States are the first to be designated as such in 15 years, the White House said in a statement.

The 875-square mile area of Wisconsin’s Lake Michigan extends from Port Washington to Two Rivers, containing a collection of 39 known shipwrecks. Fifteen are listed on the National Register of Historic Places.

The Mallows Bay-Potomac River in Maryland encompasses a 14-square mile area of the tidal Potomac River next to Charles County. Nearly 200 vessels, some dating to the Revolutionary War, are found in the largely undeveloped area that provides habitat for endangered species of wildlife and fish.

Virginia, Maryland legislators fighting fake Chesapeake Bay blue crab meat

September 16, 2015 — A group of federal legislators from Virginia and Maryland urged the White House this week to do more to curb the mislabeling of Chesapeake Bay blue crab.

In a letter Monday, U.S. Sens. Mark Warner and Tim Kaine and Rep. Rob Wittman from Virginia and Sen. Barbara Mikulski from Maryland applauded President Barack Obama for launching the Presidential Task Force to Combat Illegal, Unreported, and Unregulated Fishing and Seafood Fraud earlier this year.

But, they said, its draft recommendations don’t go far enough to protect area watermen from dishonest people willing to import foreign crabmeat and repackage it as Atlantic or Chesapeake Bay blue crab.

Federal agents are investigating allegations that Casey’s Seafood Inc. in Newport News did just that. No charges have been filed in connection with the case, but DNA tests on several of Casey’s Seafood products contained mixtures of Atlantic blue crab and cheaper alternatives native to foreign waters. All of the products were labeled “Product of the USA.”

“This deceptive labeling misleads consumers and threatens the livelihood of the watermen in our states,” reads the letter, which indicates Virginia’s blue crab fishery generates nearly $30 million in total fishing revenue for watermen each year. Maryland’s blue crabs generate over $58 million annually.

Maryland DNR Creates New Position to Give Seafood Industry More Input

July 29, 2015 — EASTON MD — Former Queen Anne’s County commissioner and waterman George O’Donnell has been brought onto the Department of Natural Resources’ payroll as a seafood industry and fisheries stakeholders liaison, of sorts.

O’Donnell has been in the position since July 8, and according to Maryland Watermen’s Association President Robert T. Brown, he’s already been working with the commercial industry to find solutions to their issues.

“We’ve finally got a friend up there,” Brown said.

O’Donnell’s official title at DNR is the fisheries customer relations manager.

It’s an outreach position to ensure that fisheries stakeholders’ views are communicated to state departments and policymakers for consideration.

“The administration believes that through outreach a better understanding can be reached to benefit the user groups as well as our marine resources,” O’Donnell said.

O’Donnell said that Gov. Larry Hogan, in his quest for the state government to provide better “customer service” to the people of Maryland, wants to make sure that any industry area of the state that feels underserved has a voice in Annapolis.
