‘Just short of a crisis’: Tensions flare as Virginia halts oyster seed harvest in James

December 17, 2018 — Virginia fishery managers are taking the rare step of halting oyster seed harvests in the lower James River as they seek to protect the baby bivalves from overfishing.

Oyster seeds are wild-grown juvenile oysters, or “spat.” Many oyster farmers working in the Chesapeake Bay and its tributaries depend on regular shipments of fresh seed to replenish their lease areas.

The Virginia Marine Resources Commission expects to temporarily stop the catch before the season’s scheduled closure at the end of the year. Without the action, watermen almost certainly would surpass the fall quota of 40,000 oyster seed bushels taken from the river, officials said.

The commission also agreed to block out-of-state seed transfer permits, effective Oct. 31. Between half and two-thirds of the seeds collected from the James are typically sold to Maryland buyers, according to the commission, which will decide whether purchases can resume in the spring based on fall surveys of the river bottom.

The moves come after the commission cut off last year’s spring harvest — when as many as 80,000 bushels were up for grabs — with about a month left to go. That marked the first time since the cap was enacted in 2011 that the commission called on watermen to hang up their hand tongs.

“Basically, the quota did what it was supposed to do,” said Andrew Button, head of the commission’s oyster conservation and replenishment department. “It’s not really to limit anybody but a way to protect the resource.”

Healthy fisheries and aquatic grasses fuel Chesapeake Bay recovery

June 19, 2018 — Booming aquatic grasses and bellwether fisheries are driving sustained progress in Chesapeake Bay health, which experts say is finally showing “significant” overall improvement.

The 2017 Chesapeake Bay Report Card issued by Virginia and Maryland rates the estuary a C for the third straight year as recovery holds steady or improves in five of seven indicators, the James River nails a B- for the first time and the fisheries index scores its first-ever A+.

Experts call their assessment “important evidence that the positive trend in ecosystem health is real” and that cleanup efforts across the watershed are working.

“It is the first time that the … scores are significantly trending in the right direction,” said Bill Dennison at the University of Maryland Center for Environmental Science in a statement Friday. “We have seen individual regions improving before, but not the entire Chesapeake Bay.”

The UMCES compiled the report card along with the Virginia Institute of Marine Science in Gloucester Point, the Virginia Department of Environmental Quality and other governmental agencies and academic groups both in this state and Maryland. This is the 12th year of its release.

The fisheries index is comprised of the average score for blue crab, striped bass and bay anchovy indicators. These species are considered ecologically, economically and socially important to the bay.

Last year’s fisheries index was 90 percent. This year, it rose to 95 percent, the highest ever recorded for the annual reports — the average of 100 percent for striped bass and blue crab, and 84 percent for bay anchovy.

Researcher studies effects of microplastics on the ocean

June 12, 2018 — Anyone who has ever struggled with knowing which plastic items they can or cannot place in their recycling bin will appreciate the complex task facing Professor Rob Hale and his students at William & Mary’s Virginia Institute of Marine Science.

Hale began studying plastics in the 1990s after he and Marine Scientist Mark La Guardia discovered high levels of flame retardants in fishes from the James River. They quickly realized these compounds, added to household plastics to reduce their flammability, were somehow escaping their confines and entering the aquatic environment.

Subsequent groundbreaking research by Hale’s team and others revealed high levels of flame retardants in wastewater, e-waste sites, sewage sludges, soils, sediments, and indoor dust; as well as in minnows, earthworms, insects, birds of prey, deep-sea squid and other organisms. Related research—based on concerns that these chemicals persist in the environment and tend to accumulate up the food chain—revealed health impacts in both wildlife and people, and led to worldwide limitations on the use of the most troublesome flame-retardant compounds.

Hale’s early experience with plastics research has now poised his team for a leading role in addressing the most recent worry about plastics in the environment—the growing concern about the effects of microplastics in the ocean.

VIRGINIA: Endangered sturgeon’s return to James River could be hurdle for industry

Dominion seeking federal permit to ‘take’ protected fish after dead ones found in power plant’s water intake

November 17, 2017 — In the James River south of Richmond, endangered Atlantic sturgeon have become so common that observant spring and fall boaters are nearly guaranteed to see one breach. It’s hard to miss — a 6– or 7-foot fish exploding out of the water, as if shot from a cannon, wiggling for a split second in midair, then belly-flopping back into the river with a theatrical splash.

Long-lived and enormous — in its 60-year lifespan it can grow to 14 feet and weigh as much as 800 pounds — the Atlantic sturgeon was harvested to the brink of extinction in the late 1800s. But after a century of marginal existence, this prehistoric-looking fish, with its flat snout and rows of bony plates covering its back, is staging a steady but still fragile comeback in the Chesapeake Bay.

The sturgeon’s increased presence could complicate matters for industrial facilities that draw water from that same stretch of river. In one case, it already has.

After finding two dead sturgeon larvae and one adult in its water intake system in the fall of 2015, Dominion Virginia Power’s Chesterfield Power Station began seeking an “incidental take” permit from the National Marine Fisheries Service, which would allow the company to continue operating despite a potential impact to the endangered fish. In its application for the permit, Dominion estimated that up to 846 sturgeon larvae and maybe two adult fish per year could be trapped or killed in the intakes over the next decade.

The fisheries service, part of the National Oceanic and Atmospheric Administration, will determine in the coming months whether to grant Dominion’s Chesterfield plant a federal permit under an Endangered Species Act provision that allows private entities to “take” a given number of an endangered or threatened species in the process of conducting otherwise lawful operations.

Request for Comments: Application for Incidental Take of Atlantic Sturgeon in the James River, Virginia.

August 15, 2017 — The following was released by NOAA Fisheries:

We recently received an application from Dominion for an Endangered Species Act Section 10(a)(1)(B) Incidental Take Permit for activities associated with their Chesterfield Power Station along the James River in Chesterfield, Virginia.

We are considering issuing a 10-year permit to the applicant that would authorize take of endangered Atlantic sturgeon (Acipenser oxyrinchus oxyrinchus) from the Chesapeake Bay Distinct Population Segment (DPS) incidental to the withdrawal of cooling water from the James River and sampling required by the Clean Water Act.

Dominion’s application for an Incidental Take Permit, their draft habitat conservation plan, and our draft environmental assessment are all available at Regulations.gov for public review and comment.

Comments are due on September 13, 2017.

MARYLAND: More sturgeon turn up in Bay, raising new questions – and worry

July 13, 2016 — For years, scientists thought there might not be any native Atlantic sturgeon in the Chesapeake Bay. That idea changed in recent years, as biologists began netting hundreds of adults in the James River, and others began turning up in other tributaries.

Now, genetic analyses show the Chesapeake is home to at least two — and possibly more — distinct populations of the endangered fish.

DNA analysis shows that James River sturgeon and those recently found spawning next door in the Pamunkey River, a tributary of the York River, are not even particularly closely related, despite their geographic proximity.

The 138 Pamunkey fish sampled seem more closely related to what could be a third population farther up, and across, the Bay in the Nanticoke River where 15 adult fish have been caught — and released — the last two years.

It’s too early to say whether the sturgeon netted in the Nanticoke and its tributaries constitute a unique population, said Tim King, a fisheries biologist with the U.S. Geological Survey who did the genetic analysis. King said he would like at least 25–30 samples before offering a more concrete opinion about the Nanticoke sturgeon.

“It is way too early to draw any conclusions,” King said. “But it would seem that they are not James fish. They are genetically more similar to the Pamunkey fish than they are the James, but I am not willing to say that they are Pamunkey fish.”
