JOHN SACKTON: If it is Unethical in Thailand, It is Unethical in Hawaii Also

September 8, 2016 — SEAFOOD NEWS — Charlie Nagle said it best:  We “do not and will never knowingly source from vessels that mistreat their crew.” The Nagle family has been in the fish business on the Boston Fish Pier for 130 years.

The AP report on the imprisonment of foreign fishermen on Hawaiian vessels is a wake-up call.  No seafood buyer will tolerate abusive conditions for fishermen, whether the result of a legal loophole or not.

The US has been highly critical of Thailand, where abusive labor practices and human trafficking in the seafood industry earned worldwide condemnation and resulted in changes in laws and in close audits of the supply chain.

In New Zealand, documentation of abusive labor practices on offshore vessels led to changes in the law and requirements that crews on these boats be free from unfair labor contracts, be paid according to New Zealand laws, and through New Zealand bank accounts out of reach of the labor brokers who hired them.

Can we expect anything less in Hawaii?

The fishermen in question are hired overseas, brought to Hawaii by boat never having set foot in the US, and then kept onboard for months without any possibility of coming ashore while their vessels dock in Hawaii and California.  They are paid as little as $0.70 per hour.

The AP report says that “under the law, U.S. citizens must make up 75 percent of the crew on most American commercial fishing boats. But influential lawmakers, including the late Hawaii Sen. Daniel Inouye, pushed for a loophole to support one of the state’s biggest industries. It exempted Hawaiian commercial fishing boat owners from federal rules enforced almost everywhere else.

Thus the workers in Hawaii, who catch $110 million worth of seafood annually, are paid as little as 70 cents an hour. They are detained on boats by captains who are required by law to hold their passports. That potentially goes against federal human trafficking laws saying bosses who hold workers’ identification documents can face up to five years in prison.”

The Hawaiian tuna and mahi fleet has no excuse.  They can either find fishermen and pay them a US wage, or stop selling to most US markets.

It is simply not acceptable for buyers to express huge concern about fishery labor abuses in Thailand, and ignore those that legally take place in Hawaii.

The fact that these workers can’t come ashore due to lack of visas doesn’t excuse the practice of holding these men on vessels who have no opportunity to leave, nor any opportunity to change their work situation or demand higher pay.  All the condemnation of labor agents and traffickers that supply labor to Thai fishing boats applies to these vessels in Hawaii also.

Undoubtedly the AP story will lead to a change in laws.  But the seafood industry, including the Hawaii longline fleet, cannot wait until then.  They must reform this practice immediately, or shut down.  There is no middle ground.

How to Make Sure Your Fish Wasn’t Caught by Slaves

September 8, 2016 — For years, news outlets have been reporting on the systemic use of slavery in commercial fishing in places such as New Zealand and Thailand. With much of the industry’s byproduct ending up in the United States and Europe—according to a report in The Guardian, “The U.S., U.K., and E.U. are prime buyers of this seafood—with Americans buying half of all Thailand’s seafood exports and the U.K. alone consuming nearly 7 percent of all Thailand’s prawn exports.”—there’s a strong possibility that at some point, slave-caught fish has been served on a dinner plate near you. But thanks to blockchain, a technology best known as the basis for Bitcoin, soon there will be a new digital weapon to fight slave labor.

“We want to help support fish that is caught sustainably and verify these claims down the chain to help drive the market for slavery-free fish,” Provenance founder Jessi Baker told the Guardian. Provenance is an organization dedicated to socially responsible consumerism—it recently began piloting a blockchain program with the Co-Op Food group in the United Kingdom. “This pilot shows that complex, global supply chains can be made transparent by using blockchain technology.”

Currently, the only way to track the progress of seafood through the region’s supply chain is with paper records and tagged animals. According to the Guardian, the world’s biggest tuna exporter, the Thai Union, is all for utilizing blockchain technology. “Traceability—which allows us to prove that our fish is caught legally and sustainably and that safe labor conditions are met throughout the supply chain—is vital if we are to interest consumers in the source of their tuna,” the union’s director of sustainability Dr. Darian McBain told the paper.

Foreign Fishermen Confined to Boats Catch Hawaiian Seafood

September 8, 2016 — HONOLULU — Hawaii’s high-quality seafood is sold with the promise that it’s caught by local, hard-working fishermen. But the people who haul in the prized catch are almost all undocumented foreign workers, confined to American boats for years at a time without basic rights or protections.

About 700 men from impoverished Southeast Asian and Pacific Island nations make up the bulk of the workforce in this unique U.S. fishing fleet. A federal loophole allows them to take the dangerous jobs without proper work permits, just as long as they don’t set foot on shore.

Americans buying Hawaiian seafood are almost certainly eating fish caught by one of these workers.

A six-month Associated Press investigation found fishing crews living in squalor on some boats, forced to use buckets instead of toilets and suffering running sores from bed bugs. There have been instances of human trafficking, active tuberculosis and low food supplies.

“We want the same standards as the other workers in America, but we are just small people working there,” said fisherman Syamsul Maarif, who didn’t get paid for four months. He was sent back to his Indonesian village after nearly dying at sea when his Hawaiian boat sank earlier this year.

Because they have no visas, the men can’t fly into Hawaii, so they’re brought by boat. And since they’re not technically in the country, they’re at the mercy of their American captains on American-flagged, American-owned vessels, catching choice swordfish and ahi tuna that can fetch more than $1,000 apiece. The entire system contradicts other state and federal laws, yet operates with the blessing of U.S. officials and law enforcement.

“People say these fishermen can’t leave their boats, they’re like captives,” said U.S. Attorney Florence Nakakuni in Hawaii. “But they don’t have visas, so they can’t leave their boat, really.”

JOHN SACKTON: Oceana Uses ‘Study’ on Seafood Fraud to Push for More Traceability Regulation

September 8, 2016 — SEAFOOD NEWS — Oceana has released a new ‘study’ claiming that 20% of global seafood trade is mislabeled.

The study was not a scientific sampling, but instead an analysis of Oceana’s sampling of high-risk species in various countries such as escolar, pangasius, and hake.  They also had a high proportion of snapper and grouper samples, species where literally dozens of genetically distinct species are legally sold under one name.

However, the implication to consumers is that they should suspect that their McDonald’s pollock fillet could potentially be mislabeled.  It is not.

The seafood industry and the supply chain have focused increasingly on traceability in the past few years.

NFI says “mislabeling is fraud and fraud is illegal, period. We emphasize that NFI members are required to be members of the Better Seafood Board, the only seafood industry-led economic integrity effort. And NFI Member Companies are at the forefront of eliminating fish fraud.”

NFI suggests that Oceana would be far more effective lobbying for stronger enforcement of existing laws.

The report was released prior to an upcoming Our Oceans conference in Washington, and also to pressure the  Presidential Task Force on Combating IUU Fishing and Seafood Fraud to issue stronger recommendations.

The task force has proposed to require traceability for 13 species deemed to be at risk of IUU fishing and fraudulent labeling.  However, the requirements would only be for imports, and not apply to commerce within the US.

Oceana wants species scientific name traceability to extend to all seafood, period.  They hold up the EU traceability requirements for imports as a model, and say that this has helped reduce seafood fraud in Europe.  Yet at the same time they document numerous examples of mislabeling in the UK, Italy, Belgium and Germany and other EU countries (see map).

The fact is that importers still have little control over how restaurants menu their items.  Oceana admits this in a backhand fashion, saying in the report that the fraud numbers for Massachusetts are low due to the fact that most samples were from retail, and that retail stores generally label their products correctly.

Oceana is the NGO that ‘owns’ seafood mislabeling, relying on their mislabeling reports to get media attention. Other NGO’s have other brands.  The competition among NGOs for media attention, donations,  members, and activists can warp their approach to simple problems.  So for Oceana, DNA testing and labeling is the path to improved seafood sustainability.

Oceana recognizes that stronger fishery management and enforcement globally would eliminate overfishing and IUU fishing, but can’t make that case because it is indistinguishable from what is also being recommended by the global seafood industry, governments, the FAO, and all others with a stake in long-term seafood sustainability.

NOAA Training Aims To Stop Illegal Fishing within U.S. territories and International Waters

August 24, 2016 — In June the Port State Measures Agreement (PSMA) entered into force globally, marking a major milestone in the effort to combat illegal, unreported, and unregulated (IUU) fishing. To maximize the effectiveness of the PSMA, broad implementation is critical and international capacity building has become of the utmost importance. NOAA’s Office of Law Enforcement (OLE) stepped up to ensure domestic implementation of the operational provisions went forward as quickly as possible. The Office of Law Enforcement has also begun the important task of working with international partners on training and implementation as well.

NOAA has responsibility for enforcing marine resource laws of the United States and is the lead agency for enforcement of the PSMA. The Office of Law Enforcement was also tasked with providing technical assistance to other countries for the PSMA, under the President’s Task Force. So, they went to work on an implementation plan, as well as creating training modules for state, territorial, and international partners. Before the training was initiated in the U.S. territories, there was a three-day conference with staff from OLE headquarters, national training team and Pacific Island Division. In this meeting, national level training materials were refined and tailored to the specific needs of the Pacific Island Region as well as reviewed to ensure the modules were comprehensive, but as simple as possible.

“We wanted to make sure that the training material is easy to understand, yet covers all areas necessary to meet PSMA requirements,” said Deputy Special Agent in Charge Martina Sagapolu of OLE-PID. “We knew the implementation of PSMA will directly impact American Samoa because this is the main U.S. port where the foreign fleet delivers its catch daily. The (Pago Pago) port sees all sizes of FFV and the inspection process under PSMA is arduous. Ensuring the training material was simple yet straightforward is critical for our partners.”

After the conference, training commenced — first with American Samoa, then Guam.

“The training was extremely beneficial to all involved,” said Special Agent Todd Dubois, Assistant Director of Operations for the Office of Law Enforcement. “The American Samoa Department of Marine and Wildlife Resources officers that participated in the workshop were very receptive to the implementation training. There were numerous discussions that highlighted the importance of information sharing, collaborative enforcement efforts and thorough vessel inspections to further promote PSMA compliance and combat IUU fishing.”

New online trawler tracking tool aims to help end overfishing

August 19, 2016 — Anyone with internet access and a passion for seafood will soon be able to track commercial fishing trawlers all over the world, with a new tool that its developers hope will help end the overfishing that has decimated the world’s fish stocks.

Millions of people depend on fish to survive, and fish will be vital to feeding the world’s growing population that is predicted to reach 9.7 billion people by 2050, the United Nations says.

But overfishing has diminished fish stocks, and illicit fishing is threatening people’s access to food in many poor countries, according to the United Nations.

“We currently have around 450 million people globally who get their primary source of food from the ocean. This is 450 million meals a day under threat,” said Lasse Gustavsson, executive director of Oceana in Europe on Wednesday.

“To solve the overfishing problem, including illegal fishing, we want to create transparency in the oceans,” Gustavsson told the Thomson Reuters Foundation from Madrid.

Is That Real Tuna in Your Sushi? Now, a Way to Track That Fish

August 18, 2016 — “Most people don’t think data management is sexy,” says Jared Auerbach, owner of Red’s Best, a seafood distributor in Boston. Most don’t associate it with fishing, either. But Mr. Auerbach and a few other seafood entrepreneurs are using technology to lift the curtain on the murky details surrounding where and how fish are caught in American waters.

Beyond Maine lobster, Maryland crabs and Gulf shrimp, fish has been largely ignored by foodies obsessing over the provenance of their meals, even though seafood travels a complex path. Until recently, diners weren’t asking many questions about where it came from, which meant restaurants and retailers didn’t feel a need to provide the information.

Much of what’s sold has been seen as “just a packaged, nondescript fish fillet with no skin,” says Beth Lowell, who works in the seafood-fraud prevention department at Oceana, an international ocean conservation advocacy group. “Seafood has been behind the curve on both traceability and transparency.”

What’s worse is that many people have no idea what they’re eating even when they think they do. In a recent Oceana investigation of seafood fraud, the organization bought fish sold at restaurants, seafood markets, sushi places and grocery stores, and ran DNA tests. It discovered that 33 percent of the fish was mislabeled per federal guidelines. Fish labeled snapper and tuna were the least likely to be what their purveyors claimed they were.

Several years ago, Red’s Best developed software to track the fish it procures from small local fishermen along the shores of New England. Sea to Table, a family business founded in the mid-1990s with headquarters in Brooklyn that supplies chefs and universities, has also developed its own seafood-tracking software to let customers follow the path of their purchases. Wood’s Fisheries, in Port St. Joe, Fla., specializes in sustainably harvested shrimp and uses software called Trace Register.

And starting this fall, the public will be able to glimpse the international fishing industry’s practices through a partnership of Oceana, Google and SkyTruth, a nonprofit group that uses aerial and satellite images to study changes in the landscape. The initiative, called Global Fishing Watch, uses satellite data to analyze fishing boat practices — including larger trends and information on individual vessels.

Sea to Table hopes to sell fish directly to home chefs starting this year, too.

But local seafood can cost more than many Americans are accustomed to paying, which partly accounts for the rampant seafood fraud in this country.

“U.S. fisheries are very well managed and are actually growing nicely,” said Michael Dimin, the founder of Sea to Table. “But the U.S. consumer’s been trained to buy cheap food, and imported seafood is really cheap because of I.U.U. fishing.” I.U.U. stands for illegal, unreported and unregulated. The result is unsustainably fished, cheap seafood flooding American fish markets and grocery chains.

“To us, the secret is traceability,” Mr. Dimin said. “If you can shine a light on where it came from, you can make informed decisions.”

American Samoa Key To Combatting ‘Illegal, Unreported, And Unregulated’ Fishing

August 18, 2016 — PAGO PAGO, American Samoa — With the United States a signatory to an international agreement to combat IUU — illegal, unreported, and unregulated — fishing, American Samoa, home to two canneries and many fishing vessels, is now part of the agreement, which went into force on June 5 this year.

According to the US National Oceanic and Atmospheric Administration (NOAA), the Port State Measures Agreement does not solely focus on IUU fishing vessels, but also requires action against vessels that engage in supportive activities such as refueling or transshipping fish from IUU fishing vessels at sea.

Adopted in 2009 by the UN Fish and Agriculture Organization (FAO), the Agreement identifies measures to block the entry from ports of IUU-caught fish into national and international markets.

For the US, the NOAA Office of Law Enforcement (NOAA-OLE) is charged with enforcing the Agreement, which according to the federal agency, applies to foreign flagged fishing vessels carrying fish that have not been previously landed in a port.

Under other U.S. law (Nicholson Act), foreign flagged vessels cannot land these fish/fish products in U.S. ports, with the exception of ports within U.S. territories. Because of this, the most significant impact will be seen in the US territories of American Samoa and Guam.

“The… Agreement is the most significant legislation passed in nearly 40 years and American Samoa is at the center of this effort,” NOAA-OLE special agent Murray Bauer told Samoa News yesterday.

Flocking to Robben Island: Tourists by Day, Poachers by Night

August 16, 2016 — Robben Island in South Africa is getting to be notorious again — and this time it’s not for racial oppression.

The apartheid-era prison on the island is now a tourist attraction, where visitors from around the world pause with reverence outside the cell where Nelson Mandela was kept. The ferry ride back to the mainland merely deepens the sense of isolation that the inmates must have felt.

But the waters surrounding Robben Island, just off the coast near Cape Town, also happen to be among the richest in the world for delicious shellfish — especially abalone, which is highly prized in Asia. That has made the island a hot spot for shellfish poaching.

At night, when the island is closed to tourists, poachers in inflatable boats known as rubber ducks often make their way toward its rocky coastline and dive illegally in the shallows in search of the mollusks.

Money Lost To Illegal Fishing In Pacific Upwards Of $616 Million

August 16, 2016 — WELLINGTON, New Zealand — The money Pacific countries lose to illegal, unreported and unregulated tuna fishing in the region is estimated at $616 million, according to figures provided by the Forum Fisheries Agency.

Under an international agreement via the Western and Central Pacific Fisheries Commission, also known as the Tuna Commission, 34 countries including the United States have signed an agreement to stomp out IUU fishing.
