Biden administration turning attention to seafood’s labor issues

January 14, 2022 — The administration of U.S. President Joe Biden has released an action plan to combat human trafficking at home and abroad, an initiative that includes a focus on labor issues in the global seafood industry.

The U.S. Trade Representative National Action Plan to Combat Human Trafficking, released in December 2021, involves better coordination among American agencies as well as with other countries’ law enforcement bodies to track and prosecute human trafficking on fishing vessels and in onshore seafood processing facilities. Under the plan, the USTR will ramp up its efforts to encourage other countries to put in place bans on imports of goods made with forced labor.

US seafood associations respond to human trafficking task force recommendations

February 9, 2021 — Commercial seafood organizations have begun responding to a U.S. Justice Department task force report on human trafficking in international waters.

The report, nearly three years in the making, included 27 recommendations for the federal government to eliminate loopholes or strengthen policies. Some of those recommendations include the need for congressional legislation. Among this is a recommendation to create a temporary worker visa program that would ban “recruitment fees” paid by workers on American vessels that fish in international waters but deliver products in U.S. ports.

Hawaii Longliners Take Action To Fight Poor Conditions And Human Trafficking

February 8, 2021 — The Hawaii Longline Association says it welcomes the recommendations contained in two recent reports to Congress that outline ways the seafood industry can prevent labor abuse.

The longliners, which primarily target tuna and swordfish, faced intense scrutiny after a 2016 investigation by The Associated Press found a number of foreign crewmen working the vessels were living in squalid conditions and earning as little as 70 cents an hour.

Since then, Congress has called for more oversight of the national and international seafood industry, particularly when it comes to issues of illegal fishing and human trafficking.

Hawaii Longline Association Supports Federal Agency Recommendations Regarding Human Trafficking in the Seafood Supply Chain

February 4, 2021 — The following was released by the Hawaii Longline Association:

Human trafficking, including forced labor in fisheries and the seafood supply chain, has rightfully garnered attention in recent years. This unconscionable activity is not condoned by the Hawaii Longline Association (HLA) and other responsible fishing organizations, and has led to seafood industry-developed standards and social responsibility auditing mechanisms. Recent reports to U.S. Congress present government actions to further prevent and respond to such labor abuses including: 1) Department of Commerce and Department of State Report to Congress on Human Trafficking in the Seafood Supply Chain, Section 3563 of the National Defense Authorization Act for Fiscal Year 2020 (P.L. 116-92) and 2) Federal Agency Task Force on Human Trafficking in Fishing in International Waters.

“The Hawaii Longline Association commends the work of federal agencies to address this important topic and supports many of the recommendations made in these reports,” said HLA Executive Director Eric Kingma.

Paramount among the recommendations covering domestic fisheries is the development of a temporary visa program for foreign fishing crews. “Providing foreign crews temporary work visas, as recommended in the Task Force report, is an important measure that would benefit foreign workers in our fishery, allowing them to go home and visit family and friends and then return to Hawaii via air travel in an efficient, humane manner,” Kingma said.

Currently, foreign fishermen employed in the fishery are ineligible to obtain a visa and thus are prohibited from flying into Honolulu. Rather, these fishermen must board their employer’s Hawaii-based longline vessel in a foreign port (e.g., Mexico or Canada) or U.S. Territory (e.g., American Samoa) and transit nearly two weeks to Honolulu to begin their legal employment, which is authorized under U.S. law (46 USC 8103(2)(b). However, despite being legally employed to fish on U.S. vessels fishing for highly migratory species in the U.S. EEZ and high seas, without visas they are required to stay within the Honolulu Harbor port area. The only exception to leave the port area is for medical visits or to depart from Honolulu International Airport with permission from the U.S. Department of Homeland Security, Customs and Border Protection (CBP).

The majority of the 140 active longline vessels operating out of Honolulu Harbor have legally employed foreign crew for over 30 years. Like migrant farm and food processing workers employed across the nation, these skilled fishermen temporarily leave their countries to seek higher paying jobs in the United States, to support their families back home. Other U.S. tuna fleets that fish on the high seas also employ foreign crew, including U.S. distant water purse seine vessels, West Coast-based albacore vessels, and East Coast-based longline vessels. Hawaii longline crew are mainly from Indonesia, Philippines, Vietnam, and Pacific Island countries.

Hawaii Court Hears Case On Legality Of Foreign Fishing Labor

September 21, 2020 — The Hawaii Supreme Court heard arguments Friday on the legality of granting licenses to foreign workers in Hawaii’s longline commercial fishing fleet, which for years has been under scrutiny after an Associated Press investigation revealed claims of human trafficking and questionable labor practices.

The case involves the issuance of Hawaii state commercial fishing licenses to individual foreign fishermen who are not “lawfully admitted” to the United States.

State law says only those legally in the country can get licenses to catch and sell marine life, but the workers do not have visas to enter the U.S. so they are ordered to live onboard the fishing boats by federal officials. They must eat, sleep and work on the boats, often for years at a time, and are subject to deportation.

Friday’s hearing stems from a petition that was filed by a Native Hawaiian fisherman who sought to have the state enforce a statute that declares only people who are in the U.S. legally can acquire commercial fishing licenses.

The petition was denied by the Hawaii Department of Land and Natural Resources, which issues the permits, and a lower court upheld the ruling before the Supreme Court agreed to hear the case.

The human impact of organized crime in fisheries extends far beyond the ocean

September 1, 2020 — Despite the name, organized crime in fisheries is not only about fishing. While illegal fishing is a serious problem across many regions of the world, organized crime in the fisheries sector extends much farther. It occurs globally throughout the entire fisheries value chain: on-shore; at-sea; at the coastal interface; and in cyberspace. Regardless of where it occurs or how it happens, its harmful effects take a massive toll on human populations worldwide.

Organized crime in the fisheries sector can take various forms including drug and human trafficking, fraudulent catch documentation, money laundering and corruption — crimes that have potentially dire humanitarian implications. These crimes are profit-driven, diverting government revenue to the shadow blue economy at the expense of coastal communities and the pursuit of key sustainable development goals such as zero hunger, zero poverty and peace, justice and strong institutions. These crimes also directly can endanger those who are exploited in their perpetration.

People in many coastal nations, particularly developing countries, depend on the fisheries sector for food and jobs. Large ocean nations are particularly vulnerable to disruptions in the sector, as recently exposed by the impacts of COVID-19. Criminal networks operating in the fisheries sector exacerbate the economic dislocation of local coastal communities, threaten already tenuous food security and divert much-needed state revenue. But there is hope: effectively tackling organized crime in fisheries will help foster a sustainable ocean economy which, in turn, will benefit communities reliant on the ocean and its resources.

Oversight of fishing vessels lacking, new analysis shows

February 19, 2020 — Policies regulating fishing in international waters do not sufficiently protect officials who monitor illegal fishing, the prohibited dumping of equipment, or human trafficking or other human rights abuses, finds a new analysis by a team of environmental researchers.

“These fisheries observers risk their lives to watch over industrial fishing activities, and yet they are often not afforded sufficient legal safeguards,” says Jennifer Jacquet, an associate professor in New York University’s Department of Environmental Studies and a co-author of the study. “If we are serious about protecting ocean life, we must first put policies in place to protect fisheries observers.”

The analysis, co-authored with the nonprofit Greenpeace and the Association of Professional Observers, appears in the journal Marine Policy.

There are an estimated 2,500 observers globally, and in recent years many have been subject to human rights and safety violations, including intimidation, assault, and even murder or disappearance under suspicious circumstances. The researchers add that since 2010, at least seven fisheries observers have disappeared while monitoring fisheries under the authority of Regional Fisheries Management Organizations (RFMOs). Notably, very little information is available regarding the circumstances.

New film, “Buoyancy,” tackles issue of slavery in Thai seafood industry

August 19, 2019 — An Australian filmmaker is hoping that his debut feature film entitled, “Buoyancy,” will help to raise greater awareness of human trafficking and slavery on Thai fishing vessels.

Rodd Rathjen’s award-winning film highlights the plight of thousands of migrant Cambodian workers trapped in modern slavery in the Thai seafood industry. Shot in Cambodia in the Khmer and Thai languages, the film centers on the plight of an impressionable 14-year old Cambodian boy, who sets out to escape poverty by finding work in a Thai factory, but finds himself sold by a broker and enslaved on a fishing trawler. The result is a harrowing exposition of a reality that remains an issue for the Thai industry, despite ongoing efforts to combat it.

Bill to Address Trafficking in Seafood Supply Chain Introduced in U.S.

September 18, 2018 — U.S. Congresswoman Madeleine Z. Bordallo (D-Guam) introduced the “Human Trafficking and IUU Fishing Act” (H.R.6834) on Monday.

The bill, with Representatives Raúl M. Grijalva (D-AZ), Aumua Amata Coleman Radewagen (R-AS), and Suzanne Bonamici (D-OR) as original cosponsors, would add the Secretary of Commerce (NOAA Fisheries) to the President’s existing Interagency Task Force to Monitor and Combat Trafficking in Persons, in response to the growing prevalence of human trafficking, forced labor and human rights abuses within the global seafood supply chain.

In June 2018, the U.S. State Department’s Trafficking in Persons Report identified more than 40 countries with substantial human trafficking and forced labor across their seafood industries and supply chains. This is especially prevalent in southeast Asia and the south Pacific, where illegal, unreported, and unregulated (IUU) fishing is a widespread problem. Since 2016, U.S. Customs and Border Protection has detained 15 shipments of seafood processed illegally in mainland China by North Korean workers under forced labor.

A 2016 U.S. Intelligence Community report identified IUU fishing as a global security challenge, linked to human and narcotics trafficking.

Corporate Coordination Can Stop Seafood Slavery

April 4, 2017 — In 2015, media investigations revealed horrific occurrences of physical and emotional violence, human trafficking, and murder on fishing vessels and in shrimp processing facilities primarily in Southeast Asia. The stories sent shockwaves through the seafood industry, but despite efforts by several companies to combat these abuses, seafood slavery persists and will continue to erode consumer trust without a more comprehensive response. At a moment when many U.S. policymakers and ordinary citizens are voicing skepticism over U.S. participation in a globalized economy, now is the time for the international seafood industry to take robust and unified steps toward a transparent and traceable seafood supply chain.

The U.S. Department of State has identified seafood-related human trafficking in more than 65 countries over the past half-decade, many of which supply seafood to the United States, including major exporters such as Thailand, Indonesia, and Vietnam. The paths by which seafood from these countries enters the United States is complex and often opaque. There are numerous points along supply chains at which fish caught or processed using forced labor are mixed with responsibly caught fish—some occurring even before the fish first hit dry land. For example, vessels will often offload their catch onto a supply ship in exchange for provisions and fuel, where it commingles with fish from other vessels. This practice, known as transshipment at sea, allows fishing boats to stay offshore for months—or even years—at a time, keeping laborers from escaping from what amount to floating prisons.

The international seafood supply chain is composed of tens of millions of people moving 158 million metric tons of fish and shellfish annually. This complexity alone poses a serious obstacle to eliminating slave-caught seafood from the U.S. market. The solution is not as straightforward as simply refusing to buy fish from boats with slaves on board. And yet, despite the complicated nature of the problem, the industry must address these abuses. The United States is the second-largest seafood importer after the European Union, and U.S. importers and retailers have a crucial role to play in the global fight against trafficking in persons and other labor abuses.
