NOAA Fisheries Announces Changes to the Current Seasonal Prohibition on Fishing with Black Sea Bass Pots and Gear Marking

December 29, 2016 — The following was released by NOAA:

The final rule for Regulatory Amendment 16 to the Fishery Management Plan for the Snapper-Grouper Fishery of the South Atlantic Region (Regulatory Amendment 16) will publish in the Federal Register on December 29, 2016.  Regulations for the reduced size of the prohibited area for fishing for black sea bass with pots are effective December 29, 2016.  Regulations for the enhanced gear markings are effective January 30, 2017.

Currently, fishermen may not fish with black sea bass pots from November 1 through April 30, each year, in the entire management area for black sea bass in the South Atlantic.  The seasonal prohibition was established in 2013 as a precautionary measure to prevent interactions between black sea bass pot gear and whales during periods of large whale migrations, and during the right whale calving season off the U.S. southeastern coast.  Regulatory Amendment 16 would retain a November 1 through April 30 seasonal prohibition but would reduce the size of the prohibited area.  The goal is to reduce the adverse socioeconomic impacts to fishermen resulting from the current seasonal prohibition while continuing to provide the necessary protection to large whales in the South Atlantic region.

The new seasonal prohibitions are below.  The prohibition shown in Figure 1 will apply annually during November and April.  The prohibition shown in Figure 2 will apply annually from December 1 through March 31.  The coordinates for the new area seasonal prohibitions can be found here.

Regulatory Amendment 16 will also require an additional 12-inch wide purple band in three locations on black sea bass pot lines.  The goal is to enhance current gear marking requirements for black sea bass pots to distinguish black sea bass pot lines from other fishing lines.  Currently, three 12-inch color marks at the top, midway, and bottom sections of the buoy line are required.  Effective January 30, 2017, an additional 12-inch wide purple band must be added at the end of each 12-inch colored mark, making each of the three marks a total of 24 inches in length.  The new gear marking requirements are required in the following areas and during the following dates:  from September 1 through May 31 in the Atlantic Large Whale Take Reduction Plan (ALWTRP) Offshore Trap/Pot Waters Area and Southern Nearshore Trap/Pot Waters Area, and from November 15 through May 31 in the ALWTRP Southeast U.S. Restricted Area North.  The areas and current gear marking requirements may be found here.

Draft Addendum XXVIII was initiated to consider alternative management approaches for the 2017 recreational summer flounder fisheries, while also seeking to address needed reductions due to a decrease in the coastwide RHL in 2017. In August, the Board and Mid-Atlantic Fishery Management Council approved a 30% reduction in the 2017 coastwide RHL relative to 2016. This action was taken in response to the 2016 Stock Assessment Update which found fishing mortality was higher in recent years and population estimates were lower than previously projected.

Changes in summer flounder distribution, abundance and availability have created problems under the static state-by-state allocations, with overages often occurring. In response, states would implement regulations to reduce harvest, resulting in differing regulations between neighboring states. In 2014, the Board shifted away from traditional state-by-state allocations to a regional approach for managing summer flounder recreational fisheries.  A benefit of the regional approach is it provides the states the flexibility to share allocations. The intent is to set regulations that account for shifting distribution, abundance and availability while providing stability and greater regulatory consistency among neighboring states, and enabling the states to meet but not exceed the coastwide RHL.

Anglers and interested stakeholders are encouraged to provide input on Draft Addendum XXVIII either by attending state public hearings or providing written comment. NOAA slashes recreational, commercial limits for flounder, black sea bass

December 27, 2016 — NOAA Fisheries is slashing 2017 and 2018 recreational and commercial catch limits for summer flounder and the 2017 commercial quota for black sea bass.

The sweeping cuts will impact both the commercial and recreational harvesting of the summer flounder. The cuts, based on the recommendations of the Mid-Atlantic Fishery Management Council, will be most severe in 2017, when the commercial and recreational quota for the species is cut by 30 percent from current levels.

Those reductions will set the set the commercial quota at 5.66 million pounds and the recreational at 3.77 million pounds in 2017.

The 2018 reduction summer flounder catch limits is projected to be 16 percent below current levels, setting the commercial quota at 6.63 million pounds and the recreational catch limits at 4.42 million pounds.

The federal fishing regulator is cutting the commercial black sea bass quota by 31 percent in 2017 to 1.86 million pounds as “an automatic accountability measure” because the fishery exceeded its annual catch limit in 2015.

“In 2015, the commercial annual catch limit was exceeded due to both a 4 percent overage of the commercial quota and higher-than-anticipated estimated discards of black sea bass,” NOAA Fisheries said in announcing the cuts.

The agency, however, said it is possible that a final report on the black sea bass stock assessment, due in early 2017, might provide the impetus for increasing recreational and commercial catch limits in the midst of the next fishing season.

“It is possible that the next black sea bass assessment will provide justification for increasing the 2017 black sea bass catch limits for both the commercial and recreational fisheries,” NOAA Fisheries said. “If that is the case, we will work with the (Mid-Atlantic Fishery Management Council) to quickly implement revised catch limits mid-year. A final report for the assessment is expected in early 2017.”

The 2017 recreational harvest limit for black sea bass will hold steady at about 2.82 million pounds, according to NOAA Fisheries spokeswoman Jennifer Goebel.

Mid-Atlantic Council Initiates Action in Response to Overage of Black Sea Bass Catch Limit

December 21st, 2016 — The following was released by the Mid-Atlantic Fishery Management Council: 

On December 15, 2016, at their meeting in Baltimore, Maryland, the Mid-Atlantic Fishery Management Council initiated a framework action to review and modify accountability measures (AMs) for the commercial black sea bass fishery. The Council initiated this action in response to new information from the National Marine Fisheries Service (NMFS) indicating that commercial catch in 2015 exceeded the annual catch limit due to higher than anticipated discards. On December 21, NMFS announced a rule which reduced the 2017 commercial quota by 34% in response to this overage, as required by the Council’s AMs.

AMs are measures that are implemented if annual catch targets are exceeded and are intended to mitigate the negative biological impacts of such overages. Commercial AMs for black sea bass currently require pound for pound paybacks through quota deductions in following years, regardless of the circumstances of the overages. The Council initiated a framework action to consider adding flexibility in the commercial AMs based on stock status. The Council intends to develop and implement this framework by mid-2017.

Black sea bass management measures for 2017 may also be modified as a result of a new benchmark stock assessment, which was peer-reviewed this month. According to this assessment, black sea bass are not overfished and overfishing is not occurring. The Council’s Scientific and Statistical Committee (SSC) will meet in January 2017 to review the assessment and determine if it can be used to inform the Council’s management decisions. If so, the SSC will recommend acceptable biological catch limits for black sea bass for 2017-2019. At their February 2017 meeting in Kitty Hawk, North Carolina, the Council plans to recommend commercial and recreational black sea bass catch and landings limits for 2017-2019 based on this new information. These recommendations are expected to result in a revised 2017 commercial quota that could reduce the magnitude of the reduction needed to address the overage of the 2015 annual catch target.

Legal Proceedings Preserve Fishing Industry Rights as New York Wind Energy Lease Sale Proceeds

December 15, 2016 — The following was released by the Fisheries Survival Fund:

Last week, a group of fisheries organizations, communities and businesses filed suit against the Bureau of Ocean Energy Management (BOEM), seeking a temporary restraining order to delay today’s auction of leasing rights to the proposed New York Wind Energy Area. The suit also sought a preliminary injunction to prevent BOEM from executing any resulting wind energy lease.

The plaintiffs allege that BOEM did not adequately consider the effect on the region’s fishermen of a 127-square-mile wind farm off the coast of New York and New Jersey.

Subsequently, a scheduling agreement was reached between the parties that allows the court to take adequate time to deliberate carefully on the case’s important issues. The plaintiffs agreed to withdraw their motion for a temporary restraining order that would have delayed the scheduled auction. Although the auction is proceeding today, under BOEM’s final sale notice for the auction, the lease will not be final until further steps, as outlined in the sale notice, are completed.

On Monday, Judge Tanya Chutkan of the United States District Court for the District of Columbia set a court schedule on the plaintiffs’ motion to preliminarily enjoin BOEM’s execution of any lease resulting from today’s auction. The schedule concludes with a hearing in Federal court on February 8.

Under Judge Chutkan’s order, if the lease is ready to be executed before the court is able to rule on the plaintiffs’ preliminary injunction motion, BOEM must provide the court no less than 14 days notice. If that notice is provided, the preliminary injunction proceedings will be expedited.

The Fisheries Survival Fund, representing the majority of the U.S. Atlantic scallop industry, is the lead plaintiff in the case. The lease area includes documented scallop and squid fishing grounds, which serve as essential fish habitat and grounds for other commercially important species, including black sea bass and summer flounder. It is also an important foraging area for threatened loggerhead sea turtles and critically endangered North Atlantic right whales.

Other organizations joining as plaintiffs include the Garden State Seafood Association and the Fishermen’s Dock Co-Operative in New Jersey; the Long Island Commercial Fishing Association in New York; and the Narragansett Chamber of Commerce and Rhode Island Fishermen’s Alliance.

Joining as plaintiffs are the City of New Bedford, Mass.; the Borough of Barnegat Light, N.J.; and the Town of Narragansett, R.I.

Also joining are three fishing businesses: SeaFreeze Shoreside, Sea Fresh USA and The Town Dock.

Marine Scientist Follows Hot Fish as They Move to Cooler Waters

November 30, 2016 — Warming oceans have fish on the move, and one man is in hot pursuit.

That man, Rutgers University marine biologist Malin Pinsky, has tracked fish species all over North American waters to learn where they’re headed in search of cooler conditions.

Recently, he’s seen lobsters nearly disappear from Long Island Sound, driven out by disease and a series of warm summers. The delicacies are thriving in the cooler Gulf of Maine, but that may be temporary: Water temperatures there are rising faster than anywhere else in the North Atlantic. Pinsky has also observed Black sea bass, traditionally plentiful off Virginia, start to relocate to the Gulf of Maine and the waters off the New Jersey coast. And out west, Pacific halibut and arrowtooth flounder in the eastern Bering Sea off Alaska have shifted north toward the Arctic.

“It’s not one species in one place or a few species in a limited area,” Pinsky says of the moving populations. “It’s actually hundreds of species in North America shifting toward cooler waters, and that’s significant.”

The changes pose major questions for fishermen and fishery managers. As species move, will fishermen relocate their businesses to follow? How do fishery managers set rules when fish have moved to new areas where they may be more susceptible to overfishing? And will species such as lionfish, which are invasive in the Atlantic Ocean and thrive in warm Southern waters, suddenly appear in force farther north along the Atlantic coast? Even more confounding is the effect of temperature changes on species such as corals that have difficulty relocating to a more suitable place.

Mid-Atlantic Council to Hold Hearings on New Jersey Special Management Zones

October 31, 2016 — The following was released by the Mid-Atlantic Fishery Management Council:

The Mid-Atlantic Fishery Management Council will hold three public hearings in November 2016 to gather public comments on a request by the State of New Jersey to designate 13 of its artificial reef sites located in federal waters as Special Management Zones (SMZ). The hearings will be held November 15-17, 2016. Written comments will be accepted until Friday, November 25, 2016, 11:59 p.m. EST.

Background

In November 2015, the New Jersey Department of Environmental Protection (DEP) petitioned the Mid-Atlantic Council to designate 13 artificial reef sites as SMZs under provisions of Amendment 9 to the Summer Flounder, Scup and Black Sea Bass Fishery Management Plan. The petition was based on the need to reduce gear conflicts between hook and line fishermen and fixed pot/trap gear at those sites. The SMZ designation could prohibit the use of any gear except hook and line and spear fishing (including the taking of fish by hand) within the 13 potential SMZ sites. The Council’s SMZ Monitoring Team (MT) evaluated the NJDEP request and recommended that the Council designate all 13 artificial reef sites as SMZs. The MT analysis indicated that commercial fishing vessels deploying pot/trap gear off the coast of New Jersey would likely face minimal to no losses in ex-vessel revenue if the artificial reefs are designated as SMZs. The Council is scheduled to review public comments and make a decision relative to NJ SMZ designation at its December 2016 meeting in Annapolis, MD.

At that meeting, the Board and Council will also consider extending ad-hoc regional approaches for 2017 black sea bass and scup recreational management in state waters. The Board and Council are scheduled to review the Black Sea Bass Stock Assessment Report and Peer Review Report and consider possible management responses at their joint meeting in February 2017 in Kitty Hawk, North Carolina.
