Frenchman Bay salmon farm developer sues Maine for spiking its lease application

May 31, 2022 — The company behind a controversial plan to build an industrial-scale salmon farm in Frenchman Bay is taking its case to court after the Maine Department of Marine Resources terminated its lease application last month.

American Aquafarms filed a complaint against the state in Cumberland County Superior Court last week. The Portland company, funded by Norwegian investors, proposed raising 66 million pounds of Atlantic salmon annually at two closed, 15-pen sites in Frenchman Bay, between Bar Harbor and Gouldsboro, with each pen encompassing 60 acres. The company also proposed operating a fish processing plant in Gouldsboro.

In its complaint, American Aquafarms alleges that the department’s decision was not supported by evidence. It also claims that the department spoke with a third party without its knowledge just days before the decision, violating American Aquafarms’ right to due process.

The state’s marine regulatory body terminated the application April 19. There were two major issues with it, said Jeff Nichols, department spokesperson.

First, the company failed to find a proper source for its fish eggs, according to Patrick Keliher, commissioner of the department. The hatchery listed in the application, AquaBounty in Newfoundland, is not on Maine’s list of qualified egg sources.

American Aquafarms also failed to show that the proposed hatchery satisfied genetic requirements mandated by state law, Keliher said.

Opportunity, controversy grow for Maine’s aquaculture industry

November 8, 2021 — Joanna Fogg, perched at the prow of her boat, looks out at the 350 oyster cages rocking in the Mount Desert Narrows that make up the bulk of Bar Harbor Oyster Co., the business that she and her husband, Jesse, have spent the past seven years building from the ground up.

The black plastic floats, spread across about 22 acres, may not look like much to some – and may even be an eyesore to others – but Fogg hopes that one day, people will see them as beautiful.

Her farm may not conjure the same quintessential working waterfront images as a lobster boat and brightly colored buoy, Fogg said, but she thinks it should hold the same meaning: “This is what it looks like to feed people.”

And feed people she does.

Even with a projected harvest of about 100,000 oysters this year, Fogg can’t keep up with the demand of Bar Harbor, let alone a state that is rapidly growing its brand as a premier destination for farm-grown seafood.

Fogg’s business is just one of the hundreds of Maine sea farms contributing to the state’s successful aquaculture industry, selling oysters, mussels, seaweed and salmon as fast as they can be grown. The practice has been around for thousands of years, but only in the past few has it become a vital economic engine for the state.

But as more farms have cropped up, so have coalitions and interest groups concerned about Maine’s coastline being overrun by industrial-size operations that pollute the state’s pristine waters and take valuable bottom from Maine’s iconic, nearly half-billion-dollar lobster industry.

MAINE: More than 125 boats participate in protest on Frenchman Bay

August 30, 2021 — More than 125 boats chugged across Frenchman Bay on Sunday to protest plans by American Aquafarms to place an industrial salmon farm in the bay off the coast of Bar Harbor and Acadia National Park.

Organizers of the “Save the Bay” flotilla said it demonstrates the depth of opposition to the proposed salmon farm. The parade of boats included working lobster boats as well as pleasure craft.

The flotilla passed by the Bar Harbor town pier, where people stood holding signs in opposition to the fish farm.

Protect Maine’s Fishing Heritage Foundation helped organize Sunday’s protest. The foundation and other parties are concerned that the fish farm will have negative environmental implications on the bay and its users.

American Aquafarms describes itself on its website as an American company that is in the process of establishing a hatchery, fish farm facilities – for both Atlantic salmon and cod – and a state-of-the art processing plant in coastal Maine.

A Ropeless Future for Lobster Fishing

August 4, 2021 — Motoring out of Bar Harbor recently, a small boat slowly navigated a field of colorful buoys before hitting the open water. It hooked around Bar Island, passed the Porcupines and slowed up on the leeward side of Ironbound, a mostly undeveloped private island. Had a person been standing on the rocky cliffs then, they would have seen the crew on the boat dump a lobster trap into the water and watch it sink, then motor off to a short distance away, from which the dozen people aboard watched the spot where the trap went down. Some time later, a bundle of floats would appear at the surface and the boat would circle back and snag it with a boat hook. By now the observer would have pulled out some binoculars to get a better view, and would see that the float was attached to the lid of the lobster trap, and that from the lid, a rope disappeared into the water, by which the rest of the trap was soon retrieved.

The object thrown overboard was not in fact a trap but a ropeless fishing system deployed in a demonstration for passengers on the boat, including a film crew, a reporter and three people who study or advocate for right whales.

Zack Klyver chartered the boat and arranged the demonstration. Through his consultancy, Blue Planet Strategy, he has been working as an intermediary between manufacturers, whale advocates and lobstermen, who find themselves on various sides of a regulatory survival equation as the federal government moves to protect endangered right whales.

In ropeless fishing, Klyver sees a potential win for everyone involved, but getting there may take time and a fair amount of persuasion.

Ropeless fishing is still in its infancy. Only a handful of companies make the gear, and as Maine law requires lobster traps to be marked with a buoy, it’s not even legal to use here yet.

MAINE: Bar Harbor to try to intervene on American Aquafarms lease

June 24, 2021 — As a controversial proposed salmon farm goes through the state lease process, Bar Harbor will likely be the first in line to ask for “intervenor status.”

The Town Council voted unanimously last week to apply to be an intervenor with the state Department of Marine Resources (DMR) on the American Aquafarms salmon farm project, which is proposed to be in the waters of Frenchman Bay off Bar Harbor, though it is technically in the jurisdiction of Gouldsboro.

The Norwegian-backed company has applied to grow salmon at two 60-acre, 15-pen sites northwest of Long Porcupine Island and northeast of Bald Rock Ledge in Frenchman Bay, sparking concerns among local conservationists and fishermen.

If the town is granted intervenor status, it would be allowed to provide testimony at a public hearing on the lease. In some cases, intervenors may also comment on draft decisions.

No other entity has applied for intervenor status yet, said Jeff Nichols, a spokesman for DMR.

The council’s decision to pursue intervenor status took only a few minutes with little discussion. The council had previously sat down with James Hanscom, a Bar Harbor lobsterman and member of the Lobster Zone B Council, and heard his concerns about the project. Before last week’s meeting, Hanscom delivered a statement of opposition on the project to council member Valerie Peacock.

MAINE: Two dozen Bar Harbor fishermen sign against proposed Frenchman Bay salmon farm

June 23, 2021 — Twenty-six Bar Harbor fishermen have signed onto a statement opposing a proposed salmon pen operation in Frenchman Bay.

The statement cited numerous concerns about the proposal by American Aquafarms, a business based in Norway that has submitted applications to the Department of Marine Resources to lease 120 acres in order to install 30 “closed net” pens for raising salmon. The company has said its goal is to scale up to grow 66 million pounds of salmon per year.

Hatchery and processing facilities would be located in Gouldsboro. Support vessels would travel between the pens and facilities.

Fishermen say they’re concerned about the potential “loss of prime fishing ground for lobster, scallops and shrimp,” increased fishing pressure on grounds adjacent to the proposed operation, loss of gear from service vessels and related support activity, navigational conflicts, water pollution related to discharge, feed and fuel spills, habitat impacts, and disturbance to the ocean bottom around the pens.

In addition, the statement said, the proposal could lower “the potential for a comeback to the historical fisheries of the bay, including the recent shrimping fishery that centered inside the bay on these two deep water holes.”

Bar Harbor, Maine seeks intervenor status on American Aquafarms salmon farm

June 21, 2021 — The town council of Bar Harbor, Maine, U.S.A. has filed to seek intervenor status in with the Maine State Department of Marine Resources regarding a salmon farm project proposed by American Aquafarms.

The project is planned to initially produce 30,000 metric tons of salmon a year out of its proposed site in Frenchmen’s Bay in Gouldsboro, Maine – across the water from Bar Harbor’s location on Mt. Desert Island. Bar Harbor’s intervenor status, if approved, would allow the town to provide testimony at a public hearing on the lease and potentially comment on draft decisions, reports the Mount Desert Islander.

MAINE: Fishermen, harbor pilots, cruise industry work to minimize gear loss from ships

February 27, 2020 — There’s a lot going on in the few square miles of ocean around Mount Desert Rock, the offshore island about 20 miles south of the entrance to Frenchman Bay.

College of the Atlantic operates a research station there. The rocky ocean bottom near the island is a prime spot for lobsters and has become more and more popular in recent years.

There is shipping traffic in the area, tankers going to and from Searsport, Portland and Portsmouth, according to harbor pilot Skip Strong of the Penobscot Bay Pilots.

And there are cruise ships. This year, 197 ship visits to Bar Harbor are scheduled, the bulk of them in September and October.

On their way into Frenchman Bay and Bar Harbor, the ships pass near Mount Desert Rock. Until recently, the recommended channel for large ships entering Frenchman Bay started about five miles north of Mount Desert Rock.

But enough fishermen were losing money and equipment when buoy lines were cut by a passing ship (or an underwater stabilizer sticking out from the side of a ship, or an underwater tow wire between a tug and barge), that they got to talking.

The conversation had some added urgency beginning in 2018, when the Maine Department of Marine Resources (DMR) changed the rules for gear configurations in the area. Many fishermen used to use strings, or trawls, of 15 traps with a surface buoy at either end, in the area. Now, with more fishermen working in the same area, a 5-trap maximum is in effect. That means if a buoy line is cut, the whole trawl is lost.

Why climate emergency declarations matter for Maine

December 18, 2019 — On the evening of Dec. 2, the Brunswick Town Council joined Bar Harbor, South Portland, and Portland in declaring a state of climate emergency. Compared to the climate rally that followed on Dec. 6, this was a quiet affair — but a resounding one nonetheless. With unanimous approval, council members passed a resolution drafted by members of Bowdoin Climate Action, naming the urgency of the climate crisis and committing Brunswick to developing an action plan to potentially eliminate carbon emissions by 2030.

At first, such municipal action might seem nominal or unnecessary. Why bother to come out with a statement or engage with a massive, global issue on the scale of local government?

As it turns out, Maine’s towns are hardly the first to make the move. As early as December of 2016, the city of Darebin, Australia, a Melbourne suburb, declared a state of climate emergency. Since then, more than 1,200 local governments in 25 countries have followed suit, translating to nearly 800 million people globally represented by governments that have declared a climate emergency. Eight hundred million — that’s a lot, and it’s a number that will only continue to grow.

Let’s face it: in a time of crisis, where 2019 marks the end of the warmest decade on record and the number of billion-dollar climate disasters each year continues to rise, our federal government has effectively chosen to ignore this. We have no choice but to build power from the bottom up, tackling the climate crisis from our hometowns and city halls. A municipal climate emergency declaration isn’t an empty statement — it’s a bright red flag on the map. Enough of these, and state governments would be hard put to ignore the demands of their constituents.

MAINE: Lobstermen at Ellsworth whale meeting ask state to resist federal pressure

November 5, 2019 — A growing number of Maine lobstermen are asking the state to resist federal pressure to change how they fish to protect the endangered right whale and called for state legal action to protect the $565 million a year fishery.

At a hearing in Ellsworth on Monday night, lobstermen chimed in on a state whale protection proposal that calls for a combination of weak rope, gear marking and more traps on offshore buoy lines to reduce the risk to right whales by about 58 percent.

It’s better than earlier plans, which called for the elimination of 50 percent of buoy lines, but it’s still dangerous for Maine fishermen who will be mired waist-deep in rope on deck, and won’t do anything to help the whales, they argued.

“It’s not going to work, there’s got to be a different way,” said Jim Hanscom, a Bar Harbor lobsterman who spoke out against adding more traps to weaker rope. “You’ve got to just buck up and say we can’t do this. it’s just not going to work.”
