Federal Managers Continue to Address Red Snapper and Cobia Management

June 16, 2017 — The following was released by the South Atlantic Fishery Management Council:

Members of the South Atlantic Fishery Management Council gathered in Ponte Vedra Beach, Florida this week, where red snapper and cobia fisheries continued to dominate discussions. The harvest of red snapper is currently prohibited in federal waters ranging from three to 200 miles off the South Atlantic coast as the stock continues to rebuild. The recreational fishery for Atlantic cobia (Georgia to New York) closed in federal waters earlier this year as a result of harvest estimates from NOAA Fisheries showing the annual catch limit was exceeded in 2016.     

The Council received a presentation by NOAA Fisheries during this week’s meeting showing that the estimated number of red snapper removed (landings plus dead discards) exceeded the acceptable biological catch in 2016, a situation that has kept the fishery closed for the past two years under the current management plan. The removals are primarily associated with the recreational fishery where red snapper are captured and released while fishermen target other co-occurring species. Approximately 28% of the fish released by recreational anglers are estimated to die primarily due to barotrauma, the physical damage to body tissues caused by differences in pressure as the fish is being retrieved.     

Meanwhile, Council members, with representatives from both commercial and recreational fisheries, focused on how to allow limited harvest of red snapper beginning in 2018. “Council members and members of the public have repeatedly expressed their frustration at the increasing numbers of red snapper that are being released as this stock recovers,” said Council Chair Dr. Michelle Duval. “While we explore measures to allow limited harvest we must also be cautionary in our approach to not allow overfishing to occur should the fishery reopen next year.”     

After lengthy discussion, the Council approved modifying draft Amendment 43 to the Snapper Grouper Fishery Management Plan to include a single action to revise annual catch limits for red snapper. The draft amendment would remove the current process and equation used to specify the annual catch limit and includes alternatives for establishing an annual catch limit for 2018 ranging from approximately 23,600 to 76,000 fish. The intent is to expedite the amendment by holding public hearings via webinar in August, in-person hearings at the Council’s September meeting, and approving the amendment for Secretarial review at that time. The new measures could be in place in time to allow limited harvest beginning in July of 2018.     

Earlier in the week, the Council hosted a workshop on “Improving the Survival of Released Fish”. Eight speakers presented on best practices for reducing discard mortality, including the use of various descending devices, minimizing handling, and other practices. “These best fishing practices show the cumulative positive affects recreational anglers can have in reducing mortality of fish that are released,” stated Council member Chester Brewer, a recreational representative from West Palm Beach, Florida. “It is imperative that anglers learn about these tools and put them to good use.” Workshop information and the presentations are available from the Council’s website at: http://safmc.net/briefing-books/2017-june-council-meeting-briefing-book/.  

Cobia      

Council members continued to address management of Atlantic cobia including a request from the Atlantic States Marine Fisheries Commission that the Council consider transferring management authority to the Commission. The move would allow additional flexibility between the states for management of the fishery, which primarily occurs in state waters off the northeastern coast of North Carolina and Virginia. The Council decided to move forward to develop an amendment with options for transferring management authority as well as complementary management with the ASMFC.

The Council decided not to pursue taking emergency action to change the management boundary and annual catch limits for Atlantic cobia but did request that NOAA Fisheries recalculate the recreational harvest estimates for 2015 and 2016 as reported through the Marine Recreational Information Program. Fishermen and others have expressed considerable doubt in the estimates, especially for landings off the coasts of North Carolina and Virginia. The Council plans to hold a workshop in collaboration with the Gulf of Mexico Fishery Management Council in November of this year to address recreational data collection and estimates. A stock assessment for cobia is scheduled to begin in 2018.

Other Business     

The Council approved measures that will allow increases in the harvest of spiny lobster in both the South Atlantic and Gulf of Mexico following a recent stock assessment. Spiny Lobster Regulatory Amendment 4 would increase the acceptable biological catch from 7.32 million pounds to 9.6 million pounds. The amendment would also prohibit the use of traps for recreational harvest of spiny lobster.  The amendment will be submitted to the Secretary of Commerce for formal review and approval.        

After reviewing a white paper, recommendations from its advisory panel, and public comment, the Council voted to move forward with development of an amendment to consider a moratorium on the issuance of federal for-hire snapper grouper permits, using the established control date of June 15, 2016.

JOHN BULLARD: There Is No Silver Bullet for Groundfish

June 16, 2017 — The great philosopher Yogi Berra said, “You can observe a lot by watching.” You can also learn a lot by listening. I try to do a lot of listening. I think it’s the most important part of my job, and of all of our jobs at the Greater Atlantic Regional Fisheries Office and the Northeast Fisheries Science Center.

With all of the activity in the last couple of months, there has certainly been a LOT to listen to. For example, we held recreational roundtable meetings in New Jersey and New Hampshire and a commercial roundtable in New Bedford. We also attended the New England and Mid-Atlantic Fishery Management Council meetings and an Atlantic States Marine Fisheries Commission meeting. And let’s not forget the daily meetings, emails, and phone calls with stakeholders.

What did we hear? We heard about recreational catch estimates and allocations among different fishing sectors. We heard reports on the Standardized Bycatch Reduction Methodology and observer coverage for last year and next. We heard progress reports on electronic monitoring projects. And, in every hallway, there has been talk of the Carlos Rafael case and its potential impact on the groundfish industry.

While obviously I can’t comment on the specifics of an ongoing case, I am going to comment on a larger issue that I think is important. To put it briefly: There’s no such thing as a silver bullet.

When people come up to me passionately lamenting that Amendment 18 will not do enough to address consolidation within the groundfish fleet, I understand their passion. The power of a very large fleet can be misused. But, I wonder if they are looking to Amendment 18 to be a silver bullet that will singlehandedly solve this problem.

Some blame sector management for our troubles. I don’t buy it. Instead, I see the ability of the private sector to manage quota with accountability, flexibility, and initiative. All of these are necessary ingredients for a healthy fishing industry, especially in tough times.

At many meetings, people line up to decry the science and management. And yet, some of the same people who condemn the status quo are the ones who advocate for no action. It causes me to wonder whether or not we share the same sense of urgency towards improving the accuracy of our data, which is needed to gain more confidence in our scientific models, which is needed to improve our management. The status quo is short-sighted and leaves us with few options.

I see a system under a lot of stress. When there is a lot of stress, there is a tendency to blame:  Blame the science. Blame woeful observer coverage levels. Blame errors in reporting or illegal discarding. Blame the management. Blame fleet consolidation or the sector system. Blame overfishing over the years. Blame warming ocean waters. Blame NOAA Fisheries. Blame the Councils. Point the finger somewhere.

Just as there is the tendency to blame, there is also the quest for the silver bullet. While understanding causes is essential to providing solutions, an emphasis on blame can be distracting and destructive, especially if the fingers never point in the mirror. The solution is likely to be a network of responses rather than a single answer. A network that will provide accuracy, accountability, and efficiency.

I think that network of answers has several fundamental elements:

  • A renewed management focus on optimum yield and business flexibility that follows on the heels of improved monitoring and complete accountability, and that provides diversity and stability to the groundfish fleet.
  • A revamped Office of Law Enforcement that will continue to help fishermen comply with the rules and root out the few bad apples. Nearly every single fisherman works hard to comply with complicated regulations to bring quality seafood to the consumer. So when the occasional violator decides the rules don’t apply to him, that person is stealing from his neighbors and emboldening others to cheat, and needs to be brought to justice. Our Law Enforcement team is doing just this with increasing efficiency.
  • An improved monitoring program that will provide full accountability and full coverage. The program will tap into emerging technologies with increased use of electronic monitoring coverage by either the “trust but verify model” or “maximized retention/ dockside sampling model.” The resulting increase in accuracy and shared sense of responsibility for effective monitoring and management of this fishery may allow uncertainty buffers to be reduced, which could then allow us to increase quotas.
  • Improved and integrated science that includes fishermen and their insights into the design, implementation, and interpretation of science, a wider understanding of ecosystem changes, and better communication and coordination with stakeholders, all of which ultimately leads to wider acceptance of results. The best science is transparent, timely, adaptable to our rapidly changing environment, and allows us to make better management decisions.

There is no silver bullet. Each of these elements is equally important in transforming the groundfish fishery into a one that provides a stable source of protein for U.S. consumers, and a stable source of jobs for New England fishermen.

New England groundfish is certainly not the only fishery with high profile enforcement cases or challenging scientific questions. But these issues are most acute in groundfish—one of the most iconic and complex fisheries in the world. The fishery has been dealt a series of devastating blows, and the cumulative effects have finally caught up to us.

Yogi Berra also said, “When you come to the fork in the road, take it.” Well we’re at a fork in the road in groundfish management. The status quo has gotten us record low abundance in some stocks, arguments about the science, pressures to discard legal fish that have proven as irresistible to avoid as they are to acknowledge, and all of us skirting the truth in many ways at a cost to the fishery and future generations. Seeking accuracy should not be something that anyone gets penalized for. Rather, we must remove the disincentives for full accountability and full coverage. We have to bring illegal discarding out of the shadows. Talk about it. Acknowledge it. Account for it.

If anyone thinks that the status quo is good enough, then they haven’t been paying attention.

Hearing on new shrimp rules draws tiny crowd

June 15, 2017 — Fishermen barely outnumbered representatives of the Atlantic States Marine Fisheries Commission last Thursday at a public hearing in City Hall on proposed rule changes that would reshape shrimp fishing in the Gulf of Maine.

Three fishermen — John Williams and Ricky Trundy, both of Stonington, and James West of Sorrento — offered comments on a proposed amendment to the ASMFC fisheries management plan for northern shrimp. Department of Marine Resources External Affairs Director Terry Stockwell and Resource Management Coordinator Trisha Cheney dutifully recorded those comments on behalf of the ASMFC.

Stockwell serves as DMR Commissioner Patrick Keliher’s representative on the multi-state fisheries management group. He plans to retire at the end of the month after 21 years at DMR and Cheney will assume his role.

Although a somewhat larger crowd was on hand for a hearing the previous evening in Augusta, the sparse audience reflected the state of the fishery from Downeast waters. It also is a reflection of the fact that there has been no commercial shrimp fishery in the Gulf of Maine since ASMFC shortened the season in 2013 and imposed a complete fishing moratorium before the 2014 season.

For more than a decade, ASMFC managed the fishery by establishing a total allowable catch (TAC) for the entire fishery based on assessments of the size and reproductive success of the shrimp resource that was adjusted annually. As the shrimp resource declined, so did the TAC — and the fishery.

NOAA Fisheries Announces Reimbursement Rate of 60 Percent for 2017 At-Sea Monitoring Costs in Groundfish Fishery

June 16, 2017 — The following was released by NOAA:

Effective at-sea monitoring (ASM) programs are essential to the success and sustainability of Greater Atlantic Region fisheries. Groundfish vessels in the Greater Atlantic Region that participate in the sector program are required to carry a fisheries observer or an at-sea monitor for a portion of their trips. Fisheries observers are provided and typically paid for by the Federal government in the Standardized Bycatch Reporting Methodology (SBRM) program and at-sea monitors are partially paid for by industry in the at-sea monitoring program.

In 2016, industry began paying their portion of at-sea monitoring costs and NOAA Fisheries was able to reimburse 85 percent of industry’s expenses for July 2016-April 2017. We used these funds to offset a portion of industry’s costs of the groundfish ASM program through a grant administered by the Atlantic States Marine Fisheries Commission (ASMFC). For fishing year 2017, there are remaining funds in the grant, and therefore we will continue the reimbursement program.

We estimate there is funding to reimburse 60 percent of ASM costs for the 2017 fishing year. 

Any sector trip beginning on or after May 1 is now eligible for reimbursement. 

We are committed to providing as much stability to sectors as possible, so we have based our reimbursement rate on one that we anticipate will be consistent through the entire fishing year.

Elver season ends

June 8, 2017 — Maine’s elver season ended Wednesday. By most accounts it was successful.

The Atlantic States Marine Fisheries Commission limited Maine harvesters to a landings quota of 9,616 pounds for this year. According to the Department of Marine Resources, as of 6 p.m. Monday, Maine dealers reported buying 9,281.269 pounds of elvers and paying harvesters a total of $12,088,884 — an average price of $1,303 per pound.

The total quota is allocated among harvesters licensed by the state and the four federally recognized Indian tribes.

As of Monday evening, DMR-licensed harvesters had landed just over 7,315 pounds out of a total quota of 7,566.3 pounds.

Harvesters of the Houlton Band of Maliseet had landed about 87 pounds from their approximately 107-pound quota.

Micmac Nation harvesters landed their entire 38.8-pound quota and Penobscot Nation harvesters had landed all but one pound of their 620-pound quota.

New Jersey has good reasons to resist federal rules on fluke

June 7, 2017 — If federal fisheries managers got fan mail from some flounder these days, would it side with their catch limits or New Jersey’s defiant alternate rules?

State and local officials and the N.J. congressional delegation pushed hard against this year’s federal plan to reduce the catch of summer flounder, also called fluke, by 30 percent. The Atlantic States Marine Fisheries Commission wanted to require fish to be an inch bigger to be kept — 19 inches in the ocean and nearby waters and 18 inches in Delaware Bay.

Since last year’s limits were already tough on fishers and marine businesses, the plan prompted an uproar. Rep. Frank LoBiondo said “unelected bureaucrats in Washington use questionable methodologies and outdated science to cut us off at the knees.” He and fellow Rep. Frank Pallone introduced bipartisan legislation to prevent the new flounder quotas from taking effect.

The state Department of Environmental Protection also went all in, telling the U.S. secretary of commerce the new rules would destroy recreational flounder fishing in the state, an important part of its summer tourism appeal. It asked for a return to 2016 rules and a new full assessment of the flounder stock.

New Jersey ruled out of compliance on summer flounder, moratorium possible

June 5, 2017 — If New Jersey doesn’t bring its summer flounder limits in line with federal regulations, the Atlantic States Marine Fisheries Commission said it may result in a moratorium on fluke fishing.

When summer flounder season began May 25, New Jersey decided to keep in place an 18-inch limit it felt was a fair compromise to the 19-inch limit federal regulators were requiring.

The Marine Fisheries Commission did not agree and voted earlier that week not to accept New Jersey’s rules. On Thursday, the federal agency found New Jersey out of compliance with the mandatory management measures for summer flounder, scup and black sea bass.

The commission believes the 19-inch limit achieves conservation goals and helps to end overfishing of summer flounder. The state argues the larger minimum size would result in more dead fish. Other opponents of the federal rules, including many local anglers, say the rules directly target female spawning flounder.

“We’re disappointed the Atlantic States Marine Fisheries Commission continues to myopically distance itself from sound fisheries management and advocates for a 19-inch size limit that kills more fish through dead discards than the actual harvesting of fluke,” N.J. Department of Environmental Protection Commissioner Bob Martin said. “This would result in an overall higher mortality rate and be more detrimental to the fish stock that we are sworn to protect.”

Feds threaten shutdown of N.J. fishery as showdown escalates

June 2, 2017 — Call it the Great Flounder War of 2017.

A simmering battle between New Jersey recreational fisherman and the federal agency governing fishing along the Atlantic Coast has now escalated — with potentially disastrous consequences for the fishermen.

In a teleconference on Thursday morning, the Atlantic States Marine Fisheries Commission (ASMFC) officially found New Jersey to be out of compliance with federal regulations. The decision follows months of wrangling between the two sides, casting shadow over the opening of summer flounder (sometimes called fluke) fishing season.

The matter is now headed to U.S. Secretary of Commerce Wilbur Ross for a final decision. If Ross agrees with the recommendation, both recreational and commercial fluke fishing could end up banned altogether in the Garden State.

The clash began in February, when the ASMFC announced stricter rules for fishing fluke coast-wide in order to address overfishing worries. The ASMFC called for a a 19-inch minimum on fishes caught, with a three fish limit per trip over a 128-day season.

New Jersey’s Marine Fisheries Council immediately pushed back and created its own rules as a compromise: a shorter fishing season (104 days from May 25 to Sept. 5 — 24 fewer days than were allowed in 2016), but an 18-inch minimum.

ASMFC Finds New Jersey Out of Compliance with Addendum XXVIII to the Summer Flounder, Scup, and Black Sea Bass FMP

June 1, 2017 — The following was released by the Atlantic States Marine Fisheries Commission:

Arlington, VA – The Atlantic States Marine Fisheries Commission has found the State of New Jersey out of compliance with the mandatory management measures contained in Addendum XXVIII to the Interstate Fishery Management Plan (FMP) for Summer Flounder, Scup, and Black Sea Bass. The Commission will notify the Secretaries of Commerce and the Interior of its finding. This action was taken pursuant to the provisions of the Atlantic Coastal Fisheries Cooperative Management Act of 1993. The State of New Jersey has failed to effectively implement and enforce the provisions of Addendum XXVIII to the FMP for Summer Flounder, Scup, and Black Sea Bass. Specifically, New Jersey has not implemented the following regulations required by Addendum XXVIII:

  • Shore mode for Island Beach State Park only: 17-inch minimum size limit; 2-fish possession limit and 128-day open season.
  • Delaware Bay only (west of the COLERG line):   18-inch minimum size limit; 3-fish possession limit and 128-day open season.
  • All other marine waters (east of the COLERG line):  19-inch minimum size limit; 3-fish possession limit and 128-day open season

The implementation of these measures is necessary to achieve the conservation goals and objectives of the FMP to end overfishing of the summer flounder stock. In order to come back into compliance the State of New Jersey must implement all of the above measures. Upon notification by the Commission, the Secretaries of Commerce and the Interior have 30 days to review the recommendation and determine appropriate action, which may include a federal moratorium on fishing for Summer Flounder in New Jersey’s state waters.
