Blue ticked off: the controversy over the MSC fish ‘ecolabel’

July 26, 2021 — This month, two right whales in the Gulf of St Lawrence were found entangled in fishing gear. One, a female, was first spotted entangled off Cape Cod last year, but rescuers were not able to fully free her; the other, a male, is believed to have become entangled in the Gulf.

Hunted to near extinction before a partial whaling ban in 1935, North Atlantic right whales are once more critically endangered, with only 356 left. The main threat remains human contact: entanglement in fishing gear, and ship strikes. Fatal encounters, caused in part by the whales’ migratory shift into Canada’s snow crab grounds, have soared: more than a tenth of the population died or were seriously injured between 2017 and 2021, mostly in Canada and New England.

One of the threats they face is from the growing crab and lobster fisheries. The whales migrate from their calving grounds in Florida to feed in Canada – putting them on a collision course with the pots and traps.

“We’re talking millions of lines, placed in the water every year,” says Kate O’Connell, a marine wildlife consultant for the Animal Welfare Institute. “These animals are running the gauntlet – and it’s getting harder and harder for them to survive.”

When a whale gets entangled, ropes from buoys on the surface to the seabed traps can become embedded in its skin, weighing it down and leaving it unable to swim or feed properly, leading to a “really traumatising death”, O’Connell says.

But what makes it even more concerning to conservationists is that some of the fisheries they say threaten the right whale were certified as “sustainable” by the world’s largest fisheries certification programme: the Marine Stewardship Council.

The MSC, which grants the right to use its well-known “blue tick” label on products, has grown from 315 certified fisheries in 2017 to 421, representing 14% of all global fish landings. In the last year its labelled products were worth $12bn (£9.5bn). In the absence of governments looking after our oceans, “the MSC is definitely the best we’ve got” in terms of consumer labels, according to Ruth Westcott of the environmental alliance Sustain.

MSC urged to raise the bar on shark-finning

February 17, 2021 — A new report by a cadre of scientists and members of environmental NGOs is calling on the Marine Stewardship Council (MSC) to take further action to combat the practice of shark-finning.

The report, which analyzed the MSC’s policies relating to shark-finning, asserts that the organization should adopt a “fins naturally attached” (FNA) policy in order to curtail – and hopefully eliminate – shark-finning. The council is failing its zero-tolerance policy on shark-finning, a press release from the organizations behind the report said.

Lawsuit demands Trump administration to impose vaquita-related sanctions against Mexico

June 11, 2020 — The Center for Biological Diversity and the Animal Welfare Institute have sued the administration of U.S. President Donald Trump in an effort to force it to implement sanctions against Mexico for its failures to protect the highly endangered vaquita porpoise.

The CBD and AWI said the sanctions are “long overdue,” accusing the U.S. Department of the Interior of failing to respond to a 2014 petition they filed under the Administrative Procedure Act requesting the United States “certify” Mexico under the U.S. Pelly Amendment for Mexico’s “ongoing failure to halt illegal fishing of and international trade in endangered totoaba fish.”

With US ban on Mexican seafood imports in place, vaquita court case dismissed

April 22, 2020 — A lawsuit against the U.S. government aiming to require it to enforce the Marine Mammal Protect Act in regard to the critically endangered vaquita porpoise has been dismissed after the U.S. National Marine Fisheries Service expanded a ban on imports of seafood products caught in the vaquita’s habitat.

U.S. Court of International Trade Judge Gary S. Katzmann dismissed the suit at the request of the plaintiffs, the Natural Resources Defense Council, the Center for Biological Diversity, and the Animal Welfare Institute, on 22 March.

Appeals court blocks another US gov’t effort to overcome Mexico gillnet import ban

November 30, 2018 — The US Court of Appeals for the Federal Circuit on Wednesday shot down an effort by the US National Marine Fisheries Service (NMFS) and other federal agencies to end a four-month-old ban on the import of Mexican shrimp and other seafood caught in the country with the use of gillnets.

The decision to reject a “stay of the order” request backs a US Court of International Trade (CIT) ruling, issued in July, that was sought by the Natural Resources Defense Council (NRDC), Center for Biological Diversity and Animal Welfare Institute as part of an effort to protect the endangered vaquita porpoise in the northern Gulf of California from being driven into extinction by pressuring the Mexican government.

Widely decimated by the use of gillnets in pursuit of the totoaba — another endangered fish sought for its swim bladder due to black market demand in China — there are believed to be a little more than a dozen vaquita remaining.

Federal court upholds ban on Mexican imports in vaquita case

October 24, 2018 — A federal court has upheld a ruling from July that banned seafood imports from Mexico harvested by a drift gillnet.

The decision by the U.S. Court of International Trade on Monday, 22 October came after Trump administration officials appealed Judge Gary S. Katzman’s temporary injunction against the practice. Conservation groups sued the administration seeking a ban in an attempt to save the vaquita, a small porpoise on the brink of extinction.

The porpoise lives in the Gulf of California and estimates put the species population at around a dozen. However, roughly half the stock dies each year in encounters with gillnets. The Natural Resources Defense Council, the Animal Welfare Institute, and the Center for Biological Diversity filed the lawsuit in March and claimed the acceptance of Mexican seafood caught by those nets violated the Marine Mammal Protection Act.

How Whale Poop Could Counter Calls to Resume Commercial Hunting

August 29, 2018 — Before whales dive into the darkness of the deep ocean they often come to the surface and release a huge plume of fecal matter—which can be the color of over-steeped green tea or a bright orange sunset. When Joe Roman, a conservation biologist at the University of Vermont, saw one of these spectacular dumps in the mid-1990s, he got to wondering: “Is it ecologically important? Or is it a fart in a hurricane?”

Roman and other researchers have since shown whale excrement provides key nutrients that fuel the marine food chain, and that it also contributes to the ocean carbon cycle. These important roles are now influencing scientific and economic arguments for protecting whales, at a time when calls for a resumption of whaling are growing. “The scientific community is coming to understand a new value of whales: their role in maintaining healthy and productive oceans,” says Sue Fisher, a marine wildlife consultant at the nonprofit Animal Welfare Institute. “We are beginning to see governments use this rationale to justify measures to protect whales.” But as the International Whaling Commission (IWC) prepares for its biennial meeting next month, the ecological services whales provide are set to split the gathered countries—with an unknown outcome for the whales.

Whale poop’s importance is nothing to sniff at. In a 2010 study Roman’s team found whale defecation brings 23,000 metric tons of nitrogen to the surface each year in the Gulf of Maine—more than all the rivers that empty into the gulf combined. This nitrogen fertilizes the sea by sustaining microscopic plants that feed animal plankton, which in turn feeds fish and other animals including the whales themselves. Studies have found similar effects elsewhere, and with other nutrients found in whale feces. And when they migrate, whales also redistribute nutrients around the globe. By moving them from higher latitudes, Roman says, the giant mammals could be increasing productivity in some tropical waters by 15 percent.

By stimulating the growth of microscopic plants called phytoplankton, whale scat may also help limit climate change. These tiny aquatic plants remove carbon from the atmosphere and carry it deep into the ocean when they die. Research in the Southern Ocean showed the iron defecated each year by some 12,000 resident sperm whales feeds phytoplankton that store 240,000 more metric tons of carbon in the deep ocean than the whales exhale. This means that, on balance, whales help lock carbon away.

Court Orders Seafood Import Ban to Save Vaquita

July 31, 2018 — Responding to a lawsuit filed by conservation groups, the U.S. Court of International Trade has ordered the U.S. Government to ban seafood imports from Mexico caught with gillnets that kill the critically endangered vaquita porpoise.

As few as 15 vaquita remain, and almost half the population drowns in fishing gillnets each year. Without immediate additional protection, the porpoise could be extinct by 2021.

This is the life line the vaquita desperately needs, said Giulia Good Stefani, staff attorney with the Natural Resources Defense Council, who argued the case before the Court.

The ruling follows a lawsuit filed in March by the Natural Resources Defense Council, the Animal Welfare Institute and the Center for Biological Diversity, and it affirms Congress’ mandate under the U.S. Marine Mammal Protection Act that the United States protect not just domestic marine mammals, but also foreign whales, dolphins, and porpoises.

50 NGOs critique MSC over bycatch

January 26, 2017 — A group of 50 non-governmental organizations (NGOs) has sent a letter to the Marine Stewardship Council (MSC) expressing their concerns about its certification of fisheries with high levels of bycatch.

The letter was authored by Kate O’Connell of the Animal Welfare Institute and Friederike Kreme-Obrock of Sharkproject Germany and signed by the heads of 50 nonprofits dedicated to environmental conservation, including dozens of groups dedicated to the protection and preservation of sharks, whales and dolphins.

“Many of our organizations have commented on fishery assessments under the MSC process, and over the years we have noted an apparent, and deeply worrying, lack of concern regarding the potential impacts on these species, as well as certain target species,” the letter said. “It is our view that many of the fisheries that have been assessed via the MSC certification process have not been subject to an adequate review of information available on bycatch of non-target species.”

The letter accuses the MSC of being subjective in interpreting evidence and in estimating the effects of a fishery’s impact on non-targeted species. It cites the absence of in-depth stock assessments for some species of bycatch as a problem under MSC Principle 2, which aims to maintain population levels of all species affected by a fishery at biological based limits.

Environmental groups want thorny skate on endangered list

November 11, 2015 — PORTLAND, Maine (AP) – A pair of environmental groups wants the U.S. government to add a species of skate to the list of animals protected under the Endangered Species Act, touching off a drive from some fishermen who say they are already burdened with too many regulations.

Animal Welfare Institute and Defenders of Wildlife say the thorny skate’s decline in the northwest Atlantic Ocean is troubling enough that it should be afforded protections reserved for endangered animals. Their request is before the National Oceanic and Atmospheric Administration, which has a year to make a decision about whether to protect the bottom-dwelling fish.

Federal surveys state that the fish’s population has declined since the late 1960s, and it was only 3 percent of its target level in the early part of this decade.

The thorny skate is one of at least three species in the Gulf of Maine, a key New England fishing area, that are up for potential listing. Listing a species under the Endangered Species Act can lead to habitat protections and fishing restrictions, and some fishermen plan to oppose listing the skate.

The listing would be especially bad for New England lobstermen because some use skate as bait, said Beth Casoni, executive director of the Massachusetts Lobstermen’s Association.
