As Canned Tuna Fly Off Shelves, Operations of U.S. Boats Are Compromised

March 18, 2020 — HONOLULU — The following was released by the American Tunaboat Association, StarKist Samoa, and the Western Pacific Regional Fishery Management Council:

Consumers bracing against Covid-19 have raised demands not only for health and safety products but also for many food staples, including tuna. According to an NPR report yesterday, tuna sales were up more than 31 percent last week compared to the same time last year.

StarKist Samoa, located in the US Territory of American Samoa, supplies tuna for the US market.

“The StarKist Samoa operation relies on the US tuna fishermen, and direct fish deliveries to the cannery are a major component of our business model,” said StarKist Samoa in a statement today. “We have seen an increase in sales that has been attributed to the Covid-19 impact, and we are doing our best to keep up with the demand. It’s important to note that the global impact of Covid-19 highlights the importance of keeping US suppliers and producers in business to ensure we can sustain the tuna supply for US consumers. It continues to be a struggle for the US tuna fisherman to stay in business. The Pacific Remote Islands Marine National Monument, as well as the continued burdens of the international fishing restrictions, has had a detrimental impact on both our US tuna fishermen and the American Samoan economy. In addition, these measures have had little or no impact on tuna conservation or the protection of sensitive marine habitats. Any interruption to the StarKist Samoa supply chain impacts our company’s ability to provide healthy seafood products to our US customers.”

Under US law, American tuna purse-seiners are stringently managed under regulations and enforcement regimes that are far more robust than those of other nations. Among the regulations for US purse-seiners is the requirement for vessels to carry fishery observers.

“The current situation poses critical problems for the operation of the US tuna purse-seine fleet on almost every level,” notes Bill Gibbons-Fly, executive director of the American Tunaboat Association (ATA). The nonprofit organization, established in 1917, represents the owners and operators of the US Pacific tuna purse-seine fleet and is the last true distant-water fishing fleet operating under US flag. “Most Pacific Island countries that provide observers have pulled those observers off boats and called them home,” Gibbons-Fly adds. “We expect others to follow. The increasing travel constraints throughout the Pacific are complicating efforts to get crew, repair parts, technicians and supplies to boats in a timely fashion. And some ports where the boats would offload or transship fish are simply closed to them. This combination of factors not only puts the immediate operations of the fleet at risk, but also raises questions about the ability of this industry, along with many others, to overcome the broader economic and social disruption caused by the current pandemic.”

American Tunaboat Association loses lawsuit in fight against NMFS

August 7, 2019 — The American Tunaboat Association, a trade group representing owners and operators of the U.S. tuna fleet, has lost a lawsuit that it filed after being denied “applicant” status by the National Marine Fisheries Service in Endangered Species Act consultations.

In December 2018, the ATA received a notification of rejection from the NMFS in its attempt to be given applicant status under the agency’s rules for participating with full rights and status in consultations on the NMFS’ decisions regarding how to apply the Endangered Species Act in the U.S. purse-seine tuna fishery in the Western and Central Pacific Ocean. The ATA’s appeal of the decision was rejected in January 2019 by senior officials in the NMFS and U.S. Department of Commerce. In response, the ATA sued in April 2019.

Tuna Fishermen Say Agencies Rejected Input on New Rules

April 12, 2019 — Representing large net-fishing vessels in the Pacific Ocean, the American Tunaboat Association filed a lawsuit Wednesday claiming government fishery regulators left industry experts in the dark about a forthcoming biological opinion that could limit commercial tuna operations.

The complaint, filed by Baker Botts attorney Megan Berge in Washington, D.C., federal court, names as defendants Commerce Secretary Wilbur Ross, the National Oceanic and Atmospheric Association and the National Marine Fisheries Service, or NMFS.

According to the lawsuit, NMFS is preparing a biological opinion that could impose new permit requirements and limits on tuna fishery operations in the western and central Pacific Ocean, and the American Tunaboat Association says it was denied the ability to provide input during an informal phase of the assessment process.

The fishing advocacy group claims the NMFS violated the Administrative Procedure Act by not allowing it to review any drafts or provide first-hand, expert recommendations for the developing opinion that could directly impact its members.

CALIFORNIA: Seaport developer, fishermen reach deal to help save San Diego’s storied fishing industry

October 25, 2018 — After years of negotiations, San Diego’s fishermen and a local developer have signed an agreement to recapture a lost piece of the city’s history – a thriving commercial fishing trade that once employed thousands of people while netting hundreds of millions of dollars.

Much of the agreement focuses on five acres called Tuna Harbor, and the role it will play within Seaport San Diego, the billion-dollar waterfront development expected to break ground in 2022.

The marina is expected to provide a true “working waterfront” – a unique attraction for the Seaport project, an economic boon for the region and an opportunity for the fishermen to revive their struggling industry.

Throughout the talks, inewsource monitored the arguments, near-implosions and compromises that finally led to a deal being signed last month. It was a rare and noteworthy episode in San Diego history: Downtown land was up for grabs, and the two sides vying for a part of its future couldn’t have contrasted more in their history, finances or motivations.

“It wasn’t easy,” Peter Halmay said.

The 77-year-old urchin diver, representing San Diego’s commercial fishermen, sat next to Seaport San Diego developer Yehudi Gaffen at the conference room table of the American Tunaboat Association on Sept. 24. For years, Halmay had worked for this moment, though in a way he’d been planning it for decades – as one of the biggest advocates for commercial fishing’s “fantastic future” in San Diego.

Fishing Industry Tells Committee Regulations Go Too Far

March 16, 2017 — Allegations of bad science and lobbying by overzealous environmentalists dominated talks on marine sanctuary and monument designations during a Congressional hearing Wednesday.

The House Committee on Natural Resources met to unpack the pros and cons of such designations with a panel of industry insiders and their supporters called to testify.

Among those who testified were Brian Hallman, executive director of the American Tunaboat Association, and Chett Chiasson, executive director of the Greater Lafourche Port Commission.

Hallman offered a robust defense of watermen and the fishing industry and was quick to remind representatives that tuna profits reel in a half billion dollars annually and serves as a major boon for the U.S. economy.

According to Hallman, his organization represents all U.S. flagged fishing vessels in the Pacific Ocean and trawls the waters there pursuant to three separate treaties.

Marine Monument Designations Sideline Communities and the Domestic Fishing Industry

March 15, 2017 — The following was released by the House Committee on Natural Resources:

Today, the Subcommittee on Water, Power and Oceans held an oversight hearing on the creation and management of marine monuments and sanctuaries. The panel overwhelmingly objected to the lack of local input, transparency and scientific scrutiny in the marine monument designation process.

“Federal decision-making directly impacts local citizens, local economies and the environment. It is important to review how these decisions are being implemented, and, where needed, correct or improve the laws guiding these decisions,” Subcommittee Vice Chairman Daniel Webster (R-FL) said.

Chairman Rob Bishop (R-UT) discussed his visit to New Bedford, MA, the nation’s top-grossing commercial fishing port, with Democrat Mayor Jon Mitchell, who was unable to attend due to weather.

“[D]uring my visit to New Bedford, we met with dozens of local fishermen and industry to talk about the Magnuson-Stevens reauthorization as well as the state of federal fisheries management. It didn’t take long for the conversation to quickly turn to the then-proposed Marine National Monument off of the coast of Massachusetts. However, the fishermen weren’t just blindly opposing the Monument, they actually came to the table with a pragmatic solution,” Bishop stated.

Unfortunately with the stroke of his pen, President Obama ignored a viable alternative developed with stakeholders and unnecessarily cordoned off vital acreage for fishing communities off the coast of Cape Cod.

In his written testimony, Mayor Mitchell pointed out inherently flawed issues in the monument designation process: “It lacks sufficient amounts of all the ingredients that good policy-making requires: scientific rigor, direct industry input, transparency, and a deliberate pace that allows adequate time and space for review,” Mitchell wrote.  

“A decision-making process driven by the simple assertion of executive branch authority ultimately leaves ocean management decisions permanently vulnerable to short-term political considerations,” Mitchell added. “Such an outcome is cause for deep concern no matter one’s position in the current policy debates.”

Brian Hallman, Executive Director of the American Tunaboat Association, outlined the troubling conflicts monuments and sanctuaries have with established procedures including the federal Magnuson-Stevens Act and international treaties and conventions.

“The fundamental purpose of marine monuments, as I understand it, is to preclude, or at least severely limit, human activity in the designated area […] but limiting fishing via marine monuments makes no sense whatsoever. […] The establishment of marine monuments completely pre-empts and usurps these longstanding, legally binding and effective processes,” Hallman stated.

U.S. Fishing Fleet Prepares To Fight For Fishing Rights In Pacific

November 30, 2016 — PAGO PAGO, American Samoa — San Diego-based American Tunaboat Association (ATA) is calling for, among other things, a “level playing field” and the protection of US fishing rights on the high seas at the 13th meeting of the Western and Central Pacific Fishery Commission from Dec. 5- 9 Nadi, Fiji.

Tri Marine International, which has a fishing fleet based in Pago Pago, as well as American Samoa officials have called for more fishing days on the high seas for the US fleet, as fishing restrictions have impacted fish delivery to the two canneries in American Samoa.

Responding to Samoa News questions, ATA Executive Director Brian Hallman says he as well as eight to ten ATA members will be attending the WCPFC meeting.

Asked to name some of the important issues he plans to argue for ATA, Hallman says, “Our main approach will be to ensure that all management proposals are science based.”  He went on to explain that in the past that has not always been the case; and rules should be applied equally and enforced equally for all fishing fleets, so that there is a level playing field for US vessels.

San Diego tuna chief addresses Congress

March 1, 2016 — A leader in the San Diego tuna industry addressed U.S. Congress on Tuesday over fishing restrictions on the high seas that he said favor foreign boats.

American Tunaboat Association head Brian Hallman threw his support behind legislation that would potentially give U.S. boats a leg up in treaty negotiations for areas of the world’s largest ocean.

The U.S. fleet, many with ties or based in San Diego, has had a rough year so far, losing access to massive sections of the western and central Pacific Ocean.

Compliance in international waters — for things like how many days boats are allowed to fish for tuna in areas where there is no treaty — is governed by three multinational agreements.

The problem, American fleets say, is they are the only nation that ever gets checked on. Also, critics of negotiators from the State Department and the National Oceanic and Atmospheric Administration suggest they could do a better job with treaties.

The legislation, called the Ensuring Access to Pacific Fisheries Act, was introduced by congressional delegate Aumua Amata Coleman Radewagen (R-American Samoa) and Rep. Don Young (R-Alaska).

Its basic function would give more people a chance to negotiate for fishing rights instead of just two people from the federal government.

U.S. to pull out of Pacific tuna treaty

January 19, 2016 — The U.S. State Department has announced its intention to pull out of a nearly 30-year treaty that allowed American boats to fish tuna in a vast area of the Pacific Ocean.

Prompted by some U.S. boats saying they could not pay fees to a cluster of Pacific island nations, the 37-boat fleet — many with ties to San Diego — were not issued licenses at the start of 2016.

The department gave formal notice this week to island nations in the South Pacific Tuna Treaty that it planned to pull out of the world’s biggest tuna fishery.

Pressure on the island nations will likely build as Rep. Duncan Hunter, R-Alpine, plans to introduce legislation in Congress at the end of this week to cut $21 million in foreign aid to 15 of the countries in the treaty.

Brian Hallman, executive director of the San Diego-based American Tunaboat Association, said the treaty has one year to expire and he was hopeful a new deal could be worked out.

“During that year, I believe there will be efforts and negotiations to try to get a restructured treaty,” Hallman said Tuesday, “and we support that.”

He said it was hard to say how many American jobs would be lost because many local fishing captains can transfer to boats in the eastern Pacific Ocean. However, he said the U.S. territory of American Samoa employs thousands who work in canneries and other jobs related to the U.S. fleet.
