Massachusetts: NOAA’s ban suffocating shoreside industry in New Bedford

March 1, 2018 — NEW BEDFORD, Mass. — The hits keep coming from NOAA’s groundfishing ban with financial losses spreading to businesses that support New Bedford’s fishing fleet.

“No one ever really paid attention to our shoreside businesses,” manager of Reidar’s Trawl Gear and Marine Supply Tor Bendiksen said. “We’re the last of the group. We all remember when there was companies like ours up and down this entire coast. The only reason that we’ve all survived in New Bedford is because we had not only groundfishing but we have the scallop industry to support us. But this one little incident with how important groundfish is has put us all to our knees.”

It’s been three months since NOAA installed a groundfishing ban on Sector IX, which halted operations of about 80 fishermen.

Though, the collateral damage of the ban extends beyond fishermen.

Virginia Martins, the president of Sector IX, also is the president of Bay Fuel, which has sold more than 1 million fewer gallons of gas this year compared to past sales.

John Reardon, also a board member and general manager at Hercules SLR, said sales of safety marine equipment is down 50 percent since the ban.

Bendiksen, a Sector IX board member, said sales at Reidar’s are down 30 percent. Reidar’s, which employs 14 people, manufactures fishing nets. In the past, a fisherman’s net would be in his shop at least once a week. Since November, they’ve done three total.

Bullard, fish sector to talk punishment

December 6, 2017 — The New Bedford fishing sector, banned by NOAA from groundfishing for the remainder of this season and possibly beyond because of noncompliance with its own management plan, has issued its rebuttal. And an invitation.

Northeast Fishery Sector IX, accused by NOAA of negligence for allowing Carlos Rafael’s massive illegal misreporting of the scope and nature of his groundfish landings, sent a letter to NOAA Regional Administrator John K. Bullard refuting much of NOAA’s reasoning for the groundfish ban and inviting Bullard to New Bedford to see the changes for himself.

“Sector IX strongly believes that your initial determination was based upon incomplete information and respectfully asks that you reconsider your positions,” Virginia Martins, Sector IX president, wrote Bullard. “This board is willing to reshape the sector for the good of the community and the industry.”

Martins stressed the sector has made “substantial changes in the past six months” by appointing new board members and establishing an enforcement committee.

Sector IX responds to NOAA’s groundfish ban

December 5, 2017 — NEW BEDFORD, Mass. — Sector IX sent a 15-page response to John Bullard and NOAA on Saturday after the governing agency banned the sector from groundfishing two week ago.

The documents sent to NOAA’s Northeast Regional Administrator by Sector IX President Virginia Martins included a six-page letter that outlined grievances with the decision as well as biographies of the new board members and the agenda of an Oct. 26 meeting between the sector and the Greater Atlantic Regional Fisheries Office.

The materials were sent after NOAA banned Sector IX from groundfishing on Nov. 20. The decision came down after Bullard concluded the sector hadn’t addressed lingering issues associated with Carlos Rafael’s illegal activity. Rafael’s boats make up Sector IX. Vessels with non-groundfish permits can still fish. Sector IX is one of 19 fishing divisions in the Northeast that organize fishing operations including overseeing reporting regulations.

Massachusetts: NOAA shuts down Rafael’s fishing sector

November 20, 2017 — NOAA Fisheries dropped the hammer on New Bedford’s Carlos Rafael-dominated Northeast Fishing Sector IX on Monday, withdrawing the sector’s operation plans for 2017 and 2018 and shuttering the groundfish elements of the sector for the remainder of this fishing season.

NOAA Fisheries, which announced the management action Monday morning, said the sector was derelict in its compliance of the previously approved plans and that noncompliance helped Rafael misreport the scope and nature of his catch in a scam that led to his conviction and 46-month jail sentence.

“The action follows the guilty plea of Mr. Carlos Rafael, a major participant in Sector IX, who admitted to falsely reporting catch information,” NOAA Fisheries said in its statement.

NOAA Fisheries said its review showed that Sector IX failed to uphold section plan requirements to the extent that it undermined “foundational principles” necessary for successful sector operations.
