Scallops: NEFMC Advances Framework Adjustment 38 for Fishing Year 2024; Higher VMS Ping Rates Part of the Package

December 7, 2023 — The following was released by the New England Fishery Management Council:

The New England Fishery Management Council has signed off on Framework Adjustment 38 to the Atlantic Sea Scallop Fishery Management Plan. Next, the framework will go to NOAA Fisheries for review and implementation. The target implementation date is April 1, 2024, the start of the new scallop fishing year.

Framework 38 contains specifications and other measures for 2024 and default specifications for 2025. It also includes more frequent reporting through the vessel monitoring system (VMS). A higher 5-minute ping rate will be triggered when a scallop vessel crosses seaward of the VMS demarcation line on a scallop declaration code. Implementation of this measure may be slightly delayed beyond April 1 but is intended for 2024 to improve enforcement.

FULL-TIME ALLOCATIONS: Full- time limited access scallop vessels will be allocated three 12,000-pound access area trips with two trips into Area II and one into the New York Bight. Full-time vessels also will be allocated 20 open area days-at- sea for fishing year 2024.

PART-TIME ALLOCATIONS: Part- time limited access vessels will be allocated one 14,400-pound trip, which can be fished in either Area II or the New York Bight. These vessels will be allocated eight open area days-at-sea.

LAGC ALLOCATIONS: Limited access general category (LAGC) vessels collectively will be allocated 856 access area trips that can be fished in Area II, the New York Bight, and the central portion of Area I as shown in the map on page 1 in green. Once the 856 trips have been taken, access area fishing by LAGC vessels will end. The Council did not suballocate trips by specific area.

The northern portion of Area I, known as “the sliver,” will be closed in 2024. The Area I-Sliver contains high densities of scallops that are likely to recruit to the 4” rings in scallop dredge gear by the 2025 fishing year. These scallops are being protected in 2024 to grow and gain weight for 2025.

Global Fishing Watch responds to Ray Hilborn’s critiques of its study

March 27, 2018 — Global Fishing Watch welcomes Dr. Ray Hilborn’s recent statement in Seafood Source expressing his desire to work together to strengthen our collective insights into commercial fishing activity.

Furthering innovation and collaboration with the scientific community is at the heart of Global Fishing Watch’s mission to advance responsible stewardship of our oceans through increased transparency. Our Research Partners program, an interdisciplinary collaboration with some of the world’s leading marine science institutes, strives to improve fisheries management and science through the sharing of data, new research and cooperation.

Our recent study published in Science was produced with partners at the University of California, University of Santa Barbara, National Geographic Society’s Pristine Seas project, SkyTruth, Dalhousie University, Stanford University, and Google. This research has produced the first-ever dataset of global fishing activities, as captured by satellites using automatic identification system (AIS) positions. Global Fishing Watch’s algorithm processed 22 billion AIS messages to identify more than 70,000 commercial fishing vessels, the sizes of and engine powers of these vessels, what type of fishing they engaged in, and where and when they fished down to the hour and kilometer.

The study and associated maps also depict global fishing activity with an unprecedented resolution – the fishing effort footprint is two to three orders of magnitude higher in spatial and temporal resolution than previous datasets – and reveals that industrial fishing covers more than 55 percent of the ocean’s surface – over four times the area covered by agriculture. This new high-definition global view of fishing would not have been possible without recent advances in computing power, an increase of satellites in orbit, and improved machine learning algorithms.

Importantly, by making all of the data in this study public and freely available, we aim to increase transparency in the commercial fishing industry and improve opportunities for sustainable management and informed decision making. We have also grown the data available within our transparency platform, including adding more AIS data, and through our government and research partners, including vessel monitoring system (VMS) and Visible Infrared Imaging Radiometer Suite (VIIRS) data.

Dr. Hilborn says that vessels monitored for the study were largely tuna boats over 100 feet in length. Technically, these tuna boats are only a fraction of the 70,000 vessels monitored in our study. By far, the vast majority of vessels we observe are Chinese vessels operating in Chinese waters.

For the study, we also only track vessels that have AIS devices, and the fraction of fishing vessels with AIS varies considerably between regions of the ocean. In some regions, such as in Europe, almost all sizeable fishing vessels broadcast their locations. Similarly, in the high seas, we can capture most of the fishing activity, as a high fraction of high seas fishing vessels carry AIS. By contrast, in many developing countries, only a small number do. This fact makes our dataset incomplete, but it is still far more comprehensive than previous global datasets of fishing effort.

Fishing Boats ‘Going Dark’ Raise Suspicion Of Illegal Catches, Report Says

March 12, 2018 — A new report raises concerns that when fishing vessels “go dark” by switching off electronic tracking devices, in many cases they are doing so to mask the taking of illegal catches in protected marine parks and restricted national waters.

In the report released Monday by Oceana, an international conservation group, authors Lacey Malarky and Beth Lowell document incidents of fishing vessels that disappear from computer screens as they shut off collision-avoidance beacons near restricted areas, only to have them reappear days or weeks later back in legal fishing grounds.

“This practice of vessels going dark is really widespread on a global scale,” Malarky tells NPR.

Malarky and Lowell used Global Fishing Watch, which aggregates automatic identification system, or AIS, signals to give an unprecedented view of global fishing activity. AIS signals can be viewed by the public through such websites as Vesselfinder.com.

Yet another system, known as Vessel Management System, or VMS, is not available to the public but is used by countries to monitor their fishing fleets. However, “some countries can’t afford it — developing countries like those in West Africa,” Malarky says. “So, a lot of developing countries rely on AIS to monitor their fishing fleet.”

Global Fishing Watch Partners With NOAA to End Illegal Fishing in Indonesia

January 17, 2018 — SEAFOOD NEWS — The U.S. National Oceanic and Atmospheric Administration (NOAA) has entered into a partnership with the Global Fishing Watch to “improve understanding of the activity of fishing vessels in Indonesian waters.”

The two organizations looked at Vessel Monitoring System (VMS) data from the Indonesian government and compared it to NOAA’s Visible Infrared Imaging Radiometer suite (VIIRS). According to a press release, they hoped to be able to use the data to “identify fishing vessels that are not picked up by other monitoring systems and to test and refine the use of VIIRS for identifying and distinguishing different types of fishing vessels.” What they found was that approximately 80% of VIIRS detections “could not be correlated to a vessel broadcasting VMS.”

The reason a vessel may not be broadcasting VMS is because they are under a 30 gross ton threshold, which was previously established by the Indonesian government. Or, a vessel could not be broadcasting VMS because they are fishing illegally.

“I’m excited for this opportunity to see the dark fleet,” Global Fishing Watch Research Program Director David Kroodsma said in a press release of vessels that don’t show up in VMS. “NOAA’s VIIRS data shows up vessels we can’t see by any other means and helps us to gain a more complete picture of fishing activity.”

The Global Fishing Watch will be using this new data to identify “dark vessels” that may be illegally fishing.

MASSACHUSETTS: State Rep. Straus request reveals NOAA has yet to penalize Rafael

August 25, 2017 — NEW BEDFORD, Mass. — Through a public records request, Rep. William Straus said he discovered that NOAA hasn’t disciplined Carlos Rafael since the indictment has been released.

That included an incident on Aug. 5, 2016, which occurred after the indictment, where public records also show that the Coast Guard cited the Lady Patricia, a Rafael vessel listed in the indictment, for “fishing without proper VMS designation.”

NOAA defines its Vessel Monitoring System (VMS) as a system supporting law enforcement initiatives and preventing violations of laws and regulations. It is used as evidence in the prosecution of environmental laws and regulations including regional fishing quotas, the Endangered Species Act, and the Marine Mammal Protection Act.

Rafael pleaded guilty in March to falsely labeling fish quotas, tax evasion and smuggling money.

NOAA said it doesn’t comment on ongoing cases, but it said it isn’t uncommon for the organization to issues penalties after criminal proceedings.

Straus, D-Mattapoisett, had requested from NOAA all charging documents involving Rafael.

“There was a pattern of behavior which concerned me about its impact on what we want to have in terms of managing the fishery,” Straus said.

Indonesia makes its fishing fleet visible to the world through Global Fishing Watch

June 8, 2017 — This week, at the United Nation’s Ocean Conference, the Republic of Indonesia becomes the first nation ever to publish Vessel Monitoring System (VMS) data revealing the location and activity of its commercial fishing fleet. The new data being made public on the Global Fishing Watch public mapping platform reveals commercial fishing in Indonesian waters and areas of the Indian Ocean where it had previously been invisible to the public and other nations.

Susi Pudjiastuti, the Minister of Fisheries and Marine Affairs for the Republic of Indonesia, is taking a bold step toward increasing transparency in her country’s fishing industry. Today she urges other nations to do the same.

“Illegal fishing is an international problem, and countering it requires cross border cooperation between countries,” says Minister Susi. “I urge all nations to join me in sharing their vessel monitoring data with Global Fishing Watch. Together, we can begin a new era in transparency to end illegal and unreported fishing.”

Also at the UN Ocean’s Conference, Global Fishing Watch has committed to host any country’s VMS data, calling on other governments to follow Indonesia’s lead. “We believe publicly shared VMS will become a powerful new standard for transparent operation in commercial fishing,” says Paul Woods, Global Fishing Watch CEO and Chief Technology Officer for SkyTruth, a founding partner of Global Fishing Watch along with Oceana and Google. “SkyTruth has been collaborating with the Indonesian government for the past two years to really understand their VMS data and find new ways for VMS to enhance their fisheries management.”

Working closely with Oceana toward a united goal of transparency at sea, Peru becomes the first nation to follow Indonesia’s lead. Vice Minister for Fisheries and Aquaculture, Hector Soldi, announced Peru’s intent to publicly share their VMS data in Global Fishing Watch.

“We applaud the commitments made by Peru and Indonesia to publish their previously private vessel tracking data and encourage other countries to follow their lead,” said Jacqueline Savitz, Senior Vice President for the United States and Global Fishing Watch at Oceana. “Together, with forward-thinking governments like these, we can bring even greater transparency to the oceans. By publishing fishing data and using Global Fishing Watch, governments and citizens can unite to help combat illegal fishing worldwide. With more eyes on the ocean, there are fewer places for illegal fishers to hide.”

Putting fishermen first: An open letter to Donald Trump

March 23, 2017 — In your campaign, you correctly recognized that many basic industries in the United States — ones that have created stable jobs and communities for generations — have increasingly come under siege. You identified globalization, overzealous regulation, and the past administration’s inclination to advance international policy goals at the expense of domestic jobs, as among the culprits.

Your words struck a chord among many in the commercial fishing industry, where middle class jobs have been hollowed out of the coastal communities. There are many fishing ports around the country that bear witness to this sad fact.

While your policy prescription is general, like advanced cancer treatments, the best cures may be patient-specific.

We’d like in this column to focus on infrastructure, but not infrastructure as it’s generally thought of. There are plenty of fishing vessels available for use. Many issues with fish processing are largely a function of disuse, rather than a lack of capacity. Instead, we respectfully ask you to focus on the intellectual infrastructure of fisheries management.

Among our chief complaints with the administration just past is that it was long on big plans, but short on follow-through. It’s one thing to center fisheries management policy on data-hungry ecosystem management models and complex catch share programs. It’s quite another to implement these regimes effectively.

Maybe worse than being overzealous, fisheries management in the Obama administration became over-ambitious.

A reflexive reaction might be to throw out all regulation, but that’s not the solution, either. Sustainable fisheries do produce more economic benefits. The U.S. Atlantic scallop fishery is but one example of a somewhat flexible management regime producing an ecologically stable fishery. The lean years have become less lean, and the good — even great — years more prevalent. Product quality improved. Scallopers maintained a consistent level of supply when the rest of the world couldn’t or didn’t. Marketplace rewards followed.

Also, and this may be controversial even among our clients, but starving managers of federal funds does not necessarily make them do less. Specifications need to be set each year, and much of fisheries regulation is just keeping up with what’s happening in the ocean. A lack of resources can, however, make them do what they do less well. “Bureaucratic incompetence” can become a self-fulfilling prophesy when there aren’t sufficient funds for data collection and brain power.

New Fisheries Monitoring Technology to Take Center Stage at Seafood Source Webinar

WASHINGTON (Saving Seafood) — October 19, 2016 — This Thursday, October 20, advances in low-cost small-scale fisheries monitoring will be showcased on Seafood Source’s monthly webinar series. Viewers will learn how emerging technology is significantly smaller and cheaper than traditional vessel monitoring systems, and is helping to lead the fight against illegal, unreported, and unregulated (IUU) fishing. These new tools are also ensuring that small-scale and artisanal fishermen remain competitive as standards for seafood transparency increase.

“Small Vessels, BIG Data: Silicon Valley Takes Up the Fight Against IUU Fishing” will feature Pelagic Data Systems’ (PDS) CEO Dave Solomon and Chief Scientific Officer Melissa Garren, along with Jack Whalen of the Sustainable Fisheries Partnership, and will be hosted by Seafood Source editor Cliff White. It will be held from 12 p.m. to 1 p.m. EST, and is free to view with registration at seafoodsource.com.

PDS is the developer of lightweight vessel tracking systems made specially for small vessels that are being used to fight IUU fishing, and the exploitation of global fish stocks. It has partnered with fishing and conservation groups to pilot its technology in Southeast Asia, as well as Latin America and West Africa. The Sustainable Fisheries Partnership is a non-profit that works to rebuild depleted fish stocks.

Technology such as the one developed by PDS provides monitoring for vessels that are otherwise unable to accommodate large and expensive traditional satellite-based monitoring systems. Such technology is growing in importance as regulations increasingly put a premium on transparency in the seafood supply chain. Just recently, the U.S. raised standards on imported seafood, making it more important than ever for fishermen to have cheap tracking tools to verify sustainable practices.

Using vessel-monitoring tools can also help small-scale and artisanal fishermen stay competitive as the demand for seafood transparency grows. Certifications for fairly traded and sustainably caught seafood can increase the price of catch, but require more comprehensive monitoring to achieve. New technologies allow fishermen to be proactive in demonstrating they are doing things the right way, without waiting for regulations to force their hand.

Today, 95 percent of the global fishing fleet consists of small-scale vessels, and most of these are invisible to data monitoring. This allows for IUU fishing, which hurts the vast majority of the fishing industry and steals profits from legitimate fishing businesses. Filling in the data gap for small-scale fisheries has the potential to benefit law-abiding fishermen while helping to rid the world of IUU fishing.

Ocean Plans In New England And Mid-Atlantic Released

July 12, 2016 — Both the Northeast and Mid-Atlantic Ocean Plans have been released and are open for public comment

Back in May, Rip Cunningham wrote that the soon-to-be-released ocean plans for the Northeast and Mid-Atlantic are about ‘doing the best job possible of coordinating all the previously independent ocean development regulations [and giving] concerned citizens a process to make sure that they are recognized in the development process.’ Rip’s article called on the fishing community to have an open mind about the planning processes and to take the time to read and comment on them. Simply put, he asks people to give the plans a chance and to be active participants.

Now that both plans are released and open for public comment, let’s take a look at what’s in them.

The Northeast and Mid-Atlantic plans have the same basic framework. Using interactive maps and narrative text, they describe the region’s major ocean resources and uses, and lay out actions and commitments to consider and engage those users when decisions are being made that might affect them. For commercial and recreational fisheries, both plans contain a dedicated subchapter describing the industry and a series of maps developed in consultation with fisheries representatives that should help decision-makers understand current fishing uses and trends, the potential impacts proposed development projects would have on fishermen, and which agencies should be reaching out to when potential conflicts arise. Here are some more specifics on each of the two plans:

NOAA Fisheries Announces Atlantic Mackerel Fishery Consequence Measures for Slippage Events

August 11, 2015 — The following was released by NOAA Fisheries:

NOAA Fisheries announces measures to enhance catch monitoring and address slippage (catch that is discarded before it has been sampled by observers) in the Atlantic mackerel fishery.

The slippage consequence measures for limited access mackerel vessels carrying an observer are:

  • If slippage occurs due to safety, mechanical failure, or excess catch of spiny dogfish, the vessel has to move and remain at least 15 nautical miles from the location of slippage; and
  • If slippage occurs for any other reason, the vessel must terminate its trip immediately and return to port.

We are also requiring that vessel operators report slippage events that occur on observed trips via the vessel monitoring system daily catch reports.
