ASMFC Summer Flounder, Scup and Black Sea Bass Management Board to Meet Via Conference Call March 20

Board to Consider Approval of 2018 Recreational Black Sea Bass Regional Proposals

March 13, 2018 — ARLINGTON, Va. — The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic States Marine Fisheries Commission’s Summer Flounder, Scup and Black Sea Bass Management Board will meet via conference call on Tuesday, March 20th at 9 a.m. to consider approval of regional proposals for the 2018 black sea bass recreational fishery. The proposals are required under Addendum XXX, which was approved in February 2018 and uses a combination of exploitable biomass information from the latest stock assessment and historical harvest to regionally allocate the coastwide recreational harvest limit (RHL). The three management regions are:  (1) Massachusetts through New York, (2) New Jersey, and (3) Delaware through North Carolina. Their respective allocations of the 2018 coastwide RHL are 61.35%, 30.24%, and 8.41%.

To improve accountability, Addendum XXX holds states within each region collectively responsible for managing harvest to their regional allocation through the cooperative development of recreational measures. To increase regional consistency in measures, each region will establish a standard set of measures, with each state in the region provided the flexibility to adjust its measures up to one inch in minimum size and three fish in possession limit. Collectively, the combined regional measures are intended to achieve, but not exceed, the 2018 RHL.

ASMFC Approves Black Sea Bass Draft Addendum XXX for Public Comment & ASMFC and MAFMC Initiate Bluefish Amendment

December 19, 2017 — ANNAPOLIS, Md. — The following was released by the Atlantic States Marine Fisheries Comission:

The Atlantic States Marine Fisheries Commission (Commission) and the Mid-Atlantic Fishery Management Council (Council) met jointly to establish recreational specifications for black sea bass, scup, and summer flounder; consider approval of Black Sea Bass Draft Addendum XXX for 2018 recreational management; discuss the initiation of a new Bluefish Amendment; and jointly take action on several items related to all four species (detailed below). The Commission’s actions are final and apply to state waters. The Council will forward its federal waters recommendations regarding summer flounder specifications to NOAA Fisheries Greater Atlantic Regional Fisheries Administrator for final approval.

Black Sea Bass

As part of the discussion on black sea bass recreational specifications, the Commission approved Draft Addendum XXX to the Black Sea Bass Fishery Management Plan (FMP) for public comment. The Draft Addendum considers alternative regional management approaches for the recreational fishery, including options for regional allocation of the recreational harvest limit (RHL) based on historical harvest and exploitable biomass. A subsequent press release on the document’s availability and the public hearing schedule will be distributed once hearings have been finalized. The Council recommended the following recreational measures for federal waters from February 1-28, 2018: a 12.5” minimum size limit and a 15 fish possession limit. Specifications for the remainder of 2018 fishing season will be determined in February.

The Commission and Council also initiated the development of an addendum/framework to address several recreational management issues. The addendum/framework will consider implementing a conservation equivalency management program for black sea bass similar to that used with summer flounder by allowing state or regional measures to be implemented in both state and federal waters; allow for a summer flounder, scup and black sea bass transit provision in federal waters around Block Island similar to the provision allowed for striped bass; and consider the possible implementation of slot limits in federal waters for summer flounder and black sea bass. This addendum/framework will be developed in 2018 with the goal of implementation prior to the 2019 recreational fishing seasons.

Additionally, the Commission/Council reviewed draft alternatives for an addendum/framework to consider the opening of the Wave 1 recreational fishery in 2019 through a Letter of Authorization. Work on these documents will continue in 2018.

Bluefish

The Council and Commission initiated a new amendment to the Bluefish FMP. The intent of the Draft Amendment is to review and possibly revise commercial/recreational allocation of the resource, as well as the distribution of the commercial quota among the states. A Scoping Document will be released sometime in 2018.

Scup

For scup, Commission and Council maintained status quo recreational management measures in federal waters (e.g., 9-inch minimum size, 50 fish possession limit, and year-round open season). For state waters, the Commission approved the continued use of the regional management approach. Based on interest expressed by fishery managers and stakeholders, the Technical Committee will conduct an analysis on the potential impacts of lowering the size limit for northern region state waters on the 2018 coastwide harvest. The Technical Committee will present this analysis at the Commission’s Winter Meeting in February. 

Summer Flounder

For summer flounder, the Commission and Council extended the provisions of Addendum XXVIII, allowing for the use of conservation equivalency to achieve, but not exceed, the 2018 summer flounder RHL of 4.42 million pounds. Conservation equivalency allows individual states or multi-state regions to develop customized measures that, in combination, will achieve the coastwide RHL. Further, it was specified that any modifications to state measures in 2018 should result in no more than a 17% liberalization in coastwide harvest relative to the projected 2017 harvest of 3.23 million pounds. This maximum liberalization was set based on continued concern for the stock status of summer flounder. Additionally, information suggests 2017 appears to be an anomalous low year in terms of effort and harvest, raising concern that overages in 2018 may occur under a larger liberalization in regulations if catch and effort rates increase in 2018. In extending the provisions of Addendum XXVIII, the regional delineation for 2018 will be:  (1) Massachusetts (2) Rhode Island (3) Connecticut‐New York, (4) New Jersey, (5) Delaware‐Virginia, and (6) North Carolina. Any state or region wishing to modify its management measures must submit proposals for Technical Committee review in January, and Board consideration in February.

The Commission and Council set non-preferred coastwide measures in the event that state conservation equivalency measures are not approved by NOAA Fisheries. These measures include a 4-fish possession limit, a 19-inch total length minimum size, and an open season of May 15 – September 15. The Council and Board also approved precautionary default measures (i.e., a 2-fish possession limit, a 20-inch total length minimum size, and an open season of July 1 – August 31), which will be implemented in any state or region that does not adopt measures consistent with the conservation equivalency guidelines.

Lastly, work continues on the development of a new Summer Flounder Amendment. The Commission and Council reviewed the latest revisions to the Draft Amendment, including FMP goals and objectives, and commercial alternatives. An updated draft document is scheduled to be released in 2018 for public comment.

New York Commercial Fishermen Want Gov. Cuomo to Sue Federal Government Over Fluke Quota

October 10, 2017 — Several dozen fishermen, women and lawmakers last week urged Gov. Andrew M. Cuomo to make good on a promise to sue the federal government over New York’s disproportionately low share of the fluke fishery.

At a meeting at East Hampton Town Hall last Wednesday, the gathering of fishing interests sought to unify their agenda before a meeting with top state officials scheduled for next month.

The commercial fishery for fluke was shut down in September for the first time in recent memory. It reopened Oct. 1 with a 50-pound daily limit. New York gets 7.6 percent of the commercial fluke quota, while North Carolina and Virginia get more than 20 percent each.

Chuck Morici, a Montauk commercial fisherman, used an empty fish basket to demonstrate the inequities. New York’s current daily quota fills the basket by about a third, he said, while boats from Virginia can take 153 baskets — about 10,000 pounds.

Commerce chief Ross makes waves, roils fisheries rules

September 21, 2017 — Commerce Secretary Wilbur Ross has wasted little time in giving a jolt to the nation’s fisheries.

In June, the 79-year-old billionaire investor who now oversees NOAA Fisheries singlehandedly extended the fishing season for red snapper in the Gulf of Mexico, ignoring protests from scientists and environmentalists that it could spur overfishing of the popular species.

Then in an unprecedented decision in July, he handed a big win to New Jersey fishermen and the state’s Republican governor, Chris Christie, by overturning catch limits for summer flounder that had been approved by an interstate fisheries commission.

While Ross wants more fishing and more seafood exports, critics say his early moves have smacked of meddling and favoritism and will ultimately sabotage hard-won conservation gains.

And many fear that states and fishing groups will directly seek political relief instead of following NOAA procedures and adhering to fishing quotas set by government experts and scientists.

“It just really seems that it’s kind of setting a bad precedent,” said Trey Blackiston, a former commercial fisherman from Chestertown, Md.

Noah Oppenheim, executive director of the Pacific Coast Federation of Fishermen’s Associations, said he’s still waiting for Ross to sign an emergency declaration for California crabbers and salmon fishermen. But he’s worried about the signals from Washington.

“We’re asking maybe the wrong questions, right?” Oppenheim said. “If the Trump administration is finding it easier to disrupt the status quo than to follow the normal procedures to get this done, we don’t want any part of that. We’re sort of sitting on the West Coast with one of the best fishery management council processes in place … watching the country crumble and wondering what the hell’s going on. But I’m not inclined to seek political favors.”

Federal Regulators Conduct Fishing Net Testing for Flounder

September 15, 2017 — WASHINGTON — A National Oceanic and Atmospheric Administration research project in the Northeast was recently conducted to test the efficiency of different sweep types of fishing nets.

The team targeted summer flounder from Long Island to Nantucket and red hake in the western Gulf of Maine off Cape Ann.

Preliminary results show that smaller fish were caught more often using a chain sweep.

NEW YORK: Commercial fishers reeling from shutdown of fluke fishery

September 6, 2017 — It was the busy Labor Day Weekend, and Southold Fish Market owner Charlie Manwaring had been forced to stock his popular East End restaurant and market with out-of-state fluke for the first time in recent memory.

“This is my backyard, and on a holiday weekend I have no fluke,” he complained to Rep. Lee Zeldin (R-Shirley) at a meeting Friday morning with two dozen angry Long Island fishermen and women at the Mattituck fishing dock. “I have to rely on Rhode Island and Jersey and Massachusetts and Carolina.”

Late last month, state regulators, working with a limited New York quota from a multistate fishery council, shut down the commercial fluke fishery for September.

As a result, Manwaring and other local shop owners will “pay more, the fish will cost customers more, and they’ll be older,” said Bob Hamilton, a trawler operator out of Greenport, who typically sells his fluke to Southold Fish Market. “It’s just people in fisheries management who have no understanding of running a business.”

“The fluke paid our bills,” said Cindy Kaminsky, who fishes commercially out of Mattituck. “It’s hard to be just put out of business, and it’s a month out of a short fishing period. We don’t fish in winter and every year it gets a little bit worse.”

Cooperation between fishermen, regulators not just a fluke

August 30, 2017 — NARRAGANSETT, R.I. — The following is excerpted from an article published today by the Providence Journal:

Fisheries management is only as good as the science that it’s based upon. The better the science, the more effective the management.

For the past three years, Point Judith fisherman Chris Roebuck has partnered with federal regulators to get a better handle on fish stocks, taking scientists with the National Oceanic and Atmospheric Administration out to sea on his 78-foot Western-rig stern trawler the Karen Elizabeth to help figure out where groundfish are and in what numbers.

This summer’s trip wrapped up this week when the team of five researchers led by John Manderson, a senior ecosystem field scientist with NOAA’s Northeast Fisheries Science Center, and a four-man crew headed by Roebuck returned to port in Galilee with new information on summer flounder, red hake and other species.

Their research is more important than ever as regulators try to respond more nimbly to shifts in fish abundance and distribution caused by the changing climate.

The work depends on the collaboration between Roebuck and Manderson.

“I can’t do this research without him because I don’t know the ecosystem the way he does,” Manderson said. “I can work with him and quantify what he knows.”

Roebuck, 45, has been fishing his whole life. A second-generation fisherman, he was lobstering at 12 and has captained the Karen Elizabeth for the past two decades.

He fishes for squid from September to April and for sea scallops from April to June, trawling ocean waters from Delaware to the Canada border.

Working with the fisheries science center was a no-brainer for Roebuck, who believes that there are more fish in the sea than regulators are currently counting. Better data could end up benefiting him and other fishermen if they’re allowed to catch more.

“In the end, I’m just interested in making the science more accurate,” Roebuck said.

Warming oceans: fish on the move

August 17, 2017 — The oceans are getting warmer, and fish are adapting to rising ocean temperatures with their fins and swimming to waters that better suit their temperature preferences. Shifts in the distribution of important coastal fish species are resulting in changes to historical fishing options, new fishing opportunities and new fisheries management challenges.

There are many examples of the distributions of fish species changing in response to the warming oceans, but let’s focus on a few species important to Delaware both past and present. Winter flounder were popular recreational fish decades ago, but they have largely left Delaware waters that are now too warm. Summer flounder and black sea bass remain two of the most sought-after recreational fish in Delaware, but their distribution is gradually shifting northward, with fewer fish available in Delaware waters.

While flounder and black sea bass are examples of changing fish distributions that have decreased fishing opportunities in Delaware, other species seem to be more available in Delaware due to the warming ocean, such as cobia and blueline tilefish, with other southern species likely to become more common in Delaware as our waters continue to warm.

Changing temperatures, changing fish

Winter flounder were a popular, cool weather catch for Delaware’s recreational anglers during the 1960s and 1970s. Delaware was at the southern range of winter flounder distribution and their departure from Delaware waters began soon after those peak years. The number of winter flounder caught during December in Delaware’s Inland Bays by the Division of Fish and Wildlife’s trawl survey declined by more than 90 percent between 1966 and 1981.

Adult winter flounder had virtually disappeared from the trawl survey catches by the early 1990s, with a similar and notable reduction in recreational angler catches. Winter flounder have suffered a steep population decline over the past 20 years and the current winter flounder distribution suggests that this species is still moving north to stay in its preferred temperature range, making it unlikely that they will return to Delaware.

ASMFC & MAFMC Modify Scup Specifications for 2018 and 2019

August 11, 2017 — PHILADELPHIA — The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic States Marine Fisheries Commission (Commission) and the Mid-Atlantic Fishery Management Council (Council) reviewed previously approved specifications for summer flounder, black sea bass and bluefish fisheries and modified 2018 and 2019 specifications for scup. The Commission’s actions are final and apply to state waters. The Council will forward its federal waters recommendations regarding scup specifications to NOAA Fisheries Greater Atlantic Regional Fisheries Administrator for final approval.

The table below summarizes commercial quotas and recreational harvest limits (RHL) for summer flounder, scup, black sea bass, and bluefish (2017 values are provided for comparison purposes). Please note the 2019 scup specifications may be adjusted based on changes in the fishery or new scientific information.

Scup

The scup stock assessment update, which includes data through 2016, indicates the stock was not overfished and overfishing was not occurring in 2016. Spawning stock biomass was estimated to be 206% of the biomass target. Given the desire to maintain stable measures and take into account management uncertainty raised by the Monitoring Committee, the Commission and Council approved a commercial quota of 23.98 million pounds (a 30% increase from the 2017 quota) and a RHL of 7.37 million pounds (a 34% increase from the 2017 RHL) for the 2018 and 2019 fishing seasons. The difference between the increases in the commercial quota and RHL is due to projected discard estimates for the commercial and recreational fisheries.

Summer Flounder

For summer flounder, the Commission and Council received a data update, including catch, landings, and survey indices through 2016. The Council and Board maintained the previously approved 2018 specifications based on stock projections from the 2016 assessment update. A benchmark stock assessment is scheduled for peer review in late 2018. A working group is being formed to develop alternative modeling approaches to be considered in the assessment.

The Commission and Council were also presented a range of commercial alternatives for possible consideration in the Draft Summer Flounder Amendment. Based on feedback from both bodies, work will continue on the development of management alternatives for permits and latent effort, as well as commercial allocation. The Board and Council will decide which management alternatives to include in the document at a later meeting.

Black Sea Bass

The Commission and Council received a data update for black sea bass, including catch, landings, and survey indices through 2016. The update indicates black sea bass biomass continues to be high, and the 2015 year class appears to be above average. The Commission and Council maintained 2018 specifications, which were set in February 2017 based on stock projections from the 2016 assessment update. An assessment update is tentatively scheduled for 2018.

Bluefish

The Commission and Council also maintained 2018 specifications for bluefish. The 2018 commercial quota and recreational harvest limit are preliminary and will likely change following release of 2017 final Marine Recreational Information Program harvest estimates. These estimates can impact how much is transferred from the recreational sector to the commercial sector. An assessment update is scheduled for 2018.

Jim Lovgren: Managers responsible for summer flounder mismanagement

August 9, 2017 — The following was submitted to Saving Seafood by Mr. Jim Lovgren:

Earlier this year New Jersey was found to be out of compliance by the Atlantic States Marine Fishery Commission (ASMFC) in regard to the proposed recreational catch specifications for summer flounder, or fluke. The ASMFC, which jointly manages summer flounder with the Mid Atlantic Fishery Management Council (MAFMC), had recommended an increase in the recreational size limit for summer flounder to 19 inches for New Jersey. New Jersey fishery management representatives balked at that proposal and instead presented an alternative proposal that would keep the size limit at the present 18 inches but with a shorter season which would still meet the same conservation goals as the Commission’s plan.

The Commission denied this alternative and declared New Jersey out of compliance, an action that would result in the shutdown of the summer flounder fishery, both recreational and commercial, sometime later this summer. Unfairly, this shutdown would have occurred after the recreational season was over, and would only impact New Jersey’s commercial fishermen, who are already struggling with a 50% cut in their quota over the last two years.

New Jersey appealed the ASMFC’s finding of non-compliance to U.S. Department of Commerce Secretary Wilbur Ross, who on July 11th announced that he agreed with New Jersey, and found its proposed specifications would meet the mandated conservation goals as well as the Commission’s regulations would. The Commission responded with a “sky is falling” press release objecting to the Secretary’s decision, and setting up New Jersey as the fall guy for the so-called collapse of the stock.

Even though I firmly disagree with the assertion that the summer flounder stock is in trouble, fishery managers need to examine their past mistakes in managing the species. It is their mismanagement that has caused the recreational industry to target only the largest breeders in the biomass, killing the large females that produce the most viable eggs, while at the same time causing millions of fluke to be discarded dead every year because they do not meet the stringent length requirements.

Fifteen years ago, as a member of the MAFMC, I stated that the constant increasing of the recreational size limit was at some point going to do more damage than good. I said then that I believe that once you reach a size limit of 16 or more inches that the effects of discarding would nullify any effect a higher limit had on reducing the catch. At that time, with a possession size limit of 16 inches, I estimated a five-to-one discard-to-catch rate. That has since climbed to twenty-to-one in some areas, meaning that to catch a single “keeper” an angler will discard 19 smaller fish.

Obviously many of those twenty fish will die, and the National Marine Fishery Service is sticking with a 10% mortality rate for those discards. I personally know of nobody who believes that percentage to be correct, and mortality may well be as high as 50%.

Regardless of what the real mortality rate is, at 10% with a twenty-to-one keeper rate would lead to millions of dead fish annually, and hundreds of thousands of disaffected anglers, who now disregard the regulations because they find them ridiculous. I urged the Council/Commission to do the math and to find the number where discard mortality negates any benefits from increasing the size limit. They never did.

I have been commercial fishing for over forty years and summer flounder is my primary target. The stock reached a historical high about five years ago, and has since declined slightly according to my fishing experience. The last two years I’ve noted a small decline in my catch per unit of effort (CPUE), but this year I have seen the best recruitment of 14 and 15 inch fish I have seen in at least five years. This past month my CPUE has been the best ever, resulting in short day trips of 5 hours dock to dock for my 500 pound trip limit: one two-hour tow, and go home. The two-month season lasted two weeks thanks to the ease of catch, combined with the recent reductions in quota. The summer flounder stock is still near the historic high level of spawning stock biomass, yet the fishing industry is allowed to catch only 20% of the landings that were common 35 years ago with a lower spawning stock biomass.

There is no shortage of summer flounder, only some angry stock assessment scientists who’re still mad that the fishing industry hired their own scientist a few years back to do his own independent stock assessment using the same NMFS data. The scientist, Dr. Maunder, discovered the science was wrong. Coincidentally the fishing industry has hired their own scientists on the east coast for two other fisheries, scallops and monkfish. In both those fisheries the Northeast Fisheries Science Center’s stock assessment science was found to be inaccurate, resulting in a higher quota for the species. So it seems like there is a pattern regarding the NEFSC that indicate the quotas have been set too low.

This brings up the National Academy of Science’s review of all of the fishery management plans that underwent rebuilding after being found to be overfished since the Sustainable Fisheries Act was implemented in 1996. They discovered that in the whole country twenty stocks underwent rebuilding plans that were later found to have not needed them, causing reductions in quota, closures, and putting people out of business. Amazingly, the study found that of those twenty stocks ten of the wrong assessments originated in the NEFSC. There are 6 Fishery Science Centers in the U.S. and no other one had more than two mistakes. Not included in the study were butterfish and menhaden, which were erroneously declared overfished after the study was concluded, which were also wrongly assessed by the NEFSC. That makes 12 out of 22 stocks wrongly assessed by the NEFSC, which is clear incompetence in anybody’s book. These mistakes cost the American public hundreds of millions of dollars, yet no one was held accountable, and the results were swept under the rug.

A decade before the National Academy of Science study, “Trawlgate” occurred, where it was discovered that a trawl survey vessel had been towing their net around for at least two annual surveys with one tow cable shorter than the other. As a result, a trawl survey advisory group was formed, of which I was a member, and designed a new net for the new survey vessel that was soon to be deployed. This net was going to use two different sweeps, a large “rock hopper” sweep for the Gulf of Maine with 12 inch rubber “cookies,” while a smaller 4 inch “cookie” sweep would be used in the Georges Bank and Mid Atlantic regions due to their sand/ mud bottom habitat. The 4 inch cookie sweep is the industry standard size and is designed to catch flatfish and other demersal species. The large rock hopper just rolls over flatfish.

At the same time, the NEFSC cancelled their annual winter trawl survey which was designed to catch flatfish, explaining that by using the new 4 inch cookie sweep in the spring and fall surveys they should get accurate data on flatfish. Within months of the winter survey cancellation they decided that they would only use the large rock hopper sweep throughout the whole of the survey area, resulting in the abandonment of the trawl survey advisory panel, as industry members quit in disgust.

With that track record in mind, we return to Dr. Maunder, who discovered that although summer flounder stock assessments were performed for over 40 years, no one noticed that males rarely grew bigger than 17 inches, and that fish bigger than 18 inches are almost all female. Not taking this important basic biological fact into consideration in doing a stock assessment is going to lead to very inaccurate spawning stock biomass numbers, and hence, another wrong assessment. How embarrassing, of course doing the science right resulted in an increased quota. NMFS has been trying to get those fish back ever since.

So congratulations to Secretary Ross for his well-reasoned decision. As for the Commission and the Council, get your act together and develop a management plan that does not target all the spawning stock biomass, while creating an enormous discard problem, think about a slot limit or total length, ideas that have been suggested for decades, and ignored.

Mr. Lovgren’s grandfather, who was a lifelong fisherman himself, came to New Jersey from Sweden after World War I. Mr. Lovgren has been active in fishery management issues for decades. He currently holds the position of the Director at the Fisherman’s Dock Cooperative, is a Board of Trustee member for Clean Ocean Action, is on the board of directors for the Garden State Seafood Association, and is President of the Ocean County Farm Bureau. Additionally, he has served as the Director of the New Jersey Seafood Harvesters’ Association. Mr. Lovgren has also served on several state and regional fishery advisory councils and served two terms on the Mid-Atlantic Fishery Management Council. In addition to the various councils and boards he has served on, Mr. Lovgren has also presented on Fishing Responsibility for Dogfish at the Responsible Fishing Workshop in Providence, Rhode Island. In 2006, Mr. Lovgren received the Highliner Achievement Award for lifetime service to the fishing industry.
