IAN URBINA: Out on the high seas, when news happens no one sees it

April 26, 2021 — About 100 miles off the coast of Thailand, three dozen Cambodian boys and men worked barefoot all day and into the night on the deck of a purse seiner fishing ship. Fifteen-foot swells climbed the sides of the vessel, clipping the crew below the knees. Ocean spray and fish innards made the floor skating-rink slippery.

Seesawing erratically from the rough seas and gale winds, the deck was an obstacle course of jagged tackle, spinning winches and tall stacks of 500-pound nets. Rain or shine, shifts ran 18 to 20 hours. At night, the crew cast their nets when the small silver fish they target — mostly jack mackerel and herring — were more reflective and easier to spot in darker waters.

This was a brutal place, one that I’ve spent the past several years exploring. Fishing boats on the South China Sea, especially in the Thai fleet, had for years been notorious for using so-called sea slaves, mostly migrants forced offshore by debt or duress.

Two-thirds of the planet is covered by water and much of that space is ungoverned. Human rights, labor and environmental crimes occur often and with impunity because the oceans are vast. What laws exist are difficult to enforce.

Arguably the most important factor, though, is that the global public is woefully unaware of what happens offshore. Reporting about and from this realm is rare. As a result, landlubbers have little idea of how reliant they are on the sea or the more than 50 million people who work out there.

Taiwan responds to NGO reports on forced labor within its fishing fleet

April 2, 2021 — Taiwan’s fisheries regulator has answered NGO claims of forced labor in its fishing fleet through a statement issued to SeafoodSource.

Noting the attention NGOs have brought to the abuse of foreign workers aboard Taiwanese fishing vessels, the Taiwan Fisheries Agency said in its statement it has “endeavored to improve the protection of the rights and benefits of the crew members through institutional guarantees.”

Thai labor ministry, industry groups sign deals to improve anti-slavery efforts

April 1, 2021 — The Thailand Department of Labor Protection and Welfare is partnering with seafood industry groups on an effort to eliminate the use of forced labor in the sector.

On 29 March, the Thai government signed non-binding memoranda of understanding with several industry associations, under which the companies will make public their policies to combat forced and child labor, establish mechanisms to deal with complaints, and undergo audits on the quality and effectiveness of their labor standards.

Tuna brands slammed for “glacial” progress in addressing labor abuses

March 23, 2021 — A new report on labor abuses in the tuna-fishing industry points to “sustained abuse of workers” aboard vessels.

The report by the United Kingdom-based Business & Human Rights Resource Centre (BHRRC), “All at sea: An evaluation of company efforts to address modern slavery in Pacific supply chains of canned tuna,” found labor abuse issues were worsening as a result of increased demand for tuna during the global COVID-19 crisis, which has forced vessels to stay at sea for longer intervals.

How new technology is helping to identify human rights abuses in the seafood industry

February 26, 2021 — After being at sea for two long years, 37-year-old Indonesian fisherman Darmaji finally stepped off the Taiwanese tuna fishing vessel he had been working on and back onto firm ground in May of 2020. Verbally abused daily, Darmaji’s largely Indonesian crew of 22 often worked 18-hour days—even when seven-meter waves flooded the boat interior—and were typically allowed to sleep for only three hours. Meals consisted of gummy rice, boiled chicken or fish, and, at times, even bait fish. The crew had to pay for any other food they consumed and drank largely distilled saltwater.

As if the daily indignities weren’t enough, Darmaji didn’t receive the full pay he was promised in his contract, and even had to pay a $1,200 security deposit before receiving his monthly salary. “It’s a prison at sea,” Darmaji said.

Lured by the promise of high wages offered by recruitment agencies, Darmaji is one of an estimated 23,500 Indonesians working on foreign boats. Globally, capture fishing employs 27 million people, primarily from developing countries. Indonesia is one of the biggest sources of cheap migrant labor for fishing fleets from China, South Korea, and Taiwan.

Darmaji experienced verbal abuse, debt manipulation, underpayment, and atrocious living conditions, but he is one of the luckier ones—thousands of other forced laborers also endure physical abuse at sea. Beatings for insubordination are not uncommon, said Max Schmid, deputy director at the Environmental Justice Foundation, a nonprofit that aims to raise public awareness of environmental and human rights abuses. One worker described getting locked in a freezer, and later electrocuted with a tool used to kill tuna, he notes. Schmid and colleagues have interviewed hundreds of Indonesian fishermen about working conditions on distant water fishing vessels mainly flagged to Taiwan, China or South Korea; over 20 percent of them described physical violence.

Hawaii Longline Association Supports Federal Agency Recommendations Regarding Human Trafficking in the Seafood Supply Chain

February 4, 2021 — The following was released by the Hawaii Longline Association:

Human trafficking, including forced labor in fisheries and the seafood supply chain, has rightfully garnered attention in recent years. This unconscionable activity is not condoned by the Hawaii Longline Association (HLA) and other responsible fishing organizations, and has led to seafood industry-developed standards and social responsibility auditing mechanisms. Recent reports to U.S. Congress present government actions to further prevent and respond to such labor abuses including: 1) Department of Commerce and Department of State Report to Congress on Human Trafficking in the Seafood Supply Chain, Section 3563 of the National Defense Authorization Act for Fiscal Year 2020 (P.L. 116-92) and 2) Federal Agency Task Force on Human Trafficking in Fishing in International Waters.

“The Hawaii Longline Association commends the work of federal agencies to address this important topic and supports many of the recommendations made in these reports,” said HLA Executive Director Eric Kingma.

Paramount among the recommendations covering domestic fisheries is the development of a temporary visa program for foreign fishing crews. “Providing foreign crews temporary work visas, as recommended in the Task Force report, is an important measure that would benefit foreign workers in our fishery, allowing them to go home and visit family and friends and then return to Hawaii via air travel in an efficient, humane manner,” Kingma said.

Currently, foreign fishermen employed in the fishery are ineligible to obtain a visa and thus are prohibited from flying into Honolulu. Rather, these fishermen must board their employer’s Hawaii-based longline vessel in a foreign port (e.g., Mexico or Canada) or U.S. Territory (e.g., American Samoa) and transit nearly two weeks to Honolulu to begin their legal employment, which is authorized under U.S. law (46 USC 8103(2)(b). However, despite being legally employed to fish on U.S. vessels fishing for highly migratory species in the U.S. EEZ and high seas, without visas they are required to stay within the Honolulu Harbor port area. The only exception to leave the port area is for medical visits or to depart from Honolulu International Airport with permission from the U.S. Department of Homeland Security, Customs and Border Protection (CBP).

The majority of the 140 active longline vessels operating out of Honolulu Harbor have legally employed foreign crew for over 30 years. Like migrant farm and food processing workers employed across the nation, these skilled fishermen temporarily leave their countries to seek higher paying jobs in the United States, to support their families back home. Other U.S. tuna fleets that fish on the high seas also employ foreign crew, including U.S. distant water purse seine vessels, West Coast-based albacore vessels, and East Coast-based longline vessels. Hawaii longline crew are mainly from Indonesia, Philippines, Vietnam, and Pacific Island countries.

Slavery and overfishing on the high seas can’t hide from these researchers

December 22, 2020 — A tracking system designed to help ships avoid crashing into each other has become an important tool for spotting bad behavior on the high seas. Researchers can now put a spotlight on corporations that dominate fishing in unregulated international waters where it’s easier to get away with overfishing. And it’s giving us a better idea of how widespread slave labor could be on fishing vessels.

Two recently published papers use this technology, the maritime Automatic Identification System (AIS), to make high-seas fishing a little less mysterious. The first study, published in the journal One Earth on December 18th, traces the origins of thousands of high-seas fishing vessels back to big-time corporations that keep store shelves stocked with seafood. Other researchers use AIS to reveal telltale markers of forced labor on fishing boats, which were published today in the journal Proceedings of the National Academy of Sciences (PNAS). That all makes it easier to make companies answer for any abuses they commit at sea.

The technology, the maritime Automatic Identification System (AIS), has actually been around for about two decades. Basically, vessels carry around a box that sends out radio signals that anyone else can pick up on. Those radio signals share information about the ship, an identifying number, and other things like its size, course, and speed. That’s supposed to help vessels spot each other so they don’t get in each other’s way.

US ramping up pressure on China’s use of forced labor in distant-water fishing

November 19, 2020 — Fishery products from China and Taiwan have been added to a list of commodities associated with forced labor in the latest edition of a US government report on child and forced labour globally.

The 2020 edition of the List of Goods Produced by Child Labor or Forced Labor – a report required by the Trafficking Victims Protection Reauthorization Act of 2005 – claims that the majority of workers on Chinese distant-water fishing vessels are migrants from Indonesia and the Philippines.

ISSF Announces First Conservation Measure Addressing Social and Labor Standards

October 29, 2020 — The following was released by the International Seafood Sustainability Foundation:

The International Seafood Sustainability Foundation (ISSF) today announced the adoption of a new conservation measure requiring ISSF participating companies to develop and publish a public social and labor standards and/or sourcing policy that applies to the company and its entire supply chain. The measure will be in effect for processors, traders, importers, transporters marketers and others involved in the seafood industry associated with ISSF and includes production facilities and fishing and supply vessels.

“With the announcement of this conservation measure, ISSF is pleased to formalize our commitment to human rights protections in global tuna fisheries, a topic we have increasingly supported as our work toward sustainable fisheries has evolved,” said ISSF President Susan Jackson. “Conservation Measure 9.1 Public Policy on Social and Labor Standards joins the now dozens of ISSF conservation measures for sustainability best practices. With the majority of the world’s canned tuna processing capacity conforming to these measures — and with major tuna companies being transparently audited against them — we are driving unique and positive change across the world’s tuna fisheries.”

Conservation Measure 9.1 Public Policy on Social and Labor Standards states that processors, traders, importers, transporters, marketers and others involved in the seafood industry shall develop and publish a public social and labor standards policy and/or sourcing policy that applies to it and its supply chain, including production facilities and fishing and supply vessels, that addresses, at a minimum, the following categories:

  • Forced labor
  • Child labor
  • Freedom of association
  • Wages, benefits and employment contracts
  • Working hours
  • Health and safety
  • Discrimination, harassment and abuse
  • Grievance mechanisms

Under the new measure, a company policy will be considered public if it is published on the company’s website or is otherwise available to the general public. The conservation measure will go into effect on January 1, 2021.

About ISSF Conservation Measures & Compliance Process

ISSF is a global partnership among scientists, the tuna industry and the environmental non-governmental community whose mission is to undertake science-based initiatives for the long-term conservation and sustainable use of tuna stocks, reducing bycatch and promoting ecosystem health.

Since its inception in 2009, ISSF has adopted conservation measures and commitments to facilitate this mission with the intent that processors, traders, marketers and others involved in the seafood industry will follow them to facilitate real and continuous improvement across global tuna stocks. Each ISSF participating company commits to conform to these conservation measures to improve the long-term health of tuna fisheries. They also must adhere to the ISSA Compliance Policy.

ISSF participating tuna companies, which represent the majority of the world’s canned-tuna production and include well-known brand names, are audited yearly by MRAG Americas on their compliance with ISSF conservation measures.

US includes Taiwan on forced labor list due to fishing industry abuses

October 1, 2020 — The U.S. Department of Labor (DOL) has released its 2020 “List of Goods Produced by Child Labor or Forced Labor,” and has included Taiwan for the first time for its issues related to forced labor in the fishing industry.

The inclusion comes after 19 NGOs and businesses urged the DOL to include the nation on its list after discoveries of forced labor on fishing vessels in Southeast Asia. A damning Greenpeace report accused 13 foreign distant-water fishing vessels of using forced labor.
