ALASKA: Proposal for state buyback of Cook Inlet setnet permits advances in Legislature

March 12, 2021 — Legislation aimed at easing tensions and fishing pressure in one of the state’s most popular fisheries is already on the move this session after dying in the COVID-shortened session last year.

Without objection, the Senate Resources Committee advanced Sen. Peter Micciche’s Senate Bill 29 to the Finance Committee March 8; the bill authorizes the state to buy back nearly half of the upper Cook Inlet setnet permits on the Kenai Peninsula from any members.

Micciche, a Soldotna Republican who was also selected Senate President earlier this year, said during a March 3 Resources hearing that the plan for the state to voluntarily repurchase permits from East Side Cook Inlet setnetters was initially drafted by a group of sport anglers and commercial harvesters “who have struggled to work together for many years and now feel like they have a solution moving forward.”

Resources chair Sen. Josh Revak, R-Anchorage, noted that public testimony on SB 29 generated nearly 30 mentions of support, primarily from East Side setnetters, and no opposition, which was a contrast from prior attempts to move similar legislation.

“We’re finally at the end of our rope. Fishing families that have been fishing the East Side of Cook Inlet for generations are at the end of their rope,” Micciche said to the committee. “We want some of those fishing families to remain viable and give those that choose to be bought out an opportunity to move to other fisheries or to retrain for another line of work.”

‘Derelict vessel’ law snags Alaska fishermen

June 26, 2019 — A well-intended new Alaska law has gone awry from a botched rollout that has turned thousands of Alaskan fishing vessel, tender, barge and sport fish operators into lawbreakers.

Since the start of 2019, all vessels over 24 feet are required to be registered with the state at a Department of Motor Vehicles office. Previously, vessels that were documented with the Coast Guard were not required to also register with the state. The state registration costs $24 and is good for three years.

“You need to get down to the DMV whether you’re documented or not,” explained Frances Leach, executive director of United Fishermen of Alaska.  “If you’re documented you have to register, and if you’re not documented, you have to register and get a title.”

The new rule stems from Senate Bill 92, the Derelict Vessels Act introduced last year by Sen. Peter Micciche (R-Soldotna) and passed by the Legislature. It is intended to help harbormasters and others track down owners of abandoned vessels.

But virtually no mariners know about the new registration requirement.

“We found out about it from a DMV personnel in Haines who told one of our gillnetters, and he told me. And we both called the troopers and they didn’t know anything about it,” said fisherman Max Worhatch of Petersburg. “Later they got back to us and said it was indeed the law.”

Will the fish habitat ballot proposal prod Alaska lawmakers to pass a similar bill? Don’t count on it.

January 30, 2018 — JUNEAU, Ala. — Opponents of a citizens initiative to boost protections for salmon habitat have a path to adapt the proposal to better suit them: helping pass a similar bill through the Alaska Legislature, which would render the initiative void.

The largely Democratic House majority last week introduced a new version of its legislation, House Bill 199, that could serve as that vehicle. Both proposals would create new permitting systems for projects that would affect fish habitat.

But the initiative’s pro-development opponents say they’re not exactly thrilled by HB 199 either.

And they’re making no promises to try to transform it into a compromise measure that could permit resource-development projects while still achieving some of the habitat protections that supporters want.

“These solutions have to be to problems that actually exist,” said Soldotna Republican Sen. Peter Micciche, a Cook Inlet commercial salmon fisherman who also works for ConocoPhillips. “The Senate majority doesn’t recognize, at this point, that there’s a gap.”

The state elections division has not yet placed the initiative on the ballot. Yet it’s already proven polarizing, and its legality is also being challenged in the Alaska Supreme Court.

The initiative is backed by an array of conservation groups that have teamed with three sponsors: Mike Wood, a Cook Inlet commercial setnet fisherman; Gayla Hoseth, a tribal chief from the Bristol Bay region; and Stephanie Quinn-Davidson, an Anchorage ecologist and fisheries advocate.

The supporters say Alaska’s permitting standards are outdated and wouldn’t provide adequate fish protections if proposed megaprojects such as dams, coal export projects, and the Pebble mine near Bristol Bay are ultimately built. The eight-page initiative would create a two-level permitting system with more stringent rules, like requiring that developers avoid or minimize damage to fish habitat or promise to clean up damage caused by projects.

The initiative has raised $300,000, with support from conservation groups like Homer-based Cook Inletkeeper, Virginia-based Trout Unlimited, the Oregon-based Wild Salmon Center and New Venture Fund, a left-leaning nonprofit based in Washington, D.C., according to filings with state campaign finance regulators.
