Northeast Canyons fishing prohibition may be added to councils’ management plans

November 11, 2022 — The National Marine Fisheries Service is developing an amendment to incorporate the Northeast Canyons and Seamounts ban on commercial fishing into regional fishery management plans.

Originally declared during the Obama administration, partially overturned in the Trump years, and reinstated by President Biden, the Northeast Canyons and Seamounts Marine National Monument covers nearly 5,000 square miles of sea floor east-southeast of Cape Cod.

Commercial Fishing Prohibited in Northeast Canyons and Seamounts Marine National Monument

December 17, 2021 — The following was released by NOAA Fisheries:

President Biden revised the prohibited activities for the Northeast Canyons and Seamounts Marine National Monument to include a prohibition on commercial fishing. All commercial fishing, other than for American lobster and Atlantic deep-sea red crab taken with fixed gear, is prohibited within the Monument as of October 8, 2021. American lobster and red crab fisheries are exempted from this prohibition until September 15, 2023, except where restricted under the New England Fishery Management Council’s Deep-Sea Coral Amendment (see below). These prohibitions reinstate the fishing prohibitions outlined in the original Monument proclamation signed by President Obama on September 15, 2016.

The Monument covers underwater seamounts (Bear, Mytilus, Physalia, and Retriever) and submerged canyons (Oceanographer, Gilbert, and Lydonia). You can find more information about the Monument on our Northeast Canyons and Seamounts Marine National Monument webpage and in the Federal Register.

Since the Monument was first designated in 2016, the New England Fishery Management Council developed and NOAA Fisheries approved and implemented (86 FR 33553, June 25, 2021) an Omnibus Deep-Sea Coral Amendment to its fishery management plans. This action prohibited the use of bottom-tending commercial fishing gear (with an exception for red crab pots) within the designated Georges Bank Deep-Sea Coral Protection Area, an area along the outer continental shelf in waters no shallower than 600 m to the Exclusive Economic Zone boundary. This action closed approximately 82 percent of the Monument to fishing earlier this year. This reinstated fishing prohibition applies to the remainder of the Monument area, shown in Figure 1. Lobster fishing with fixed gear may continue in the area of the reinstated Monument fishing restrictions (red hashed area in Figure 1) until September 15, 2023. Retraction of Flawed Study Implies Larger Problems with Science Used to Support Creation of MPAs

December 14, 2021 — A scientific paper (Cabral et al. 2020, A global network of marine protected areas for food) that claimed that closing an additional 5% of the ocean to fishing would increase fish catches by 20% has been retracted by Proceedings of the National Academy of Sciences of the United States of America (PNAS), the journal in which it was published.

At the time of publication, the paper’s findings were immediately covered by The Economist (Stopping some fishing would increase overall catches) and Forbes (Protecting 5% More Of The Ocean Can Increase Fisheries Yield By 20% According To New Research) and other mainstream outlets, including the New York Times, Axios, National Geographic, and The Hill.

Representative Deb Haaland, now the Secretary of the Interior, who recently restored Obama-era prohibitions on fishing in the Northeast Canyons and Seamounts Marine National Monument without scientific or economic review — and without meeting with affected fishermen —  submitted the now-retracted paper as supporting evidence for the “30×30” provisions of the Ocean-Based Climate Solutions Act. The provision calls on the federal government to conserve at least 30% of Federal waters by the year 2030. (For a longer critique of the 30×30 initiative see this piece by Dr. Roger Mann of the Virginia Institute of Marine Science at the College of William and Mary).

It has since been determined that the paper had both conflict of interest as well as data and model assumption problems.

PNAS determined that the person responsible for assigning Cabral et al.’s peer reviewers, Dr. Jane Lubchenco, currently White House Deputy Director for Climate and Environment, had a conflict of interest. According to the editor-in-chief of PNAS, the frequent collaboration relationship Lubchenco had with the paper’s authors constituted a conflict of interest, as did her personal relationship with one of the authors, Dr. Steve Gaines—her brother-in-law.

Several close collaborators of the Cabral et al. group wrote scientific critiques that pointed out errors and impossible assumptions that suggested the paper was inadequately peer reviewed.

According to an analysis of the paper from Sustainable Fisheries at the University of Washington:

Cabral et al. 2020 assembled a computer model out of several kinds of fishery data to predict where marine protected areas (MPAs) should be placed to maximize global sustainable seafood production. MPAs meant to increase food production do so by reducing fishing pressure in places where it is too high (overfishing). Asia and Southeast Asia have some of the highest overfishingrates in the world—reducing fishing pressure there is a no-brainer, but the model determined many of those areas to be low priority for protection.  The results should have been red flag for the peer reviewers of Cabral et al. 2020. Why were MPAs prioritized all around the U.S., where overfishing has been practically eliminated, but not prioritized around India, Thailand, Indonesia, Malaysia, Vietnam, and China?

Clearly, something was wrong with the model.

ICCAT: BIGEYE IN THE CROSS-HAIRS

November 12, 2018 — Fisheries representatives and environmental activists from around the globe will convene through November 19 for the 21st Special Meeting of the International Commission for the Conservation of Atlantic Tunas (ICCAT) in Dubrovnik, Croatia.

An international treaty organization, ICCAT is responsible for the conservation and management of tuna and tuna-like pelagic species (tuna, marlin, sharks, swordfish, etc.) found in the Atlantic Ocean.

Of all the discussion, debate and deliberation this week by the participating ICCAT nations, bigeye tuna decisions will have the biggest impact on Northeast canyon fishermen next season.

Based on a recent ICCAT scientific report, bigeye tuna is currently considered overfished and subject to overfishing. The major issue however is that the current international harvest cap of 65,000 tons set by ICCAT has been exceeded by approximately 20 thousand tons.
