Restaurant demand fuels Maine, NH fish-to-table movement

October 17, 2017 — ELIOT, Maine — The vibrantly colorful Memorial Bridge passes overhead, briefly cutting through the early morning darkness, casting alternating hues of blues, reds, greens and yellows on the slack tide waters of Portsmouth Harbor.

It is 1:36 a.m. Friday, Sept. 8 and the crew of the small fishing boat F/V Finlander, a 36-foot Northern Bay, leaves the protection of the channel and ventures into the open Atlantic Ocean.

The pilot house of the Finlander is dark, illuminated only by a sole Global Positioning System (GPS) display screen showing navigational information and an eastward course plot. The boat begins to pitch as sea swells grow larger and cross winds increase.

“Today is going to be a rough one.” says Capt. Tim Rider, a Dover, New Hampshire, native and owner of the Finlander. “The wind is coming from a different direction than the swells, it’s going to bounce us all over. It’s going to get rougher the farther out we go, but I think we can handle it.”

The Finlander and her five-member crew are headed to fishing grounds approximately 60 miles due east of Portsmouth, New Hampshire, an ocean-going commute of four hours in five-foot seas. They will be fishing for Atlantic pollock, considered a successful and sustainable species of whitefish, according to the National Marine Fisheries Service FishWatch website, and whose popularity among Seacoast chefs is increasing.

Demand for locally caught fresh fish by Seacoast restaurants has created a viable market for the crew of the Finlander.

Atlantic Herring Eastern Maine Spawning Closure Effective 6:00 p.m. October 16th

October 17, 2017 — The following was released by the Atlantic States Fisheries Commission

The Atlantic herring Area 1A (inshore Gulf of Maine) fishery regulations include seasonal spawning closures for portions of state and federal waters in Eastern Maine, Western Maine, and Massachusetts/New Hampshire. The Commission’s Atlantic Herring Section approved a forecasting method that relies upon at least three samples, each containing at least 25 female herring in gonadal states III-V, to trigger a spawning closure. If additional samples taken from a spawning area during or following the closure indicate a significant number of spawning herring, the closure will resume for an additional two weeks.

Samples from the Eastern Maine spawning area indicate a significant number of spawning herring, defined as 25% or more mature herring by number in a sample that have yet to spawn. As a result, the Eastern Maine spawning area will re-close for two additional weeks, starting at 6:00 p.m. on October 16, 2017 and extending through11:59 p.m. on October 30, 2017; however, directed vessels who have Atlantic herring on board upon release of this notice can land this herring by 11:59 p.m. on October 16th.

Vessels in the directed Atlantic herring fishery cannot take, land, or possess Atlantic herring caught within the Eastern Maine spawning area during this time and must have all fishing gear stowed when transiting through the area. An incidental bycatch allowance of up to 2,000 pounds of Atlantic herring per trip/ calendar day applies to vessels in non-directed fisheries that are fishing within the Eastern Maine spawning area.

Eastern Maine spawning area includes all waters bounded by the following coordinates:

Maine coast 68° 20’ W

43° 48’ N 68° 20’ W

44° 25’ N 67° 03’ W

North along the US/Canada border

ASMFC American Lobster Board Approves Draft Addenda XXVI & III to the American Lobster and Jonah Crab FMPs for Public Comment

October 17, 2017 — NORFOLK, Virginia — The following was released by the Atlantic States Marine Fisheries Commission

The Atlantic States Marine Fisheries Commission’s American Lobster Management Board approved American Lobster Draft Addendum XXVI/Jonah Crab Draft Addendum III for public comment. Given the same data collection needs apply to both American lobster and Jonah crab fisheries, Draft Addendum XXVI and Draft Addendum III are combined into one document that would modify management programs for both species upon its adoption. The Draft Addenda seek to improve harvest reporting and biological data collection in the American lobster and Jonah crab fisheries. The Draft Addenda propose using the latest reporting technology, expanding the collection of effort data, increasing the spatial resolution of harvester reporting, and advancing the collection of biological data, particularly offshore.

Recent management action in the Northwest Atlantic, including the protection of deep sea corals, the declaration of a national monument, and the expansion of offshore wind projects, have highlighted deficiencies in current American lobster and Jonah crab reporting requirements. These include a lack of spatial resolution in harvester data and a significant number of fishermen who are not required to report. As a result, efforts to estimate the economic impacts of these various management actions on American lobster and Jonah crab fisheries have been hindered. States have been forced to piece together information from harvester reports, industry surveys, and fishermen interviews to gather the information needed. In addition, as American lobster and Jonah crab fisheries continue to expand offshore, there is a greater disconnect between where the fishery is being prosecuted and where biological sampling is occurring. More specifically, while most of the sampling occurs in state waters, an increasing volume of American lobster and Jonah crab are being harvested in federal waters. The lack of biological information on the offshore portions of these fisheries can impede effective management.

The Draft Addenda present three questions for public comment: (1) what percentage of harvesters should be required to report in the American lobster and Jonah crab fisheries; (2) should current data elements be expanded to collect a greater amount of information in both fisheries; and (3) at what scale should spatial information be collected. In addition, the Draft Addenda provide several recommendations to NOAA Fisheries for data collection of offshore American lobster and Jonah crab fisheries. These include implementation of a harvester reporting requirement for federal lobster permit holders, creation of a fixed-gear VTR form, and expansion of a biological sampling program offshore.

It is anticipated the majority of states from Maine through New Jersey will be conducting public hearings on the Draft Addenda. The details of those hearings will be released in a subsequent press release. The Draft Addenda will be available on the Commission website, www.asmfc.org (under Public Input) by October 27th. Fishermen and other interested groups are encouraged to provide input on the Draft Addenda either by attending state public hearings or providing written comment. ASMFC Spiny Dogfish Board Approves 2018 Fishery Specifications

October 17, 2017 — NORFOLK, Virginia — The following was released by the Atlantic States Marine Fisheries Commission

The Commission’s Spiny Dogfish Management Board approved a spiny dogfish commercial quota of 38,195,822 pounds for the 2018 fishing season (May 1, 2018 – April 30, 2019). The Board maintained a 6,000 pound commercial trip limit in state waters (0-3 miles from shore) in the northern region (Maine through Connecticut). The quota and northern region trip limit are consistent with the measures recommended to NOAA Fisheries by the Mid-Atlantic Fishery Management Council. States in the southern region (New York to North Carolina) have the ability to set state-specific trip limits based on the needs of their fisheries.

2018 marks the third year of the current federal 3-year specifications cycle. It is anticipated the stock assessment will be updated in 2018 to inform development of fishery specification recommendations, including the commercial quota, for 2019 and beyond. Additionally, the Board intends to discuss issues raised by the Advisory Panel (and other fishery participants) in more detail prior to setting 2019 specifications. The timing of the next benchmark stock assessment for spiny dogfish is less certain, however, the Board supported the Council’s recommendations to conduct a benchmark stock assessment in 2019, or soon after.

The 2018 spiny dogfish commercial quota allocations (in pounds) for the northern region and the states of New York through North Carolina are provided below. Any overages from the 2017 season will be deducted from that region’s or state’s 2018 quota allocation. Similarly, any eligible roll overs from the 2017 season will be applied to that region’s or state’s 2018 quota allocation.

Groundfishermen: ‘It feels like we’re just forgotten’

October 16, 2017 — HAMPTON, New Hampshire — New Hampshire fishermen say temporary federal aid for at-sea monitor coverage is barely holding their industry afloat now that a court battle over the cost appears to have ended.

The National Oceanic and Atmospheric Administration is currently covering 60 percent of the cost for third-party at-sea monitors to observe commercial groundfishermen’s compliance with federal regulations. That coverage is projected to end May 1, 2018, when fishermen will be expected to cover the entire cost, according to NOAA spokeswoman Allison Ferreira. Groundfish include New England seafood staples like cod and haddock.

Hampton fisherman David Goethel said he would probably sell his boat and stop fishing if NOAA stops funding its portion of the cost. He and other fishermen filed a federal suit arguing it was unfair for fishermen to pay for monitors required by NOAA. Judges at the district and circuit court levels ruled the fishermen filed the suit too late to be considered on its merits, and the U.S. Supreme Court denied a petition to have the case heard this month.

After Supreme Court ruling, fight over at-sea monitoring costs may head to Congress

October 10, 2017 — Despite a recent decision by the Supreme Court of the United States, a New Hampshire fisherman pledges to continue his fight against having to pay for monitors to accompany them while at sea.

When the court opened its new term last Monday, 2 October, it decided against hearing David Goethel’s case against the U.S. Department of Commerce, allowing the 1st Circuit Court of Appeals ruling to stand. The Hampton fisherman filed suit in December 2015, about nine months after the National Oceanic and Atmospheric Administration announced it would begin passing the costs of the monitoring program to the fishermen.

The monitoring costs more than USD 700 (EUR 596.03) per day, a price that Goethel and officials from the Northeast Fishery Sector 13 claim is too steep.

ASMFC Atlantic Herring Section Launches New Website on Atlantic Herring Area 1A Spawning Monitoring System

October 6, 2017 — ARLINGTON, Va. — The following was released by the Atlantic States Marine Fisheries Commission:

In May, the Atlantic States Marine Fisheries Commission’s Atlantic Herring Section approved the continued use of the GSI30-based forecast system to predict when the population will be spawning and when spawning closures should be set based on the development of herring gonads (reproductive organs) in Area 1A (inshore Gulf of Maine). GSI stands for gonadosomatic index and in its simplest terms assesses the onset of spawning based on the ratio of the weight of a female herring’s ovaries to its body weight. This new system, which was successfully piloted in 2016, uses the observed rate of increase in GSI to predict when spawning will occur and when the fishery will be closed. This replaces an earlier system that simply closed the fishery when the observed GSI was above a threshold value.

Atlantic herring spawn in the late summer or early fall of each year. The timing of this event can vary by several weeks, which necessitates sampling the population each year to determine when the spawning closure should occur.  Once three samples have been collected that show a positive progression in gonadal development, a forecasted closure date can be determined by projecting forward when the population is likely to cross the spawning threshold. This forecasted closure date is continuously updated as new samples are acquired, and the closure is finally set within 5 days of the forecast date.

If not enough samples can be collected to forecast a closure date, a default closure date will go into effect. This date varies slightly by region:

  • Eastern Maine: August 28th
  • Western Maine: October 4th
  • Massachusetts-New Hampshire: October 4th

Whether initiated by the forecast model or a default date, the spawning closure lasts four weeks. If more than 25% of sampled fish are still in spawning condition when the fishery is reopened, the fishery will reclose for another two weeks. High court declines to hear fishing monitor case

Fisherman: Justices ruled on technicalities, not merits

October 3, 2017 — The U.S. Supreme Court on Monday declined to hear New Hampshire fisherman David Goethel’s case that challenged the federal government’s ability to force commercial fishermen to pay the costs of at-sea monitoring.

The rejection by the Supreme Court is the third defeat suffered by Goethel and co-plaintiff South Dartmouth-based Northeast Fishing Sector XIII since they first sued NOAA Fisheries and other federal officials in December 2015 in U.S. District Court in New Hampshire.

The court’s rejection closes the door on this particular legal challenge of the government’s right to impose the cost of at-sea monitoring on commercial fishermen, as the Supreme Court also declined to remand the case back to a lower court.

“The Supreme Court was our last judicial hope to save the centuries-old New England industry,” Goethel said in a statement.

Later, in an interview, Goethel let loose against what he said is the “stacked deck” of standing up to regulators, as well as his frustration with the justice system.

“We had three chances and not once was our case decided on the merits,” Goethel said. “I’m bitterly disappointed with the government and I’m bitterly disappointed with the justice system. At each step of the way, our fate was decided by a technicality without ever having a hearing on the merits of the case.”

New England Council Unanimously Reelects Dr. John Quinn as Chair and Terry Stockwell as Vice Chair for Another Term

October 3, 2017 — The following was released by the New England Fishery Management Council:

The New England Fishery Management Council in late September expressed full confidence in its leadership team when it unanimously affirmed the reelection of Dr. John Quinn of Massachusetts and Terry Stockwell of Maine to serve as Council chair and vice chair, respectively, for another term.

This marks Dr. Quinn’s second consecutive year as chairman. Prior to that, he served three years as Council vice chair under Stockwell. The two switched leadership positions during 2016 but continued to work together as a team to direct the Council’s management and policy initiatives.

“I am honored to be reelected by my colleagues as chairman,” said Dr. Quinn. “We have a lot of very complex and important issues facing us in the year ahead, and I am looking forward to collaborating with my fellow Council members and various stakeholders to attempt to solve some of the problems confronting the industry.”

Dr. Quinn is Director of Public Interest Law Programs at the University of Massachusetts (UMass) School of Law. He also is a former member of the Massachusetts House of Representatives and represented many fishing interests while practicing law in private practice for over two decades in New Bedford before joining UMass.

Stockwell is beginning his first term on the Council as a secretarial appointee. He previously served as the state of Maine’s designated fisheries official to the Council but retired from state service in June following a 21-year career at the Maine Department of Marine Resources (DMR). DMR Commissioner Patrick Keliher now sits at the Council table in that capacity. Stockwell was appointed in August to fill the seat previously held by Mary Beth Tooley of Maine, who had served three consecutive terms on the Council, the maximum allowed under the Magnuson-Stevens Fishery Conservation and Management Act.

In another show of confidence in leadership, the Council reelected the same slate of members to serve on its Executive Committee for the 2017-2018 Council year:

  • Doug Grout, chief of the New Hampshire Fish and Game Department’s Marine Division, was elected to serve his fifth consecutive term on the Executive Committee;
  • Peter Kendall of New Hampshire also was elected to serve a fifth consecutive term; and
  • Terry Alexander of Maine was elected to serve his second consecutive term.

Dr. Quinn and Stockwell also serve on the Executive Committee in their roles as Council chair and vice chair.

Atlantic Herring Massachusetts/New Hampshire Spawning Closure in Effect Starting October 1 through October 28, 2017

September 27, 2017 — The following was released by the Atlantic States Marine Fisheries Commission:

The Atlantic Herring Area 1A (inshore Gulf of Maine) fishery regulations include seasonal spawning closures for portions of state and federal waters in Eastern Maine, Western Maine and Massachusetts/New Hampshire. The Commission’s Atlantic Herring Section approved a forecasting method that relies upon at least three samples, each containing at least 25 female herring in gonadal states III-V, to trigger a spawning closure.

Fifteen samples of female herring were collected to evaluate spawning condition. Based on the analysis of the samples, the Massachusetts/New Hampshire spawning area will be closed starting at 12:00 a.m. on October 1, 2017 extending through 11:59 p.m. on October 28, 2017. Vessels in the directed Atlantic herring fishery cannot take, land or possess Atlantic herring caught within the Massachusetts/New Hampshire spawning area during this time and must have all fishing gear stowed when transiting through the area. An incidental bycatch allowance of up to 2,000 pounds of Atlantic herring per trip/ calendar day applies to vessels in non-directed fisheries that are fishing within the Massachusetts/New Hampshire spawning area.
