Cape Cod Times: A landmark fisheries plan

January 15, 2018 — For seafood lovers, there’s nothing better than a lightly battered scallop, freshly harvested from the North Atlantic, and dipped in simmering butter. And now that federal regulators have agreed to open an area east of Nantucket, closed since the 1990s, fishermen could catch as much as $218 million worth of scallops this year, and $313 million over three years. Expect those fried scallop plates to cost less this summer.

The reopening of the sea bed is just one of the many beneficial outcomes of a new fisheries management plan that was nearly 15 years in the making. The landmark set of regulations opens a large swath of the region’s waters to fishing while maintaining other closures to protect vulnerable species. The plan uses science and the latest technology to decide which ocean areas are important for the critical life stages of fish and shellfish species and how to protect them.

Two decades ago, habitat closures were decided based on drawing a line around areas where fish were congregating. Now, with a model that compares the sea bed with the impact of fishing, regulators can make decisions that will help restore and protect fish stocks. The new plan also sets aside research areas to investigate the link between habitat and fish productivity.

“We think these are groundbreaking regulations,” said John Bullard, NOAA’s outgoing regional administrator, who issued the regulations as one of his last acts on the job. “It puts the focus on the quality of the habitat protected — not the quantity, or how many square miles were protected.”

Cape fishermen are pleased with at least two elements of the plan. They cheered the closing of a large part of the Great South Channel that runs between the Cape and Georges Bank because it is essential habitat for spawning cod and other fish species. State and federal surveys have found that the region’s cod population has plummeted by about 80 percent over the past decade. Closing this area will now help ensure the continued survival of species like Atlantic cod, haddock, and flounder for years to come.

Pentony steps into NOAA’s top Atlantic post with much underway

January 15, 2018 — Michael Pentony, John Bullard’s successor as administrator of the National Oceanic and Atmospheric Administration’s (NOAA) Greater Atlantic region, is a “straight shooter,” who works toward “yes,” and has a lot of experience on fisheries management issues, sources tell Undercurrent News.

NOAA ended months of speculation on Thursday when it announced that Pentony, a long-time NOAA staffer and also a one-time member of the New England Fishery Management Council (NEFMC) staff, was its pick to lead all fishery policy making in the 100,000 square mile long region that stretches from the state of Maine to Cape Hatteras, in North Carolina, and the Great Lakes.

“Michael’s deep experience in every aspect of sustainable fisheries management, both commercial and recreational, positions him perfectly for this job. He is going to hit the ground running,” assured Chris Oliver, director of NOAA Fisheries, in a statement announcing the decision.

Bullard announced his retirement back in July, ending a nearly six-year rein in the region’s top spot, which comes with an office in Gloucester, Massachusetts, and beginning the agency’s search for a replacement. He said at the time that he had a long list of chores to complete before he could finish, most of which he took on during a recent flurry of activity at the agency.

However, Bullard left quite a few big matters for Pentony to finish up.

Pentony, who is set to assume his new role on January 22, enters his new job at the end of an eventful period, including the prosecution and sentencing of the owner of New England’s largest fishing operation, Carlos Rafael.

NOAA names a new regional administrator

January 12, 2018 — The National Oceanic and Atmospheric Administration on Thursday named Michael Pentonyas its new regional fisheries administrator, succeeding John Bullard.

A New Jersey native, Pentony has worked for the federal agency since 2002, most recently as assistant regional administrator for the sustainable fisheries division, NOAA said in a news release. Pentony will begin his new post Jan. 22.

“Michael’s deep experience in every aspect of sustainable fisheries management, both commercial and recreational, positions him perfectly for this job,” NOAA Fisheries Director Chris Oliver said. “He is going to hit the ground running.”

Pentony will head the agency’s regional office in Gloucester, which is responsible for managing about 100,000 square miles of the Northwest Atlantic. He will also oversee aspects of international fisheries conservation and management, NOAA said.

NOAA Names Michael Pentony to Lead Greater Atlantic Region

January 11, 2018 — The following was released by NOAA Fisheries:

Today, NOAA Fisheries announced that Mr. Michael Pentony is the new Regional Administrator for NOAA Fisheries Greater Atlantic Regional Fisheries Office in Gloucester, Massachusetts. He will assume his new duties on January 22, 2018. Mr. Pentony has been with the agency since 2002, serving in a series of positions including as the Assistant Regional Administrator for the Sustainable Fisheries Division since 2014. He succeeds retiring Regional Administrator John Bullard who had been in the position since 2012.

“I am extremely pleased to announce this appointment,” said NOAA Fisheries’ director Chris Oliver. “Michael’s deep experience in every aspect of sustainable fisheries management, both commercial and recreational, positions him perfectly for this job. He is going to hit the ground running.”

In his new role, Mr. Pentony will head the agency’s regional office, which has responsibility for managing approximately 100,000 square miles of the Northwest Atlantic, the large marine ecosystem from Maine to Cape Hatteras and the Great Lakes. To do that, the office works closely with two fishery management councils, the states, the fishing industry, and other stakeholders to manage federal commercial and recreational fisheries, marine mammals, habitat, and much more. As Administrator, he will also oversee critical aspects of international fisheries conservation and management in the region.

Mr. Pentony has extensive experience leading the development and implementation of the fishery management plans and regulations established by the Mid-Atlantic and New England Fishery Management Councils and the Atlantic States Marine Fisheries Commission. In his role as the region’s lead for sustainable fisheries management, he oversaw all aspects of 14 management plans targeting 42 species valued at nearly $1.6 billion annually. Prior to taking the Assistant Regional Administrator position in 2014, Mr. Pentony served for 12 years as a team supervisor in the sustainable fisheries division.

“Under Michael’s leadership, the region’s sustainable fisheries team worked hard to meet the needs of fishermen and fishing communities from Maine to North Carolina. In doing so, they have implemented successful, innovative approaches to protecting and restoring stocks, habitat, and marine mammals. They also paved the way for an expansion of the aquaculture industry in the region by working hard to break through barriers to that industry,” said Oliver.

Before joining NOAA Fisheries in 2002, Mr. Pentony worked for five years as a policy analyst for the New England Fishery Management Council, primarily on issues related to habitat, marine protected areas, and the deep-sea red crab fishery.

He has a Bachelor of Science in Engineering from Duke University in North Carolina, and a Master’s of Environmental Management from the Nicholas School of the Environment at Duke University. Between college and graduate school, Mr. Pentony served for six years as an officer in the United States Air Force as an engineering project manager on a variety of military satellite and launch vehicle programs.

Michael grew up in the town of Point Pleasant, New Jersey, where he spent his summers fishing for bluefish and fluke at the Manasquan Inlet. He currently lives in New Hampshire with his family including his wife and daughter. In his free time he enjoys traveling with his family, cheering on his daughter at swim meets, cycling the back roads of New Hampshire, and trying to learn to play the bass guitar.

NMFS Approves New England Council Habitat Amendments; Will Provide Boost to Scallops up to 60 Million lbs

January 10, 2018 — SEAFOOD NEWS — NMFS has given formal approval to the New England Council’s Fish habitat amendment that makes major changes in rules regarding closed areas in New England.

The most immediate impact is on scallops, where NMFS approved the opening of closed area 1 and the Nantucket Lightship area.  The concept here was that an abundance of scallops in these areas would lead to rapid harvesting, and a lower swept area by scallop dredges than if vessels were trying to gain their allocations outside the closed areas.

Also research has shown that these were not significant areas for fish spawning.  The approval means that the options for scallop harvest will be at the maximum level considered by the council, which projects about 60 million pounds of scallop landings for the 2018-19 season.

NMFS rejected the opening of closed area II on Georges Bank, which is also a major scallop producer.

Overall, full time license holders will get a total of 6 closed area trips of 18,000 lbs each, along with 24 days at sea in the open areas.

The habitat framework is the most far reaching adjustments of closed areas in 20 years, and it will provide better protection for both fish and habitat while eliminating closures that no longer serve their intended purpose.

The major change that was not allowed by NMFS was the opening of Eastern Georges Bank, called closed area II.  This is the so called Northern Edge, which historically was one of the most abundant scallop producing areas.  NMFS is keeping it closed to protect habitat.

Council Executive Director Tom Nies said, “Naturally we’re disappointed that our proposed Closed Area II changes were not approved, but the fact that the vast majority of the amendment will be implemented is a solid endorsement of the work the Council and staff did to dramatically change the closure system off New England.”

The habitat framework also establishes a series of seasonal cod spawning closures to all gear, both recreational and commercial; and it also sets a number of areas where bottom trawl gear is prohibited, but the council makes distinctions in many areas that will allow use of gillnets and lobster gear, as well as scallop and clam dredging.

John Bullard: Incomplete investigation by Rafael sector is ‘show stopper’

January 9, 2018 — John Bullard, the outgoing northeast region administrator for the National Oceanic and Atmospheric Administration, has provided a clue as to what he believes is needed to re-open groundfish harvesting in Sector IX, Carlos Rafael’s former fishing group.

“As far as we know, the sector’s enforcement committee has not yet completed an investigation of the sector’s operations issues or determined the full extent of the sector’s non-compliance,” he says in a column published in South Coast Today, a newspaper serving New Bedford, Massachusetts, the port city Sector IX calls home.

“That’s a show stopper.”

Bullard has heard plenty of criticism from the newly constituted board of Sector IX, the mayor of New Bedford, Massachusetts, out-of-work crew members and many others since he announced his decision in November to shut down all groundfish harvesting for the group nearly five months before the season was due to end on April 30.

2018 will be good year for clam chowder, Bumble Bee, thanks to NOAA moves

January 9, 2018 — The makers and fans of New England clam chowder, including Bumble Bee Seafood, can feel confident that the kind of mollusk most often used to make the soup — ocean quahogs — will be in ample supply in 2018 thanks to two moves made recently by the National Oceanic and Atmospheric Administration (NOAA).

Ocean conservationists, however, are not breaking out their party hats and noisemakers.

When John Bullard, NOAA’s northeast regional administrator, informed the New England Fishery Management Council last week that the agency will authorize the majority of NEFMC’s Omnibus Essential Fish Habitat Amendment 2 (OA2), many focused on the positive ramifications for scallop harvesters.

But NOAA’s approval of the council’s new plan for balancing the conservation of different sea life with the concerns of local fishermen also came with good news for harvesters of ocean quahogs and surf clams. Bullard informed NEFMC that his agency also agrees with its suggestion to provide a one-year exemption for clam harvesters to prohibitions against the controversial use of hydraulic dredging gear in the Great South Channel habitat management area (HMA), a deep-water passage that cuts between Nantucket and Georges Bank.

NEFMC: NMFS Approves “Majority”of Council’s Habitat Amendment

January 8, 2018 — The following was released by the New England Fishery Management Council: 

NOAA’s National Marine Fisheries Service (NMFS) has approved – with two exceptions – the New England Fishery Management Council’s Omnibus Essential Fish Habitat Amendment 2 (OHA2), paving the way for sweeping change to the existing network of closed and management areas in the Gulf of Maine, Southern New England, and Georges Bank. The changes will provide better protection for both fish and habitat while eliminating closures that no longer serve their intended purpose. The final rule implementing the new regulations will not be published until later this winter, but NMFS informed the Council on January 3 of its decision to approve “the majority” of the amendment, which sets the stage for what’s to come.

Two of the Council’s proposed habitat management areas (HMAs) were disapproved:

  • Cox Ledge in Southern New England; and
  • Eastern Georges Bank, which called for the removal of Closed Area II as currently configured, replacing it with new management areas that would have allowed fishermen to access the abundant scallop resource on the Northern Edge.

Council Executive Director Tom Nies said, “Naturally we’re disappointed that our proposed Closed Area II changes were not approved, but the fact that the vast majority of the amendment will be implemented is a solid endorsement of the work the Council and staff did to dramatically change the closure system off New England.”

As for the disapproved measures, Nies said, “We’ll be discussing NMFS’s comments at our late-January meeting, and the Council may decide it wants to revisit these issues going forward.”

The habitat amendment has five key purposes, which are to: (A) designate essential fish habitat (EFH) by lifestage for each species managed by the Council; (B) minimize the adverse effects of fishing on EFH to the extent practicable – a monumental undertaking that took years to carry out using the state-of-the-art Swept Area Seabed Impact model known as SASI; (C) identify other actions to encourage conservation and enhancement of habitat; (D) improve protection of habitats on which juvenile groundfish depend; and (E) improve protection of spawning groundfish.

The Council used six types of management approaches to achieve these purposes: (1) the EFH designations; (2) Habitat Areas of Particular Concern (HAPCs); (3) Habitat Management Areas; (4) Spawning Management Areas; (5) Dedicated Habitat Research Areas; and (6) changes to approaches involving framework adjustments and monitoring.

NMFS approved:

  • All of the Council’s EFH designations;
  • All of the HAPC designations, including: (a) the two existing ones for Atlantic Salmon and Northern Edge Juvenile Cod, (b) four new ones called Inshore Juvenile Cod HAPC, Great South Channel Juvenile Cod HAPC, Cashes Ledge HAPC, and Jeffreys Ledge/Stellwagen Bank HAPC, (c) 11 deep-sea canyons, and (d) two offshore seamounts;
  • Most of the Habitat Management Area measures, including: (a) establishing new HMAs in Eastern Maine and on Fippennies Ledge where mobile bottom-tending gear is Hake and red crab along the slope between Heezen and Nygren Canyons. – 2013 Northeast U.S. Canyons Expedition image. prohibited, (b) maintaining the Cashes Ledge Groundfish Closure Area with current restrictions and exemptions, (c) modifying both the Cashes Ledge and Jeffreys Ledge Habitat Closure Areas, which are closed to mobile bottom-tending gear, (d) prohibiting all fishing gear except lobster pots in the Ammen Rock Area, (e) maintaining the Western Gulf of Maine (WGOM) Habitat Closure Area, which is closed to mobile bottom-tending gear, (f) aligning the boundaries of the WGOM Groundfish Closure Area to match the WGOM Habitat Closure Area, (g) exempting shrimp trawling from the northwest corner of the WGOM areas, and (g) identifying the existing Gulf of Maine Roller Gear restriction as a habitat protection measure

Also related to Habitat Management Areas, NMFS approved the Council’s proposals to open up prime scallop fishing bottom in Closed Area I and the western portion of the Nantucket Lightship Area. In short, the current Closed Area I Habitat and Groundfish Closure Area designations will be removed, as will the Nantucket Lightship Habitat and Groundfish Closure designations.

Instead of keeping these less-effective habitat/groundfish areas in place, the Council established a Great South Channel HMA, which will be closed to: (1) mobile bottom-tending gear throughout the area; and (2) clam dredge gear in the northeast section (see map on page 1). NOTE: Clam dredge gear will be allowed throughout other parts of the area for one year while the Council considers refinements through a Clam Dredge Framework, which is under development. OHA2 also created a new research area for Georges.

Two new Dedicated Habitat Research Areas (DHRAs) will be established through this habitat amendment as well, each with a three-year sunset provision. One is on Stellwagen Bank within the Western Gulf of Maine Closure Area, and the second is on Georges Bank in what is the current Closed Area I South Habitat Closure Area. These areas will be the focus of coordinated research to improve understanding of the ecological effects of fishing across a range of habitats and, ultimately improve model forecasts. The Council identified a set of priority research questions that the DHRAs should address. The questions are based on four broad focus areas: (1) gear impacts; (2) habitat recovery; (3) natural disturbance; and (4) productivity.

John Bullard: Sector IX board’s failure to act stopped its fishing

January 8, 2018 — For New Englanders, Atlantic cod is not just another fish. The Sacred Cod that hangs in the Massachusetts State House is testament to the cod’s place in our culture and history.

For centuries, we fished for cod, and, as we watched the stock decline, we tried various ways to protect the resource that is considered as much a birthright as a commodity.

In 2009, the New England Fishery Management Council under the Magnuson-Stevens Act, agreed to try a system called “catch-shares,” which worked well on the West Coast.

The idea was simple: figure out how much fish from a particular stock can be sustainably caught— the “total allowable catch”—and divide that among fishermen.

By allocating quota, fishermen would have more control over when and how they fish, and — fishermen could fish when the weather and markets were most favorable. Catch shares eliminated the “race to fish” once a season opens.

A catch-share system allocating shares to groups of self-selected fishermen called ‘sectors’ went into place in the New England groundfish fishery in 2010. Within these sectors, fishermen organized themselves, determined how to fish their quota, and established other rules by which they would operate.

All sectors then submitted an operations plan to NOAA Fisheries and, under that plan, were responsible for policing themselves. The primary responsibility of a sector is to keep within its quota and account for its catch.

While most sectors have done a great job meeting this responsibility, Sector IX failed miserably over many years.

The former sector president, Carlos Rafael, is now behind bars for years of falsifying catch information, such as calling catch of low-quota, high-value cod, high-quota, lower-value haddock. He also admitted to tax evasion and bulk money laundering, all from his fishing operation.

MAFMC: NEFMC to Hold Mid-Atlantic Port Meetings to Gather Public Input for Independent Program Review

January 5, 2018 — The following was released by the Mid-Atlantic Fishery Management Council:

The New England Fishery Management Council is currently undergoing an independent review to: (1) assess past performance; (2) gather feedback on strengths and weaknesses of the Council process and operations; and (3) identify potential areas for improvements. Twelve port meetings and one webinar meeting were held in November and December to gather public input.

Two additional port meetings have been scheduled in the Mid-Atlantic region:

  • Monday, January 8, Montauk, NY – Montauk Playhouse Community Center, 240 Edgemere Street, 5 p.m.
  • Tuesday, January 9, Cape May, NJ – Rutgers University, 1636 Delaware Ave., 5 p.m.
